MINUTES OF THE CI'TY COUNCIL
CITY OF COSTA MESA
JUNE 29, 1953
ROLL CALL The City Council of the City of Costa Mesa met at a
regular meeting on June 29, 1953, at 7:30 P. M. at
116 Last 18th Street, Costa Mesa, and immediately
thereafter adjourned to the'Justice Court Building
on West 18th Street, Costa Mesa, California.
Present: tCouncilmen Martin, Miller, Nelson, Smith,
and TeWinkle.
Absent : None.
ORGANIZATION Councilman Nelson moved that Councilman Smith be made
MEETING chairman pro tem, Councilman Miller seconded the
motion and it was carried by the following vote:
AYES: Councilmen Martin, Miller, Nelson, Smith, and
TeWinkle.
NOES: None.
Chairman Pro Tem Smith opened the meeting by pledge
of allegiance to the flag followed by invocation by
Reverend Charles Hand.
SELECTION OF Chairman Pro Tem Smith stated that the first order of
MAYOR business would be the selection of a Mayor. Councilman
Nelson nominated Councilman TeWinkle for Mayor. The
nomination was seconded by Councilman Martin and carried
by the following vote:.
AYES: Councilmen Martin, Miller, Nelson and Smith.
NOES: Councilman TeWinkle.
Councilman TeWinkle accepted the position of Mayor and
thanked the Council and people of Costa Mesa for the
honor bestowed upon him,
APPOINTMENT Mayor TeWinkle stated that the first order of business
OF would be the appointment of a City Clerk. On a motion
CITY CLERK made by Councilman Martin and'seconded by Councilman
Miller, A. C, Swartz was appointed City Clerk by the
following vote:
AYES: Councilmen Martin, Miller, Nelson, Smith and
TeWinkle.
NOES: None.
APPOINTMENT Mayor TeWinkle stated that the second order of business
OF would be the appointment of the City Attorney. On a
CITY ATTORNEY emotion made_ by Councilman Nelson and seconded by
Councilman Smith, Donald Dungan was appointed City
Attorney by the following vote.:
AYES: Councilmen Martin, Miller, Nelson, Smith, and
TeWinkle,
NOES: None.
The above named persons being in the audience were
ushered into office..
APPOINTMENT Mayor TeWinkle. stated that. the next order of business
OF would be the appointment of a City Treasurer. On a
..CITY TREASURER motion made by Councilman Nelson and seconded by
F Councilman Miller, W. C. Ries was appointed City Treasurer
by the following vote:
AYES: Councilmen Martin, Miller, Nelson, Smith and
TeWinkle.
NOES: . None.

CITY SEAL Mayor TeWinkle appointed Councilman Nelson as
chairman of a committee to obtain ideas for a
seal for`the City of Costa Mesa.
ORDINANCE Mayor TeWinkle introduced proposed Ordinance
NO. 1 No.1, which designates "TIMfE AND PLACE OF
DESIGNATING MEETINGS OF THE CITY COUNCIL." Following the
TIME AND PLACE reading of the Ordinance, Councilman Martin
FOR MEETING OF moved its adoption. Councilman Smith seconded
CITY COUNCIL the motion and was carried by the -following vote:
AYES: Councilmen Martin, Miller, Nelson, Smith
and TeWinkle.
NOES: None.
ORDINANCE Mayor Telnrinkle introduced proposed Ordinance No.2,
NO. 2 "FIXING THE AMOUNT OF THE OFFICIAL BONDS OF THE
FIXING,AMOUNP CITY CLERK AND CITY TREASURER." Following the
OF BONDS FOR reading of the ordinance Councilman Smith moved
CITY CLERK AND its adoption, seconded by Councilman Miller and
CITY TREASURER the motion carried by the following vote:
AYES: Councilmen Martin, Miller, Nelson, Smith,
and TeWinkle.
NOES: None
ORDINANCE Mayor TeWinkle introduced proposed Ordinance No.3,
NO. 3 providing for "DEPOSIT IN BANK OF MUNICIPAL FUNDS
PROVIDING FOR AND WITHDRAWAL THEREOF". Following the reading of
DEPOSIT OF FUNDS the ordinance Councilman Martin moved its adoption,
seconded by Councilman Miller and the motion carried
by the following vote:
AYES: -Councilmen Martin, Miller, Nelson, Smith,and
TeVinkle.
NOES: None.
ORDINANCE Mayor TeWinkle introduced. proposed Ordinance No. 4,
NO. 4 "RELA.TING TO THE CARE AND EXPENDITURE OF MONIES
CREATION OF RECEIVED FROM THE STATE OF CALIFORNIA UNDER THE
HIGHWAY TAX PROVISIONS OF ARTICLE 5, CHAPTER 1, DIVISION 1 OF
FUNDS THE STREETS AND HIGHWAYS CODE." Following the

