HomeMy WebLinkAbout10/04/1954 - City CouncilMINUTES OF THE CITY COUNCIL CITY OF COSTA_MESA _ October 4,.1954 The City Council of the City of Costa Mesa, California, met in regular session at 7:30 P.M., October 4, 1954, at the Newport Justice Court, 567 West 18th Street, Costa Mesa. The meeting was called to order by Mayor Nelson, followed by the Pledge of Allegiance to the Flag and invocation by Mayor Nelson. ROLL CALL Councilmen Present: Mayor Nelson, Martin, Smith, Pinkley and TeWinkle. Officials Present: City Manager Coffey, City Attorney Dungan, City Treasurer Ries and City Clerk Swartz MINUTES Upon motion by Councilman Pinkley, seconded by Cuuncilman Smith, the Council voted unanimously to waive the reading of the minutes of the previous meeting and to approve them as written. WRITTEN Notice of Claim for Damages for Personal Injury pertaining to COMMUNICATIONS Arthur J. King, a minor, was -read. Since the claim is for injuries w received at -the park which is under the jurisdicition of the County, C") Councilman Pinkley moved that the claim be denied. Councilman Martin seconded the motion and it carried unanimously. A letter was read from the Costa Mesa Chamber of Commerce relative to a possible noon meeting with the Council members to discuss the disposition of the "Christmas Tree Fund". A temporary meeting time was set for Thursday, October 14. Upon motion of Councilman Smith, seconded by Councilman Martin, Resolution No. 91 was adopted by the following roll call vote: AYES: Councilmen Martin, Pinkley, Smith, Nelson and TeWinkle. _NOES: None ABSENT: None ORDINANCE Ordinance No: 61, an ordinance "PROHIBITING THE SALE OF ILLUSTRATED NO. 61 CRIME OR HORROR COMICS TO ANYONE UNDER EIGHTEEN YEARS OF AGER, was (Comic Books) presented for second reading. Following reading of the ordinance, 2nd Reading Councilman Martin moved the adoption of of Ordinance No. 61. The motion was seconded by Councilman TeWinkle and carried by the following roll call vote: AYES: Councilmen Martin, Pinkley, Smith, Nelson and TeWinkle. NOES: None ABSENT: None. ORDINANCE Ordinance,No. 62, an Ordinance "GRANTING TO SOUTHERN CALIFORNIA NO. 62 EDISON COMPANY, ITS SUCCESSORS AND ASSIGNS, A FRANCHISE -TO USE AND TO (Edison Co) CONSTRUCT AND USE, FOR TRANSMITTING AND DISTRIBUTING ELECTRICITY 70 2nd Reading THE PUBLIC FOR ANY AND ALL PURPOSES, POLES, WIRES, CONDUITS AND APPURTENANCES, INCLUDING COMMUNICATION CIRCUITS, NECESSARY OR PROPER THEREFOR IN, ALONG, ACROSS, UPON, OVER AND UNDER THE PUBLIC STREETS, WAYS, ALLEYS AND PLACES WITHIN THE CITY OF COSTA MESA" was presented 162 for second reading. Following the readin g of the Ordinance, Councilman Smith moved the adoption of Ordinance No. 62. Councilman Pinkley seconded.the motion and it carried by the following roll call vote: AYES: Councilman Martin, Pinkley, Smith, Nelson and TeWinkle. NOES: None ABSENT: None. VARIANCE Upon the recommendation of the City Attorney and upon motion of Councilman NO. 61 TeWinkle, seconded by Councilman Pinkley, it was unanimously carried that (Aloha Trailer a committee be appointed by the Mayor to study the application for Park) variance to increase the number of trailer spaces at the Aloha Trailer Park and to make a report to the Council. Named to this committee were: Walter Weimer, Chairman of the Planning Commission, A. -J. Volz, Building Department Superintendent, and'Don Dungan, City Attorney. ORDINANCE Ordinance No. 65, an ordinance "REGULATING THE CONSTRUCTION, MAINTENANCE, NO. 65 SANITATION AND CONDUCT OF TRAILER PARKS AND TRAILER COACHES AND/OR (Trailer Parks) CAMP CARS IN THE CITY OF.COSTA MESA, CALIFORNIA, AND PROVIDING FOR PENALTY 1st Reading FOR THE VIOLATION THEREOF" was introduced by Councilman Smith. Following reading of the title, Councilman Smith moved that further reading of the Ordinance be waived and that it be read by title only. The motion was seconded by Councilman Martin and was unanimously carried. Thereupon Councilman Smith moved that this constitute the first reading of Ordinance No. 65. The motion was seconded by Councilman Martin and carried by the following roll call vote: AYES: Councilman Martin, Pinkley, Smith, Nelson and Tellinkle. NOES: None ABSENT: None RESOLUTION A communication was read from the Planning Commission urging the NO. 92 Council's action in obtaining the Justice Court as a meeting place for (Meeting place the Commission. Upon motion by Councilman TeWinkle, seconded by Councilman Smith, Resolution No. 92 was adopted by the following roll call vote: AYES: Councilmen Martin, Smith, TeWinkle and Nelson. NOES: Councilman. Pinkley ABSENT: None TENTATIVE -Tentative Map of Tract No. 2387 was submitted in the name of Hunny MAP ##2387 Investment Company, 9026'East Las Tunas.Drive, Temple City, California. Upon motion of Councilman Smith, seconded by Councilman Pinkley, the Council voted unanimously to approve the tentative map. HOUSE MOVING House Moving Permit No. 52 was submitted.in the name of the Girlst Club PERMIT #52 of the Harbor Area, to move a 121xl2a building from the northeast -corn r off' Wilson and Newport Blvd. to 2206 Newport Blvd. Mrs. Piper was present to represent the Girls' Club. Councilman Pinkley moved that a non- transferrable permit be granted and that the fee be waived. Councilman Martin seconded the motion and it was unanimously carried. The permit required by the Division of Highways to move a building was presented to Mr. Castle who has agreed to move the building without charge. BUILDING -MOVING Huilding Moving Permit No. 53 was submitted in the name of W. A. Huscroft, PERMIT ##53 1643 Placentia Avenue, for permission to move a house from 1625 Bush Street, Santa Ana to 2529 Santa Ana Avenue, Costa Mesa. Attached to the application was a petition bearing the signatures of 100% of the property owners along Santa Ana Avenue, voicing no objections. Upon motion of Councilman Smith, seconded by Councilman TeWinkle, the Council voted unanimously to grant the permit subject to such remodeling as demanded by the Building Department.. VARIANCE Variance Application No. 62 was submitted in.the name -of James E. N0. 62 Davisson, 943 Cedar Place, to permit a rear yard setback of 9 feet in. the construction of a garage on his premises. Upon motion of Councilman Smith, seconded by Councilman Pinkley, the application was unanimously approved. VARIANCE Variance Application No. 63 was submitted in the name of Carl NO. 63 Lambert, 2419 Elden Avenue, to permit a rear yard setback of 6'-6R on the southeasterly 1131 of Lot 91, Tract 300, Costa Mesa. Upon the recommendation of the Planning Commission and on motion of Councilman Smith, seconded by Councilman TeWinkle, the permit was granted subject to the compliance of the applicant to other provisions of the City's ordinance as to curb, gutters and paving. W WARRANT Warrant Resolution No. WR-29,-.resr7;ution'tALLOTn�ING:`.GERTAIN_CLAIMS RESOLUTION AND DEMANDS, INCLUDING PAYROLL N0. 60, was read. It was moved by N0. WR -29 Councilman Pinkley, seconded by Councilman TeNinkle that Warrant Resolution No. WR -29 be adopted. The motion carried by the following roll call vote: AYES: Councilmen Martin, Smith, TeWinkle, Nelson and Pinkley. NOES: None ABSENT: None REPORT OF City Manager Coffey reported on the need of the City to register a CITY MANAGER definite protest with the Department of Public Works, Division of Highways, concerning the proposed construction of an inaccessible ` freeway between 20th Street in Costa Mesa and Palisades Road in County territory. He urgently requested that the Council, any civic group, or private individuals that are concerned with the existing proposal, file a written protest with the Department of Public Works. The City Manager read a report from the fiscal officer relative to the failure of four firms to file a sales tax return for the period quarter ending June 30, 1954. Upon the recommendation of the City Manager and upon motion of Councilman Martin, seconded by Councilman TeWinkle, the Council voted unanimously to revoke the sales taxe�rOit$�of tib folloTtring firms: usi ess icenses Alice Paulle Needle Arts, 2544 Newport Blvd., Costa Mesa, Calif. Report of the Building Department was read anddupon, Wion of Councilman Smith, seconded by Councilman Marin, was accepted and ordered filed. Report of the Police -Department was read and upon motion of Councilman Pinkley, seconded by Councilman Martin, and carried, the report was accepted and ordered filed. Letters were read from the Costa Mesa Sanitary District and the Newport Mesa County Water -District, stating that money from the "Christmas Tree Fundi will not be needed for their improvement programs. Crossing Upon motion of Councilman Smith, seconded by Councilman Martin, Guard at the'Council voted unanimously to extend the employment of one crossing 19th & guard at 19th and Harbor Blvd. for an additional month, with money to Harbor Blvd be paid from the Traffic Safety Fund. Councilman Pinkley presented to the City Planning Commission a copy of the City of San Bernardino Master Plan.
