The meeting was called-to-ord-er by-_ Mayor Nelson, followed by the Pledge of Allegiance to the Flag and In_ vocation by Claire H. Nelson. Roll Call Councilmen Present: Martin, Pinkley, Smith, Meyers, Nelson Councilmen Absent: None Officials Present Deputy City Clerk, City Clerk, City Manager, City Attorney, Director of Finance,. Minutes Upon motion by C. Pinkley, seconded by C: Martin, and unanimousl�y,carried, the reading of the minutes of February 4, 1957, was waived, and they were approved as written. Upon motion by C. Smith, seconded by C. Meyers, and unanimously carried, _ the reading of the minutes of the Special Meeting of February 11, 1957, was waived, and they were approved as written. Written The Deputy Clerk read a communication from H. A. Cooksey, Business Manager Communications of the Machinists District Lodge #94, requesting permission to use a trail- er as a temporary field office at 1940 Placentia Avenue, an M1 zone, for approximately two months. Upon motion by C. Pinkley, seconded by C. Mey- ers, and unanimously carried, the request was referred to the Building Department and the City Attorney to ascertain how long the trailer has been in use without a permit and for their recommendation to the Council. The Deputy Clerk read a communication from the Southern California Coun- cil of Outdoor Advertising stating their opposition to Senate Bill #666 which seeks to regulate outdoor advertising. Upon motion by C. Smith, seconded by C. Meyers, and unanimously carried, the communication was order- ed filed. Upon motion by C. Pinkley, seconded by C. Smith, and unanimously carried, a communication from the Department of Alcoholic Beverage Control, State of California, acknowledging receipt of the protest filed against the is- suance of a liquor license to Lewellyn Wills by the City of Costa Mesa, was ordered filed. Upon motion by C. Pinkley, seconded by C. Meyers, and unanimously carried, a communication protesting a leash law from Margaret Edwards, 273 Monte Vista, aid a communication from the Costa Mesa Chamber of Commerce advising results of their leash law poll, were ordered filed. A communication from the Health Department, County of Orange, was read by the Deputy Clerk, requesting permission to use the Costa Mesa fire house to conduct a community -wide poliomyelitis immunization clinic. Upon motion by C. Smith, seconded by C. Pinkley, and unanimously carried, the Mayor was authorized to issue a proclamation to this effect, a copy to be directed to the County Health Department. Reports of Dir. Upon motion by C. Smith, seconded by C. Meyers, and unanimously carried, of Finance and the reports of the Treasurer and the Director of Finance for the month of Treasurer January, 1957, were accepted and ordered filed. Audit of AC's Upon motion by C. Pinkley, seconded by C. Smith, and unanimously carried, action on the Report on Audit of Accounts for the period July 1, 1956 through December 31, 1956, as prepared by Pyle, Lance & Schlinger, Account- ants, was deferred to the next regular meeting to allow the Council time to study the report. Final Map The City Engineer presented the final map of Tract No. 3106, submitted in TRACT #3106 the name of G. D. Buccola, 1242 Lincoln Avenue, Anaheim, for the subdivi- (Buccola) sion of 5 acres between Fullerton and Orange Avenues and 20th and 21st Streets, into 24 lots, together with a check in the amount of $2,219.41, a bond in the amount of $30,700.00, and signed Agreement. Thereupon C. Smith moved the adoption of Resolution No. 330, "A RESOLUTION #3,J0 RESOLUTION APPROVING THE FINAL MAP OF TRACT NO. 3106 AND ACCEPTING THE 1 0 537 STREETS AND ALLEYS -SH9.0 THEREON FOR- PUBLIC USE FOR HIGWAY PURPOSES AND AUTHORIZING THE CITY CLERK TO SIGN THE MAP AND AUTHORIZING THE CITY CLERK AND THE. MAYOR TO SIGN THE AGREEMENT." The motion_ was secorided by C. Pacini and Lucille M. Pacini. The motion was seconded by C. V.P.D. #1 The Deputy Clerk read a communication from the Costa Mesa Vehicle Parking Acquisition District No. 1, setting forth the recommendation of