December 17, 1957
The City Council of the City of Costa Mesa, California, met in regular
adjourned session at 8:00 p.m., December 17, 1957 at -the City Hall,
695 W. 19th Street, Costa Mesa. The meeting was called to order by
the Mayor followed by the Pledge of Allegiance to the Flag and Invocation
,by Councilman John Smith.

The Mayor announced that the hour of 8:00 o'clock p.m. having arrived
Rezone Petition
No. 40, initiated
this was the time and place fixed by the City Council for public Hearing
on Rezone Petition No. 40, and declared the hearing open.

The Clerk read the recommendation for approval of the petition
by the Planning Commission.
The Clerk reported that no written protests had been received.
There being no writeen communications, the Mayor asked if there were any-
-one present wishing to speak. All persons having been given full oppor-
tunity to be heard, and no one else wishing to speak, it was moved by
Councilman B.Smith, seconded by Councilman J.'Smith, and carried that the
hearing be closed.

and on motion by Councilman Pinkley, seconded by Councilman Meyers, Ordi-
nance No. 192 was given first reading and passed to second reading by
the following roll call vote:

ORAL COMMUNICA-
TIONS
The Mayor inquired if there were anyone present wishing to speak on any

tem not on the agenda. There being no one wishing to speak the Mayor
called for written communications.
A communication was read from Roven-,Spiegel Comtruction Co., 5656 W. 3rd
Street, Los Angeles 36, requesting the Council to reconsider the stipu-
lation that the contract be let in 60 days and work be commenced in 90.
days on the Fairview Avenue improvement on Tentative Tracts 2953 and
2951. Mr. Dick Horton was present representing Roven-Spiegel Construction
Co. After discussion it was moved by Councilman B.'Smith that a six month
extension on the improvement be granted. The motion -died for lack of a
second. After further discussion it was moved by Councilman Pinkley, and
seconded by Councilman Meyers, that the one year extension on Tentative
Tracts No. 2953 and 2954 be rescinded on the ground that the representa-
tive of the company indicated that they would not want to comply with the
conditions attached. Motion carried by the following roll call vote:

Uponmotion by Councilman Meyers, seconded by Councilman Pinkley,
and carried Tentative Tracts No. 2953 and 2954 be extended for sixth months
to May 19, 1958.
Fucshia Society A communication was read from the Costa Mesa -Bay Cities Branch Fuchsia
Society offering the City fucshia plants for the new City Hall. Upon
motion by Councilman B.Smith, seconded by Councilman Pinkley, and carried
the City Manager was directed -to accept the plants from the Fucshia Society
the landscape architect to choose the site and varieties to be planted, and
a plaque to be placed near the plantings by the City.
Vard Road
A communication was read from Vard Products, P. 0. Box 719, Costa Mesa,
stating that on November 21 and 22, 1957 the road North. of Fair Drive
running east from Fairview Road to Newport Road.had been closed for a
period of forty-eight hours. Upon motion by Councilman B.Smith, seconded
by Councilman J.Smith and carried the communication was ordered received
and filed.
Orange County Park
A communication was read from the Planning Commission stating that fl. - r.
Plan Comm.
Harry M. Aldrich had been appointed to serve on the newly formed Orange
County Park Plan Committee. Upon motion by Councilman J.Smith, seconded
by Councilman Pinkley, and carried the communication was ordered received
and filed.
Heart Assn.
'A communication was read from the Orange County Heart Association requesting
permission to solicit funds during the month of February, 1958, designated
as Heart Fund Month. Upon motion by Councilman Pinkley, seconded.by
Councilman Meyers, permission was granted for solicitation during the month
of February, 1958. Motion carried by the following roll call vote:

Recognition of
A communication was read from County Clerk L. B. Wallace with a.REsolution
Orange County
adopted.by the Orange County_Board of Supervisors calling for Metropolitan.
Area recognition of Orange County by the Federal Government. Thereupon,
Resolution No. 1315 being A RESOLUTION OF THE CITY COUNCIL, CITY OF OOSTA
MESA, CALLING FOR METROPOLITAN AREA RECOGNITION OF ORANGE COUNTY BY -THE
FEDERAL GOVERNMENT was presented. On motion by Councilman Pinkley, seconded
by Councilman Meyers, Resolution No. 431 was adopted by the following roll
call vote;

