The meeting was called to order by the Mayor followed by the Pledge of Allegiance to the Flag and Invocation ,by Councilman John Smith. ROLL CALL, Councilmen Present: Councilmen Absent: Officials Present: J. Smith, B.Smith, Meyers Nelson Plinkley City Manager, City Attorney, City Ergineer, Deputy City Clerk, Director of Finance, Planning Commissioner Aldrich. - PUBLIC HEARING The Mayor announced that the hour of 8:00 o'clock p.m. having arrived Rezone Petition No. 40, initiated this was the time and place fixed by the City Council for public Hearing on Rezone Petition No. 40, and declared the hearing open. by Planning Com. The Clerk read the recommendation for approval of the petition by the Planning Commission. The Clerk reported that no written protests had been received. There being no writeen communications, the Mayor asked if there were any- -one present wishing to speak. All persons having been given full oppor- tunity to be heard, and no one else wishing to speak, it was moved by Councilman B.Smith, seconded by Councilman J.'Smith, and carried that the hearing be closed. ORDINANCIE # 191 . ORDIRANCE NO. 191, being AN ORDINANCI; OF THE CITY OF COSTA MESA AMENDING SECTION 3.2 OF ARTICLE III OF ORDINANCE NO. 32 OF THE CITY OF COSTA MESA, CALIFORNIA, ENTITLED It AN ORDINANCE OF THE CITY OF COSTA MESA ESTABLISHING LAND CLASSIFICATIONS IN DISTRICTS, REGULATING THE USE OF PROPERTY THEREIN, ADOPTING A MAP OF SAID DISTRICTS, D X1NGNTHE:I=, S USED IN THE ORDINANCE, PROVIDING FOR THE ADJUSTMENT, ENFORCEMENT, AND AMEND- MENT HEREOF, PRESCRIBING PENALTIES FOR VIOLATION THEREDF, AND REPEALING - ORDINANCES AND PARTS OF ORDINANCES INCONSISTENT AND IN CONFLICT`='THEREWITH, changing the zoning of the West 1/2 of Lot 7, Block E, Berry Tract from Al to -M1 -A was presented and on -motion by Councilman B.Smith, seconded by Councilman J.::Smith, Ordinance No. 191 was given first reading and passed to second reading by the following roll call vote: AYES: Councilmen J.Smith, B.Smith,_Meyers,Nelson NOES: Councilmen - None ABSENT: Councilman Pinkley PUBLIC HEARING The Mayor announced that the hour of 8;00 O'clock p.m. having arrived this Rezone Petition 41 was.the time and placed fixed by the City Council for public hearing on Initiated by Plan- Rezone Petition No. 41, and declared the hearing open. ning Commission The Clerk read the recommendation for approval of the petition by the Planning Commission. ORDINANCE #192 ORDINANCE No: 192, being AN ORDINANCE OF THE CITY OF COSTA MESA AMENDING SECTION 3.2 OF ARTICLE III of ORDINANCE NO. 32 OF IHE CITY OF COSTA MESA, CALIFORNIA, ENTITLED "AN ORDINANCE OF THE CITY OF COSTA MESA 'ESTABLISHING LAND CLASSIFICATIONS IN DISTRICTS, REGULATING THE USE OF PROPERTY THEREIN, ADOPTING A MAP OF SAID DISTRICTS, DEFINING THE TERMS USED IN THE ORDINANCE, PROVIDING FOR THE ADJUSTMENT, ENFORCEMENT, AND AMENDMENT THEREOF, PRESCRIBING' -,PENALTIES FOR. VIOLATION THEREOF, AND RE- PEALING ORDINANCES AND PARTS OF ORDINANCES INCONSISTENT AND INCONFLICT THEREWITH, changing the zoning of th e.Westerly 811' of Geo. W. Griffiths Subdivision of Fountain Addition to Fairview, from -A1 to M1 was presented. and on motion by Councilman Pinkley, seconded by Councilman Meyers, Ordi- nance No. 192 was given first reading and passed to second reading by the following roll call vote: AYES: Councilmen J.Smith, B.Smith, Pinkley, Meyers, Nelson NOES: Councilmen - None ABSENT: Councilmen - None ORAL COMMUNICA- TIONS The Mayor inquired if there were anyone present wishing to speak on any I tem not on the agenda. There being no one wishing to speak the Mayor called for written communications. A communication was read from Roven-,Spiegel Comtruction Co., 5656 W. 3rd Street, Los Angeles 36, requesting the Council to reconsider the stipu- lation that the contract be let in 60 days and work be commenced in 90. days on the Fairview Avenue improvement on Tentative Tracts 2953 and 2951. Mr. Dick Horton was present representing Roven-Spiegel Construction Co. After discussion it was moved by Councilman B.'Smith that a six month extension on the improvement be granted. The motion -died for lack of a second. After further discussion it was moved by Councilman Pinkley, and seconded by Councilman Meyers, that the one year extension on Tentative Tracts No. 2953 and 2954 be rescinded on the ground that the representa- tive of the company indicated that they would not want to comply with the conditions attached. Motion carried by the following roll