REGULAR MEETING OF THE CITY COUNCIL
CITY OF COSTA MESA -
February 4, 1957
The City Council of the City of Costa Mesa, California- met in regular ses-
sion at 7:30 p.m., February 4, 1957, at the Newport Justice Court, 567 West
18th -Street, Costa Mesa. The meeting teras called -to order by Mayor Nelson,
followed by the Pledge of Allegiance to the Flag -and Invocation by Mayor
Nelson.
Roll Call- Councilmen Present: Martin, Smith, Meyers, Pinkley,-Nelson
Councilmen Absent: None
Officials Present: Deputy City Clerk, City Clerk, City Attorney, City
Manager, City -Treasurer, Director of Finance
Minutes Upon motion by C. Pinkley, seconded by C: Meyers, and unanimously carried,
the reading of the minutes of.January 21', 1957, was waived, and they were
approved as written.
Oral Mayor Nelson-asked_if there were any in"the audience wishing to speak on a
Communications matter not on the agenda.- Thereupon Florence Wolmuth inquired about a letter
regarding M1 zoning in the Baker Street area. The City Clerk stated that the
matter was under consideration and a reply,would,be sent later in the week.
'ITTritten The Costa Mesa Friday Afternoon Club expressed -its appreciation for the re -
Communications moval of a dead tree on their property. On motion by C. Smith, seconded by
C. Meyers, and carried, the letter was ordered filed.
A bulletin from the California Disaster Office, stating that a state of ex-
treme, -,emergency exists upon.the receipt of an alert signal, and pointing out.
that control: of alcoholic beverages, as we11"as regulations on oil and food
stocks become immediately effective, was read; -and 'on motion of C. Pinkley,
seconded by C. Meyers, and carried, was ordered filed.
Three communications regarding the proposed dog leash law were presented
from Mrs. Victor Lee; Ethel M. Rhodes and Mr. and Mrs. K. E. Thompson. On
motion by C. Pinkley, seconded by C. Meyers, and carried, the communications
were ordered filed.
Notice was received from -the County of Orange that Council -approval should
be given to proposed annexation of inhabited territory before the proposals
were forwarded -to Orange County Boundary Commission.. On motion by C. Smith,
sebonded by C. Pinkley, and carried., the communication was ordered filed.
The Murray -Sanders Company offered to -arrange with the Edison Company for
the installation of ornamental lighting standards -in Tract No. 2727, the
cost to be -paid by the subdivider. On motion of C. Smith, s eco nded by C.
Pinkley, and.carried, the installation"was approved, subject to the require-
ments of location by the,City Engineer.
Harbor Rest Memorial Park, expressing its realizations of its community
obligations, offered its services.to any member,of the Police and -Fire Depart-
ment who may lose his life in line of duty. On motion of C. Smith, seconded
by C. Meyers, and carried, the offer was accepted and the letter ordered filed.
Departmental, The Deputy City Clerk presented the monthly reports of City departments, and

on motion of Ce-Pinkley,,seconded by C. Smith, and carried, the reports were

Dr. Edward Lee Russell, County Health Officer, reported that investigation
Ditch
of the drainage ditch at Costa Mesa,Street and Walnut Place, had been made,
and that no public health hazard existed. The -Fire Chief also reported that
no fire hazard existed at this time. It was pointed out by C. Pinkley that
the ditch was on private property, -and after discussion, C. Martin moved -
that the attorney for property owners in the -area-be notified of the City's
desire to help alleviate the condition.. The motion was seconded by C. Pink -
ley, and carried.
Final Map
The City Engineer presented the final map of Tract No. 30655 submitted in
TRACT #3065
the name of Kenneth 7& Ko11, for the subdivision of 5 acres between Congress
(Koll)
Street and Wilson Street into 22 lots, together with a"check in the amount
of $1,717.17, a bond in the amount of $22,000.00, and signed agreement.

Knitting Bag The Commissioners of Vehicle Parking District No. I recommended the ex -
Lease'' tension of the lease on the property at 113 East 18th Street occupied by
the Knitting Bag, to June 30, 1959. On motion by C. Pinkley, seconded by
C. Martin, and carried, the extension of the lease was approved and the
City Attorney was instructed to draft the lease.
Widening of Notice was received from the Board of Supervisors of Orange County that
Harbor Blvd. a public hearing vould be held on the proposed improvement of Harbor Boule-

Final Map
The City Engineer presented the final map of. Tract No. 3166, submitted in
TRACT #3166
the name of College Park Corporation, for the subdivision of 17.7 acres
(College Park)
east of Harbor Boulevard into 85 lots, together with a check in the amount
of $2,D93.66, a bond in the amount of $67,200.00, and signed agreement.
Thereupon, C. Pinkley moved the adoption of Resolution No. 3205 "A

