HomeMy WebLinkAbout07/22/1957 - Adjourned City Council MeetingX1-0 ADJOURNED REGULAR MEETING OF THE CITY COUNCIL CITY OF COSTA MSA July 22, 1957 The City Council of the City of Costa Mesa, California met in adjourned regular session at 7:30 p.m., July 22, 1957, at the Newport Justice Court, 567 West 18th Street, Costa Mesa. The meeting was called to order by the Mayor, followed by the Pledge of Allegiance to the Flag and Invocation by Reverend Chandler Jackson. ROLL CALL Councilmen Present: J. Smith, B. Smith, Pinkley, Meyers, Nelson Councilmen Absent. None , Officials Present. City Clerk, Deputy City Clerk, Assistant City Attorney, City Engineer, Director of Finance Minutes The minutes of the meeting of July 15, 1957, having been distributed to the Councilmen prior to the meeting, were approved on motion by Councilman B. Smith, seconded by Councilman Meyers, and carried. PUBLIC HEARING The Mayor announced that this was the time and place set for public Rezone Petition 34 hearing on Rezone Petition No. 34, being the petition of Gray and Gray & Mullins Mullins, 10911 South Atlantic Blvd., Iynwwood, California, to rezone to C1 -S all of Lot 5, Fairview Farms Tract from R4 and C2 to C1 -S. The Deputy Clerk read the Planning Commissions recommendation of approval. There being no written communications and no one from the audience wishing to speak it was moved by Councilman B. 'Smith, seconded by Councilman J. LSmith, and unanimously carried thatthe hearing be closed and the petition was approved in accordance with the recom mendations of the Planning Commission. A Councilman Pinkley entered the meeting and took his.seat at 7:40 p.m. Ordinance #175 Ordinance No. 175, being AN ORDINANCE OF THE CITY OF COSTA MESA AMENDING SECTION 3.2 OF ARTICLE III OF ORDINANCE NO. 32 OF THE CITY OF COSTA MESA,_ CALIFORNIA, ENTITLED "AN ORDINANCE OF THE CITY OF COSTA 14ESA ESTABLISHING LAND CLASSIFICATIONS IN DISTRICTS WITHIN THE INCORPORATED TERRITORY OF THE CITY . OF COSTA MESA AND REGULATING THE USES OF PROPERTY THEREIN, ADOPTING A MAP OF SAID DISTRICTS, DEFINING THE TERMS USED IN THIS ORDINANCE, PROVIDING FOR THE ADJUSTMENT, ENFORCEMENT AND AMENDMENT HEREOF PRESCRIBING PENALTIES FOR VIOLATION HEREOF, AND REPEALING OR- DINANCTS AND PARTS OF ORDINANCES INCONSISTENT AND.IN CONFLICT HEREWITH, was presented changing the zoning of the property in question to C1 -S, and on motion by Councilman B. Smith, Ordinance No. 175 was given first reading and passed to second reading by the following roll call voter AYES: Councilmen Pinkley, B. Smith, J. Smith, Meyers, Nelson NOES: Councilmen - None ABSENT: Councilmen - None Oral Communications The Mayor stated that at this time the Council would hear oral communi- cations. No one responded and the Mayor called for written communica- tions. Written Communica- A letter from Mrs. Harry Hess, 1537 South Ogden Drive, Los Angeles 19, tions as to whether or not property owned by her at the Southeast corner of V'icto'ria and Canyon Drive; Lot 102, Tract 653, was in the Costa Mesa city limits, was read. The City Manager reported that.the Building Department had answered this letter, and that said property was not in the City limits. Upon motion by Councilman Pinkley, seconded by Councilman Meyers, and carried the letter was ordered filed. -A communication was read from Norman IE, Watson, Director,, ,Summer Session., Orange Coast College requesting permission to put up im-_ mediately a temporary banner advertising the forthcoming production - of "Kismet", to be displayed through August 3. A letter from Jay & Renfro , insurance carriers accompanied the request. 