HomeMy WebLinkAbout06/04/1956 - City Council2 < 41, ROLL CALL Minutes REGULAR MEETING OF THE CITY COUNCIL CITY OF COSTA MESA June 4, 1956 The City Council of the City of Costa Mesa, California, met in regular session at 7:30 p.m., June 4, 1956, at the Newport Justice Court, 567 West 18th Street, Costa Mesa. The meeting was called to order by Mayor Nelson, followed by the Pledge of Allegiance to the Flag and Invocation by Reverend A. C. Starn. Councilmen Present: Martin, Pinkley, Smith, Nelson and Meyers Councilmen Absent: None Officials Present City Attorney, City Clerk, City Manager, City Treasurer Upon motion by C. Smith, seconded by C. Meyers, and unanimously carried, the reading of the minutes of May 21 was waived, and they were approved as written. WRITTEN A communication was read from Mr. A. J. Delphino, 1623 Mesa Drive; re - COMMUNICATIONS questing permission to drive a sound truck through the City on June 4th and 5th between the hours of 10:00 a.m. and 5:00 p.m., urging people to go to the polls. Upon motion by C. Pinkley, seconded by C.,Smith, and unanimously carried, approval was granted providing no political adver- tising is involved, and the fee waived. Departmental Upon motion by C. Pinkley, seconded by C. Following reading of the title, C. Pinkley moved that further reading be waived and that this constitute the second reading of Ordinance No. 129. The motion was seconded by C. Smith, and ORDINANCE #131 unanimously carried. Thereupon C. Smith moved the adoption of Ordinance Cemetery Zone No. 129. The motion was seconded by C. Following reading of the title, C. Smith moved that further reading be waived and that this constitute,the second reading of Ordinance No. 130. The motion was seconded by C. Pinkley, and unanimously carried. There- upon C. Pinkley moved the adoption of Ordinance No. 130. The motion was seconded by C. Smith. Following full reading of the Ordinance, sec- tion by section, C. Pinkley moved that this constitute the first reading of Ordinance No. 133. The motion was seconded by C. Martin, and carried by the ° following roll call voter 1 AYES: Councilmen Martin, Smith, Nelson, Pinkley, Meyers NOES: Councilmen - None ABSENT: Councilmen - None RESOLUTION #236 Resolution No. 236, "A RESOLUTION OF THE CITY OF COSTA MESA, CALIFORNIA, Street REQUESTING THAT THE COUNTY ALLOCATE TO THE CITY OF COSTA MESA THE SUM OF Resurfacing FIVE THOUSAND TWO HUNDRED AND SIXTY-TWO DOLLARS ($5,262.00) FROM ITS SHARE OF GAS TAX MONEY,'I was presented and read. Thereupon C. Pinkley moved the adoption of Resolution No. 236. The motion was seconded by C. Martin, and carried by the following roll call vote AYES: Councilmen Martin, Smith, Nelson, Pinkley, Meyers NOES: Councilmen - None ABSENT: Councilmen - None Cancellation Upon recommendation of the Planning Commission, C. Smith moved that the of Bond Improvement Bond in the amount of $1,000.00 on Subdivision Application No. (C.E. Jones) 11, submitted in the name of C. E. Jones, 2592 Willo Lane, to subdivide the southeast corner of Del Mar and Elden Streets into four lots, be cancelled. The motion was seconded by C. Pinkley, and unanimously carried. Subdivision Subdivision Application #90 was submitted in the name of Ina Pearl Hatcher, Application 2025 Anaheim Street, requesting permission to subdivide land=2161 south of #90 Bay Street on the east side of Meyer Place, into three parcels, and refer- red to the Council because of two substandard lots. Upon recommendation of the Planning Commission and subject to their recommendations on file in the office of the City Clerk, C. Smith moved that Subdivision Application No. 90 be approved. The motion was seconded by C. Pinkley, and unanimously carried. Variance #227 (Harbor Trin- ity Baptist Church) Variance #230 (C.M. 'Sanitary District) Variance Application No. 227 was submitted in the name of Harbor Trinity Baptist Church to permit construction of a church on the northwest corner of Baker Avenue and Fairview Road for religious services. Upon recommenda- tion of the Planning Commission and subject to their recommendations on file in the office of the City Clerk, C. Martin moved that Variance Application No. 227 be approved. The motion was seconded by C. Pinkley, and unanimously carried. Variance. Application No. 230 was submitted in the name of Costa Mesa Sanitary District, 111--East-20th Street, requesting permission to use land on West 19th Street and 3151 east of Whittier on the south, an R2 zone, for a City Corporation Yard; Upon recommendation of the Planning Commission, and upon motion by C. Martin, seconded by C. Pinkley,Variance Application No: 230 was denied by the following roll call vote: AYES: Councilmen Martin, Smith, Nelson, Pinkley, Meyers NOES: Councilmen - None ABSENT: Councilmen - None 426 Variance #232 Variance Application No. 232 was submitted in the name of James (Gallacher) Gallacher, 2027 Placentia Street, requesting permission to construct an industrial building on the south side of Baker Street east ofFair- view Road, an R4 zone. As the applicant was not present to clarify his request as to location, size of building, setbacks, etc., C. Smith moved that action be delayed until later in the meeting pending appear- ance of the applicant. The motion was seconded by C. Pinkley, and unanimously carried. As the applicant failed to appear, the Application being too vague to warrant final