HomeMy WebLinkAbout07/29/1957 - Adjourned City Council Meeting62() ADJOURNED REGULAR MEETING OF THE CITY COUNCIL CITY OF COSTA MESA July 29, 1957 The City Council of the City of Costa Mesa, California met in adjourned regular session at'77:30 p.m., July 29, 1957, at the Newport Justice Court, 567 West 18th Street, Costa Mesa. The meeting was called to order by the Mayor, followed by the Pledge of Allegiance to the Flag and Invocation by Reverend Chandler Jackson. ROLL CALL Councilmen Present. J. Smith, B. Smith. Pinkley, Meyers, Nelson Councilmen Absent; None Officials Present: City Clerk, Deputy City Clerk, City Attorney, City Engineer, Director of Finance Minutes The minutes of the meeting of July 22, 1957, having been distributed to the Councilmen prior to the meeting, were approved on motion by Council- man Pinkley, seconded by Councilman J. Smith, and carried. PUBLIC HEARING The Mayor announced that this was the time and place set for public Lighting District hearing on the proposed Lighting District. The.Deputy Clerk reported that no written communictions or protests had been received. Thereupon the Mayor asked if there was anyone present desiring to protest. ;There being no one present desiring to speak and no written communications having been received it was moved by Councilman Pinkley, seconded by Councilman Meyers, and carried, that the hearing be closed. 'Resolution No. 388 Resolution No. 388, BEING A RESOLUTION CONFIRMING THE REPORT OF THE CITY ENGINEER, DATED i JUNE�� .24 " 1957; ,`:PREPARED, ;PURSUANT i -TO.. THE, PRO- VISIONS OF THE "STREET LIGHTING ACT OF 1919", AND REFERRED TO IN RESOLUTION OF INTENTION NO. 3.77 OF SAID COUNCIL, AND THE PLANS AND SPECIFICATIONS, ESTIMATE, DIAGRAM AND ASSESSMENT CONTAINED IN SAID REPORT; ORDERING THE WORK AND LEVYING THE ASSESSMENT FOR SERVICE NECESSARY TO MAINTAIN AND ILLUMINATE BY -ELECTRIC ENERGY THE STREET LIGHTS VITHIN SAID CITY FOR THE PERIOD OF MONTHS ENDING OCTOBER 31, 1958, was presented and'read in full by the City Attorney. On motion by Councilman B.Smith, seconded by Councilman Meyers, Resolution No. 388 was adopted by the following roll call vote: AYES:_ Councilmen Pinkley, Meyers, B.Smith, J. ,Smith, Nelson NOES: Councilmen - None ABSENT. Councilmen - None OPENING OF BIDS The Mayor announced that this was also the time and place fixed by Revised Parking the City Council of the City of Costa Mesa for the opening of bids Lot pursuant to Notice Inviting Bids for the Revised Parking Lot. The Clerk reported that three (3) bids had been received. Upon motion by Councilman B. 'Smith, seconded by Councilman Pinkley, and carried the bids were referred to the City Engineer for check and report back. The City Engineer advised the City Council that the bid -of Sully -Miller was the lowest regular bid submitted for said work and was reasonable and within the estimate made for said work. I" Whereupon Councilman B. Smith moved that the contract be awarded to Sully Miller, and the Mayor and City Clerk be authorized to sign said contract in behalf of the City. The motion was seconded by Council- man Meyers, and carried by the following roll call vote: AYES: Councilmen Pinkley, Meyers, B.Smith, J. No one responded and the Mayor called for written communicationso. Written Communi- A letter from Mr. C. 9. Van Vlack, together with a petition signed by cations twenty-six citizens was read, commending the Council and the Poundmaster on the improvement in the dog situation since the adoption of the Dog Ordinance. Upon motion by Councilman Pinkley, seconded by Councilman J. Smith, and carried the letter was ordered filed. Communications were read from J. R. Ludwig, Superintendent, Soundcast. Col, 17th & Placentia; D. G. Griswold, President Cla-Val Co. 17th and Placentia; David and Lucille Coffman, Shadeland Trailer Park. 1741 Pomona; and D. E. Ericson and Lois G. Ericson, 1718 Monrovia, protesting the issuance of an Alcoholic Beverage License to Edward F. Zilm, The Hauf Brau, 1712 Placentia. After discussion it was moved by Councilman Nelson, seconded by CouncilmanJ. Smith, that the City protest the issu- ance of an Alcoholic Beverage License to Mr. Zilm at this address. Councilmen - None ABSENT: Councilmen - None A communication was read from P. L. Reiner, Laguna Transit, 2192 Ocean Ave., Laguna Beach, California, requesting from the Council a possible starting date for the proposed bus service in the City of Costa -Mesa. After discussion Mr. 