Improvement A resolution of the Board of Supervisors of Orange County, granting to the
of Harbor City of Costa Mesa $12,402.00 from the County's apportionment of the Califor-
Boulevard nia Highway User's Tax Fund to be used for the improvement of Harbor Boulevard
between 19th Street and Wilson Street in the City of Costa Mesa, was present-
ed, and on motion by C. Pinkley, seconded by C. Martin, and carried, this
grant was accepted.
Crane-McCray A request from James A. Crane and A. A. McCray for the annexation of portions
Annexation of Blocks 1, 2, 3 and 4 of the Cummings and Moons Addition to Fairview to
Request the City, of Costa Mesa, together with the recommendation of the Planning
Commission that the annexation be approved, was presented. On motion by C.
Martin, seconded by C. Pinkley, and carried, the proposed annexation was ap-
proved and the City Engineer instructed to prepare a map for presentation to
the Orange County Boundary Commission.
Taylor, Cald- The request of Wilfred B. Taylor, Richard W. Taylor and Eunice L. Caldwell
well, Felipe for the annexation of Lots 7 and 8; Block B, Berry Tract, and Ruben Jose
Annexation Felipe and John Felipe for the annexation of Lot 6, Block. B, Berry Tract,
Request both with M1 usage, were presented, together with the recommendations of the
Planning Commission for approval of the annexations. C. Martin stated that
it was contrary to the plans for the development of the area to permit Ml
usage and moved that the request be tabled and the applicants advised,of the
proposed development of the area. The motion was seconded by C. Smith, and
carried.
Madera Appli- The application of Thomas James Madera for permit to operate a'taxi cab in
cation Denied. .the City of Costa Mesa, was presented, with a recommendation of the Chief
of Police that the application be denied. On motion by C. Martin, seconded
by C. Meyers, and carried, the application was denied.
ORDINANCE #135 Ordinance No. 135, "AN ORDINANCE OF THE CITY OF COSTA MESA, CALIFORNIA, ADDING
Readopted NEW SECTIONS TO ORDINANCE NO. 25 TO REQUIRE A BUSINESS LICENSE FEE FOR SUB-
DIVIDING REAL PROPERTY WITHIN THE CITY OF COSTA MESA, AND AMENDING ORDIIa NCE
NO. 46 OF THE CITY OF COSTA MESA,11 was presented for ratification, confirma-
tion and readoption to correct a technical error in publication. On motion
by C. Pinkley; seconded by C. Meyers, Ordinance No. 135 was readopted by the
following roll call vote:

Tentative Map Tentative Map of Tract No. 3190 was again presented for approval. After
TRACT #3190 discussion, C. Pinkley moved that the map be approved subject to the'require-

Anorco Corp.) of the Engineer's requirements relative to the proposed North Costa Mesa
Storm Drain. The motion was seconded by C. Smith, and.carried.
Tentative Map The Tentative Map of Tract No. 3191 was again presented for approval, and
TRACT #3191 on motion by C. Pinkley, seconded by C. Smith, and carried, the map was ap-
(Number Seven proved subject to the recommendations of the Planning Commission and the
Anorco Corp.) City Engineer, with the exception of the Engineer's recommendation relative
to the North Costa Mesa Storm Drain.
RESOLUTION Resolution No. 3215 "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA

Kempton- The application of Tdlliam G. Kempton and Morial Thornburg for a zone change

ed by C. Pinkley, and carried.
The application of Mario C. Pacini to rezone the rear portion of Lot #231,
Pacini Rezoning Newport Heights Tract, from R4 to C2,was presented, with a'recommenda-

RESOLUTION Upon recommendation of the City Manager, C. Pinkley moved the adpti.on

House Moving The application of Loyd B. Croney for permit to move, a building from
Permit (Crony) 12084 Westminster Boulevard, Santa Ana, California, to 280 Costa Mesa
Street, Costa Mesa, having been approved by the Planning Commission, was
granted, subject to the requirements of the Building Department, on motion
by C. Smith, seconded by C. Martin, and carried.
RESOLUTION x#'323 Notice was received that petition has been filed for the abandonment of a
Protest Banning portion of Banning Place in the Fifth Road District, and that a public
Place Abandmt. hearing on the proposed abandonment would be held by the Board of Super-
visors on February 20, 1957. The City Engineer stated that the proposed
abandonment would block an alley of the City of Costa Mesa, and on motion
by C. Pinkley, seconded by C. Meyers, Resolution No. 323, "A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF --COSTA MESA PROTESTING PROPOSED ABANDONMENT
OF A PORTION OF BANNING PLACE IN THE FIFTH ROAD DISTRICT, ORANGE COUNTY,
CALIFORNIA," was adopted and ordered forwarded to the Board of Supervisors
by the following roll call vote:

