ROLL CALL The City Council of the'City of Costa Mesa met at a regular adjourned. meeting October 26th, 1953 at 7:30 P. M. at the Tustice Court Building on West 18th St., Costa Mesa, California. Present: Councilmen Martin, Miller, Nelson, Smith and Yhyor TeWinkle,_ Absent:' None. Officials Present: City-Attorney.Dungan, Treasurer Ries, Acting. Clerk Hartzler, City Manager Coffey, Chief of Police -McKenzie. C0I4:UNICATIONS ; _. ...City ;Manager Coffey read .a: letter from the State Division -or Highways.regarding the intersection of Walnut Street and Newport Boulevard. City Manager Coffey read a -letter from the Costa Mesa Elementary School District requesting that the corner of East 18th Street and Tustin Avenue be provided with Stop Signs at each of the four corners. A communication from the County of Orange Traffic . _. Committee was read -recommending that "No Parking" zone%be established on the North side of West 18th St., from Newport Avenue to the Easterly line of Park Ave., and on the South side of West 18th Street from Newport Avenue to the alley known as Legion Way. On motion of Councilmen Miller, seconded by Councilman Nelson, and unanimously,earried; the City Attorney was requested to prepare an ordinance incorporating both of the above traffic safety recommendations. COMMITTED Councilman Smith reported on the progress made in the - REPORTS study of various contracting codes. A full and lengthy BUILDING CODES discussion was held whereat several contractors ex -- pressed opinions regarding the codes now in effect and suggested changes that could be included in a future building ordinance of the City. ORDINANCE Ordinance No. 27, being an ordinance "ESTABLISHING NO. 27 THE HOURS OF BUSINESS OF THE CITY OFFICES" was read CITY BUSINESS and after full reading thereof Councilman Miller moved HOURS the adoption of Ordinance No. 27. The motion was (FIRST seconded by Councilman Martin and carried by the READING) following vote: AYES: Councilmen martin, Miller, Nelson, Smith and TeWinkle. NOES: None. RESOLUTION Resolution No. 28, being a resolution"PROVIDING FOR NO. 28 CREATION AND ESTABLISIR41ENT OF A BUILDING INSPECTOR, CREATION OF ASSISTANT BUILDING INSPECTOR, A CLERK, A SECRETARY, EUILDING AND A STREET FOREMAN"", was presented and read. INTSPECTOR Whereupon Councilman Miller moved the adoption of Resolution No. 28. The motion was seconded by Councilman Nelson and carried by the following vote: AYES: Councilmen Martin, Miller, Nelson, Smith and TeWinkle . NOES: None. RESOLUTION Resolution No, 29, being a resolution "ESTABLISHING NO. 29 TM SALIuRY OF THE CITY CLERK, CITY ATTORNEY, AND CITY ESTABLISHING TREASURER," was presented and read, whereupon •Council- S_A.LARY CITY man Miller -moved the adoption of Resolution No. 29, CLERK, ATTORNE Y The motion. was seconded by Councilman Smith and carried AND TREASURER by the following vote: AYES: Councilmen_ Martin, Miller, Smith and TerJinkle. NOES: Councilman Nelson. RESOLUTION Resolution -No. 30 being a resolution "RATIFYING AND N0. 30 APPROVING THE ACTION HERETOFORE TiUM7 BY THE COUNTY CHARLE STREET k' ORANGE. D\T " CONNECTION WITH THE CHARLE STR � + T IM'ROV24ENT PROCEEDINGS", was presented and read. Whereupon Councilman Nelson moved the adoption of Resolution No. 30 -and Councilman Martin seconded the motion, It was carried by the following vote: AYES: Councilmen PJ1:,rtin, Miller, Nelson, Smith, and TeWinkle. NOES: None, TRAFFIC After a genera]. discussion of various traffic SAFETY safety problems in several locations of the City, the City Attorney was requested to prepare ordinances for the following: 1. Regulation'of abandoned vehicles on public Streets, Highways and Alleys, 2.' Regulation of excavations in public streets. City Manager Coffey recommended as a solution to the traffic problem along Newport Avenue, that only South bound traffic be allowed on this street. It was agreed by the Council: that further study be made before.any action is taken. It was moved by Councilman Miller, seconded by Councilman Martin and unanimously carried, that the parking regulation for Newport Avenue between Harbor Boulevard. and 17th Street be established as fol loT..rs : 450 angle parking on the West side and Parallel parking on the East side of street, RESOLUTION Warrant Resolution No, W-2 was presented and read, NO. W-2 whereupon Councilman Smith moved the adoption of Warrant Resolution Noa LT,,2, The motion was seconded by Councilman Miller and carried by the following vote: AYES: Councilmen Martin, Miller,- Nelson, Smith and Te Winkle. HG'4.5 : None. ( Warrants No. 3 to 5 inclusive total $1727.58 charge to General Fund) PERMITS An application of the Base Novelty Co., was read requesting permit for one additional pin ball machine and the relocation of two other machines. It.was moved by Councilman Nelson to deny the permit and to revoke the present license granted the said Company for seven machines and to refund the entire license fee of $750.00 paid by the Company. The motion was secondee. by Councilman Martin and. carried 'by the following vote: AYES: Councilmen Martin,'Nelson, Smith and TeWinkle. NOES: Councilman_ Miller. An application by Mr. Guy Boldman for an advertising sign permit was read, It was ruled by the City Attorney that as this type of sign was not classed as a billboard under License Ordinance No. 25 no action of the Council was necessary, STAYi+K01 T OF It was moved by Councilman Nelson that the following POLICY statement be adopted as the policy of the City Council PIN BALL regarding pin ball machines, and to give the statement MACHINES to the press for publication: A STATEMENT TO THE PUBLIC "There h:Fd—been considerable publicity given to the AT TOLRNMENT granting of a license for the operation of Pin Ball Machines. Pin Ball Machines have been in operation in Costa Mesa for many years--- but not with the best of control. ^Je feel it only fair that you know and understand the policy and the thinking of your City Council, concerning this problem. It is our opinion that we would have better control of these machines when operated under a license. It has been understood that these machines are to be operated as a game of skill and positively not a game of chance. It is the pledge of -the City Council that this will be enforced to the letter. At any time that we find it is impossible. -to control this situation, the machines shall be eliminated promptly. We ask that you keep faith in our sincerity of purpose. 1.1a shall not betray your trust". The motion was seconded by Councilman Martin and carried by the.'following vote: AYES: Councilmen Martin, Miller,Nelson, Smith, and TeWinkle. NOES: None. On motion of Councilman Martin, seconded by Councilman Miller and unanimously carried the meeting adjourned. 1