'Upon motion --by Councilman Pinkley, seconded by Councilman Meyers, and unanimously-.. carried the permit to erect the banner was granted. Water Mains on The City Engineer presented plansand.specifications for installing Harbor Blvd. water mains on Harbor Boulevard and Baker Streets On motion by Council - and Baker Street man B. Smith, seconded by Councilman Pinkley, and carried, the plans and specifications for Plan No. 8 together with the Standard Wage Scale, A 6117 were adopted and the City Clerk was instructed to advertise for -bids to be opened on August 19, 1957, at 7:30 -p.m. in the Co'iitacil Chambers. Order of Business The City Attorney not being present at this time it was moved by Council - Waived man B. Smith, seconded and carried that the order of business be waived, and if the Attorney.arrived, it be taken up at that time. Ordinance #172 Ordinance No. 172; being AN ORDINANCE OF THS CITY OF COSTA MESA AMENDING Rezone Petition 30 SECTION 3.2 OF ARTICLE III OF ORDINANCE NG. 32 OF THE CITY OF COSTA MESA, to Cl -S CALIFORNIA, ENTITLED 'SAN ORDINANCE OF THE CITY OF COSTA MESA ESTABLISHING (2nd reading) LAND CLASSIFICATIONS IN DISTRICTS WITHIN THE INCORPORATED TERRITORY OF THE CITY OF COSTA MESA AND REGULATING THE USES OF PROPERTY THEREIN, ADOPTING A MAP OF SAID DISTRICTS, DEFINING THE TERMS USED IN THIS OR- DINANCE, PROVIDING FOR THE ADJUSTMENT, ENFORCEMENT AND AMENDMENT HEREOF PRESCRIBING PENALTIES FOR VIOLATION HEREOF, AND REPEALING ORDINANCES AND PARTS OF ORDINANCES INCONSISTENT AND IN CONFLICT HEREWITH, was pre- sented changing the zoning of the property fronting on the North side of Baker Avenue, between Fairview Road and Babb Avenue in the C1 -S zone was presented for 'second reading and on motion by Councilman B. Smith, seconded by Councilman Pinkley, and carried the -reading of the Ordinance was waived. On motion by Councilman Meyers, seconded by Councilman J. Smith., Ordinance No. 172 was adopted by the following roll call vote: AYES: Councilmen J. Smith, B. Smith, Pinkley, Meyers, Nelson NOES: Councilmen - None ABSENT: Councilmen - None Ordinance #173 Ordinance No. 173, being AN ORDINANCE OF THE -CITY OF COSTA MESA AMENDING Rezone Petition 33 SECTION 3.2 OF ARTICLE III OF ORDINANCE NO. 32 OF THE CITY OF COSTA MESA, to Cl -S CALIFORNIA, ENTITLED IIAN ORDINANCE OF THE CITY OF COSTA MESA ESTABLISHING (2nd reading) LAND CLASSIFICATIONS IN DISTRICTS 11ITHIN THE INCORPORATED TERRITORY OF THE CITY OF COSTA MESA AND REGULATING THE USES OF PROPERTY THEREIN, ADOPTING A MAP OF SAID DISTRICTS, DEFINING THE TERMS USED IN THIS OR- DINANCE, PROVIDING FOR THE ADJUSTMENT, ENFORCEMENT -AND AMENDMENT HEREOF PRESCRIBING PENALTIES FOR VIOLATION HEREOF, AND REPEALING ORDINANCES AND PARTS OF ORDINANCES INCONSISTENT AND IN CONFLICT HEREWITH, placing the westerly 229.331 of Lot 2 and the East one-half of Lot 3, Berry Tract, in C1 -'S zone -was presented for second reading and on motion by Councilman B. Smith, Pinkley, Meyers, Nelson NOES: Councilmen - None ABSENT: Councilmen - None Ordinance #174 Ordinance No. 171 , being AN ORDINANCE OF THE CITY OF COSTA MESA, CALI- Establishing a FORNIA, AMENDING ORDINANCE NO. 32, ENTITLED "AN ORDINANCE OF THE CITY C1 -S zone OF COSTA MESA, ESTABLISHING LAND CLASSIFICATIONS IN DISTRICTS WITHIN (2nd reading) THE INCORPORATED TERRITIORY OF THE CITY OF COSTA MESA, AND REGULATING THE USES OF PROPERTY THEREIN, ADOPTING A MAP OF SAID STREETS, DEFINING THE TERMS USED IN THIS ORDINANCE, PROVIDING FOR THE ADJUSTMENT, ENFORCE- MENT AND AMENDMENT HEREOF, PRESCRIBING PENALTIES FOR VIOLATION HEREOF, AND REPEALING ORDINANCES AND PARTS OF ORDINANCES INCONSISTENT AND IN CONFLICT HER51ITH AND ESTABLISHING A Cl -S DISTRICT, Shopping District Zone, was presented for second reading and on motion by Councilman Pinkley, seconded by Councilman Meyers, and carried the reading of the Ordinance was waived. On'motion by Councilman B. Smith, seconded by Councilman Pinkley, Ordinance No. 174 was adopted by the following roll call vote: AYES.