District SPECIFICATIONS, ESTIMATE AND REPORT PURSUANT TO THE PROVISIONS OF DIVISION
14, PART 1, STREETS AND HIGI-DTAYS CODE, STREET LIGHTING ACT OF 1919, AS
AMENDED, FOR THE FURNISHING OF ELECTRIC CURRENT AND FOR THE MAINTENANCE
OF CERTAIN° LIGHTING FIXTURES AND -APPLIANCES IN SAID CITY- FOR A PERIOD OF

by the City Attorney as a preliminary step in the formation of the Street
Lighting District in the City of Costa Mesa. On motion by C. Martin,

Planning Con- The City Manager requested that the Council consider sending members of

San Francisco Society of Planning Officials Conference in San Francisco March 17 - 21,
1957. The Council expressed the opinion that the volunteer services of
the Planning Commissioners should be recognized and appreciated, and on
motion_ by C. Pinkley, seconded by C. Smith, and carried, approved the At-
tendance at the Conference of any Commissioner desiring to.go, the expen-
ses to be defrayed by the City, and the Planning Technician to make all
necessary arrangements.
Recreation Con- The City Manager recommended that the Council designate two representatives
ference in to attend the 9th Annual California Recreation Conference in Sacramento on
Sacramento February 24 - 27, 1957. C. Pinkley moved that the Mayor appoint one Coun-
cilman and one member of the Park Board as delegates. The motion was sec-
onded by C. Meyers, and carried. The Mayor appointed C. Martin to represent
the Council and suggested that the Park Board appoint one of their members
to attend.
Bonelli letter A letter from Assemblyman Frank G. Bonelli with copies of Assembly Bill
Comic Books AB -64 banning the sale of crime horror comics to minors under 18 years of
age, and requesting support of the bill, was read. It ti•1as pointed out

that on October 4, 1954, the City of Costa Mesa had adopted an Ordinance to
the same effect and on motion by C. Smith, seconded by C. Pinkley, and car-
ried, the City Clerk was instructed to notify Assemblyman Bonelli of the
action already taken by the City.
Variance.#128 The application of the Hale Company for an extension.of time for a year to
continue use of existing signs and temporary real estate office for Tract
No..2671 in an Rl.zone, being Variance Application No. 128, was presented
with the approval of the Planning Commission, and on motion by C. Pinkley,
seconded by C. Meyers, and carried, the Variance was granted for an addition-
al year -or until the homes are sold, whichever is.sooner.
Variance #280 The Busy Bee Rancho requested an additional.continuance of 30 days on Vari-
ance Application No. 289. On motion by C. Pinkley, seconded by C. Meyers,
and carried, the continuance was granted.
The Dog House The application of. Lewellyn Wills to the Alcoholic Beverage Control Commis-
sion fora license to operate The Dog House at 812 West 19th Street, was
referred to the Council. After consideration of the applicant's record,
C. Martin moved -that the Council go on record as opposed -to the granting of
this permit by the -Department of Alcoholic -Beverage Control. Thelmotion was
seconded by C. Meyers, and carried.
Spiwak Permit Upon -motion by C. Smith,.seconded by C... Meyers, and carried, -a permit was
granted to Charles Spiwak to pick up and haul out -of .town junk cars, the
Police Department to be notified of motor numbers and license plates.
Seal's Taxi The application of Seal's Taxi Service for permit to operate a third taxi
Service was granted on motion by C. Pinkley, seconded by C. Meyers, and carried.
Edlyn Studios The application of the Edlyn.Studios for a transient photography license
was granted on motion by C. Pinkley, seconded by C. Meyers, and carried.
Auction The application of Jack Rouse and Robert Rouse for permit to hold a one -day
auction on February 7, 1957, at 643 -West 17th Street, was granted on motion
by C. Smith, seconded by C. Martin, and carried.
WR -104 Warrant Resolution No. 104, including Payroll No® 62, was presented for ap-
proval. On motion by C. Pinkley; seconded by C. Meyers, Warrant Resolution
No. 104 was adapted by the following roll call vote:

ABSENT: Councilmen = None
City Manager's The City Manager recommended.that an architect be appointed for the new fire
Report station on Fairview Road, and suggested -the appointment of Willard Jordan.
On motion by C. 'Smith, seconded by C. iIartin,.and-carried"the appointment
of Mr. Jordan was confirmed and the Mayor and the CityClerk authorized to
sign the contract.
On motion by C. Pinkley, seconded by C. Meyers, and carried, the City Attor-
ney was instructed to prepare a draft of an amendment.to the _oil drilling
ordinance to cover contingencies that might arise.
The City Manager reported that the Boy Scouts, in.observance of Boy Scout
Week, would take over the administration of the"City on Wednesday, February
6, 1957, f or•a half day, and that the -boys would-be notified by letter of
their appointments. On motion by C. Martin, seconded by C. Pinkley, and
-.carried, the Mayor was authorized to issue a proclamation in commemoration
of Boy Scout Week.
On motion by C. Smith, seconded by C. Martin, and unanimously carried, the
meeting was adjourned at 10:00 p.m.."