approval, it was suggested that the applicant be notified immediately to prepare a detailed plan for the use of the 10 acres, showing streets, etc., and approximate location of proposed buildings, for submission at the next regular meeting of the Planning Commission. Thereupon C. Smith moved that Variance Application No. 230 be approved subject to approval of the Planning Commission on June 12th,.at which time the applicant must be present to submit detailed and clarified plans. Variance #234 Variance Application No. 234 was submitted in the name of Fletcher Oil (Fletcher Oil) Company, Box 548, Wilmington, for permission to replace two existing floodlight poles with two 6f target signs at 799 West 19th Street, a Cl zone. Mr. W. A. Juergen, Sales Manager, was present to clarify his intent. Upon advice of the City Attorney that a variance cannot legal- ly be granted under the Sign Ordinance,.C. Martin moved that Variance Application No. 234 be returned to the applicant and fee refunded. PERMITS Upon motion by C. Martin, seconded by C. Pinkley, and unanimously carried, a permit was granted to Mesa Ranch Market, 1976 Newport Boulevard, to sell fireworks at 494 East -17th Street from 12:00 noon, June 28, to July 6, 1956, subject to the requirements of Ordinance #50. Upon motion by C. Smith, seconded by C. Pinkley, and unanimously car- ried, the U. S. Marine Corps Air Station, E1 Toro, was granted permis- sion to operate a sound truck in the City streets between May 28 and June 15, to advertise a dance and rodeo for Navy Relief, with the ex- ception of Sundays, and fee waived. aria -84 Warrant Resolution No. WR -84, including Payroll #46, was presented for approval. On motion by C. Pinkley, seconded by C. Meyers, Warrant Reso- lution No. WR -84 was adopted by the following roll call vote: AYES: Councilmen Martin, Smith, Nelson, Pinkley, Meyers NOES: Councilmen - None ABSENT: Councilmen - None CITY MANAGER'S Upon recommendation of the City Manager, and upon motion by C. Martin; REPORT seconded by C. Smith, and unanimously carried, the City Manager was authorized to offer the Newport Heights Irrigation District.a rental increase from $25.00 to $50.00 a month, retroactive to January 1, 1956, for use of office space at 116 East 18th Street, the District Office. RESOLUTION #237 Upon the recommendation of the City Manager, and on motion by C. Pink - Water Serviceman ley, seconded by C. Martin, Resolution No. 237, "A RESOLUTION OF THE CITY COUNCIL, CITY OF COSTA MESA, CREATING TIE POSITION OF WATER SER- VICaTAN, AND ESTABLISHING THE SALARY RANGE," was adopted by the follow- ing roll call vote: AYES: Councilmen Martin, Smith, Nelson,.-Pinkley, Meyers NOES: Councilmen - None ABSENT: Councilmen - None Service Truck Upon the recommendation of the City Manager, and upon motion by C. Water Dept. Smith, seconded by C. Meyers, and unanimously carried, the City Manager was authorized to advertise for bids for a truck and body to be used as a service truck for the Water Department. L Personnel Upon recommendation of the City Manager, and upon motion by C. 'Smith,. Water Dep;t. seconded by C. Martin, and unanimously carried, the water Superintendent was authorized to employ personnel, as needed, for the Water Department Performance The City Manager advised that the performance bonds for the City Clerk Bonds and City Treasurer will expire as of July 1, 1956. Upon motion by C. Pinkley, seconded by C. Martin, and unanimously carried, the City Manager was authorized to call for proposals for one, two and three years, the 1 L amount of the bonds to be recommended by the City Attorney. Procurement Upon recommendation of the City Manager, and to expedite procurement of of Equip- equipment for the Fire Department, C. Smith moved that the City advertise ment for bids for the necessary equipment and proceed with the purchase thereof, FIRE DEPIT. applying to the Civil Defense Department for reimbursement of their portion of the cost. The motion was seconded by C. Meyers, and unanimously carried by the following roll call vote: AYES: Councilmen Martin, Smith, Nelson, Pinkley, Meyers NOES: Councilmen - None ABSENT: Councilmen - None County Approv- The City Manager advised that the work of the Fire Department would be ex - al to revamp pedited if it were completely set up by July 1. Thereupon C. Smith moved FIRE DEPIT. that the City Attorney be instructed to request and obtain County approval to advertise for bids for the remodelling of the second floor of the Fire Station, and to advertise for bids for the purchase of the necessary equip- ment to render the Station useable by Fire Department personnel. �>l Issuance of The City Manager advised that the present Ordinance covering the issuance of ;ll� Business business licenses creates a hardship on certain contractors who, for some cz.-) Licenses reason, cannot complete their job within the stipulated period of time, and, asked Council consideration of a pro -'rata plan on a quarterly basis. After discussion, C. Martin moved that the City Attorney check with surrounding .14 communities both as to pro -rata and flat fee, to determine the method by which this situation is being handled elsewhere, the City of Costa Mesa to follow suit, and all licenses issued during the interim period to be held in abeyance until a decision is reached. 1 Rezoning of Upon recommendation of the City Manager, C.
