HomeMy WebLinkAbout00-09 Adoption of Rezone Petition R-00-01; Prezoning of Property Addressed as 2087 Garden LaneORDINANCE NO. 00-9 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING THE PREZONING OF PROPERTY ADDRESSED AS 2087 GARDEN LANE (ASSESSOR PARCEL NO. 426-221-34) TO R2 -MD BY ADOPTION OF REZONE PETITION R-00-01. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Costa Mesa finds and declares as follows: WHEREAS, an application was filed by James Cefalia, as agent for the owner of real property located at 2087 Garden Lane, to prezone the westerly 83 feet of the subject site; and WHEREAS, the westerly 83 feet of the project site is currently located within an unincorporated County of Orange island; and WHEREAS, the applicant has submitted an annexation application to the Local Agency Formation Commission of Orange County (LAFCO) to annex the subject property to the City of Costa Mesa; and WHEREAS, LAFCO may require the prezoning of property prior to approving an annexation request; and WHEREAS, the subject annexation area has a General Plan designation for property within the City's Sphere of Influence of Medium Density Residential, and the R2 -MD zoning classification is the corresponding zoning designation for this General Plan category; and WHEREAS, the Planning Commission held a duly noticed public hearing on May 8, 2000, and recommended approval of R-00-01 to the City Council; and WHEREAS, the proposed prezone has been reviewed for compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines, and the City's environmental procedures, and has been found to be exempt from CEQA per Section 15332; and 2000; WHEREAS, the City Council held a duly noticed public hearing on June 5, ACCORDINGLY, the City Council of the City of Costa Mesa hereby approves an amendment to the City of Costa Mesa Zoning Map as follows: SECTION 2. The subject property identified as Assessor Parcel No. 426- 221-34, and addressed as 2087 Garden Lane, upon incorporation into the City of Costa Mesa, shall be zoned R2 -MD as shown on attached Exhibits "A" and "B". SECTION 3. Pursuant to Section 13-23 of the Costa Mesa Municipal Code, District Map G-3 of the City of Costa Mesa is hereby amended by the change of zone described in Section 2 hereof and in the respective exhibits. A copy of the District Map is on file in the office of the Planning Division. SECTION 4. Severability If any provision or clause of this ordinance or the application thereof to any person or circumstances is held to be unconstitutional or otherwise invalid by any court of competent jurisdiction, such invalidity shall not affect other provisions or clauses or applications of this ordinance which can be implemented without the invalid provision, clause, or application; and to this end, the provisions of this ordinance are declared to be severable. SECTION 5. Publication This ordinance shall take affect and be in full force and effect thirty (30) days from and after its passage and, before the expiration of fifteen (15) days after its passage, shall be published once in a newspaper of general circulation printed and published in the City of Costa Mesa. In the alternative, the City Clerk may cause to be published a summary if this ordinance and, a certified copy of the text of this ordinance shall be posted in the office of the City Clerk five (5) days prior to the date of adoption of this ordinance. Within fifteen (15) days after adoption, the City Clerk shall cause to be published the aforementioned summary and shall post in the office of the City Clerk, a certified copy of this ordinance together with the names of the members of the City Council voting for and against the same.
