REGULAR MEETING OF THE CITY COUNCIL
CITY OF COSTA MESA
September 16, 1957
The City Council of the City of Costa Mesa, California,.met.-in
regular session_at.7:30 p.m. September 16, 1957, at the Newport
Beach Justice Court, 567 West 18th Street, Costa Mesa.- The meeting
was called to order by the Mayor followed.by the Pledgeof Allegiance
to the Flag and Invocation by Reverend Fred A. David.

The minutes of the meeting of September 3, 1957, having been distri-
buted to the Councilmen prior to the meeting, were approved on motion
by Councilman B. Smith, seconded by Councilman Meyers, and carried.
PUBLIC HEARING
The Mayor announced. that this was the time and place set for the
Rezone Petition #35
public hearing on Rezone Petition No. 35, being the petition of
Keith S. Rima
Keith S. Rima, 104 W. Wilson to rezone from R4 to P1, portion of
Lot 702, Newport Mesa Tract, (the westerly 200 ft. of the northerly
150 ft. of Lot 702, Newport Mesa Tract). The Deputy City Clerk read
the Planning Commissions recommendation for approval, and reported there
were no additional written communications. Mr. Paul A. Robertson
2569 Oxford Lane, spoke in opposition to the rezoning. There being
no one else desiring to speak it was moved by Councilman Meyers,
seconded by Councilman Pinkley and. carried that the hearing be closed..
Ordinance No. 182, being AN ORDINANCE AMENDING SECTION 3.2 OF
ARTICLE III OF ORDINANCE NO. 32 OF THE CITY OF,COSTA MESA, CALIFORNIA,
ENTITLED: 'SAN ORDINANCE OF THE CITY OF COSTA MESA ESTABLISHING LAND
CLASSIFICATIONS IN DISTRICTS WITHIN THE INCORPORATED TERRITORY OF
THE CITY OF COSTA MESA REGULATING THE USE OF PROPERTY THEREIN,
ADOPTING A MAP OF SAID DISTRICTS, DEFINING THE TERMS USED IN THIS
ORDINANCE, PROVIDING FOR THE ADJUSTMENT, ENFORCEMENT AND AMENDMENT
HEREOF, PRESCRIBING PENALTIES FOR VIOLATION EEREOF, AND REPEALING
ORDINANCES AND PARTS OF ORDINANCES INCONSISTENT AND IN CONFLICT
HEREWITH119 was presented, changing the zoning from R4 to P1.
Mr. Paul Trautwein requested. the hearing to be reppened., as he
had. been late in arriving, and desired to speak. Thereupon on motion
by Councilman Pinkley, seconded by Councilman J. Smith, and carried the
hearing was again reopened.
Mr. Paul Trautwein then spoke in opposition to the rezoning,
stating that the existing building would not upgrade the adjacent
buildings. Mr. Keith Rima was present and. stated that he intended
to put a new building on the property as soon as Dr. Phaff would like
it, and stated that Dr. Phaff had a three year lease from July 1, 1957.
On motion by Councilman B. Smith, seconded by Councilman Pinkley,
and carried the hearing was again closed.
Mr. Rima stated that he had submitted plans for the new building
that is proposed., to the Planning Commission. Councilman B. Smith
suggested that further discussion be postponed until the Planning
Technician returned with the plans to the Council Chambers.
PUBLIC HEARING
The Mayor announced that this was the time and place set for the public

hearing on Rezone Petition No. 363, being the petition of Willard. L.
Killion & McClintock
Killion,'3400 Via Lido, Newport Beach, and Don McClintock, Rt. 49
Box 431, Chico to rezone from Alto R2 and Ml -A in the Baker Street
area. The Deputy City Clerk read the Planning Commissions recom-
mendation for approval, and reported there were no additional written
communications. Mr. Willard Killion, and Mr. Barney Francque, re-
presenting Mr. McClintock, were both present. Discussion was held
on ingress and egress on Baker Street. It was suggested that
Mr. Killion, or the new property owner discuss this with the City
Engineer and his recommendation be brought back to the Council. Upon
motion by Councilman B. Smith, seconded by Councilman Pinkley and
c arried. the hearing was closed.

