June 24, 1957 The City Council of the City of Costa Mesa, California, met in adjourned regular session at 7:30 p.m., June 24, 1957, at the Newport Justice Court, 567 West 18th Street, Costa Mesa. The meeting was called to order by Mayor Nelson, followed by the Pledge of Allegiance to the Flag and invocation by Bruce Martin. Roll Call Councilmen Present: Martin, Pinkley, Smith, Meyers, Nelson Councilmen Absent: None Officials Present: City Clerk, Deputy City Clerk, City Attorney, City Manager, City Engineer, Director of Finance Minutes Upon motion by Councilman Pinkley, seconded by Councilman Martin, and unanimously carried, the reading:" -of the minutes of the regular meeting of June 17, 1957 was waived, and they were approved as written. J PUBLIC HEARING Mayor Nelson announced that the hour of 7:30 o'clock p.m."hdiring-._arrived, City Budget this was the time and place fixed by the City Council of the City -of 1957-1958 Costa Mesa, California, for hearing for the City Budget for the Fisdal Year 1957-1958, and declared the hearing opened. 'The Deputy Clerk stated that no written communications had been received, and no one, spoke from the floor. The Mayor said that he believed the budget would P y g bear further study, and after discussion, Councilman Pinkley moved that the.;hbaring be continued until Monday, July 1, 1957.at 7:30 o'clock p.m. Seconded by Councilman Martin and unanimously carried. Oral Communications The Mayor stated that at this time the Council would -hear any oral com- munications not listed on the agenda. No one responded and the Mayor called for written communications. 7Written Communica- The resignation of Councilman Bruce Martin, due to health and pressure tions of business, was presented. The members of the Council expressed their appreciation of Councilman Martins civic service, and upon motion by Councilman Pinkley, seconded by Councilman Meyers, and carried the resig- nation was accepted with regrets, to become effective at 11:59 p.m. on July 1, 1957. On motion by Councilman Smith, seconded by Councilman Pinkley, RESOLUTION NO. 375 Resolution No. 375, being A RESOLUTION OF THE CITY COUNCIL, CITY OF COSTA MESA, EXPRESSING APPRECIATION OF THE LONG AND FAITHFUL SERVICE OF COUNCIL- MAN MARTIN, was adopted by the following roll call vote: AYES: Councilmen Pinkley, Smith, Meyers, Nelson NOES: Councilmen - None ABSENT: Councilmen - None The City Clerk was instructed to transmit a copy of the resolution to Councilman Martin. Street Lighting/( The City Engineer presented a report covering the plans and specifications, District Report cost estimate, maps, and diagrams showing the proposed City of Costa Mesa Lighting District, and proposed assessment of the total amount:of the cost and expenses of the proposed improvement as required and designated by the Street Lighting Act of 1919. Resolution No. 374 The City Attorney stated that it was necessary- to make certain changes Change in W. 19th in the work proposed to be done in the West 19th Street Improvement Street Improvement District and presented Resolution No. 374, being'a RESOLUTION OF THE -District CITY COUNCIL OF COSTA MESA, CALIFORNIA, DECLARING ITS INT'ENT'ION TO MAKE CHANGES IN THE WORK PROPOSED TO BE DONE, STATII,IG THE AMOINNT OF THE .ESTIMATED AMOUNT OF THE INCREASE OR DECREASE IPJ TNS COST OF THE ITORK BY REASON OF SAID PROPOSED CHANGE AND GIVING NOTICE OF A TIME AND PLACE FOR HEARING OBJECTIONS TO SAID CHANGE IN CONNECTION WITH WEST 19TH STREET IMPROVED= DISTRICT (ASISES`SMENT DISTRICT NO. 5). Carried by the following roll call vote:: AYES: Councilmen Martin, Meyers, Smith, Nelson NOES: Councilman'Pinkley ABSENT: Councilmen - None Hearing The hearing date was -set for July 8, 1957 at 7:30 o'clock p.m. in the Set Council Chambers, at 567 W. 18th Street, Costa Mesa, California The City Attorney reported that certain changes had been made in the proposed Mutual Aid Agreement for Fire Protection between the City of Resolution -No. 373 Costa Mesa and the cities of Laguna Beach, Newport Beach, Huntington Mutual Aid Fire Beach, Santa Ana, and the County of Orange, relieving the city of in - Agreements surance responsibility for losses suffered by assisting equipment. On motion by Councilman 'Smith, seconded by Councilman Pinkley, Resolu- tion No'. 