ORDINANCE Mayor TeWinkle introduced proposed Ordinance No. 5,
NO. 5 ".PROHIBITING GAMBLING"_"dnd:Vmoved that after the read -

RE-ADING) Councilman Nelson `seconded the motion and it was
unanimously carried.
Councilman Nelson moved that this reading constitute
the First Reading of Ordinance No. 5. The motion was
seconded by Councilman Smith and was unanimously carried,

Councilman' Smith moved that the reading of the title
constitute the First Reading of Ordinance No. 6. The
motion was seconded by Councilman Martin and unanimously
carried.
ORDINANCE Mayor TeWinkle introduced proposed Ordinance No, 7,
NO. 7 "PROHIBITING DRUNKENNESS". Following the reading of
PROHIBITING the ordinance Councilman Miller moved its adoption.
DRUNKENNESS Councilman Smith seconded the motion and it was
carried by the following vote:
AYES: Councilmen Martin, Miller, Nelson, Smith and
TeWinkle.
NOES: None.
ORDINANCE Mayor TeWinkle introduced proposed Ordinance No. 8,
NO. 8 "TAX PROCEDURE LAW" and moved.that after the reading
TAX of the title of Ordinance No. 8, relating to "TAX
PROCEDURE PROCEDURE LAW", further reading of the ordinance be
LAW (FIRST waived. Councilman Nelson seconded the motion and

