HomeMy WebLinkAbout03/14/1955 - Adjourned City Council MeetingADJOURIED MEETING OF THE CITY COUNCIL CITY OF COSTA MESA March 14, 1955 The City Council of the City of Costa Mesa, California, met in adjourned session at 7:30 P.M., March 14, 1955, at the Newport Justice Court, 567 West 18th Street, Costa Mesa. The meeting was called to order by Mayor Nelson, followed by the Pledge of Allegiance to the Flag and invo- cation by Mayor nelson. ROLL CALL Councilmen Present: Martin, Smith, Pinkley, TeWinkle, Nelson Officials Present: City Attorney Dungan, City Manager Coffey, City Clerk Swartz and City Treasurer Ries APPOINTMENT Mayor Nelson presented James J. Hart, 911 Victoria, for appointment as OF PLANNING Planning Commissioner. Thereupon it was moved by Councilman Pinkley, COMMISSIONER seconded by Councilman TeTNinkle, and carried, that James J. Hart be HART appointed to fill the Vacancy on the Planning Conmission created by the resignation of W. B. Mellott. ORAL COMMliVICA- Mr. Smith and principals, purLhasers of the 1,Teaver Subdivision, Tract TIONS No. 2551, were present to inform the Council that additional property T had been purchased on Santa Ana Avenue which would allow access to the proposed subdivision. With access to the subdivision established, '`._? upon motion of Council.rnan Smith, seconded by Councilman Pinkley, and carried, Tentative Map of Tract 2551 was accepted as recommended by the City Engineer, with the exclusion of items 3 and 4 as enumerated in his letter dated February 25, 1955. (22nd Street A delegation including Mr. A. E. Coleman, 233 East 22nd Street, was Improvements) present representing the property owners on East 22nd Street to inform the Council of their desire to create a street located 3001 south of East 22nd Street between Orange and Santa Ana Avenues. The City Attorney advised the group that unless improvement district proceedings were initiated that a deed of right of way from the owners to the City would would be necessary and that 100/ of the owners owning properties on the right of way would have to sign such right of way deed. The City Engineer stated, as his opinion, that because the proposed District would be so small the cost would be very high to form a District for the purpose of opening a street under the Street Opening Act of 1903. Councilman. Tel,,Tinkle moved that the City Attorney and Cit;) Engineer prepare the right of way deed for the people in the area in question to sign, and to prepare an agreement for said people to sign agreeing to pay for the improvement of their half of the street including curbs and gutters. Motion seconded by Councilman Smith and carried. To further clarify the responsibility of the property owners, Councilman Pinkley moved that the City Attorney prepare an agreement for the creationof legal size with provision for fencing said lots where they are.not building lots, completely vacated or-f_-mprovements are not already in. I11otion secjed by Councilman Tet -,Tinkle, and. carried. EAST 17TH A communication from Roger -Watson. President of the East 17th Street . STREET Improvement Association was read requesting the Council to initiate IMPROVEMEDUS proceedings for the widening and improvement of East 17th Street. Upon motion of Councilman Smith, seconded by Councilman Pinkley, and carried the letter was referred to the City Engineer for recornrnendation to the City Council for the disposition of East 17th Street. . 0". VARIANCE 7/107 Variance Application No. 107 was submitted in the name of Lincoln Engineering, 365 North Cleveland, Orange,California, to pert -nit the operation of a hard chrome plating shop at 660 West 17th Street, Building No. 5. A communication from the Air Pollution Contrdl Engineer was read stating that the plans meet the requirements of the Orange County Air Pollution Control District. A communication from the Fire Prevention Officer was submitted enumerating the req_uirernents necessary for the building to conform to the hire Code. Upon motion of Councilman TelPTinkle, seconded by Councilman Pinkley, and carried, the matter was tabled for one week for further investigation. LIQUOR..,. On motion of Councilman Pinkley, seconded by Councilman Smith, and I.TC NSE' carried, a notice from the State Board of Equalization regarding the TRANS EER transfer of retail package off -sale general license to Vincentts Market, 221 Newmort Blvd., was ordered filed. ORDINANCE #82 (Vard Annex.) 