HomeMy WebLinkAbout07/01/1957 - City CouncilREGULAR MEETING OF THE CITY COUNCIL CITY OF COSTA MESA .July 1, 1957 The City Council of the City of Costa Mesa, California, met in regular session at 7:30 p.m., July 1, 1957, at the Newport Justice 'Court, 567 West 18th Street, Costa Mesa. The meeting was called to order by Mayor Nelson, followed by the Pledge of Allegiance to the Flag and Invocation by Reverend William Acton. Councilmen Present: Martin, Pinkley, Smith, Meyers, Nelson Councilmen Absent None Officials Present: City Clerk, Deputy City Clerk, City Attorney, Director of Finance, City Treasurer. Minutes Upon motion by Councilman Pinkley, seconded by Councilman Martin, and unanimously carried the reading of the minutes of the regular adjourned meeting of June 24, 1957, was waived, and they were approved as written. PUBLIC TEARING The Mayor announced that the hour of 7:30 otclock p.m. having arrived, (continued) this was the time and place fixed for the continued public hearing on City Budget the City Budget for the 1957-58 Fiscal Year. There being no smitten communications and no one from the floor wishing to speak it was moved by Councilman Smith, seconded by Councilman Meyers, and unanimously car- ried that the hearing be closed. Thereupon, Councilman Pinkley moved adoption of the 1957-58 City Budget in the amount of $94&#201.00. The motion was seconded by Councilman Martin, and carried by_;the following roll call vote: AYES: Councilman Pinkley, Smith, Meyers, Martin, Nelson NOES: Councilmen - None ABSENT: Councilmen - None PUBLIC DARING The mayor announced that this was the time and place set for public.hear- Rezone Petition ing on Rezone Petition No. 27, being the petition.of Co -Jay Corporation, No. 27 2120 Placentia Avenue, to rezone the West 112 of Lot 36, Tract No. 9,. Co -Jay Corp. from R4 to MI -A. The Deputy Clerk read the recommendations of the Plan= ring Commission for Ml -A zoning under the following conditions: 1. A 61 masonry wall along the easterly side -,of said property, 2. That a dedication of 51 be made for the widening of Victoria. and 5' from the widening of Hamilton. 3. That the entire said property be used for parking purposes to accommodate the'Easterly 1/2 of Lot 36, Tract 9, which is now zoned Ml, that it be adequately surfaced to accommodate all employees needing off-street parking and that the balance of the area should be oiled to keep down the dust. 4. Install curbs and gutters and pave to existing pavement on all streets (Hamilton, P'lacentia and Victoria); this to be done either by the applicant or by the Improvement District within one year. 5. Reasonable landscaping along Victoria and Placentia on subject property such as medium size trees. Mr. 'Stanley of the Co -Jay Corporation was present. There being no writ- ten communications and no one from the audience wishing to speak it was moved by Councilman Martin, seconded by Councilman Pinkley, and unani- mously carried that the hearing be closed, and the petition was approved in accordance with the recommendations of the Planning Commission. Ordinance No. 171 Ordinance No. 171, being, AN ORDINANCE AMENDING SECTION 3.2 OF ARTICLE To Ml -A Zoning III OF ORDINANCE NO. 32 OF THE CITY OF COSTA MESA, CALIFORNIA, ENTITLED "AN ORDINANCE OF THE CITY OF COSTA MESA ESTABLISHING LAND CLASSIFICATIONS IN DISTRICTS 14ITHIN THE INCORPORATED TERRITORY OF THE CITY OF CCSTA MESA AND REGULATING THE USES 0Y PROPERTY THEREIN, ADOPTING A MAP OF SAID DISTRICTS, DEFINING THE TERMS USED IN THIS ORDINANCE, PROVIDING FOR THE ADJUSTITENT., ENFORCEMENT AND AMENDMENT HEREOF PRESCRIBING PEN- ALTIES FOR VIOLATION HEREOF, AND REPEALING ORDINANCES AND PARTS OF ORDINANCES INCONSISTENT AND IN CONFLICT HEREWITH." was presented, changing the zoning of the property in question to Ml -A, and on motion by Councilman Smith, seconded by Councilman Pinkley Ordinance No. 171 was given first reading and passed to second reading by the following roll call vote: AYES: Councilmen Martin, Pinkley, Smith, Meyers, Nelson NOESCouncilmen - None ABSENT: Councilmen - None 1 1 Oral Communica- The Mayor inquired if there was anyone present wishing to speak on some tions matter not on the agenda. Mr. Don Stevens, representing American Legion Post No. 455, protested the abolition of fireworks sales in the City in coming years. Written Communi- Three letters from the County Health Department, reporting on conditions cations relative to the keeping of animals in the permit applications of Mrs. Nellie Swingle, and Mr. John J. Paul, and the complaint of Albert A. Lamp1, were read, and on motion by Councilman Martin, seconded by Council- man Pinkley, and carried, the reports were accepted and ordered filed. Upon motion by Councilman Smith, seconded by Councilman Meyers, and unani- mously carried the following departmental reports were received and or- dered filed: P'oundmaster, Building, Fire, Civil