January 24,, 1955 The City Council of the City of Costa Mesa, California, met in an adjourned session at 7:30 P.M., January 21L, 1955, at the Nevport Justice Court, 567 West 18th Street, followed by the Pledge of Allegiance .tothe Flag, and invocation by Councilman Martin. ROLL CALL Counci lnen Present: Martin, Pinkley. TerTinkle and Nelson Councilman Absent: Smith Swartz Officials Present: City Attorney Dungan, City Manager Coffey, City Clerk MANTES On motion of Councilman Pinkley, seconded by Councilman Martin, and carried, the minutes of the meeting of January 17, 1955, were approved as written. The Clerk reported that this was the time and place fixed for the hearing of protests or objections against the proposed "Halecrest Annexa- tion". PUBLIC The Clerk reported that the affidavits and proof of the publication of DARING the Resolution of Intention, the mailing of Notices of adoption of said r (Halecrest Resolution of Intention, as required by lays, had been made and are on file Annexation) in the office of the City Clerk. The Clerk read the following protests which had been received prior to 7:30 P.1%1, on this date, and reported that said protests complied with the -requi-rements of the Code section: Donald R. and Margean McClintock Clarence Martin and Alice McClintock George H. Capron by attorneys Morgan & Morningstar Anton H., Fred A., and Harold T. Segerstrom and the Estate of 'dilliam 0. Segerst-rom, deceased. Melchora and Nellie R. Colombini, Rose M. s^Takefield and Aline J. Boyle ,4illiam W. and Blanche Armstrong Mr. Stiranner, Attorney for Armstrongs, McClintocks and Segerstroms, contended that the Orange Coast College property had no - val ue as far as the annexation proceedings were concerned and that in elifti?,zting the value of the Orange Coast College property over one-half the value of the property in the proposed annexation had filed protests and that therefore the City Council had no alternative but to terminate the proceedings. Mr. W. W. Morningstar, representing Mr. George H. Capron, contended that the proposed annexation is invalid because the petitioners had committed fraud by deliberately omitting from the proposed annexation, properties which were inhabited. Others speaking against the proposed annexation were Mrs. Dale Hollingworth,Mr. McClintock, H. Hagerstrom and George Capron. An opportunity' --having been given to all persons desiring to be heard, . and a full, fair and impartial hearing having been granted, Mayor Nelson stated that in view of the protests and even though the Councilhas a just reason for the continuance of the annexation, according to the City Attorney, it would be for the best interest if the Council were not to proceed at this time. Councilman Pinklev stated that in view of the protests he would not favor proceeding with the annexation at this time as it would not be right to force an area to come in - they ,,could be no asset to the City nor would the City be an asset to them. Councilman Pinkley moved that the City Attorney be instructed to draft an ordinance disapproving the annexation. The raotidn7was seconded by Councilman Martin and carried by the following roll call vote: AYES: Councilmen Martin, Nelson, Pinkley and Te Tinkle. ALOES: Councilmen _Alone ABSENT: Cou_ncillnan Smith A communication was read inviting the Councilmen to attend the February PTA meeting ofthe Lindbergh School to be held February 9, 1955. A communication was read from the Boys' Club of the Harbor Area, 594 Center Street, asking that the Council consider the traffic hazard which exists at Anaheim and 18th Streets. Upon motion of Councilman Te,Tinkle, seconded by Councilman Pinkley, and carried, the matter was referred to the Chief of Police for study and report. RESOLUTION A petition bearing the signature of Vard, Inc., 2515 Fast Coast Highway, NO. 107 Corona del Mar, California, was submitted by the City Clerk, requesting "�Tard Annex." to have annexed certain uninhabited property lying contiguous to the City, legally described in attached Exhibit "A". On motion of Councilman Pinkley, seconded by Councilman Te,dinkle, and carried, the petition was accepted and ordered filed. Thereupon Councilman Pinkley moved that Resolution No. 107, a "RESOLUTION OF TIS CITY COUNCIL OF TIE CITY OF COSTA .MESA OF INTENTION TO ANI\TEX, AND GIVING NOTICE THEREOF" be adopted. The motion was seconded by Councilman TeTATinkle and carried by the following roll call vote: AYES: Councilmen Martin, Nelson, Pinkley and Telviinkle NOES: Councilmen - None ABSENT: Councilmen - Smith The Public Hearing was set for 7:30 P.M., March 7, 1955. TENT. MAP Tentative Map of Tract 2497 was resubmitted in the name of 'Wiest ?,Mind TRACT 7#2497 Builders, Inc., 105 E..18th St., for the subdivision of portions of lots 11 to 20, inclusive, of Tract No. 278. On motion of Councilman Pinkley, seconded by Councilman Teo.linkle, and carried, the tentative map of Tract No. 2497 was approved as corrected: on the condition that Lots 9, 105 19 and 20 be 50' in tridth; Lots 11 and 18 be 51' in width, and that the alley shoz:m be - 20' in width with a 5' setback. . TRACT #1714 On motion of Councilman Pinkley, seconded by Councilman Martin, and carried, the request of the subdivider of Tract ;;`1714 to complete a portion of the improvements prior to recording the final map was approved aid the deposit of ;693.00 covering fees was accepted. VEHICLE On the recommendation of Mayor Nelson, and on motion of Councilman PARKING Pinkley, seconded by Councilman Martin, and carried, Dr. S. R. Frazier, DISTRICT 1786 Newport Blvd., was named to replace R. D. Flaherty as Parking COiJ1MISSIONER District Commissioner. L. recommendation of the City Attorney, and on motion of Council - FUNCTIONS Upon OF VEHICLE, man Pinkley, seconded by Councilman Teldinkle, and carried, the functions PAR1'HNG DIST. of the Planning Commission as it relates to parking, was transferred to the Parking District Commissioners.