ORDINANCE NO. 183 Ordinance No. 183, being AN ORDINANCE AMENDING SECTION 3.2
OF THE CITY OF COSTA MESA, CALIFORNIA, ENTITLED: "AN ORDINANCE
OF THE CITY OF COSTA MESA, ESTABLISHFNJ LAND CLASSIFICATIONS
IN DISTRICTS -WITHIN THE INCORPORATED TERRITORY OF THE CITY OF
COSTA MESA,. REGULATING THE USE OF PROPERTY THEREIN, ADOPTING A
MAP OF SAID DISTRICTS, DEFINING THE TERMS USED IN THIS ORDINANCE,
PROVIDING FOR THE ADHUSTMENT, ENFORCEMENT AND AMENDMENT HEREOF,
PRESCRIBING PENALTIES FOR VIOLATION THEER.EOF, AND REPEALING ORDI-
NANCES AND PARTS OF ORDINANCES INCONSISTENT WITH AND IN CONFLICT
HEREWITH", changing the zoning from Al to R2 (the_. northerly 150 ft.
of the Fountain's Addition to Fairview, and the northerly 1901
of the Griffith Subdivision excepting therefrom the easterly 448.594
as shown in Miscellaneous Maps 4-26) and from Al to M1.A (beginning
at the center line of Baker Street, .the souther.ly1664 of the
northerly 3561 of the easterly 307' of the westerly 817" of the
Griffith Subdivision, Miscellaneous Maps 4-26) was presented. On
motion by Councilman B. Smith, seconded by Councilman Pinkley, Or-
dinance No.*183 iias'given first reading and. passed to second read-
ing by the following roll callvdte:

Rezone Petition #35 The Planning Technician having returned.with.the plans for the pro -
Rima (conn). posed building to be built by Mr. Rima,.the Council again discussed
this rezoning. Mr. Rima was asked how soon he would. build this new
building, and requested that he be allowed the three year period of
Dr. Phaffts lease. After further discussion it was moved by Council -
Ordinance No. 182 man B. Smith, seconded by Councilman Pinkley'that Ordinance No. 182
be given first reading and.passed. to second reading. Motion carried
by the following roll call vote:

City Attorney Councilman J. Smith inquired.'if it were not.possible that the signs
to draft a that are posted for Public Hearings could not be made plainer. Mayor
Posting Ordi- Nelson"suggested. that such posting be done on a white sign board
nance .12 x 18 inches in size. The City Attorney suggested that these rec-
ommendations be drafted in an ordinance, and also that in the same
Ordinance the possibility of giving'a more direct notice to the
adjacent property owners be considered, possibly by leaving anotice
at each house,'d.elivered. to.the resident or left in the door. Upon
motion by Councilman Pinkley, seconded by Councilman J. Smith, and
carried. the City Attorney was instructed to draft an Ordinance in-
cluding the above recommendations.
VARIANCE NO. 111 Variance No. 111, for Keith Ri a, 104 West Wilson, having been con-
sidered for possible revocation by'the Planning Commission was pre-
sented. The original variance was to permit use of a room attached.
to the house at 1862 Placentia St. to be.used.for a Doctorls office
and his home. On April 18, 1955 said variance had been approved on
condition applicant provide four paved parking spaces, and that vari-
ance be non -transferable. Since this time Mr. Rima had purchased
the property and the entire house was being used fora doctor's office.
The Deputy Clerk read the recommendation of the Planning Commission
that Variance No. 111 NOT be revoked because:
111) the Planning Commission has recommended that this property
be rezoned.from R4 to P1 under Rezone Petition No. 35.
2) The applicant, and owner, has indicated. that he will increase
his off-street parking to at least ten spaces as well as
having a circular drive.
Recommended that Variance No. 111 be amended to read, "that there
be not less than ten surfaced, marked and usable off-street
parking spaces and a circular drive from Center.and Placentia
to allow for better traffic circulation, and that work is to
be completed.within thirty days.from final approval."
The City Attorney informed the Council that they could set a
time limit for the Variance, if granted, and that Mr. Rima would