- Councilmen J. :Smith, B. Smith, Pinkley, Meyers, Nelson NOES Councilmen - None ABSENT.- Councilmen - None Water Bond A communication from the City Manager was read, together with a copy Election of the Supplemental Report on the Master -Plan for Water Storage and Transmission Mains originated by the City's consulting engineering firm`: of James M. Montgomery, stating a recommendation of immediate construction of the fLrst bay of a ninety -million gallon reservoir, at a total cost of $10.09000.00. Report accepted Upon motion byt.Councilma.n Pinkley, seconded by Councilman J. Smith and carried the report of James M. Montgomery was accepted. Resolution #387 Councilman Pinkley then presented.Resolution No. 387, being a RESOLUTION Determining neces- OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DETERMINING sity THAT THE PUBLIC INTEREST AND NECESSITY DEXAND THE ACQUISITION AND CON- 618 STRUCTION OF A CERTAIN MUNICIPAL IMPROVEMENT, AND MAKING FINDINGS RELATING THERETO. The Deputy Clerk read the Resolution in full, and thereupon Councilman Pinkley moved the adoption of Resolution No. 387. Motion was seconded by Councilman J. Smith, and adopted by the follow- ing roll call vote? AYES: Councilmen J. Smith, B. Smith, Pinkley, Meyers, Nelson NOES:' Councilmen - None ABSENT: Councilmen - None Ordinance #176 After reading in full of Ordinance No. 176, AN ORDINANCE OF THE CITY OF Setting date of COSTA MESA, CALIFORNIA, ORDERING, CALLING, PROVIDING FOR AND GIVING.':: election NOTICE OF A SPECIAL MUNICIPAL BOND EL?ECTION TO BE HELD IN THE CITY OF COSTA MESA ON THE 24TH DAY OF SEPTEMBER, 1957, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY A PROPOSITION TO INCUR BONDED INDEBTEDNESS BY SAID CITY FOR A CERTAIN MUNICIPAL IMPROVEMENTO Councilman Pinkley moved its adoption and passed to second reading. Motion was seconded by Councilman B. Smith and carried by the follow- ing roll call voter f - AY S: Councilmen J. Smith, B. Smith, Pinkley, Meyers, Nelson NOES: Councilmen - None ABSENT: Councilmen - None O'Melveny & Myers A communication was read from OlMelveny & Myers outlining cost of hired services for legal services in connection with the authorization and issuance of Vrater bonds of the City. Fee to be computed as follows: 2/10ths of 1% on the first $1,000,000. and 1/10th of 1% on the excess. Said fee payable one-half following the canvass of the election returns and the remainder following the sale of the bonds or a portion thereof. In the event the bond proposition fails to carry at the election, fee will be $750 payable following the canvass of the election returns. Should sale of bonds be split into more than two sales an additional fee of $200 will be charged on each sale. Upon motion by Councilman Pinkley, seconded by Councilman Meyers the firm of O'Melveny and Meyers were hired on the fees as stated. Motion carried by the following roll call vote: AYES: Councilmen J. Smith, B. Smith, Pinkley, Meyers, Nelson NOES: Councilmen - None ABSENT: Councilmen - None Upon motion by.Councilman B. Smith, seconded by Councilman Meyers, and carried the City Manager was instructed to transmit a copy of this report to.each of the Water Companies in the City.. Rezone Petition 35 Rezone Petition No. 35 for Keith S. and Florence Rima was ordered re- referred to Planning ferred to the Planning Commission on motion by Councilman B. Smith, Commission seconded by Councilman Pinkley and carried. PERMITS The application of Golden West Amusement dba Dick Luebert and R. C. Chacon for one juke box at the Dog House, 