Defense, Planning, Street, and Police. Harbor Blvd. The City engineer presented plans and specifications for the surfacing Resurfacing and of Harbor Boulevard from 19th Street to-Wi.lson Street. Rezone Petition No. 3Q Newport. Bdiboa;_ Savings and Loan to Cl -s Rezone Petition No. 33 James A. Rimpau to Cl -S Rezone Petition No. 30 being the petition of the Newport Balboa Savings and Loan Association to rezone from R4 to Cl -S property fronting on the North side of Baker Avenue between Fairview Road and Babb Avenue, was presented and on motion by Councilman. Smith, seconded by Councilman Martin, and carried public hearing was set for July 15, 1957 at 7:30 o'clock p.m. in the Council Chambers. Rezone Petition No. 33, for James A. Rimpau, to rezone from R�l to CI -S the -Westerly 229.33' of Lot 2 and the Last one-half of Lot 3, Berry Tract, was presented and on motion by Councilman Pinkley, seconded by Councilman Smith, and carried public hearing was set for July 15, 1957 at 7:30 o'clock p.m or as soon thereafter as possible in the Council Chambers. Vehicle Parking Iiayor Nelson nominated Mir. Harvey 'Somers for appointment to the Board District No. 2 of Commissioners of Vehicle Parking District No. 2 to fill out the New Member Mr. unexpired term of Hugh Springer, resigned. On motion by Councilman Harvey Somers Pinkley, seconded by Councilman Meyers, and carried the appointment was confirmed. Building Moving Applications for Building Moving Permits No. 153 and 154, made by Applications No. Frank Bissell to move a house and garage from 1885 Park Avenue to 153, 154 1938 Fullerton Avenue were presented and on motion by Councilman Smith, Frank Bissell seconded by Councilman Martin, and carried the permits were granted subject to the recommendations of the Building Department to bring the buildings up to code. Building Moving Applications for Building Moving,Permits No. 155, 156, and 157 by Applications No. Carolyn Simonson to move two dwellings and one garage from Santa Monica 155, 156, 157 to 2088 A and B Thurin, Costa Mesa were presented. On motion by Council - Carolyn Simonson man Smith, seconded by Councilman Pinkley and carried the permits were granted subject to the requirements of the Building Department for bringing the buildings up to code, and in the amounts of the bonds required, and a 120 -day time limit was imposed for the completion of the removal and rebuilding. Tentative Tract A request for withdrawal of action on Tentative Tract Map No. 3188 No. 3188 made by Moore Homes, Inc., having been recommended by the Planning Moore Homes, Inc. Commission, was granted on motion by Councilman Martin, seconded by Councilman Smith, and carried. Tentative Tract Tentative Tract Map No. 3279 in the name of K. id. Koll for the sub - No. 3279 division of property West of Irvine Avenue and East of Aliso Avenue K. W. Koll 528.31 north of East 16th Street, into 20,1ots, was presented. On motion by Councilman Smith, seconded by Councilman Martin, and carried Tentative Tract Map No. 3279 having been approved by the Planning Com- mission was approved subject to the conditions and requirements of the City engineer. Precise Plan The Planning Commission presented a Precise Plan to extend Senate and Senate and Capital Capital Streets between Tracts -3185 and 3143, South .of ,,ilson, and Hearing Set recommended adoption of the Plan. On motion by Councilman Martin, seconded by Councilman Pinkley and carried, public hearing was set for 8:00 o'clock p.m. or as soon thereafter as possible on -the pro- posed Precise Plan on July 15, 1957,'in the Council Chambers. Subdivision No. 154 Subdivision Application No. 154 being the application of Roger Roy Roger R. Walton Walton to subdivide property at 1410 Albert Place into two parcels, was presented. On motion by Councilman Smith, seconded by Councilman Meyers, and carried the Council concurred with the Planning Commission in approving the subdivision. Subdivision No. 155 Subdivision Application No. 1--55 being the application of Mr. and Mrs. Geo. W. Sutton George W. Sutton to subdivide property at 657 West Victoria into three parcels, was presented. On motion by Councilman Smith, seconded by Councilman Pinkley, and carried the subdivision was approved subject to the conditions imposed by the Planning Commission, with the additional stipulation that the 451 lot designated as parcel No. 3 in the appli cation be restricted to use for driveway or parking for church pur- poses only. Variance No. 350 Variance Application No. 350 being the application of Helen H. Heagney Helen Heagney and and Arthur J. Heagney-for the construction of 12 units on three adjoin - Arthur Heagney ing lots at the N. W. corner of 19th and Whittier, was presented with a request from the applicants for withdrawal. On motion by Councilman Pinkley, seconded by Councilman Martin and carried, the Council con- curred with the Planning Commission in