CITY OF COSTA MESA
OCTOBER 5th, 1953
ROLL CALL The City Council of the City of Costa Mesa met at a
regular meeting October 5th, 1953 at 7:30 Po Ma® at
the Justice Court.Building on West 18th Street,
Costa Mesa, California.:
Present: Councilman Nelson,(I.9ayor Pro -Tem), Council-
men Martin, Miller, Nelson and Smith.
Absent: Mayor TeW inkle
Officials
Present: City C1erk.Swartz, City Attorney Dungan,
Treasurer Ries and City Manager Coffey.
; MINUTES Minutes of the regular meeting of September 21st,1953
and the adjourned.meeting•of September 28th, 1953 were
read and approved as read.
OATHS City Clerk Stirartz.administerad the oaths of office to
Fiscal Officer Ray I. Hartzler and Chief of Police
Arthur R. McKenzie.
COMMUNICATIONS City Manager Coffey read a letter from the Division of
Highways, stating that traffic lights along Newport
Boulevard will be in operation in the near future as
the shortage of materials will soon be overcome.
TR,ASURER'S The` monthly report of receipts and disbursements was
REPORT presented by Treasurer Ries and on motion of Council-
man Smith, seconded by Councilman Miller and unanimously
carried, was ordered filed.
City Manager Coffey reported that the County has
started the construction connecting Superior Avenue
with the Coast Highway.
RESOLUTION
Resolution No. 18 being a resolution "AUTHORIZING
NO. 18
CITY MANAGER TO SUBMIT PROTECT STATEMENT TO DEPART -
GAS TAX FUNDS
MENT OF PUBLIC WORKS, DIVISION OF HIGHWAYS, FOR
SUPERIOR AVE.
EXPENDITURE OF GAS TAX ALLOCATION FOR CONSTRUCTION
OF SUPERIOR AVENUE FROM 17TH STREET TO SOUTH CITY
LIMIT", was presented. Councilman Miller moved the
adoption of Resolution No. 18. The motion was
seconded by Councilman Martin and carried by the
following vote:
AYES: Councilmen Martin, Miller, Nelson and Smith.
NOES:- None
Absent: Mayor TeWinkle-.
ORDINANCE
The title of Ordinance No. 25, being an ordinance

"PROVIDING FOR LICENSING' AND. RE GULATING THE CARRYING
BUSINESS
ON OF VARIOUS PROFESSIONS, TRADES, CALLINGS,
LICENSES

FOR THE `TIOLATION THEREOF", was read . Whereupon

Councilman Smith moved that further reading of the
ordinance be waived. The motion was seconded by
Councilman Martin and unanimously carried.
Councilman Martin :Moved the adoption of Ordinance
No. 25. The motion was -seconded by Councilman Miller
-and carried by the following vote:
AYES: Councilmen Martin, Miller, Nelson and Smith.
NOES: None.

RESOLUTION Resolution No.'20, being a resolution "APPROVING
NO. 2.0 AGP,EEMEN'T,WITr1 THE C017NTTY OF ORANGE,, t=EBY
COUNTY COUNTY HEALTH OFFICER SHALL. PERFORM FUNCTIONS
HEALTH OFFICER RELATING TO PUBLIC HEALTH WITHIN THE CITY", was
presented. Councilman:Martin moved the adoption
of Resolution No. 20. The motion was seconded by
Councilman Miller and carried by the following vote:
AYES: Councilmen Martino Miller, Nelson and Smith.
NOES: - N one .

RESOLUTION Resolution No. 21, being a resolution, "ADOPTING
NO, .21 BUDGET.' AND APPROVING MEMORANDUM OF AGREEMENT FOR
GAS TAX EXPENDITURE, OF GAS TAX ALLOCATION FOR MkJOR CITY
ALLOCATION FOR STREETS", was presented. Councilman Miller moved
M'LJOR CITY STREE'1S the adoption of Resolution No. 21. The motion
was seconded by Councilman Smith and carried by the
following vote:
AYES: Councilmen Martin, Miller, Nelson and Smith,
NOES: None,
Absent: Mayor TeWinkle,
City Clerk Swartz read the Notice of Intention of
the California Highway Commission to relinquish
certain portions,of the State Highway along Newport
Avenue,
VARIANCES Councilman Martin moved that the variance request of
V-1341 Howard H. Thon, Monrovia .Avenue, be denied. The
motion was seconded by Councilnmi Miller and unanim-
ously carried.
VARIANCE Councilman Smith moved the granting of the variance
V* 1318 of Leola Adams, 2344 Newport Boulevard as recommended
by the Orange County Planning Commission. The motion
was seconded by Councilman Martin and unanimously
carried,
Lei _239 Councilman Smith moved the granting of a variance to
Kaith B. Collins to permit the erection of a sign on
the westerly side of Newport Avenue, approximately
600,feet North of Bay Street, as recommended by the
Orange County Planning Commission. The motion was
seconded by Councilman Martin and unanimously carried.
U11- 954 Councilman Martin moved the request of D. R. Dotson to
permit the use of a house trailer for dwelling purposes
be denied. The motion v,Tas seconded by Councilman
Miller and unanimously carried.
SHELTON Councilman 1.1iller moved that the request of Mfrs.
Edna O..Shelton to black top property at 179 E. 17th St,,
without curbs be approved on the followins conditions:
1. That there be conformance with the existing curb
line for the installation of the berm.
2; That the owners of the property agree that when the
.improvement of E. 17th St., is made that concrete
curbs will be constructed along the entire frontage
at the expense of the owners.

Councilman Martin moved that the request of
Robert A.. Eastman for a variance be referred to the
City Planning Committee. The motion was seconded
by Councilman Smith and unanimously carried,
Resolution No. 22 being a resolution "FIXING THE
AI4iOUNT OF OFFICIAL BOND OF THE' CITY FISCAL OFFICER",
was presented; Councilman Martin moved the adoption
of Resolution No. 22. The motion was seconded by
Councilman Smith and carried by the following vote:
AYES: Councilmen Martin, Miller, Nelson and Smith.
NOES: , None.
Absent: Mayor TeWinkle.
Councilman Smith moved that'the City Manager be in-
structed to receive at least three (3) written bids
for the alterations to the City Hall for the plumbing
and carpenter work. Also granting authority to the
City Manager to accept the contract of the lowest
responsible bidder, if the bid for the carpenter work
is less than Nine Hundred ($900.00) Dollars and if the
plumbing bid is less than Three Hundred and Seventy -
Five ($375.00) Dollars, The motion was seconded by
Councilman Martin and carried by the following vote:
AYES: Councilmen Martin, Miller, Nelson and Smith.
NOES: None.
Absent: Mayor TeWinkle<
Councilman'Martin requested the City Attorney to
prepare an ordinance prohibiting draw poker.
Councilman Smith requested the City Manager to survey
the possibilities of having City employees and City
equipment to do the street repair work.
On motion by Councilman Miller, seconded by Councilman
Martini and unanimously carried, the meeting adjourned
to October 13th, 1953 at 7:30 P. M..