373, being a RESOLUTIONOF THE CITY COUNCIh, CITY OF COSTA MESA' CALIFORNIA, RESCINDING RESOLUTION NO..321 AND AUTHORIZING THE EXECUTION OF AGREEMENTS FOR MUTUAL AID FIRE PROTECTION BY AND BETWEEN THE CITIES OF LAGUNA BEACH, NEVIPORT BEACH-, HUNTINGTON BEACH, SANTA AICA, AND THE COUNTY OF ORANGE, AND THE CITY_ OF COSTA MESA, was adopted by the follow- ing roll call vote: AYES: Councilmen Martin, Meyers, Smith, Nelson, Pinkley NOES: Councilman - None ABSENT: Councilmen - None Ordinance No. 168 Ordinance No. 168, being AN ORDINANCE AMENDING SECTION 3.2 OF ARTICLE (2nd reading) III OF ORDINANCE NO. 32 OF THED CITY OF COSTA MESA, CALIFORNIA, ENTITLED THm. On motion by Councilman Pinkley, seconded by Councilman Meyers, Ordinance No. 170 was adopted by the following roll call vote: AYES: Councilmen Martin,, Pinkley,, Smith, Meyers, Nelson NOES: Councilmen - None ABSENT: Councilmen - None Subdivision No. 151 Subdivision Application No. 151, being the application of Redfield T. Redfield & Eileen and Eileen H. Dinwiddie to subdivide property located south of Hamilton Dinwiddie between Wallace and Pomona Avenues, into three parcels was again pre- sented to the Council after being deferred from the meeting of June 17, 1957. Neither Mr. and Mrs. Dinwiddie being present, the City Attorney informed the Council that the applicants had not questioned the de- cision of the Planning Commissionss recommendation. Therefore upon motion by Councilman Smith, seconded by Councilman Meyers, and unani- mously carried the recommendation of the Planning Commission to deny the subdivision was upheld. Subdivision No. 152 Subdivision Application No. 152, being the application. -of Fred M. Cross, Fred M. Cross 1857 Harbor Boulevard, to divide property at 428 Hamilton Street into two lots, was again presented to the Council after being deferred from= the meeting of June 17, 1957. The City Engineer informed the board that this subdivision would not interfere with the extension of'the Street. Therefore, on motion by Councilman Martin, seconded by Councilman Smith, and unanimously carried the Subdivision was approved. Variance No. 353 Variance Application #353, beim the application of Howard B. Lawson for Howard Lawson a 221 811 rear yard setback on the south east corner of Park Avenue and 19th Street, was again presented to the Council after being deferred from the meeting of June 17, 1957. In a communication addressed to the Council Mr. Lawson requested reconsideration of Variance No. 353 to supercede the permission granted the former land owner, Harvey Somers on May 16, 1955 for angle parking on Park Avenue. On motion by Councilman Smith, seconded by Councilman Meyers, and unanimously carried the recommenda- tion of the Planning Commission was upheld. Permits The application of Rev. Clive Williams, for the Southern California District, Church of the Nazarene, to erect a tent for religious pur- poses on the campus of the Southern California Bible College on July19 and 20, with services to be held July 22 through July 28, and the re- moval of the tent on July 29 was read. Upon motion by Councilman Martin seconded by Councilman Pinkley, and unanimously carried the permit was granted and the fee waived. The application of the Kiwanis Club of Costa Mesa for a fireworks permit at 245 E. 17th Street was read and upon motion by Councilman Pinkley, seconded by Councilman Meyers, and unanimously carried the permit was granted and fee waived. 1 1 The application of the Mesa,Ranch Market, J. W. Kirkpatrick, for a fireworks permit at 467E. 17th Street was read and upon motion by Councilman -Martin, seconded by Councilman Meyers, and carried, the permit was granted. (Councilman Smith voted NO) The application of the Paint Spot and Wallpaper Co. for a fireworks permit at 1590 Newport Avenue was read. Attorney S. Franklin was - present in behalf of the applicant requesting the Council to reconsider the application. After discussion it was moved by Councilman Martin, seconded by Councilman Pinkley, and carried by the following roll call vote that the permit be granted: AYES: Councilmen Martin, Pinkley, Meyers, Nelson NOBS: Councilman Smith ABSENT: Councilmen - None On motion by Councilman Martin, seconded by Councilman Meyers, and unanimously carried the City Attorney was instructed to prepare an ordinance prohibiting the sale of fireworks in the forthcoming year. WR -115 Warrant Resolution No. 115, was presented for approval.
