HomeMy WebLinkAbout03/25/1957 - Adjourned City Council MeetingON ADJOURNED REGULAR MEETING OF THE CITY COUNCIL CITY OF COSTA MESA March 25, 1957 The City Council of the City of Costa Mesa, California, met in adjourned regular session at 7;30 p.m., March 25, 19571 at the Newport Justice Court, 567 West 18th Street,.Costa Mesa. The meeting was called to order by Mayor Nelson, followed by the Pledge of Allegiance to the Flag and Invocation by Claire M® Nelson, ROLL CALL Councilmen Present. Martin, Smith, Meyers, Nelson Councilmen Absent.- Pinkley Officials Present: City Clerk, Deputy City Clerk, City Attorney, City Manager, Director of Finance Oral Don L. Bowman, 973 Arbor Street, spoke from the floor regarding McClellants Communica road construction in the canyon. He protested the issuance of a permit to tions McClellan for ingress through Arbor Street. Mayor Nelson stated that it was his understanding that the McClellan'Company would use the entrance only oc- casionally for the purpose of filling the canyon. Mr. Bowman.said that there was no objection to such occasional use, but that regular use by he.avytrucks constituted a hazard to children and a detriment to the neighborhood. Written A letter from Assemblyman Frank G. Bonelli expressing appreciation of the Communica City's Ordinance banning the sale of horror comic books was read, and on tions motion by Councilman Smith, seconded by Councilman Martin, and carried, the communication was ordered filed. A copy of a Resolution of the Citizens' Advisory Committee on Capital Improve- ments of the City of Newport Beach, urging State Highway Authorities to expe- dite the adoption of a route for thelroposed coastal freeway, was presented, and on motion by Councilman Martin, seconded by Councilman Meyers, and carried, the communication was ordered filed. Preliminary plans for the new'fre station on Fairview Road, as prepared by Willard T. Jordan, were presented, and on motion by Councilman Martin, second- ed by Councilman Smith, and carried, the plans were ordered filed for .Committee study. 'El Pescador, 4.01 East 17th Street, requested a permit for a one-night dance on April 1, 1957, in observance of the restaurant's anniversary. On motion by Councilman Smith, seconded by Councilman Meyers, and carried, the permit was granted. A.B. #3949 A Minute Resolution endorsing Assembly Bill #3949 was introduced as follows: WHEREAS, there has-been introduced in the 1957 regular session of the Califor- nia Legislature a proposed bill (Assembly -Bill -.No. 39.9) which would eliminate the necessity for competitive bidding where. there is -only one contractor capable of serving the street3i.ghting system to be improved, and where such.contractor is subject to the jurisdiction of.the Public Utilities Commission; NOW, THEREFORE, be it resolved by this City -Council of the City of Costa Mesa that this City Council supports the enactment of said Assembly Bill No. 3949 for the reasons aforesaid. BE IT FURTHER RESOLVED, that the City Clerk be and he is authorized and directed to furnish copies of this Resolution to the Senator representing this County in the State Legislature and Assemblyman Ernest R. Geddes, who is the author of this bill; to Mr. Richard Carpenter, Executive Director and General Counsel of the League of California Cities and to Assemblyman Bruce Sumner from the District in which this city is located, as evidence of this City Council's en- dorsement of said bill. On motion by Councilman Martin, seconded -by Councilman Meyers, and carried, the above Minute Resolution was adopted. A.B. #3950 A Minute Resolution endorsing Assembly Bill #3950 was introduced as follows: WHEREAS, there has been introduced in the 1957 regular session of the Califor- nia Legislature a proposed bill (Assembly Bill -No. 3950) which would eliminate a requirement found to be expensive by City -Engineers which is not necessary to the County Tax Assessor or to the engineer for the purposes of formation or operation of street lighting districts recognized under the Municipal Lighting District Act of 1919; NOW, THEREFORE, be it resolved by this City Council of the City of Costa Mesa that this City Council supports the enactment of said Assem- bly Bill No. 3950 for the reasons aforesaid. BE IT FURTHER RESOLVED, that the City Clerk be and he is authorized and directed to furnish copies of this Resolution to the Senator represent- ing this County in the State Legislature and Assemblyman -Ernest R. Geddes, who is the author of this bill; to Mr. Richard