'Edwin L. Noack, 1977 Rosemary Pl., who was present was advised to fill out an application with the Director of Finance -for a license to operate in the City and this would then be presented to the Council for their action. Claim for damages A claim for damages made by Chester B. Phillips and Alice F. Phillips Chester B. and against the City of Costa Mesa was presented. The Attorney advised the Alice Phillips Council that neither the City nor any City Official was responsible for the items listed in the Claim. Therupon Councilman B. Smith moved that the claim be denied. Seconded by Councilman Pinkley, and carried. Tentative Tract Tentative Tract Map No. 3289 in the name of George Buccola, 3404 Via No. 3289 Lido, Newport Beach, California, to subdivide Lot No. 234, Newport George Buccola Heights Tract into 24 parcels (3301 south of thecenterline of 21st Street, on the westerly side of Santa Ana Avenue) was presented. On motion by Councilman S. Smith, seconded by Councilman Meyers, and carried Tentative Tract Map No. 3289 was approved subject to ;the recommendations of the Planning Commissiont 1) Subject.to'all of the conditions us set forth in the City Engineer's letter of July 225 1957x} 2) As to lots 1, 16, and 17, that no vehicular access be made from these lots directly onto Santa Ana Avenue. Tentative Tract Tentative Tract Map No. 3115 in the name of Dudley Smith, 10835 Santa No. 3115 Monica Blvd., Los Angeles, California to subdivide property on the Dudley Smith south side of Gisler, west and south of existing Tract No. 2353, into 451 lots was presented. After discussion it was moved by Councilman B. Smith, that this map.be approved tentatively subject to the recom- mendations of the Planning Commission and before final approval is given that the applicant give'consideratibn to a park in this area; Motion was seconded by Councilman Pinkley, and carried. Variance No. 363 Variance Application No. 3633 being the application of Harold Ebeling, Harold Ebeling 701 Larkspur, Corona del Mar to permit construction of 8 units at 380 Rochester Street was presented. Mr.Ebeling and Mr. Olinsky, the ontractor were present. After discussion it was moved by Councilman B. Smith, seconded by Councilman Meyers, and.unanimously carried the Council concurred with the P'lanning Commission in granting the variance. Variance No. 364 Variance Application No. 364, being the application of Harry M. Wright Harry '% Wright 130 Rochester St., to permit M1 Light Manufacturing on C2 zoned prop rty. in order that Regan Bros., a tenant for 10 years, may wire permanently their original 25 H.P. 3 -phase -wiring for present and future use, was presented. After discussion it was moved by.Councilman B. Smith that the variance be approved subject to the recommendations of the Planning Commission. to deny the M1 zoning but permit -rewiring, on the find- ing of the City Manager as to the type of operation and size of busi- neww that is presently being conducted. A copy of this inventory is to be attached to the Variance application and filed in the Office of the City Clerk. Motion seconded by Councilman Meyers, and carried by the following roll call voter AYES: Councilmen J. Smith, B..Smith, Pinkley, Meyers, Nelson NCESr Councilmen - None ABSENT: Councilmen - None Variance No. 365 Variance Application No. 365, being the application of Robert and Eileen Robert and Eileen 'Rapp, 228 East 20th Street, Costa Mesa, to permit construction,of a Rapp 9th unit in an R4 zone on 11,250 sq. ft. of land as per plot plan attached to Variance No 8, was presented. After discussion it,was moved by Councilman B. Smith, seconded by Councilman Meyers that this Variance be approved with the stipulation that the garages be made available to" the tenants at all times. Motion carried by the following roll call vote: AYES: Councilmen J..Smith,'-B. Smith, Pinkley, Meyers, Nelson NOES: Councilmen ABSENT. Councilmen - None PERMITS A communication from the Optimist Club of Costa Mesa requesting a free permit to hold the annual Optimist circus at the Orange:.County Fairgrounds on Sunday, September 22, 1957 was read.- Upon motion by Councilman B. Smith, seconded by Councilman Pinkley and carried, the free permit was granted and also permission to erect banners across 19th and Harbor and across 17th and Orange. The request of Mr. Eli Whitney and Bob Fullenwider, to operate an air calliope in the City of Costa Mesa Friday and Saturday, August 16 and 17 to advertise the Fair was presented. Upon motion by Councilman Pinkley, seconded by Councilman Meyrs, and carried the permit was granted. On motion by Councilman B. Smith, seconded by Councilman Meyers, Ordinance No. 177, was passed to second reading by the following roll call vote: AYES: Councilmen B. Smith, J. Smith, Meyers, Pinkley, Nelson NOES: Councilmen None ABSENT- Councilmen - None RESOLUTION NO. 390 Resolution No. 390, being, A AESOLUTION OF THE CITY COUNCIL OF THE Rates of Salary CITY OF COSTA MESA, CALIFORNIA, ESTABLISHING THE MINIMUM AND MAXIMUM RATES OF PAY FOR CITY EMPLOYEES UNDER THE BASIC SALARY SCHEDULE AND ESTABLISHING THE SALARIES FOR EMPLOYEES NOT PLACED ON THE BASIC SALARY SCHEDULE was presented by the City Attorney. Upon motion by Council- man Pinkley, seconded by Councilman Meyers Resolution No. 390 was adopted by the following roll call voter AYES: Councilmen B. Smith, J. Smith, Meyers, Pinkley, Nelson NOES: Councilmen --None ABSENT: Councilmen - None Water Bond Election It was moved by Councilman J. Smith, seconded by Councilman Pinkley Promotional Committee and carried that a committee of 50 interested people be chosen to promote the Water Bond Election, the council as a committee of five to select the committee. Adjournment Upon motion by Councilman Meyers, seconded by Councilman B.
