HomeMy WebLinkAbout05/13/1957 - Adjourned City Council Meeting4 ADJOURNED RB7xUI R MEETING OF THE CITY COUNCIL CITY OF COSTA MESA May 13, 1957 The City Council of the City of Costa Mesa, California, met in adjourned regular session at 7:30 p.m., May 13, 1957, at the Newport Justice Court, 567 West 18th Street, Costa Mesa. The meeting was called to order by Mayor Nelson, followed by the Pledge of Allegiance to the Flag and Invo- cation by Bruce Martin. Roll Call Councilmen Present: Martin, Pinkley, Smith, Meyers, Nelson Councilmen Absent: None Officials Present: City Clerk, Deputy City Clerk, City,Attorney, City Engineer, Director of Financ6, and Special Assessment .Engineer Laurence J. Thompson PUBLIC HEkRING Mayor Nelson announced that the hour of 7.30 o'clock having arrived, W. 19th ,`Street this was the time and place fixed by the City Council of the City of Improvement Costa Mesa, California, for hearing on the matter. of the improvement District of West 19th Street and certain other streets and easements, under the provisions of Division 4 of the Streets and Highways Code of the State. of California. The Clerk reported that notice of the hearing under Division: 4 was given by mail as provided for in said Division and--that-said notices were mailed more than thirty (30) days prior to the date fixed for hearing, and that an affidavit showing such compliance is on file in his office. The Mayor announced that prior to the consideration of pro- tests, it would be necessary, that the report under Division 4 of said Code be read to the Council, whereupon the report, except as to the map, plat or diagram, and the assessed valuations and true valuations of, and assessments and estimated assessments upon each parcel of land, was read to the Council. The Mayor then inquired of the Clerk if any written protests or objections had been filed. The Clerk reported that certain written pro- tests or objections had been filed with him prior to the time set for hearing. The Engineer reported that the protests., -both 575 1 Hearing Closed On motion by Councilman Pinkley, seconded by Councilman Meyers, and unani- mously carried,_ the hearing was closed. After fully considering the matter, it was moved by Councilman Pinkley, seconded by Councilman Smith, and unanimously carried that the Engineer Omissions and be instructed to make the following omissions from and decreases in the Decreases things proposed to be done as set forth in the Report filed under. Division 4 of the Streets and Highways Code of the State of California, and to estimate separately the cost of each such omission and decrease, and file such estimate with the City Clerk, and to prepare and present to the Council plans, drawings, specifications and map of assessment district for the proposed work or improvement of West 19th Street and certain other Streets and Easements: The elimination of the following sewer connections: (a) Assessment 7#337 (b) Assessment #446 (c) Assessment #445 (d) Assessment #3 - (e) Assessment #494 (f) Assessment #431 (g) Assessment #383 (h) Assessments #1 & (i) Assessment #212 (j) Assessments #153 (k) Assessment #19 - (1) Assessment #15 - (m) Assessment #13 - (n) Assessment #12 - (o) Assessment #21 - (p) Assessment #22 - - eliminate one sewer connection & 447 - eliminate 18 sewer connections - eliminate 10 Sewer connections eliminate 1 sewer connection - eliminate 1 sewer connection - eliminate 1 sewer connection - eliminate 13 sewer connections #2 - eliminate 1 sewer connection each - eliminate 1 sewer connection & 155 - eliminate 1 sewer connection each eliminate 1 sewer connection eliminate 1 sewer connection eliminate 1 sewen_connection eliminate 1 sewer connection eliminate 1 sewer connection eliminate 4 sewer connections The elimination of the following water connections: (a) Assessment #383 (b) Assessment #212 (c) Assessments #446 (d) Assessment #445 (e) Assessment #15 - (f) Assessment #13 - (g) Assessment #12 - - eliminate 6 water connections - eliminate 1 water connection & 447 - eliminate 12 water connections - eliminate 10 water connections eliminate 1 water connection eliminate 1 water connection eliminate 1 water connection oral and written, represented less than 50% (fifty per cent) of the total area of the assessment district. . After a full, fair and impartial hearing, and an opportunity having been given'to all persons desiring to be heard, it was moved by Councilman Pinkley, seconded by Councilman Meyers, and unanimously carried, that all protests, both oral and written, be overruled and denied, upon the finding th at.all protests, both oral and written, are made by the owners of less than one-half of the area of the property to be assessed for the improve- ment. The City Council having before it the Report and the plat of the assessment district, and being familiar with both, and having considered all protests filed, and the character and nature of the proposed work and the necessity for the same, and determined that the public interest, con- venience and necessity require the improvement as substantially set forth in the Report, and also having considered the matter as to the area of the property to be assessed for the said improvement, Councilman Smith present- ed Resolution No. 361, which was read in full by the Clerk'; and -moved its RESOLUTION #361 adoption, said Resolution being "A RESOLUTION OF THE CITY COUNCIL.OF THE Resolution re. CITY OF COSTA MASSA, CALIFORNIA,. DETERMINING RESULTS OF HEARING, OVERRULING Results of PROTESTS, DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY Hearing REQUIRE CERTAIN WORK OR IMPROVEMENT CF WEST 19TH STREET AND CERTAIN .OTHER STREETS AND EASEMENTS SUBSTANTIALLY AS SET FORTH.IN;REPORT ON PROJECT FILED UNDER THE 'SPECIAL ASSESSMENT INVESTIGATION, LIMITATION AND MAJORITY PROTEST ACT OF 1931,' AND DETERMINING THAT SAID PROJECT IS FEASIBLE AND MAKING OTHER DETERMINATIONS." Said motion to adopt Resolution No. 361 was duly seconded by Councilman Pinkley, and unanimously_ adopted by.,the following roll call vote: AYES. Councilmen - Martin, Pinkley, Smith, Meyers, Nelson NOES: Councilmen - None ABSENT. Councilmen - None 1 Hearing Closed On motion by Councilman Pinkley, seconded by Councilman Meyers, and unani- mously carried,_ the hearing was closed.
