HomeMy WebLinkAbout07/08/1957 - Adjourned City Council Meeting.3 0 ADJOURNED REGULAR MEETING OF THE CITY COUNCIL CITY OF COSTA MESA July 8, 1957 The City Council of the City of Costa Mesa, California met in adjourned regular session at 7:30 p.m., July 8, 1957, at the Newport Justice Court, 567 West 18th Street, Costa Mesa. In the absence of the Mayor the meeting was called to order by the City Clerk, followed by the Pledge of Allegiance to the Flag and invocation by Councilman John Smith. Roll Call Councilmen Present: J. Bmith,.B. Smith, Pinkley, Meyers Councilmen Absent: Nelson Officials Present. City Clerk, Deputy City Clerk, City Attorney, _City Engineer, Director of Finance Mayor Pro -Tempore Councilman Bert Smith was chosen Mayor Pro -Tempore on motion by Councilman Pinkley, seconded by Councilman Meyers, and carried. Councilman Bert . Smith voted NO. Minutes The minutes of the previous meeting, having been distributed to the Council- men prior to the meeting, were approved on motion by Councilman Pinkley, seconded by Councilman Meyers, and carried. PUBLIC HEARING The Mayor Pro -Tempore announced that the hour of 7;30 o'clock p.m. having N. 19th Street arrived that this was the time and place fixed by this City Council for Improvement hearing of objections to the proposed change set forth in Resolution District change No. 375 in connection with the improvement of West 19th Street and said other streets and easements. (Assessment District.No. 5) The Deputy Clerk reported that the notice of hearing was given as required by law and that the Affidavit of Publication showing such compliance is on file in his office. The Mayor Pro -Tempore then inquired of the Clerk if any written pro- tests or objections had been filed to the proposed change. The clerk reported that no written protests or objections had been filed with him prior to the time set for hearing.. The Mayor Pro -Tempore there- upon asked all persons present if they desired to file any written protests or objection to the proposed change. No person present de- sired to make written -protest or objection. The Mayor Pro -Tempore then asked if any person present desired to be ,heard on the matter of the proposed change. No person desired to speak. Written Communica- A Mutual Aid Fire Agreement with the City of Laguna Beach, having been tions approved by the Laguna Beach City Council, was presented; and on motion by Councilman Pinkley, seconded by Councilman Meyers, and carried the Mayor and City Clerk were authorized to sign the agreement in behalf of the City of Costa Mesa. 1 It was thereupon moved by Councilman-Pinkley, seconded by Councilman Meyers and carried that this Council find that no written objections or protests had been made to the proposed change and that the hearing be closed. RESOLUTION NO. 379 Councilman Meyers then presented Resolution No. 379, being a RESOLUTION Results of Hearing OF THE CITY COUNCIL, CITY OF COSTA MESA DETERMINING. RESULTS OF DARING - of Changes ON RESOLUTION OF INTENTION TO MAKE CHANGES IN THE WORK PROPOSED TO BE DONE, OVERRULING PROTESTS, DETERMINING THAT THE PUBLIC INTEREST, CON-: VENIENCE, AND NECESSITY REQUIRE CERTAIN CHANGES IN THE WORK PROPOSED TO BE DONE IN THE IMPROVEMENT OF W. 19TH STREET AND CERTAIN OTHER. STREETS AND EASEMENTS. (ASSESSMENT DISTRICT NO. 5), and moved its -adoption. Motion was seconded by Councilman John Smith, and adopted.by the follow - roll call vote: AYES; Councilmen J. Smith, Pinkley, B. Smith, Meyers NOES: Councilmen - None ABSENT: Councilman Nelson Oral Communica- The Mayor Pro -Tempore stated that at this time the Council would hear tions oral communications. Smith, and carried were ordered accepted and filed. New City Hall The City Engineer presented plans and specifications for paving of the Revised Parking parking lot at the new City Hall. The plans, as modified, were approved Lot and the City Clerk was instructed to advertise for bids to be opened Addendum to on July 29, 1957 at the hour of 7:30 oQclock p.m. on motion'by--Council- Lease on New man Pinkley, seconded by Councilman Meyers, and carried. -- Condemnation The