19th and Placentia was granted on motion by Councilman B. Smith, seconded by Councilman Meyers, and carried. The application of Santa Ana Novelty Co. for two skill games at the Dog House, 19th and Placentia was granted on motion by Councilman Pinkley, seconded by Councilman Meyers, and carried. Upon motion by Councilman B. Smith, seconded by Councilman Pinkley and carried the notification of 2.pplicstion for alcoholic beverage license to -Edward F. Zilm for the Hauf Brau at 1712 Placentia Avenue was ordered filed. Herb McDonnell & Mayor Nelson nominated Herb McDonnell to fill out the unexpired term E. R. Carr appoint- of John Smith, and E. R. Carr to fill out the unexpired term of Wm. ed to Vehicle Park- B. Brown for Vehicle Parking District No. 2. On motion by Council- ing District 2 man B. `Smith, seconded by Councilman Meyers, and carried the appoint- ments were confirmed. Neal Martin ap- Mayor Nelson nominated Neal Martin to fill out -the unexpired term of pointed to Plan- Barney Francque on the Planning Commission. On motion by Council- ning Commission man B. Smith, seconded by Councilman Meyers; and carried the appoint- ment eras confirmed. Rapp Variance The City Clerk reported receiving from the Planning Commission a referred to letter from Aileen Rapp requesting consideration of a Variance Planning Commis- granted March 19, 1954, which has expired. After discussion the sion Assistant City Attorney pointed out that it would be necessary for a new application to be filed and on motion by Councilman B. Smith, seconded by Councilman Pinkley and carried the application was re- ferred to the Planning Commission. Variance #361 Variance Application No. 361, being the application of Harry W. Wright Harry W. Wright to permit M1 Light Manufacturing on C2 zoned property, was presented. -Mr. Regan, tenant, was present stating that the purpose of this vari- ance was to add additional wiring to existing machines that had been running on extension cords. The Planning Commission recommended that C2 to M1 requestobe denied but that the request for excess horse power be recommended for approval. After discussion it was moved by Council- man B. Smith that -the variance be approved as recommended by the Plan- ning Commission, and that no additional horse power be added without the consent of the Council. Motion seconded by Councilman Meyers and failed to carry by the following roll -call vote: AYES: Councilmen B. Smith and Meyers NODS: Councilmen Pinkley and Nelson ABSTAIN: Councilman J. Smith ABSENT: • 'Councilmen - None Thereupon it was moved by Councilman Pinkley, seconded by Councilman J. Smith, and carried that .this Variance be deferred to the meeting of July 299 1957. _-Fireworks Ordi- Inasmuch as the City Attorney had not arrived it was requested by Mr. _=nance Wayne Dutro that further action on a proposed Fireworks Ordinance be delayed until the last meeting in August. Mr. Don Stevens also requested a delay. It was moved by Councilman Pinkley, seconded by Councilman Meyers, and carried that discussion on the proposed fire- works ordinance be continued to August 19, 1957. Councilman Pinkley was excused from the meeting at 8:55 p.m.. Variance 363 Variance Application No. 363 being the application of Harold Ebeling, Harold Ebeling 701 Larkspur, Corona del Mar, to permit_ construction of 8 units on 133500 sq. ft., one unit for each 1687.5 square feet.in RJB zone at 380 Rochester was presented. Mr. Olinsky, contractor, and Mr. Ebeling, were both present. Upon motion of Councilman J. Smith, seconded by Councilman B. Smith, and carried this variance is to be brought up at the meeting of July 29, 1957® Adjournment Upon motion by Councilman B. Smith, seconded by Councilman J.
