MINUTES OF THE CITY COUNCIL
CITY OF. COSTA MESA
April 26,.1954
The City Council of the City of Costa Mesa,
California, met in adjourned regular session
at 7:30 p.m., April 26, 1954, at the Justice
Court Building, 567 West 18th Street. The
meeting was called to order by Mayor Nelson,
followed by the Pledge of Allegiance to the Flag
and invocation by Rev. McShane.
ROLL CALL Present: Mayor Claire Nelson, Councilmen Martin,
Pinkley, Smith and TeWinkle.
Officials
Present: City Manager Coffey, City Treasurer Ries
City Attorney Dungan, City Clerk Swartz
sem' LICENSE Chief McKenzie reported on his investigation of the
STATE State Merchants Police regarding the application for
MERCHANTS a business license, and advised the Council of the
�- POLICE operation of this concern in and around the City of
(denied) Costa Mesa. It was moved by Councilman Martin that
the application be denied and the license fee
returned. The motion was seconded by Councilman
TeWinkle and carried by the following vote:
AYES: Councilmen Martin, Nelson, Pinkley and
TeWinkle.
NOES: Councilman Smith.
Petition No. 2 for Amendment of the Zoning Ordinance
submitted by Howard B. Lawson, to rezone West 19th
Street, was discussed. Upon motion of Councilman
Pinkley, seconded by Councilman TeWinkle, the Council
voted unanimously to refer the matter to the
Planning Commission for recommendation.
Several interested citizens spoke in regard to the
proposed ordinance of' -keeping animals. Mayor Nelson
assured them their wishes would be taken into
consideration in the final drafting of the Ordinance.
PURCHASE Councilman Smith reported on proposed purchase of
OF the Seagraves Pumper, indicating that it may be
SEAGRAVES possible to purchase the equipment by paying one
PUMPER half down and the balance after the first of July.
It was moved by Councilman TeWinkle that upon the
approval of the equipment by the men appointed by
the Mayor to make the purchase, that $500 of city
funds be included with the $1,000 donated by the
Volunteer Fire Department and used as a down payment
for the purchase by the City of the Pumper. The
.balance to be paid by the City as soon after July 1
as possible. The motion was seconded by Councilman
Martin and carried by the following vote:
AYES: Councilmen Martin, Nelson, Pinkley, Smith
and TeWinkle
NOES: None
Councilman Smith publicly thanked the people of
Costa Mesa for helping to make the "Fireman's
Dance10 a success.
ORDINANCE Ordinance No. 41, an ordinance "RELATING TO CIVIL
NO.'41 DEFENSE AND DISASTERS1° was presented for second
Civil Defenseheading. After the reading of the title, it was
(2nd.Reading)moved by Councilman Martin that further reading of
the ordinance be waived. The motion was seconded
by Councilman Smith and unanimously carried. Thereupon
Councilman Martin moved that Ordinance No. 41.be
adopted as an urgency measure. The motion was
seconded by Councilman Smith and.carried by the
following vote:
AYES: Councilmen Martin, Nelson, Pinkley, Smith
and TeWinkle
NOES: None
ORDINANCE
Ordinance No. 42, an ordinance "PROVIDING FOR THE
NO. 42
LICENSING AND IMPOUNDING OF DOGS, ETC. AND REPEALING
DOGS
ORDINANCE NO. 19" was presented. Upon motion of

Smith, seconded by Councilman Pinkley, the
Council voted unanimously that the title only be read
and it constitute the second reading. Thereupon
Councilman Martin moved that Ordinance No. 42 be
adopted as an urgency measure.- The motion wasseconded
by Councilman TeWinkle and carried by the following
vote:
AYES: Councilmen Martin, Nelson, Pinkley, Smith
and TeWinkle.
NOES: None

Ordinance No. 43, an ordinance "APPROVING THE ANNEXA -
NO. 43

After the reading of the title, it was moved by
Councilman Martin, seconded by Councilman Pinkley and
unanimously carried that further reading of the
Ordinance be waived. Thereupon Councilman Smith moved
that Ordinance No. 43 be adopted. The motion was
seconded by Councilman TeWinkle and carried by the
f ollowing vote:

ORDINANCE
Ordinance No. 44, an ordinance "REGULATING TRAFFIC
NO. 44
UPON THE PUBLIC STREETS AND REPEALING ALL OTHER

read. It was moved by Councilman Smith that Ordinance
No. 44 be adopted. The motion was seconded by
Councilman TeWinkle and carried by the following vote:

TeWinkle.

ORDINANCE Ordinance No. 45, an ordinance "LICENSING BICYCLES AND
NO. 45 REGULATING THE BUYING AND SELLING THEREOF" was presented
Bicycles and read. It was moved by Councilman TeWinkle that
Ordinance No. 45 be adopted. The motion was seconded
by Councilman Pinkley and carried by the following vote:
AYES: Councilmen Martin, Nelson, Pinkley, Smith
and TeWinkle.
NOES: None
RESOLUTION Resolution No. 56, a resolution "APPROVING DIAGRAM OF
NO. 56 ASSESSIENT DISTRICT OF CHARLE STREET AND APPOINTING
Charle St. CITY ENGINEER AS STREET SUPERINTENDENT" was read.
Upon motion of Councilman Smith, seconded by Councilman
Martin, Resolution No. 56 was adoptedby the following
vote:
AYES: Councilmen Martin, Nelson, Pinkley, Smith
and TeWinkle.
NOES: None
RESOLUTION Resolution No. 57, a resolution "AUTHORIZING MAYOR
NO. 57 PRO TEMP ORE TO ACT IN ABSENCE OF .MAYOR" was read. Upon
Mayor Pro motion of Councilman TeWinkle, seconded by Councilman
Tem Pinkley, Resolution No. 57 was adopted by the following
vote:
AYES: Councilman Nelson, Pinkley, Smith and TeWinkle.
NOES: None
NOT VOTING: Councilman Martin.

PERMITS
a request was'submitted in the name of Doroth Gossett
for an encroachment permit to blacktop from the
existing pavement to her place of business at
2014 Placentia. It'was moved by Councilman Smith,
seconded by Councilman TeWinkle and unanimously
carried that'the permit be granted,providing bumper
strips are placed in accordance with the direction
of the Police Chief.
PARSON
A request was read from the Orange County Road
ROAD
Department asking the City to accept a deed of
right-of-way over Parson Street in order that the
County could fulfill improvement commitments
previously made. On motion by Councilman Smith,
s"eco nded by Councilman TeWinkle, the Council voted
unanimously to accept the deed of right-of-way,
providing the property owners install curbs and
gutters according to City standards.
Mayor Nelson asked the Council to consider some means
whereby the City would provide a spray rig to be
rented at nominal cost to citizens in an effort -to
control the fly situation. After a general discussion
of the fly situation, the matter was postponed to
May 17.
Mr. Maxwell asked ,the Council if they had considered
imposing a curfew law for juveniles. Chief'McKenzie
stated that he and the City Attorney were at present
working on the matter.
The City Attorney was requested to investigate and
recommend to the Council, regulations on the sale
of fireworks.
Upon motion duly made and seconded, the meeting adjourned.
