ORDINANCE City Clerk Swartz read Ordirance No. 20 imposing a NO. 20 "LICENSE TAX FOR THE PRIVILEGE OF SELLING.TANGIBLE SALES TAS: PERSONAL PROPERTY AT RETAIL, PROVIDING FOR PERMITS (FIRST TO RETAILERS, PROVIDING FOR THE COLLECTION 07D READING) PAYING OF SUCH TAX AND PRESCRIBING PENALTIES FOR VIOLATIONS OF THE PROVISIONS HEREOF", After full reading thereof Councilman Nelson proposed the ROLL CALL The'City Council of the City of Costa Mesa met at a regular meeting August 17, 1953, at 7:30 P. M. at the Justice: Court Building on '!est l8th Street, Costa Mesa, California. Present: Councilmen Martin, Miller, Nelson, Smith and Mayor Terriinkle, Absenu: None, OFFICIALS Present: City Clerk Swartz, City Attorney Dungan Treasurer Ries, City Manager Coffey. MINUTES The minutes of the regular meeting of August 3rd, s,m and the adjourned meeting held August 10th, 1953, 7 were unanimously approved as read. � PETITION AGAINST Div. Ed, Stroot read a petition signed by twenty 1% SALES TAX merchants of Costa Mesa requesting that the limit of the proposed sales tax be not more than z of 1%. On motion of Councilman Miller, seconded by Councilman Smith and unanimously carried, the petition was ordered filed with the City Clerk. ORAL PROTEST 46. Fred Allen spoke against the adviseability of a 1% sales tax for the City of Costa Mesa and re- quested the City Council to look favorably upon a lower rate. COMMITTEE ON Councilman=Miller of the Streets and Highways Com - STREETS AND mittee was requested. to determine the number of HIGHWAYS miles of roads in the City of Costa Mesa and to inform the Council as to the estimated revenue available for their upkeep, APPOINTMENT OF Mayor TeWinkle stated that the City of .Costa Mesa TRUSTEE TO is entitled to have a msmber on the Board of Trustees MOSQUITO of Orange County Mosquito Abatement District. ABATEMENT DISTRICT Councilman Miller moved that Mr. Forrest B. Owen be appointed to the Board•of Trustees of the Orange County Mosquito Abatement District to represent the City of Costa Mesa. The motion_ was seconded by Councilman Nelson_ and was carried by the following vote: ,AYES: Councilmen Martin, Miller, Nelson, Smith and TeWinkle. NOES: None, RESOLUTION Councilman Miller introduced and moved the adoption 110, 11 - of Resolution No. 11, which provides "FOR THE ESTABLISHING ESTABLISHING OF A TRAFFIC SAFETY FUND". Councilman TRAFFIC SAFETY Martin seconded the motion and it was carried by the FUND following vote: AYES: Councilmen Martin, Miller, Nelson, Smith and TeWinkle. NOES: None. ORDINANCE City Clerk Swartz read Ordirance No. 20 imposing a NO. 20 "LICENSE TAX FOR THE PRIVILEGE OF SELLING.TANGIBLE SALES TAS: PERSONAL PROPERTY AT RETAIL, PROVIDING FOR PERMITS (FIRST TO RETAILERS, PROVIDING FOR THE COLLECTION 07D READING) PAYING OF SUCH TAX AND PRESCRIBING PENALTIES FOR VIOLATIONS OF THE PROVISIONS HEREOF", After full reading thereof Councilman Nelson proposed the 22 following amendment to Section No. 21 of Ordinance No. 20, provided, however, that commencing with the quarterly period endirg September 30, 1954, one half of all monies collected under and pursuant to the provisions -of this ordinance shall be deposited and paid into the Capital Outlay Fund of the City of Costa Mesa, and the remaining one half of all monies collected shall be deposited and paid into the General Fund of the City of Costa Mesa, and moved its adoption, Councilman Miller seconded the motion and the amendment was carried by the following vote: AYES: Councilmen Martin, Miller, Nelson, Smith and Tei^7inkle NOES: None. Councilman Miller moved that this reading constitute the First Reading of Ordinance No. 20 as amended; Councilman Nelson seconded the motion and it,was unanimously carried. LAND USE Councilman Martin made a motion to grant permission VARIANCE to Coastal Motor Sales for the erection of a sign at their place of business, 1984 Newport Blvd., Costa Mesa, on the termer and conditions set forth by the Orange County Planning: Commission in their recommendation report. Councilman Smith seconded the motion and it was carried by the following vote: AYES: Councilmen Martin, Miller, Nelson, Smith and TeW inkle . NOES: None. Councilman Miller made a motion to grant permission to Max W. Pope, Contractor, for the installation of cess pools in place of septic tanks and leech lines on a parcel of land between Orange and Santa Ana Avenues, on the North side of Twenty -First Street. Councilman Smith seconded the motion and it was carried by the following vote: AYES: Councilmen Martin, Miller, Smith and TeWinkle. NOES: Councilman Nelson: ORA COMMUNICATIONS Mr. Jack Palmer requested.the City Attorney to ex- plain the Firearms Ordinance in order to correct the false impression many of the citizens seem to have. Mir. Gerald B. Lovejoy presented the City of Costa Mesa with a check for $50.00 hoping that this donation would be of help in defraying the expenses of the new City. ADJOURNMENT Councilman Martin moved the adjournment of the City Council to August 214th, 1953 at 7:30 P. M. The motion was seconded by Councilman Miller and carried by the following vote: AYES: Councilmen Martin, Miller, Nelson, Smith and TeW inkl e . NOES: None, A. C.