then be able to build the new building. Mr. Rima requested the
variance be granted.for the same period. as Dr. Phaffts lease, three
years. Discussion was held on whether or not Mr. Rima should pay
the Variance Fee of $25.00 inasmuch as this was a new variance, due
to change of owner. Upon motion by Councilman B. Smith, second.ed.by
Councilman Meyers, and carried Variance No. 111 was granted for a
period of two (2) years, and is valid upon the payment of the $25.00
fee, and compliance with the recommendations of the Plannipg Com-
mission.
Oral Communications Mr. 'Don Butts, representing Elmer Smith, addressed.the Council on
the parking problem of Mr. Smiths new building. The City Attorney
advised. the Council that this was a departmental problem to be
cleared with the Planning Technician and that Mr. Butts could secure
the building permit when he made available to the Planning Technician
a Plot Plan that would. meet requirements for'Parking.
Written Communi- A communication was read.from Mrs. Mary K. Coop, Bicylce Parade Chair -
cations man, Harper School P.T.A., requesting permission to have a bieple
parade from 10:30 a.m. to 12:30 p.m. on Saturday, October 5, 1957,
Chief McKenzie reported. he had checked. the route proposed. On motion
by Councilman B. Smith, seconded by Councilman Meyers, and.carried the
permit was granted, fee waived.
A communication was read from Anna Leouing, 695 W. 18th Streets Costa
Mesa, requesting deletion of a sewer on her property in the 19th Street
Improvement District. Upon motion by Councilman Meyers, seconded by
Councilman J. Smith, and carried., the letter was ordered filed. and.
received.
A'communication was read from Oliver L. George requesting refund de-
posited with the City of Costa Mesa, for the Costa Mesa Sanitary
District in the amount of $137.57, for the development of Tract 2052,
which had been bonded for sewers. Upon the recommendation of the
City Engineer, it was moved by Councilman Pinkley that Mr. George
receive a refund. of $102.65, which is 85% of $120.77 the amount of
the inspection fee. Motion was seconded by Councilman J. Smith
and carried by the following roll call vote.-

A communication was read. from Robert G. Nelson, District Committee
Member, Orange County Empire Council Boy Scouts of American, requesting
permission to have a Motorcade on September 21, 1957, starting at
Newport Harbor Union High School, North on Irvine Avenue to 19th
Street, W. on 19th Street b Newport Blvd.., South on Newport Boulevard
to City Limits. Chief McKenzie reported he had.checked. and. approved.
the route proposed. On motion by Councilman Pinkley, seconded by
Councilman Meyers, and carried., permission was granted..
A communication was`read.from Mary s. Kimmons, 6633 Skyway, Paradise
California, owner of property on 19th Street at Anaheim, and protesting
the building of a warehouse by Mr. Elmer B. Smith. Upon motion by
Councilman Pinkley, seconded by Councilman B. Smith, and carried,
the communication was ordered received and filed..
A communication was read from Orange'Coast College requesting ap-
proval for construction of a new campus entrance and. sign on
Harbor Boulevard. On motion by Councilman J. Smith, seconded by
Councilman Meyers, and carried, approval was granted.

