A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, ESTABLISHING THE OPEN SPACE AND RECREATION ADVISORY
COMMITTEE PURSUANT TO COSTA MESA MEASURE Z, KNOWN AS THE
MEASURE FOR SENSIBLE COMMUNITY DEVELOPMENT AND DEVELOPMENT -
FUNDED OPEN SPACE AND RECREATION AND MERGING THIS COMMITTEE WITH
THE YOUTH SPORTS COMMITTEE TO CREATE A COMBINED COMMITTEE
KNOWN AS THE YOUTH SPORTS, OPEN SPACE AND RECREATION ADVISORY
COMMITTEE
WHEREAS, at the November 8, 2016 general election the Citizens of Costa Mesa
adopted a citizens sponsored initiative known as Measure Y by a majority vote; and
WHEREAS, at the November 8, 2016 general election the Citizens of Costa Mesa also
adopted City sponsored initiative Ordinance No. 2016-07, known as Measure Z, by a
majority vote; and
WHEREAS, Measure Y received the greatest number of total votes; and
WHEREAS, Measures Y and Z each deal with the same subject matter; and
WHEREAS, Measure Y provides that "If another ballot measure is placed on the same
ballot as this measure and deals with the same subject matter, and if both measures pass,
the voters intend that both measures shall be put into effect, except to the extent that
specific provisions of the measures are in direct conflict. In the event of a direct conflict,
the measure which obtained more votes will control as to the directly conflicting provisions
only. The voters expressly declare this to be their intent, regardless of any contrary
language in any other ballot measure"; and
WHEREAS, The provisions of Measure Z conflict with the provisions of Measure Y,
except for Section 5, Establishment of Open Space and Public Park Impact Fee and Open
Space & Recreation Advisory Committee; and
WHEREAS, Section 5 of Measure Z creates a citizen committee that shall be known as
the "Open Space & Recreation Advisory Committee" ("OSRAC), whose role shall be to
advise the City Council on expenditures of the Open Space and Public Park Impact
Fee; and
WHEREAS, the City Council desires to establish the OSRAC pursuant to the provisions
of Measure Z; and
WHEREAS, the City Council also desires to create a Youth Sports Advisory Committee.
WHEREAS, the City Council desires to merge the OSRAC with the Youth Sports
Advisory Committee to create a new committee known as the Youth Sports, Open
Space & Recreation Advisory Committee ("YSOSRAC").

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINEAND ORDERAS FOLLOWS:
SECTION 1. The foregoing recitals are true, correct, and adopted by the City
Council as if set forth in full.
SECTION 2. The OSRAC is hereby created, whose role shall be to advise the City
Council on expenditures of the Open Space and Public Park Impact Fee. The Open
Space and Public Park Impact Fee shall be only spent after receiving the advice and
recommendation of the Committee.
SECTION 3. The OSRAC is hereby combined with the Youth Sports Advisory
Committee to create a new committee called the Youth Sports, Open Space & Recreation
Advisory Committee ("YSOSRAC).
SECTION 4. The Youth Sports, Open Space & Recreation Advisory Committee
shall encompass the OSRAC pursuant to Costa Mesa Measure Z. The Committee shall
consist of seventeen (17) members. The Committee shall meet bi-monthly. Seven (7) of
the members shall serve as the OSRAC as mandated by Measure Z (unless and until
Measure Z is amended by the City Council to incorporate all of the members of this
Committee) as follows:
1. The Mayor.
2. One (1) City Councilmember chosen by a majority of the City Council.
3. One (1) representative of a Costa Mesa flag football organization chosen by a majority
of the City Council.
4. One (1) representative of a Costa Mesa youth baseball organization chosen by a
majority of the City Council.
5. One (1) representative of a Costa Mesa youth soccer organization chosen by a
majority of the City Council.
6. One (1) representative of the Newport Mesa Unified School District ("NMUSD")
chosen by a majority vote of the NMUSD trustees.
7. One (1) member from a properly formed and actively operating California corporation
whose primary focus is issues of environmental concern chosen by a majority of the
City Council.
The remaining Committee members shall include:
8. One (1) representative of the Costa Mesa Chamber of Commerce.
9. One (1) representative of a new development located North of the 1-405 freeway and
West of Fairview impacted by the new Open Space and Public Park Impact Fee, as
selected by the Chamber of Commerce.
10. One (1) representative from the American Youth Soccer Organization Region 120 or
Region 97 ratified by a majority of the City Council.

11. One (1) representative from a Newport -Mesa Soccer Club ratified by a majority of the
City Council.
12. One (1) representative from the California Youth Soccer League ratified by a majority
of the City Council.
13. One (1) representative from the Costa Mesa Amateur Athletic Association or Pop
Warner Football ratified by a majority of the City Council.
14. One (1) representative from Costa Mesa Pony Baseball ratified by a majority of the
City Council.
15.One (1) representative from the Athletic Department from either Costa Mesa High
School or Estancia High School ratified by a majority of the City Council.
16. One (1) representative from either the American Little League or National Little
League ratified by a majority of the City Council.
17. One (1) representative, who is a Costa Mesa resident affiliated with a sport such as:
soccer, football, baseball, softball, volleyball, golf, swimming, gymnastics, track & field,
tennis, cheerleading, dance, boxing and/or wrestling ratified by a majority of the City
Council.
SECTION 5. The purpose of the Committee is to:
• Enhance youth sports programs in Costa Mesa.
• Engage the community in supporting and promoting youth athletic opportunities.
• Provide and promote safe and sufficient facilities for all youth sports participants.
• Improve and provide better safety standards in youth sports.
• Promote a healthy youth sports environment.
• Develop public awareness concerning the needs of youth sports programs.
• Enhance economic development.
• Provide direction in regards to large outside tournaments requesting field space in Costa
Mesa.
The Committee will serve as an advisory board on the following issues:
The use of the Open Space and Public Park Impact Fee expenditures. This fee will be
used by the City to offset the impact of development upon recreational opportunities, and
shall be used for the purpose of increasing active recreation, open space and public park
facilities within the City. These uses may include, but would not be limited to, the
maintenance and development of Fairview Developmental Center upon its anticipated
closure.
Capital Improvement Projects.
Facility status.
Policy review as needed.
The members shall be appointed at a time and place pursuant to Council policy.
The Committee shall comply with the Brown Act and the Fair Political Practices Act,
including but not limited to all disclosures required therein. City Staff shall provide the
necessary support for the Committee's meetings and other official business. The City
Council shall budget an appropriate amount of funds collected from the Open Space &

Public Park Impact Fee for the OSRAC portion of the Committee's activities (unless and
until Measure Z is amended by the City Council to incorporate all of the members of this
Committee), recognizing that interfund transfers may be necessary at the beginning of
the Committee's formation before sufficient Open Space and Public Park Impact Fees
have been collected.
SECTION 6. That the City Clerk shall certify to the passage and adoption of this
Resolution and enter it into the book of original Resolutions.