call vote: AYES: Councilmen J.Smith, Pinkley, Meyers, Nelson NOES: Councilmen B.Smith ABSENT: Councilmen - None Uponmotion by Councilman Meyers, seconded by Councilman Pinkley, and carried Tentative Tracts No. 2953 and 2954 be extended for sixth months to May 19, 1958. Fucshia Society A communication was read from the Costa Mesa -Bay Cities Branch Fuchsia Society offering the City fucshia plants for the new City Hall. Upon motion by Councilman B.Smith, seconded by Councilman Pinkley, and carried the City Manager was directed -to accept the plants from the Fucshia Society the landscape architect to choose the site and varieties to be planted, and a plaque to be placed near the plantings by the City. Vard Road A communication was read from Vard Products, P. 0. Box 719, Costa Mesa, stating that on November 21 and 22, 1957 the road North. of Fair Drive running east from Fairview Road to Newport Road.had been closed for a period of forty-eight hours. Upon motion by Councilman B.Smith, seconded by Councilman J.Smith and carried the communication was ordered received and filed. Orange County Park A communication was read from the Planning Commission stating that fl. - r. Plan Comm. Harry M. Aldrich had been appointed to serve on the newly formed Orange County Park Plan Committee. Upon motion by Councilman J.Smith, seconded by Councilman Pinkley, and carried the communication was ordered received and filed. Heart Assn. 'A communication was read from the Orange County Heart Association requesting permission to solicit funds during the month of February, 1958, designated as Heart Fund Month. Upon motion by Councilman Pinkley, seconded.by Councilman Meyers, permission was granted for solicitation during the month of February, 1958. Motion carried by the following roll call vote: AYES: Councilmen J.Smith, B.Smith, Meyers, Nelson NOBS: Councilman Pinkley ABSENT: Councilmen - None Recognition of A communication was read from County Clerk L. B. Wallace with a.REsolution Orange County adopted.by the Orange County_Board of Supervisors calling for Metropolitan. Area recognition of Orange County by the Federal Government. Thereupon, Resolution No. 1315 being A RESOLUTION OF THE CITY COUNCIL, CITY OF OOSTA MESA, CALLING FOR METROPOLITAN AREA RECOGNITION OF ORANGE COUNTY BY -THE FEDERAL GOVERNMENT was presented. On motion by Councilman Pinkley, seconded by Councilman Meyers, Resolution No. 431 was adopted by the following roll call vote; AYES: Councilmen J.Smith, B.Smitb., Meyers, Pinkley, Nelson NOES: Councilmen - None ABSENT: Councilmen None REPORT'S Upon motion by Councilman Pinkley, seconded by Councilman Meyers, and carried the report of the Director of Finance, Fire Department and City Treasurer for the month of November, were ordered received and filed. City Attorney A deed of Right of Way to the City of Costa Mesa dated November 261 1957 from George and William Holstein Co. was presented. Upon motion by Councilman B.Smith, seconded by Councilman Meyers, the deed was accepted and ordered placed on record by the following roll call vote: AYES: Councilmen J.Smith, B.Smith, Meyers., Pinkley, Nelson NOES: Councilmen - None ABSENT: Councilmen - None Mrs. Isabel Law The Attorney reported that it was the recommendation of the City Attorney rence Complaint and City Engineer that legally the City can do nothing for Mrs. Isabel Parking for Theatre The City Attorney reported that he had received a communication from the Building -Moving Griffith Company concerning the parking lot for the theatre, and a plot Application #174 plan showing the location of the new parking lot. After discussion it was Abbott suggested the Planning Department write the Griffith Co. a letter -requesting them to submit a plot plan of the new parking for.approval. VARIANCE #409 Varianc e ;Application No. 409, being the application of Richfield Oil Corp. Richfield Oil Co. 1406 W. Broadway, ANaheim, to install a pump island in building setback �-'Building-Mvg. on 19th St. as per the layout on file in the City Clerks office, pump is- Application ##173 land to be within 21 ft of the curb line on E. 19th St., was read, after Cozad being deferred from the meeting of December 2, 1957, along with the recom- REZONE PETITION mendations of the .Planning Commission for approval.on the condition that #42 - Lennon there be a commercial sidewalk along E. 19th `St.; and on the further con- dition that, in case of the future widening of E. 19th ,St., that the !; pump island will be