ADJOURNED RTMUTAR MEETING OF THE CITY COUNCIL
CITY OF COSTA MESA
March 19, 1957
The City Council of the City of Costa Mesa, California- met in adjourned,
regular session at 6:00 p.m., March 19, 1957, at the Newport Justice Court,
567 West 18th Street, Costa Mesa. The meeting was called to order by Mayor
Nelson, followed by the Fledge of Allegiance to the Flag and Invocation by
Mayor Nelson.
ROLL CALL Councilmen Present: Martin, Pinkley, Smith, Meyers, -Nelson
Councilmen Absent: None -
Officials Present: City Clerk, Deputy City Clerk, City Attorney, City
Manager
-WATER BOND Mayor Nelson announced that the purpose of the meeting was to take action
ISSUE on the proposed water bond issue. The City Attorney stated that every ef-
fort had been made to reach a middle ground between Newport Beach and Costa
Mesa, that the Mayors and City Attorneys of the two cities had met, without
success. The City Manager reported that the City of Newport Beach had
rescinded all action on the proposed Joint Powers Agreement pertaining to a
joint election and was prepared to go ahead alone.
Councilman Meyers moved that the Council reaffirm its position, as expressed
by the Mayor, and the motion was seconded by Councilman Martin. The City
Attorney suggested that the motion include holding the door open for any
proposal that would allow both cities to retain their points of principle.
Councilman Meyers agreed to include this provision in his motion, and the
amended motion was seconded by Councilman Martin. The motion carried by the
following roll call voter
AYES: Councilman - Martin, Pinkley, Smith, Meyers, Nelson
NOES: Councilman - None
ABSENT: Councilman - None
The Mayor suggested that the Council go on record as recognizing the need
for additional water storage, and instruct the City Manager to find a way
to provide the storage. Councilman Martin moved that the City Manager be'
directed to study the problem and make a recommendation. The motion was s
seconded by Councilman Meyers, and carried by the following roll call vote:
AYES: Councilman - Martin, Pinkie y, Smith, Meyers, Nelson
NOES:- Councilman - Nor
ABSENT: Councilman - None
Councilman Martin moved that the City Manager formulate a. plan for the co-
operation of the Costa Mesa Planning Commission, Newport Beach Planning Com-
mission, Orange County Planning Commission, and Welton Becket and Associates,
for the orderly development of Mesa No. 2 Annexation. The motion was second-
ed by Councilman Pinkley., and carried by a unanimous vote.
On motion by Councilman Martin, seconded by Councilman Pinkley, and carried,
the meeting adjourned at 6:40 p.m. to Monday, March 25, 1957.
The City Attorney stated that Costa Mesa's choice was to give up its obli-
gation to the residents of Mesa No. 2 Annexation, or to drop the Joint Powers
proceedings. Councilman Pinkley pointed out that an election had been held
in the Mesa No. 2 Annexation; that Costa Mesa had won; that Newport Beach
had sued in Superior Court and Costa Mesa had won. He said that a definite
obligation existed on the part of Costa Mesa to protect the interests of
Mesa No. 2, and the other residents of Costa Mesa. If Newport Beach would
not abide by the results of a fair election and the decision of the Superior
Court judge, he could not see any reason for condoning further dissension
and uncertainty regarding Mesa No. 2.
Mayor Nelson said that the Council was agreed that Mesa Not 2 residents
diould have an opportunity to vote on the water bond issue. He said that
they were further agreed that the issue was one of great importance and that
future action on the water bonds should be withheld until the residents of
Mesa No. 2 could vote.
Councilman Meyers moved that the Council reaffirm its position, as expressed
by the Mayor, and the motion was seconded by Councilman Martin. The City
