HomeMy WebLinkAbout07/19/1954 - City CouncilROLL CALL MINUTES OF THE CITY COUNCIL CITY OF COSTA MESA July 19,1954 The City Council of the City of Costa Mesa met in regular session July 19, 1954, at the Justice Court Building, 567 West 18th Street, at 7:30 P.M. The meeting was called to order by Mayor Nelson, followed by the Pledge of Allegiance to the Flag, and invocation by Ta-, Nelson. Councilmen Present: Officials Present: - Martin, Pinkley, Smith, T e Hinkl e and Mayor Nelson. City Attorney Dungan City Treasurer Ries City Manager Coffee City Clerk Swartz C 011`121 UNIT CAT A communication was read from the Orange County Fair Association requesting permission for the Foley Decorating Company to place banners at various locations over City Streets to advertise the Fair. Upon motion of "mr. Smith, seconded by Mr. TeWinkle, and unanimously carried, approval was granted subject to any City of County regulations. A letter from Tdr. Howard Lawson was read e,-,pressing appreciation to the Council for their action in rezoning West 19th Street, and requesting instructions as to the best procedure for street widening. itI' was moved by •'1r® Smith that the City Manager and City Attorney be authorized to proceed with the necessary steps for property acquisition to widen West 19th Street between Harbor Boulevard_ and Placentia Avenue, upon deposit with the City of r1,000.00eby Mr. Lawson, to insure against loss to the City in case that the property acquisition or improvements are not completed. The motion was seconded by Mr. Martin and unanimously carried, COTf1ERCIAL It was moved by Mr. Smith that the City pay the Orange ?STAY IMrROVELT,IENT County Road Department from the funds now held in trust, for the resurfacing of Commercial Way, upon receipt of revised bill. The motion was seconded by Mr. Pinkley and carried by the following vote: AYES: Councilmen Martin, Pinkley, Smith, TeWin1i-le and Nelson. NOES: None ABSENT: None ORDINANCE NO.56 Ordinance No. 56 was introduced by Councilman Smith. Curfew Ordinance No, 56, an ordinance "PROHIBITING THE (lst Reading) LOI_TE_R_ING OF MINORS, FIXING THE RESPONSIBILITY OF PARENTS, PROVIDING FOR THE ENFORCEMENT AND PENALTIES THEREFORP° was read. Thereupon Mr. TeWinkle moved that this constitute the first reading of Ordinance No. 56. The motion was seconded by Mr. Smith and carried by the following vote: AYES: Councilmen Martin, Pinkley, Smith, TeWinkle, and Nelson. NOES: None ABSENT: None ORDINANCE NO.57 Ordinance No. 57 was introduced -.by Councilman Pinkley. Pawn Brokers Ordinance No. 57, an ordinance "REGULATING PAWN BROK=S (I.st reading) AND SECOND HAND DEALERS, PROVIDING FOR =PING OF RECORDS, REPORTING SALES TO POLICE AND PRESCRIBING 1 1 1 x_2.9) PENALTIES FOR THE VIQLATION,THEREOFsf was read. Thereupon Mr. Pinkley moved that this constitute the first reading of Ordinance No. 57. The motion was seconded by Mr. Martin and carried by the following vote: AYES: Councilmen Martin, Pinkley; Smith,, TeWinkle and Nelson. NOES: None ABSENT: None PERMITS It was moved by Mr. TeWinkle, seconded by Mr. Smith and unanimously carried that the request of the Beach Amusement for a license to operate one amusement machine at Dickfs Place be,granted. Upon the motion of Mr. Smith, seconded by Mr. TeWinkle, and unanimously carried, the request of the Beach " Amusement Company for permission to use an inactive amusement machine license at Vans Bowling Alley was referred 'to- the Chief of -Police for investigationl. TENTATIVE MAP The tentative map of Tract No. 2310, as submitted by TRACT N0,2310 Dike & Colegrove, was unanimously approved as recommended by the City Engineer and the Planning*Commission upon the motion of Mr. Smith, seconded by Mr. Pinkley Upon the recommendation of the Chief of Police, it - was moved by Mr. Pinkley, seconded by Mr. Martin, and unanimously carried that the application for.a free permit -submitted in the name of the California Blind Workshop Distributors be denied. ' l VARIANCE Variance Application No: 37 submitted in the name of APPLICATION Andor and Eleanor Grimstead was referred to the Building N0, 37 Department and the Planning Commission upon the motion of Mr. TeWinkle, seconded by Mr. Pinkley and unanimously carried. VARIANCE' Variance Application No. 40 submitted in the name of APPLICATION Dr. Robert G. Andrews requesting variance of street NO. 40 setback line and a rear yard setback at 1865 Newport Avenue.was approved by unanimous vote, upon the motion of Mr,. TeWinkle, seconded by Mr. Smith. VARIANCE Variance Application No. 43 submitted in the name of APPLICATION E. G. Pettingill requesting rear and side yard setback NO. 43 variance at 333 Avocado Street, was