A petition REQUESTING -AN IMPROVEMENT UNDER ACT OF 1911 AND PETITION
FOR WAIVER OF INVESTIGATION PROCEEDIItiGS UNDER.THE "SPECIAL ASSESSMENT
INVESTIGATION AND LIMITATION AND MAJORITY PROTEST ACT OF 1931", bearing
signatures of property owners on Charle Street was presented.. On
motion by Councilman B. Smith, seconded. by Councilman Pinkley, and
carried the petition was f�efeffed to the City Clerk for check and report
back to the Council at the next meeting, and the City Attorney was
instructed to confer with thb Fairview County Water District, inform-
ing them that this petition had been received., and that if such line
is installed.it would.eventually become their line.
Final Tract Map Final Tract Map No. 2955 for Dike and Colegrove Co. to subdivide
No. 2955 3..85 acres into 144 lots was presented by the City Engineer. Upon

Nora H. Dodge
The City Attorney presented a proposed agreement between Nora H.
Agreement
Dodge and the City of Costa Meaa for right of way and severance
damages for the right of way, this being in the East 17th Street
Improvement District. Upon motion by Councilman B. Smith, seconded
by Councilman Pinkley, andcarried."the agreement was approved and
the City Clerk and Mayor authorized to sign the agreement on be-
half of the City.

A communication was read from the Planning Commission referring to

Council a request from Chas. A. Riggs, Adjutant of American Legion
Post No. 455; to rename Costa Mesa Park "Finch Memorial Park". Upon
motion by Councilman J. Smith, seconded by Councilman B. Smith, and
carried., the request was'referred to the Park Board.
Variance No. 379
Variance Application No. 379, being the application of John
John Rawlins
Rawlins, 11338 Canton Drive, Studio City, California to construct
a professional building on an R4 lot was presented., with the request
from the applicant for withdrawal of this application. The Planning
Commission recommended. the withdrawal as requested. Upon motion by
Councilman B. Smith, seconded by Councilman Pinkley, and carried, the
Council concurred. with the action of the Planning Commission.

Variance No., 385 Variance Application No. 385, being the application of Dennis Hogland
Dennis Hogland • to permit a new 501 frontage building to match six adjoing stores and
to permit a parking variance, was presented. Mr. E. A. Ralston,
1769 Newport Boulevard, was present, and presented a proposed parking
plan to the Council. He agreed -to provide 22 parking spaces, as
soon as he could move the existing residence of Mr. Harmon, possibly
within 18 months. He would furnish bond to guarantee the moving of
the house and paving and. marking of the parking places. Mr. Walston
was advised. he should. take this plan back to the Planning Commission
inasmuch as they had denied his request because of the parking,and,
it would. take a 4/5 vote of the Council to overrule the decision of
the Commission. Mr. Ralston preferred..the Council to act on his
request. It was moved.by Councilman B. Smith, seconded by Councilman
Meyers, that the action of the Planning Commission be reversed, and.
that permission be granted upon the receipt of a recorded instru-
ment that Mr. Ralston agrees that the house be moved within a period
of twenty (20) months from date of approval, and. the property be
paved and marked. for parking, at his expense, that a $1500 bond be
posted. to guarantee the work to be done. Motion was defeated.by the
following roll call vote:

Upon motion by Councilman Pinkley, the above action was rescinded
and the variance was referred back to the Planning Commission for
a new prDposal. The motion was seconded by Councilman J. Smith,
and. carried by the following roll call vote:

PERMITS The request of the Kiwanis Club of Costa Me s::.to operate a mobile
public address system on the streets on Monday, September 23 and
Tuesday, September 24, 1957, in connection with the Special Muni-
cipal Election regarding the Water Bond. Proposition was approved
on, --:motion by Councilman J. Smith, seconded.by Councilman Nelson
and, carried.
The application of Foster and Kleiser Company to erect one illumi-
nated.back to back poster panel on property located on the east
side of Newport Boulevard, 670 feet south of 16th street, to replace
a Double Billboard. removed 6601 south of 16th Street was approved

The application of Willie Bailey for permit to collect junk and,
resell same out of the City, was granted on motion by Councilman
Meyers, seconded. by Councilman J. Smith, and. carried.
WR 121 Warrant Resolution No. 121, including Payroll No. 77, was adopted
on motion by Councilman Pinkley, seconded by Councilman J. Smith,
and carried.by the followingaroll call vote:
