'MINUTES OF THE CITY COUNCIL
CITY OF COSTA MESA
May 24, 1954
The City Council of the City of Costa Mesa met
m in adjourned regular session May 24, 1954, 7:30 p.m.,
at the Justice Court Building, 567 West 18th Street.
The meeting was called to order -by Mayor Nelson,
followed by the Pledge of Allegiance to the Flag and
invocation by Councilman Martin.
ROLL CALL Present: Councilmen Martin, Nelson, Pinkley and
Smith
Absent: Councilman TeWinkle
Officials
Present: City Manager Coffey, City Attorney Dungan
City Treasurer Ries, City Clerk Swartz
COMMUNICATIONS A petition was presented, signed by approximately 13
property owners in the area of East 21st Street and
Orange Avenue, protesting the issuance of a building
permit for the construction of a large greenhouse
on East 21st Street in an R4 Zone. A letter from the
Planning Commission was also read recommending the
denial of the said building permit. After a lengthy
discussion the following Ordinance was presented.
ORDINANCE Ordinance No. 47, an ordinance "AMENDING ARTICLE VI,
N0. 47 SECTION 6.1, SUBSECTION C AND ARTICLE VI, SeCTION 6.2,
Amending ADDING SUBSECTION E OF THE LAND USE ORDINANCE AS
Ordinance ADOPTED BY ORDINANCE NO. 32 OF THE CITY OF COSTA MESA"
No. 32 Jas 'read. Thereupon it was moved by Councilman
Smith that Ordinance No. 47 be adopted as an urgency
ordinance. The motion was seconded by Councilman
Pinkley and carried by the following vote:
AYES: Councilmen Martin, Nelson, Pinkley and Smith
NOES: None
ABSENT: Councilman TeWinkle
A letter was read from Mr. R. L. Patterson, City
TRfV_T Engineer, stating that the streets in Tract No. 1778
have been approved, and recommending acceptance by
the City. Upon motion of Councilman Smith, seconded
by Councilman Pinkley, Westminster Street, in Tract
No. 1778 was unanimously accepted as a City Street.
A communication was read from the'Chamber of Commerce
requesting a list of the businesses in Costa Mesa®
It was moved by Councilman Smith that the list be
provided with the condition that'it was for their sole
use and not for public information. The motion was
seconded by Councilman Martin and unanimously carried.
A communication was read from Marian Talbot requesting
an encroachment permit to black top the driveway
approach at 257 Santa Isabel. It was moved by
Councilman Pinkley, seconded by Councilman Martin and
carried unanimously that the permit be granted subject
to the condition that the flow line conform to the
grade set by the City Engineer.
OFF STREET Mr. R. D. Flaherty presented a petition signed by
PARKING interested property owners requesting the formation
DISTRICT of an Off -Street Parking District. It was moved by
Councilman Smith that the petition be filed with the
City Clerk to determine whether the signatures

represent.the required percentage of assessed
valuation and the necessary percentage of the area
to be included within -the proposed District. The
motion was seconded by Councilman Pinkley and
unanimously carried.
The City Attorney was requested to draft an ordinance
of Intention to Form an Off -Street Parking District
to be presented_ at the -next regular meeting of the
Council.
A general discussion was held regarding the Fly
Situation. Mayor Nelson advised those present
that representatives from the State Board of Health
were making a survey of the City to determine the
source ..of the flies and what could be done to
combat the situation.
An application for a business license was presented
in the name of the Butterfield Sign Company for
two advertising billboards. -Upon motion .of Council-
man Martin, seconded'by Councilman Smith the permit
was -unanimously granted.
A request was -presented by Mrs. Piper for permission
to operate a refreshment stand at Hamilton and
-Harbor Boulevard on June 5; the -proceeds to go to
the Costa Mesa Girls Club. -Upon motion of Councilman
Martin, seconded by Councilman Pinkley, the perm it
was unanimously approved and -the fee waived.
A request was read from the Horseman-ts Association
for a free permit to hold a benefit dance on June 5.
Upon - motion- of Councilman -Smith, seconded -by
Councilman.Pinkley the permit 'was unanimously
granted and the -fee waived.-
A communication from the Santa Ana Novelty Company
was read requesting permission to install one
amusement machine at-Haroldts Restaurant. It was
moved by Councilman Smith that permit be granted
subject to the-condition'that-the machine will be
located—in—the bar side—of the'es'tablishment and will
not be installed until a State Liquor License is
granted.
The application of Michael Genovese for a permit to
sell fireworks was tabled pending the enactment of
a fireworksordinance.:`
Resolution No. 63,a resolution "FIXING THE METHOD
-OF-PAYING CITY-EMPhOYEES" was read. It was moved
by 'Councilman -Smith -that_ Resolution No. 63 be
adopted® The motion.was- seconded by Councilman
Martin and carried by the following vote:
AYES:- Councilman.Martin,'Nelson, Pinkley and Smith.
NOES,: None
ABSENT: :Councilman-TeWinkle.
Variance'Application No. -28 -was submitted in the
name of George M'. Holstein & Sons 'to permit the
erect-ion.'of detached garages in front yard area
on lots designated in Tract No® 1865. Upon
-motion of Councilman Pinkley; seconded by
Councilman- Smith - the p--ermit- was 'unanimously ,approved.
A recommendation was received from the Planning
Commission approving Appli-cation'.No. 1 for, an
Amendment of the Zoning Ordinance. It was moved by

Councilman Smith that a Public Hearing be set for
June 21, 10/5LL, at 7:30 P.M. The motion was
seconded by Councilman Pinkley and unanimously
carried.
Upon motion of Councilman Pinkley, seconded by
Councilman Martin and unanimously carried the
platter of naming a PouncLmaster was tabled to,
permit the receipt of more applications for the
position.
Councilman Smith reported that Costa !Mesa has
been granted a Civilian Defense Eire Engine, with.
the necessary equipment.
After a general -discussion the City Attorney was
-requested to prepaire a Fireworks Ordinance for
the next Council meeting.
Upon motion of Councilman Martin, seconded by
Councilman Pinkley the meeting adjourned.