City Attorney was authorized to proceed with,eondemnation proceedings, Proceedings if necessary to acquire remaining rights-of-way in connection with the-, on E. 17th proposed E. 17th Street Improvement District, on'motion by Councilman Street. Pinkley, seconded by Councilman Meyers,.and carried. ORDINANCE NO. 171 'Ordinance No. 171, being an ordinance AMENDING SECTION 3.2 OF ARTICLE (Second reading) III OF ORDINANCE NO. 32 OF THE CITY OF CCSTA MESA., CALIFORNIA., ENTITLED Co -Jay Corporation "AN ORDINANCE OF THE CITY OF COSTA MEA ESTABLISHING- LAND CLASSIFICATIONS Rezone No. 27 to IN DISTRICTS WITHIN THE INCORPORATED TERRITORY OF THE CITY -OF -COSTA MESA Ml -A AND REGULATING THE USES OF PROPERTY THEREIN, ADOPTING A MAP OF SAID DISTRICTS, DEFINING THE TERMS USED`IN THIS ORDINANCE, PROVIDING FOR THE ADJUSTMENT., 'ENFORCEMENT AND AMENDMENT HEREOF PRESCRIBING PENALTIES FOR VIOLATION HEREOF, AND REPEALING ORDINANCES AND PARTS OF ORDINANCES INCONSISTENT AND IN,CONFLICT HEREWITH, placing the West one-half of Lot 36, Tract 9 in the Ml -A zone was presented for second reading and on motion by'Councilman Pinkley., seconded by Councilman Meyers, and carried the reading of the Ordinance was waived. On motion by Council- man Pinkley, seconded by Councilman Meyers Ordinance No. 171 was adopted by the following roll call vote:, , AYES: Councilmen J. Smith, Pinkley., B. Smith, Meyers NOES: Councilmen - None ABSENT: Councilman Nelson Resignation The resignation'of John W. ,Smith from the Board of Vehicle Parking District of John W,, No. 2 was accepted on motion by Councilman Pinkley, seconded by Councilman Smith Meyers, and carried. Addendum to The City Attorney presented an addendum to the lease dated February 7, Lease on New 1957 by and between the City of Costa Mesa and Costa Mesa Civic Center, Inc. City Hall for the new City Hall, amending the lease to allow the City to take possession for the purpose of landscaping the grounds, the consideration therefore being $729.16 per month, to be paid by the City, beginning July 1, 1957 and continuing :until such time as the lessor shall deliver possession of the building to the City. On motion by Councilman Pinkley, seconded by Councilman Meyers, the addendum was approved, and the Mayor and City Clerk authorized to execute the agreement on behalf of the City, by the following roll call -%-vote: AYES:- Councilmen J. Smith, Pinkley, B. Smith, Meyers NOES: Councilmen - None ABSENT: Councilman Nelson .. , One-way alley Vehicle Parking District No. 1 submitted a.plan to make the existing South of Broadway alley South of.Broadway in the Districts property, a one-way alley. On motion by Councilman Pinkley, seconded by Councilman Meyers,`and carried the recommendation was referred to the Traffic Safety Committee for investigation and report. Rezone Peti- 'Rezoning Petition No. 34, being the application of Gray and Mullins, tion No. 34 19911 So. Atlantic Blvd., Downey, California to rezone certain real Gray and - property at Wilson Street and Harbor Boulevard from C2 and R4 to C1 -S Mullins having been approved by the Planning Commission, was presented. On C2 and R4 to C1S motion By Councilman J. Smith, seconded by C. Meyers, and carried the public hearing was set for July 22, 1957 at 7.30 otclock p.m. in the Council Chambers. PERMITS The application of Foster and Kleiser Co. for renewal of license for 45 advertising billboards, permit to maintain 20 panels in newly an- nexed areas of the City and reconsideration of permit to erect two billboards at 1856 and 1857 Newport Avenue, was presented. Couhcil- man PLnkley pointed out that removal of,an existing sign to another portion of the City.would not be permitted, and that no new sign could hereinafter be erected without first having been approved by the City Council. On motion by Councilman Pinkley, seconded by Councilman Meyers, the Council granted the requested permits for 67 signs, rescinding "1 the action of the previous meeting.denying the permits for the two billboards at 1856 and 1857 Newport Avenue. Adjournment Upon motion by Councilman Pinkley, seconded by Councilman J.