the commissioners for of Land the acquisition of additional parking area in that District. Roy McCardle was present to discuss the proposed methods of financing the purchase of additional land. After discussion, C. Smith moved that the proposal be re- ferred back to the Parking Commissioners, the Council to approve the purchase of land if a satisfactory method of financing can be worked out. The motion was seconded by C. Meyers. After further discussion, C. Smith withdrew his motion. Thereupon C. Martin moved that the Council go on record as approving the purchase of additional land for parking purposes providing the District can work out a plan of financing that is mutually.satisfactory to the District and the Council. Smith moved the adoption of Resolution No. 332 accepting a deed of right ^7. 19th St. of way from Harvey Somers, -Inca, for the iTidening of West 19th Street, sub- R/W Deed ject to the condition that a stipulation be made in the agreement signed Accepted with Mr. Somers that "utility purposes" include sidewalks. The motion was seconded by C. Meyers. After -discussion, C. Smith withdrew his motion. Upon advice from the City Attorney, C. Smith moved that the City Attorney be instructed to prepare an.agreement between the City of Costa Mesa and Harvey Somers, Inc., incorporating the following conditions: (1) that the 109 r/w deeded to the City be considered part of the property of the owner for build- ing and off-street parking requirements; (2) that the owner be allowed to encroach on the r/w for parking purposes so long as the encroachment does not interfere with on -street parking, and subject to use by the City for side- walks and utility purposes; and the Mayor and City Clerk authorized to sign the agreement on behalf of the City. The motion was seconded by C. Meyers, and unanimously carried. Thereupon C.. Smith moved the adoption of Resolution No. 332, A RESOLU- RESOLUTIOV TION OF THE CITY COUNCIL OF THE CITY OF COSTA TMESA ACCEPTING A DEED OF RIGHT #332 OF WAY FROM HARVEY SOMERS, INC., FOR THE WIDENING OF WEST NINETEENTH STREET IN THE CITY OF COSTA MESA." The motion was seconded by C; Meyers, and Reso- lution No. 332 zras adopted by the following roll call vote: AYES: Councilmen.- Martin, Pinkley, Smith, Meyers, Nelson NOES.: Councilmen - None ABSENT: Councilmen = None 3 Driver Permit The request of Herman R. Tate that a driver permit be granted to Thomas (Madera) Madera to operate a taxicab in the City was �g ain submitted for recon- sideration. Upon motion by C. Meyers, seconded by C. Martin, and unanimously carried, the Chief of Police was instructed to gather addi- tional information concerning Mr. Madera's previous employment record, a confidential report to be made to the Council, and the applicant to continue on his present status until a decision is reached. Martin. Following full reading of the Ordinance, section by section., the Planning Commission, on file in the office of the City Clerk.- The C. --.Meyers moved that this constitute the first reading of Ordinance No. 157. The motion was seconded by C. Smith, and carried by the following roll call vote: Thereupon Ordinance No. 154, "AN ORDINANCE AMENDING SECTTION 3.2 AYES: Councilmen - Martin, Pinkley, Smith, Meyers, Nelson Rezoning NOES: Councilmen - None -ABSENT: Councilmen_ - None Globe -Herald At this point in the meeting Mayor Nelson commended the Globe -Herald upon receiving the award as the best non -daily newspaper in California, and expressed the Community's pride in the honor. 