Carpenter, Execu- tive Director and General Counsel of the League of California Cities and to Assemblyman Bruce Sumner from.the.District in which this city is located, as evidence of this City Council's endorsement of said bill. On motion by Councilman Meyers, seconded by Councilman Martin, and carried, the above Minute Resolution was adopted. A. B. #3951 A Minute Resolution endorsing Assembly Bi11 #3951 was introduced as fol- lows: WHEREAS, there has been introduced in the 1957 regular session of the California.Legislature a proposed bill (Assembly Bill No. 3951) which would make it quite clear that the lighting districts formed under the Municipal Lighting District Act of 1919 may properly pay for the steel pole cost differential authorized to be charged under the rate schedules filed by the utility company with.the Public Utilities Commission; NOW, THEREFORE, be it resolved by this City Council of the City of Costa Mesa that this City Council -supports the enactment of said Assembly Bill No. 3951 for the reasons aforesaid. BE IT FURTHER RESOLVED, that the City Clerk be and he is authorized and directed to furnish copies of this Resolution to the Senor representing this County in the State Legislature and Assemblyman Ernest R. Geddes, who is the author of this bill; to Mr. Richard Carpenter, Executive,Direc- tor and General Counsel of the League of California Cities and to Assembly- man Bruce Sumner from the District in which this'city is located, as, evidence of this City Council's endorsement of said bill. On motion by Councilman Martin, seconded by Councilman Meyers, and car- ried_, the above Minute Resolution was adopted. A.B. #3952 A Minute Resolution endorsing Assembly Bill #3952 was introduced as.fol- lows: WHEREAS, there has been introduced in the 1957 regular session of the California Legislature a proposed bill (Assembly Bill No. 3952), which would remove any doubt or question which may have been raised by the Shasta Case regarding the authority of a municipal lighting district to install or maintain street lights along a State highway; NOW, THEREFORE, be it resolved by this City Council of the City of Costa Mesa that.this City Council supports the enactment of said Assembly Bill No. 3952 for the reasons aforesaid. BE IT FURTHER RESOLVED, that the City Clerk be and he is authorized and directed to furnish copies of this resolution to the Senator representing this County in the State Legislature -and Assemblyman Ernest R. Geddes, who is the author of this bill; to Mr. Richard Carpenter, Executive Di- ictor and General Counsel of the League of California Cities and to Assemblyman Bruce Sumner from the District in which this city is located, as evidence of this City Council's endorsement of said bill. On motion by Councilman Smith, seconded by Councilman Meyers, and carried, the above Minute Resolution was -adopted. A.B. #3961 A Minute Resolution e2dorsing Assembly Bill #3961 was introduced as.fol- 1 rs: WHERBkS, there has been introduced- in the 1957 regular session of the California Legislature a proposed bill (Assembly Bill No. 3961) which wauld authorize municipal lighting districts organized under the Muni- cipal Lighting District Act of 1919, to annex additional lands to such districts; and WHEREAS, the enactment of such bill into law would reduce the number of districts required to be organized under present law and would simplify legal procedures and lower costs of organization and administration of 555 said street lighting districts; N(Y9, THEREFORE, be -it resolved by this City Council of the City of Costa Mesa, that this City Council supports the enactment of said Assembly Bill No. 3961 for the reasons aforesaid. BE IT FURTHER RESOLVED, that the City Clerk be and he is authorized and directed to furnish copies of this Resolution to the Senator representing this County in the State Legislature and Assemblyman Ernest R. Geddes, who is the author of this bill; to Mr. Richard Carpenter., Executive Director and General Counsel of the League of California Cities and to Assemblyman Bruce Sumner from the'District in which this city is located, as evidence of this City Council's endorsement of said bill. On motion by Councilman Smith, seconded by Councilman Martin, and carried, the above Minute Resolution was adopted. Oil Drilling On motion by Councilman Martin, seconded by Councilman Smith, and carried, the City Attorney was instructed to draft a proposed ordinance setting up restrictions on the drilling of oil within the City Limits.