2nd Reading 1 1 L, 225 Ordinance No. 82, an"ORDINANCE OF THE CITY OF COST A MESA APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY CONTIGUOUS TO THE CITY OF CoSTA MESA, IN THE COUNTY OF ORANG:E, KNGdN AS '1VARD ANNEY-kTION1" was presented for second reading. Following reading of the title, Councilman Smith moved that this constitute the second reading of Ordinance No. 82. Motion seconded by Councilman Pinkley and carried unanimously. Thereupon Councilman Smith moved the adoption of Ordinance No. 82. The motion was seconded by Councilman Pinkley and carried by the fpllowing roll call vote: AYES: Councilmen Martin, Smith, Pinkley, Tellinkle, and Nelson NOES: Councilmen - None ABS ANT Councilmen - None ORDINANCE #84 (Vacating Portion of w. 18th St.) (2nd Reading Ordinance No. 84, "AAT ORDINANCE OF THE CITY OF COSTAM+SA DECLARING ITS INTENTION TO ORDER THE VACATION OF A PORTION OF WEST 18TH STREET« was presented for second reading. Section 13 of Article X ORDINANCE #83 Ordinance,No. 83, an urgency ordinance amending/Ordinance No. 25, (Amend. #25) being entitled tf "AN ORDINANCE OF THE CITY OF COSTA 14ESA, CALIFORNIA, Urgency PROVIDING FOR LICENSING AND REGULATING TIE CARRYING ON OF VARIOUS 2nd Reading PROFESSIONS, TRADES, CALLINGS, BUSINESSES AND OCCUPATIONS AND . PRESCRIBING A PENALTY FOR THE VIOLATION THEREOF" was presented for RESOLUTION 2nd Reading. Following reading of the title, Councilman Smith moved NO. 113 that further reading of the Ord' ante be waived and that it be read by (Baker Street title only. BAKER STREET A report from the Orange County Boundary Commission was read stating ANNEXATION that the boundaries of the'p_roposed "Baker Annexation" are definite and have been approved. RESOLUTION Resolution No. 113, being a resolution of "INTENTION TO ANI= AND NO. 113 GIVING NOTICE THEREOF" was presented and read. Thereupon Councilman (Baker Street Smith moved the adoption of Resolution No. 1113 and set the date for Annexation) the public hearing at 7:30 P.M., April 18, 1955. The motion was seconded by Councilman Pinkleyand carried unanimously. AYES: Martin,Smith,Pinkley,Telinkle, Nelson. NOES -None - Absent - None FINAL MAP. , Final Map of Tract No. 2497, submitted in the name of West blind Builders, Tract #2297 lnc.,, 105 East 18th Street, was presented by the -City Engineer. He advised the Council that bond for the tract has been filed and the Resolution.#114 necessary agreements executed. Thereupon Resolution No. 114, a -resolution "APPROVING THE MAP OF TRACT 2497 AND ACCEPTING THE STREETS AND ALLEYS SHOWN THEREON FOR PUBLIC USE FOR HIGHiilAY PURPOSES AND AUTHORIZING THE CITY CLERK TO SIGN THE SAID MAP AND AUTHORIZING THE MAYOR AND THE CITY CLERK TO SIGN THE AGREENYNT" was presented and -read. On motion of Councilman Pinkley, seconded by Councilman Smith, Resolution No.. 114 was adopted by the following roll call,vote: AYES: Councilmen Martin, Smith, Pinkley, TeWirkle and Nelson NOES: Councilmen - None ABSENT: Councilmen,- None 226 CITY MANAGER'S The City Manager reported that a delegation consisting of the City Clerk, REPORT City Attorney, and City Engineer, attended a meeting of the OrangeCounty Municipal L4ater District with him, at which time the said District adopted Resolution No. 85, recommendedha th .City of Costa Mesa be granted a connection to Metropolitan tiIater�a e a :enreand Bristol Streets. The City iianager stated that he was in receipt of a section of the municipal code of the City of Fullerton relative to cuts and fills. The information was submitted to the City engineer for study and recommendation relating to amendment of Ordinance No. 60. The City Manager advised the Council that the �H_Yecutive Committee of the League of California Cities expressed a desire at their last meeting to submit a recommendation to the Board of Supervisors that Gas Tax monies be equally distributed between the cities and county when they are received, said distribution to be pro -rated on a population basis. The executive committee also discussed island and off -shore drilling , aid the Western Empire Association presented a copy of the resolution they enacted relative to the use of money derived from tideland oils. The City Manager submitted to the City Clerk, for perusal by the Council, a copy of Ordinance No. 703 of the County of Orange for the regulation and prevention of contamination of underground or surface water. The Executive Committee of the League of Orange County Cities urged that each city enact such an ordinance. A communication was read from -the League of. Cities concerning pending legislation on sales tax proposals, and advocating a uniform sales tax of 1¢ throughout the State, the State making the collection and reimbursing the cities on the basis of the collection made in that City. The City Manager advised the Council that a verbal request from Ed Stevenson had been received requesting an increase in pay of E"10 per month due to the longer and more frequent meetings of the Planning Commission and Council. Upon motion of Councilman Smith, seconded by Councilman Teli inkle, and carried, the matter was referred to the City Manager for recommendation to the Council onMarch 21. CECIL,ALBE'RT The City Attorney advised the .Council that it would be necessary to VIRGINIA PL. appoint two appraisers before proceeding further with the street opening (ApprLisers proceedings for Albert, Cecil and Virginia Place. Thereupon Councilman appointed) Smith moved that Roy McCa.rdle and Barney Francque be appointed appraisers in connection with the above matter. Motion seconded by Councilman Pinkly and carried unanimously.