It -was moved by Councilman Smith that this reading of
the title constitute the First Reading of Ordinance
No. 8. The -motion was seconded by Councilman Nelson
and unanimously carriedo
ORDINANCE Mayor TeWinkle introduced proposed Ordinance No. 9,
NO. 9 "DEFINING AUM PROHIBITING NUISANCES AND PROHIBITING
PROHIBITING FORTUNE TELLING",and moved that after the reading of
NUISANCES AND the title of Ordinance No. 9, "PROHIBITING NUISANCES
FORTUNE TELLING AND FORTUNE TELLING", further reading of the
(FIRST -READING) ordinance be waived. Councilman Nelson seconded
the motion and it was unanimously carried.
ORDINANCE Mayor TeWinkle introduced proposed Ordinance No. 10,
NO. 10 which designates "THE ESTABLISHING AND ADOPTING THE
ADOPTION OF UNIFORM BUILDING CODE, 1919 EDITION, AS THE BUILDING
UNIFORM CODE OF THE CITY OF COSTA MESA. Following the reading
BUILDING of the ordinance, Councilman Miller moved its adoption.
CODE Councilman Martin seconded the motion and it was carried
by the f ollaw ing vote:
AYES: Councilmen Martin, Miller, Nelson, Smith and
TeWinkle.
NOES: None,
ORDINANCE Mayor TeWinkle introduced proposed Ordinance No. 11,
NO. 11 which designates "THE ESTABLISHING AND ADOPTING OF THE
ADOPTION OF ORANGE COUNTY, CALIFORNIA, ADMINISTRATIVE ELECTRICAL
ELECTRICAL CODE" as the electrical code of the City of Costa Mesa.
CODE Following the reading of the ordinance Councilman Smith
moved its adoption, Councilman Nelson seconded the
motion and it was carried by the following vote:
AYES:. Councilmen Martin, Miller,.Nelson, Smith and
TeWinkle.
NOES: None.
ORDINANCE Mayor TeWinkle introduced proposed Ordinance No. 12,
NO. 12 which designates "THE ESTABLISHING AND ADOPTING OF THE
ADOPTION OF ORANGE COUNTY, CALIFORNIA, PLUMBING CODE" as the
PLUMBING plumbing code of the City of Costa Mesa. Following
CODE the reading -6f the ordinance Councilman Martin moved
its adoption. Councilman Miller seconded the motion
and it was carried by the following vote:
AYES: Councilmen Martin, Miller, Nelson, Smith and
TeWinkle,
NOES: None.
ORDINANCE Mayor TeWinkle introduced proposed Ordinance No. 13,
NO. 13 ESTABLISHING AND ADOPTING THE ORANGE COUNTY LAND USE
ADOPTING ORDINANCE 351 AS AMENDED TO MARCH 24, 1953, As AN
LAND USE ORDINANCE ESTABLISHING LAND CLASSIFICATIONS AND DIS..
ORDINANCE TRICTS WITHIN THE CITY OF COSTA MESA AND REGULATING
THE USES OF PROPER'T'Y THEREIN, ADOPTING. SECTIONAL
MAPS OF SAID DISTRICTS, DEFINING THE TERMS USED
IN SAID ORDINANCE, PROVIDING FOR THE ADJUSTMENT,
ENFORCEMENT AND AMENDMENT THEREOF AND PRESCRIBING
PENALTIES FOR ITS VIOLATION". Following the read-
ing of the ordinance Councilman Miller moved its
adoption, Councilman Smith seconded the motion
and it was carried by the following vote:
AYES: Councilmen Martin, Miller, Nelson, Smith
and TeWinkle

ORDINANCE Mayor TeWinkle introduced proposed Ordinance No. 14,
NO. 1h which "PROHIBITS OIL WELLS AND THE DRILLING OF
PROHIBITING. OIL WELLS". Following the reading of the ordinance
OIL WELLS AND Councilman Nelson moved its adoption. Councilman
OIL DRILLING Miller seconded the motion and it was carried by
the following vote:
AYES: Councilmen Martin, Miller, Nelson, Smith and
TeWinkle.
NOES: None.
RESOLUTION Councilman Martin introduced and moved the adoption
NO. 1 of Resolution No. 1, "AUTHORIZING THE MAYOR AND THE
COUNTY CITY CLERK TO EXECUTE AN AGREEMENT WITH THE COUNTY
AGREEMENT FOR OF ORANGE,FOR THE CONTINUANCE OF COUNTY SERVICES TO
SERVICES TETE CITY OF COSTA MESA". Councilman Miller seconded
the motion and it was carried by the following vote:
AYES: Councilmen Martin, Miller, Nelson, Smith and
TeUinkle
NOES: None.
COUNCIL Councilman Nelson moved that discussion from the
PROCEDURE floor be limited to not more than five minutes.
Councilman Smith seconded the motion and it was
carried by the following vote:
AYES: Councilmen Martin, Miller, Nelson, Smith
and TeWinkle.
NOES: None.
Organizations and individuals addressed the Council
and pledged their full cooperation with the Council
and to the City of Costa Mesa.
ADJOURNMENT Mayor TeWinkle moved the adjournment of the City
Council to Wednesday, July 1, 1953 at 7:30 P. M.
The motion was seconded by Councilman Nelson and
carried by the following vote:
AYES: Councilmen Martin, Miller, Nelson, Smith
and TeWinkle.
NOES: None.