1 -hr. parking The Deputy Clerk read a report from the Traffic Division relative to a Rochester St. request for 1 -hour parking on Rochester Street made by H. W. Wright, 126 Rochester. Upon recommendation of the Chief of Police, C. Smith moved the adoption of Resolution No. 333, "A RESOLUTION OF THE CITY RESOLUTION #333 COUNCIL,, CITY OF COSTA MESA, CREATING A 1 -HOUR PARKING DISTRICT FROM NEWPORT BOULEVARD EAST ON BOTH SIDES OF ROCHESTER STREET TO THE END OF THE EXISTING C2 ZONE." The motion was seconded by C. Pinkley, and Reso- lution No. 333 was adopted by the following roll call vote: AYES: Councilmen - Martin, Pinkley, Smith, Meyers, Nelson NOES: Councilmen -- None ABSENT: Councilmen - None Proclamation Upon motion by C. Martin, seconded by C. Meyers, and unanimously car- ried, Mayor Nelson was authorized to issue a proclamation designating the week of February 17 to 23, 1957, as "-Engineers' Week." Tentative Map Tentative Map of Tract No. 2956, submitted in the name of Costa Invest - 1 TRACT #2956 ment Corporation, 5556 West Third Street, Los Angeles, for the division (Costa Inv.) of property at Harbor Boulevard and Fair Drive into two parcels (re- subdivision of Lots 1-7 of Tract No. 2750), was presented for approval. After discussion, C. Smith moved that Tentative Map of Tract No. 2956 be approved, subject to the recommendations of the City Engineer and the Planning Commission, on file in the office of the City Clerk.- The motion was seconded by C. Meyers, and unanimously carried. Pinkley, and unanimously carried,'that action be deferred until the extension of Cabrillo Street is studied further. Oil Drilling Upon motion by C. Martin, seconded by C. Smith, and unanimously carried, the Council went on record as upholding the action of the Planning Commis- sion in denying Orange County Use Variance No. 3495 pertaining to oil well drilling. Variance #305 Variance Application #305 was submitted in the name of Ie Roy Posey, 212 (Posey) _ Cabrillo Street, to permit a 51 rear yard setback at the northwest corner .� i� of Orange Avenue and Virginia Place, an R4 zone. Upon motion by C. Martin, seconded by C. Meyers, and unanimously carried, Variance Application #307 was approved subject to the recommendations of the Planning Commission, on _.file in the office of the City Clerk. Variance #286 A request was submitted in the names of H. S. Iamb and R. C. Ce-rf, 457 Canon (Lamb/Cerf) Drive, Beverly Hills, for the withdrawal -of Variance No. 286 and refund of the $25.00 fee. Upon motion by C. Meyers, seconded by C. Pinkley, and unanimously carried, permission was granted to withdraw the Variance, but the request for refund of fee -vra.s denied. Variance #152 A request was submitted in the name of Rick Thunstrom, 1825 Placentia Ave- (Thunstrom) nue, for a time extension'on Variance Application No. 152 (amended), which Extension on Variance expired September 19, 1956, and permitted a house trailer to be parked and used for living quarters for a tra.tchman at 1930 Placentia Avenue, an Ml zone. Upon motion by Meyers; seconded by C. Pinkley, and unanimously carried, an extension of one year from the date the original Variance ex- pired (September 19, 1956) was approved. Refund Request A request was submitted in the name of Mrs. Amanda E. Norr; 241 - 21st Street, (Norr) for a refund of $27.50 on curb permit No. 1546 issued to Jezowski & Markel, contractors. Upon recommendation of the Street Superintendent, and upon motion by C. Pinkley, seconded by C. Meyers, a refund was granted by the following roll call vote: AYES: Councilmen - Martin, Pinkley, Smith, Meyers, Nelson NOES: Councilmen - None ABSENT: Councilmen - None Claim A claim and demand for -damages for personal injuries and property damage (Stevens) was submitted by Rutan, Lindsay, Dahl, Smedegaard, Howell & Tucker, attor- neys, in the name of --'Don F. Stevens, 162 East 22nd Street, in the amount of $4,378.89 against the City of Costa Mesa. Upon motion.'by C..Smith, sec- onded by C. Meyers, and unanimously carried, the claim was denied and refer- red to the insurance carrier. PERMITS Upon motion by C. Pinkley, seconded by C. Smith, and unanimously carried, a permit was granted to L. W. Williamson, 17813 S. Main Street, Gar- dena, to pick up and haul autos and junk. Upon motion -by C. Pinkley, seconded by C. Meyers, and unanimously car- ried, a permit was granted to Golden West Amusement to install a coin- operated phonograph at Buddy's Burgers on Harbor Boulevard. WR -105 ?Yarrant Resolution No. WR -105, including Payroll No. 63, was presented for approval. On motion by C.