Upon motion by Councilman Pinkley, seconded by Councilman Meyers, and
carried the report of the Director of Finance, Fire Department and City
Treasurer for the month of November, were ordered received and filed.
City Attorney
A deed of Right of Way to the City of Costa Mesa dated November 261 1957
from George and William Holstein Co. was presented. Upon motion by
Councilman B.Smith, seconded by Councilman Meyers, the deed was accepted
and ordered placed on record by the following roll call vote:

full, it was moved -by Councilman Pinkley, seconded by Councilman Meyers,

vised Tentative Tract 2353 be extended for a period of one year to

December 3, 1958 subject to all of that portion of the territory shown in
the said Revised Tentative Tract Map now outside of the city being annexed
to the City of Costa Mesa. Said Revised Tentative Tract Map to be subject
to all conditions, regulations, and laws in existence as of this date ex-
cept for the fee of $50.00 per lot, it being understood that the fee of
$10.00 per lot in effect as of the'date of the original Tract Map. 2353
shall be applicable.

VARIANCE #423 Variance Application No. 423, being the applicatiion of William R. McLeod
Mc Leod and Vera A. McLeod, 1944 Whittier Avenue to permit location of rear line
of proposed dwelling 8.1'6" from the rear lot line at 1783 Tustin Avenue,
was read with the recommendation of the Punning Commission for approval
subject to 1) That the present garage be used entirely for the parking
of cars and that the present living adcomodations be removed. 2) That
the driveway for the full 17" width be paved and properly marked to pro-
vide two more off-street parking spaces. 3) that the garage and the
driveway actually be used for off-street parking with no parking on the
street. Upon motion by Councilman Pinkley, seconded by Councilman Meyers
and carried the Council concurred with the action of the Planning Com-
mission.
CITY MANAGERS REPORT The City Manager reported that he had been contacted about the zoning
Safety Device Upon motion by Councilman B.Smith, seconded by Councilman Pinkley and
study carried the City Manager was directed to have a study mdde of the
installation of safety devices, street lights, signs, etc. in the two
improvement districts, W. 19th Street'and,E. 17th Street, that will be
completed next year,.and report back to the Council.
ADJOURNMENT Upon motion by Councilman J.Smith, seconded by Councilman Meyers, and
carried the meeting was adjourned at 10:20 p.m.

C2 zoning. Upon motion by Councilman B.Smith, seconded by Councilman

Pinkley, and carried the Planning Commission was requested to make a
study of the property, with the suggestion that it at least be changed
to C1 in this area.
Drainage study
The City Manager requested that thelCouncil consider the possibility
of requesting the Flood Control District to make a study of the drainage
systems to the East of the area known as the Santa Ana Improvement Dis-
trict shortly after the first of the year. After discussion it was
moved by Councilman Pinkley, seconded by Councilman Meyers and car-
ried that the City Manager be instructed to request the Board of
Supervisors to make a study of the drainage system.
Study of North
As requested by the City Manager, it was moved by Councilman B.Smith
Costa Mesa Storm
seconded by Councilman J.Smith, and carried that the City Manager be

authorized to enter into an agreement with the County Flood Control
District for a drainage project known as the -North Costa Mesa Storm
Drain, in behalf of the City of Costa Mesa.
Safety Device Upon motion by Councilman B.Smith, seconded by Councilman Pinkley and
study carried the City Manager was directed to have a study mdde of the
installation of safety devices, street lights, signs, etc. in the two
improvement districts, W. 19th Street'and,E. 17th Street, that will be
completed next year,.and report back to the Council.
ADJOURNMENT Upon motion by Councilman J.Smith, seconded by Councilman Meyers, and
carried the meeting was adjourned at 10:20 p.m.
