HomeMy WebLinkAbout10/22/1956 - Adjourned City Council Meeting9 ROLL CALL ADJOURNED REGULAR MEETING OF THE CITY COUNCIL CITY OF COSTA MESA October 22, 1956 The City Council of the City of Costa Mesa, California, met in ad- journed regular session at 7:30 p.m., October 22, 1956, in the Jury Room of the Newport Justice Court, 567 West 18th Street, Costa Mesa. The meeting was called to order by Mayor Nelson, followed by the Pledge of Allegiance to the Flag and Invocation by Mayor Nelson. Councilmen Present: Martin, Pinkley, Smith, Meyers, Nelson Councilmen Absent: None Officials Present: City Attorney, Deputy City Clerk, Fiscal Officer WRITTEN The Deputy City Clerk, acting for the City Clerk, read a communication CGEUNICATIONS from Alfred W. and Marianne Whelan, further protesting the Bristol #1 Annexation as invalid in their opinion. The letter having been read in full, C. Martin moved that the letter be filed. The motion was,second- ed by C. Pinkley, and unanimously carried. The Deputy City Clerk read a communication from Bob Fernandez, owner of Tiernan's, 902 North Main Street, Santa Ana, requesting an answer as to why the City does not purchase office equipment from him where price and quality is comparable. Upon motion by C. Smith, seconded by C. Meyers, and unanimously carried, action was deferred until an opinion can be obtained from the City Manager, now on vacation. Bldg. Moving Building Moving Permit #133 was submitted in the name of Lee Toncray, Permit #133 1680 Superior Avenue, requesting permission to move a storage building from the 100 block on Terminal Way to 1680 Superior Avenue. Upon recom- mendation of the Planning Commission, and upon motion by C. Smith, seconded by C. Martin, and unanimously carried, Building Moving Permit #133 was approved, subject to the recommendation of the Planning Commission on file in the office of the City Clerk. RA!7 Deeds The City Attorney advised that the City has now received 45 Right of Way Accepted on Deeds from owners on 'West 19th Street. Thereupon Resolution No. 269, "A 19th Street RESOLUTION OF THE CITY COUNCIL ACCEPTING RIGHT OF WAY DEEDS ON WEST 19TH RESOLUTION #269 STREET AND ORDERING THAT THEY BE RECORDED," was presented. Thereupon, C. Martin moved the adoption of Resolution #269. The motion was second- ed by C. Pinkley, and carried by the following roll call vote: AYES: Councilmen - Martin, Pinkley, Smith, Meyers, Nelson NOES: Councilmen - None ABSENT: Councilmen - None. R/W Deed The City Attorney reported that the Right of Way Deed in connection with Accepted Sanitary'District Annexation #17 had been prepared, and although the in- S.D.Annexation strument had not as yet been executed by the Sanitary District, it is #17 their intention to do so at the next meeting. Thereupon, Resolution No. RESOLUTION #270 270, "A RESOLUTION OF THE CITY COUNCIL ACCEPTING RIGHT OF WAY DEED FOR SANITARY DISTRICT ANNEXATION #17,11 was presented. Upon motion by C. Martin, seconded by C. Pinkley, Resolution No. 270 was adopted by the following roll call vote; subject, however, to approval by the Sanitary District: AYES: Councilmen - Martin, Pinkley, Smith, Meyers, Nelson NOES- Councilmen - None ABSENT: Councilmen - None ORDINANCE #144 Ordinance No. 144, "AN ORDINANCE OF THE CITY OF COSTA MESA APPROVING THE Bristol #1 ANNEXATION OF CERTAIN UNINHABITED TERRITORY CONTIGUOUS TO THE CITY OF COSTA Annexation MESA, IN THE COUNTY OF ORANGE, KNOWN AS 'BRISTOL #1 ANNEXATION,11f was (2nd Reading) presented for second reading. Follo-wing reading of the title, C. Smith moved that further reading be waived and that it be read by title only. The motion was seconded by C. Pinkley, and unanimously