approved by unanimous vote, upon -the motion of Mr. Pinkley, seconded by Mr. TeWinkle. FINAL MAP The final :map for a subdivision known as Tract No. 2092 TRACT 2092 was submitted by Mr. Ralph P. -Camp, together with a check for $3,000.00, in lieu of improvement bond, Thereupon RESOLUTION Resolution No. 73,a resolution "RATIFYING AND APPROVING NO. 73 THE MAP OF TRACT NO. 20921 was presented and read. It was moved by Mr. TeWinkle that -Resolution No. 73 be adopted. The motion was -seconded by Mr. Martin and carried by the following -vote: AYES: Councilmen Martin, Pinkley, Smith, TeWinkle r., and Nelson.. NOES: None ABSENT: None TENTATIVE MAP The tentative map of Tract No. 2310, as submitted by TRACT N0,2310 Dike & Colegrove, was unanimously approved as recommended by the City Engineer and the Planning*Commission upon the motion of Mr. Smith, seconded by Mr. Pinkley 130 TENTATIVE A tentative map of Tract No. 2315 was submitted in M111P OF the name of Dike and Colegrove. It was moved by TRACT NO.2315 Mr. Smith that the tentative map of Tract No. 2315 REPORT be approved and the City Manager is instructed to advise the subdivider of the drainage problem in that EDISON area and that the grade line must be in conformity FRANCHISE with the grade established by the City Engineer, before the final map will be approved. The motion was seconded by lir. TeWinkle and carried by the following vote: AYES: Councilmen Martin, Smith, TeWinkle and Nelson. NOES: Councilman Pinkley. Absent: None HOUSE MOVING House Moving Application No. 47 was submitted by PERMIT -47 Mr. Paul Foster with. a recommendation for approval by the Planning Commission. It was moved by Mr. Pinkley seconded by Mr. Smith and unanimously carried that the application be approved and that a performance bond of x$,'3,500.00 be pcsted with the City. �,JARRANT Warrant Resolution No. W-23, a resolution "ALLOWING RESOLUTION CERTAIN CLAIMS AND DEMANDS, INCLUDING PAYROLL NO. 1" NO. W-23 was presented. It waE moved by Mr. Pinkley that Warraint Resolution No. W-23 be adopted. The motion was seconded by Mr. Martin and carried by the following vote: AYES: Councilmen Martin, Pinkley, Smith, TeWinkle and Nelson. NOES: None ABSENT: None WARRANT Warrant Resolution W-24, a resolution 14ALLOWING CERTAIN RESOLUTION CLAIMS AND DEMANDS" was presented. It was moved NO. W-24 by Mr. TeWinkle that Warrant Resolution W-24 be adopted. The motion was seconded by Mr. Pinkley and carried by the following vote: AYES: Councilmen Martin, Pinkley, Smith, TeWinkle and Nelson. NOES: None ABSENT: None It was moved by Mr. Pin1�-:l ey, seconded by Mr. Martin and unanimously carried that the City Manager be instructed to secure bids on police cars, office equipment, etc., as requested. Mr. Coffey presented the Councilmen with the proposed specifications for a. Fire Prevention Officer for their consideration and study. City Manager informed the Council that the Orange County Coast Association is interested in securing th.e. Councilman Pinkley was presented with a badge and sworn in as a Reserve Officer by Chief McKenzie. TREASURER'S The Treasurer's Report for the month of June, 1954, REPORT was submitted and ordered filed upon motion of Mr. TeWinkle, seconded by Mr. Pinkley. EDISON Upon motion of Mr. Smith, the City Attorney was FRANCHISE instructed to draft an indeterminate franchise with. the Southern California Edison Company. The motion was seconded by Mr. TeWinkle and carried unanimously. Upon motion of i11r. Pinkley, seconded by Mr. Smith, and unanimously carried, the City Engineer was instructed to draft specifications for a drainage survey so that bids ma�T be secured for the work. It was moved by Mr. Pin1�-:l ey, seconded by Mr. Martin and unanimously carried that the City Manager be instructed to secure bids on police cars, office equipment, etc., as requested. Mr. Coffey presented the Councilmen with the proposed specifications for a. Fire Prevention Officer for their consideration and study. City Manager informed the Council that the Orange County Coast Association is interested in securing th.e. -131 A. C. Swartz, Cit Clerk 1 . Nelson, or City of Costa Mesa as a member of the Association. The _Fiscal Officer's Report for ,the month of June was read and ordered filed. In order that the sideyard setback of the lots of the subdivision of Dike and Colegrove on Shady Lane, will meet the requirements of the Building Department, it will be necessary for the developers to file the proper application for variance: Upon motion of Mr. Martin, seconded by Mr. TeWinkle and unanimously carried the City Attorney was instructed to draft a contract with the Costa Mesa Globe Herald for advertising legal notices.