granting the withdrawal and refund of 80% of the $25.00 fee. Variance No. 352 Variance Application No. 352 being the application of Harold Bontekoe Harold Bontekoe to use part of an existing residence at 1501 Orange Avenue as a re- frigerator service shop, was read. The following spoke from the floor in opposition to the granting of the Variance: Ken Smith, 3331 -15th Street, Newport Beach; John Vogel, 1500 Newport Blvd; -Ray Fields 508 Orange, Newport Beach; Mrs. Hazel Klussman, 1536 Orange; H. L. Foster 1560 Orange. A petition bearing thirty-four signatures opposing the granting of the variance was filed by Henry F. Cyr. Art Adair repre-, senting the applicant, and Steve Smith representing John Webster, spoke in favor of the variance. On motion by Councilman Smith, seconded by. Councilman Pinkley the recommended approval -of the Planning Commission was reversed and the application denied by the following roll call vote: AY Z: Councilmen Martin, Pinkley, Smith, Meyers, Nelson NOES: Councilmen - None ABSENT: Councilmen - None Variance No. 355 Variance Application No. 355 being the application of Richland Develop - Richland Develop- ment Co. for construction of one residential unit for every 1,500 square ment Co. feet of land area on Lot 105, Newport Heights, was presented. On motion by Councilman Smith, seconded. 'by Councilman Meyers, and carried, the, Variance was approved subject' to the -stipulations as set forth by the Planning Commission with the added stipulation that Westminster Avenue abutting the property be improved upon development of the rear one-half of the property or the improvement of the adjacent properties on either side, whichever is sooner. Variance No. 356 Variance Application No. 356 being the application of K. W. Koll Con - K. W. Koll Con- struction Co. for erection of a sign to advertise sales in Tract No. struction Co. 3137 having been.approved by the Planning Commission and Planning Tech-- nician, was confirmed on motion by Councilman Smith, seconded by Council- man Meyers, and carried. Variance No. 357-A Variance Application No. 357-A, being the application of William E. William E. Kempton. Kempton for 0 setback for front and rear of lots in Tract 3229 was presented with the recommendation of the Planning Commission for ap- prnval. After discussion Councilman Pinkley moved that action be de- ferred until the next regular meeting to permit a conference between 1 1 r� �, I 60 the applicant and other parties interested, and the City Attorney. The motion was seconded by Councilman Meyers, and carried. Variance No. 359 Variance Application No. 359, being the application of Leo B. Kirchner Leo B. Kirchner to construct three units on 6,127.80 square feet of land area was pre- sented with the recommendation of the Planning Commission for approval. The property is located on Anaheim Avenue, south of 18th Street. On motion by Councilman Pinkley, seconded by Councilman Martin, and car- ried. the Council concurred with the Planning Commission in granting the application, Councilman Smith voting NO. PERMITS The application of Foster and Kleiser Co. for license to erect outdoor advertising signs at 1856 and 1857 Newport Boulevard -was denied on motion by Councilman Martin, seconded by Councilman Pinkley and carried. Councilman Nelson voting NO. The application of Florence Ramey for a license to operate Tom's Trading Post, new and used furniture, at 2015 Harbor Blvd. was granted by motion of Councilman Pinkley, seconded by Councilman Smith, and carried. Permission was granted to the Orange County Square Dance Club to hold four square dances at the Orange County Fairgrounds during July and fee was waived on motion by Councilman Smith, seconded by Councilman Meyers, and carried. The report of the Director of Finance that one free permit, for the, disposition of bankrupt estates by Federal Court, had been issued during June was accepted and filed on motion by Councilman Smith, seconded by Councilman Pinkley and carried. uiR-116 -Warrant Resolution No. 1165 including Payroll No. 72 was presented for approval. On motion by Councilman Smith, seconded by Councilman Meyers darrant Resolution No.'s -116 was adopted by the following roll call votes AYES: Councilmen Martin, Pinkley, Smith, Meyers, Nelson NOES. Councilmen - None ABSENT: Councilmen -None Gift to Councilman Pinkley presented an engraved desk set to retiring Councilman Bruce Martin Bruce Martin, expressing the appreciation of Mr. Martin's fellow council- men for his long and faithful civic service. John W. Smith John W. Smith was presented for appointment to the Council to fill out Oath -of -Office the unexpired term of Councilman Martin and on motion by Councilman Smith, seconded by Councilman Pinkley, and unanimously carried, the appointment was confirmed. Councilman Smith thereupon took his seat and the oath-.ofroffice was administered by City Clerk A. C. Swartz.