carried. There- upon C. Martin moved the adoption of Ordinance #144. The motion was seconded by C. Pinkley, and carried by the following roll call vote: AYES- Councilmen - Martin, Pinkley, Smith, Meyers, Nelson NOES: Councilmen - None ABSENT: Councilmen - None 11 1 Ll 487 ORDINANCE #145 Ordinance.No. 145, "AN ORDINANCE AMENDING SECTION 3.2 OF ARTICLE III OF Rezoning ORDINANCE NO. 32 OF THE CITY OF COSTA MESA, CALIFORNIA, ENTITLED 'AN ORDINANCE (2nd Reading) OF THE CITY OF COSTA MESA ESTABLISHING LAND CLASSIFICATIONS IN DISTRICTS WITH- IN THE INCORPORATED TERRITORY OF THE CITY OF COSTA MESA AND REGULATING THE USES OF PROPERTY THEREIN, ADOPTING A MAP OF SAID DISTRICTS, DEFINING THE TERMS USED IN THIS ORDINANCE, PROVIDING FOR THE ADJUSTMENT, ENFORCEMENT AND AMENDMENT HEREOF, PRESCRIBING PENALTIES FOR VIOLATION HEREOF, AND REPEALING ORDINANCES AND PARTS OF ORDINANCES INCONSISTENT AND IN CONFLICT HEREWITH, t" was presented for second reading. Following full reading of the Ordinance, section by sec- tion, C. Martin moved that this constitute the second reading of Ordinance No. 115. The motion was seconded by C. Smith, and unanimously carried. There- upon C. Martin moved the adoption of Ordinance No. 145. The motion was sec- onded by C. Smith, and carried by the following roll call vote: AYE'S. Councilmen - Martin, Pinkley, Smith, Meyers, Nelson NOES: Councilmen - None ABSENT: Councilmen - None .•-V.P.Do #2 The City Attorney advised that before the Cowan Deed can be recorded by the Cowan Deed City, the City must adopt a Resolution accepting the Deed and ordering it k� recorded. Thereupon, Resolution No. 271, "A RESOLUTION OF THE CITY COUNCIL CIO RESOLUTION ACCEPTING THE DEED FROM COWAN AND ORDERING THAT IT BE RECORDED," was presented. #271 Upon -motion by C. Pinkley, seconded by C. Meyers, Resolution No. 271 was adopted by'the following roll call vote: AYES: Councilmen -. Martin, Pinkley, Smith, Meyers, Nelson NOES: Councilmen - None ABSENT: Councilmen - None #272 RESOLUTION R.esolution'No. 272, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA Deputy City MESA ESTABLISHING THE OFFICE OF DEPUTY CITY CLERK AND FIXING THE COMPENSATE ON Clerk THEREFOR" was presented. Upon motion by C. Smith, seconded by C. Pinkley, Resolution No. 272 was adopted by the following roll call vote: AYES: Councilman - Martin, Pinkley, Smith, Meyers, Nelson NOES: Councilmen - None ABSENT. Councilmen - None Helicopter Upon motion by C. Smith, seconded by C. Pinkley, and unanimously carried, the Promotion City went on record as granting its consent to the request of the Chamber of Commerce to land a helicopter at the park on November 26th, as an advertising promotion for pre -Christmas sales, subject, however, to the approval of the Park Board, C. Martin advised that the tree removal at 20th and Santa Ana Avenue was not progressing as rapidly as it should, and the City Manager was directed to in- vestigate the matter upon his return from vacation. CITY MAMA- The Acting City Manager advised that, in connection with the Fire Station, GERIS REPORT authority was needed for clearing the old foundation and for additional work to be done on the pumper. Fire Station Upon motion by C. Martin, seconded by C. Meyers, and unanimously carried, the Council authorized -the work of clearing the old foundation from the Fire Station site in the amount of $1.1.69, said sum to be paid from the Unapprop- riated Reserve Fund. Seagrave Upon motion by C. Pinkley, seconded by C. Martin, and unanimously carried, Pamper the Council authorized additional repair work to be done on the Seagrave Pumper while it is in Los Angeles having a tank installed, in the amount of $115.00.