set back without expense to the City. After dis- cussion it was moved by Councilman B.Smith, seconded by Councilman Meyers, and carried that the Variance be approved as recommended by the Planning Commission ORDINANCE #190 The Attorney presented Ordinance No. 190, being AN ORDINANCE OF THE CITY Load Limits OF COSTA MESA, CALIFORNIA AMENDING ORDINANCE NO.,44. After reading in full, it was moved -by Councilman Pinkley, seconded by Councilman Meyers, that Ordinance No. 190 be accepted for first reading and passed to second reading. Motion carried by -the following roll call vote:=, AYES: Councilmen JaSmith, B.Smith, Pinkley, Meyers, Nelson NOES: Councilmen - None ABSENT: Councilmen - None Mrs. Isabel Law The Attorney reported that it was the recommendation of the City Attorney rence Complaint and City Engineer that legally the City can do nothing for Mrs. Isabel 2353 - 'Summerland Lawrence, 1838 Pomona, on her complaint concerning the driveway. Building -Moving Building Moving Application No. 174 of Bailey Abbott, for a permit to Application #174 move a building from 2572 Baywhore Drive, Newport Beach to 356.Ramona Way Abbott was presented with a request from the applicant that the application be withdrawn. Upon motion by Councilman B.`Smith, seconded by Councilman Pinkley and carried the request for withdrawal was approved as recommended �-- by the Planning Commission. �-'Building-Mvg. Cozad, for a permit to Application ##173 move a building from 279 E. 17th `Street to 1710 `Santa Ana Avenue was Cozad presented with a request from the applicant that this be referred back. REZONE PETITION to the Planning Commission for further hearing. After discussion it was #42 - Lennon moved by Councilman J.,Smith, seconded by Councilman Meyers that this ap- pli6a., .be referred back to the Planning Commission at no additional fee. Name.Change IN.TRACT:NO, 2955 IN SAID CITY TO TULANE ROAD AND TULANE PLACE was pre- sented motion by Councilman Pinkley, seconded by Councilman Meyers, Resolution No. 432 was adopted by'the following roll call vote: AYES: Councilmen J.Smith, B:Smith, Meyers, Pinkley, Nelson NOES: Councilmen - None ABSENT: Councilmen - None TENTATIVE TRACT NO. A communication was read from*'Summerland Land Co. requesting an extension 2353 - 'Summerland of.the REvi.sed Tentative Tract 2353. After discussion it was moved by Land Co. Councilman B.Smith, seconded by Councilman Pinkley, and carried that Re- vised Tentative Tract 2353 be extended for a period of one year to i December 3, 1958 subject to all of that portion of the territory shown in the said Revised Tentative Tract Map now outside of the city being annexed to the City of Costa Mesa. Said Revised Tentative Tract Map to be subject to all conditions, regulations, and laws in existence as of this date ex- cept for the fee of $50.00 per lot, it being understood that the fee of $10.00 per lot in effect as of the'date of the original Tract Map. 2353 shall be applicable. REZONE PETITION Rezone Petition No. 42 for J. Warren Lennon to rezone from R4 to R2 the #42 - Lennon East 100 ft. of Lots 9 and 28, all of Lots 8 and 29, and the West 35 ft. of Lots'7 and 30, Tract No. 57, was presented; Upon motion by Councilman Pinkley, seconded by Councilman Meyers, and carried, Rezone Petition No. 42 was referred to the Planning Commission A deed of Right of Way to the City of Costa Mesa, dated December 16, 1957 from Joseph Roudot for that certain street known as Maple Avenue from 19th Street to Hamilton Street, was presented. McLeod Mc Leod and Vera A. McLeod, 1944 Whittier Avenue to permit location of rear line of proposed dwelling 8.1'6" from the rear lot line at 1783 Tustin Avenue, was read with the recommendation of the Punning Commission for approval subject to 1) That the present garage be used entirely for the parking of cars and that the present living adcomodations be removed. 2) That the driveway for the full 17" width be paved and properly marked to pro- vide two more off-street parking spaces. 3) that the garage and the driveway actually be used for off-street parking with no parking on the street. Upon motion by Councilman Pinkley, seconded by Councilman Meyers and carried the Council concurred with the action of the Planning Com- mission. CITY MANAGERS REPORT The City Manager reported that he had been contacted about the zoning Safety Device Upon motion by Councilman B.Smith, seconded by Councilman Pinkley and study carried the City Manager was directed to have a study mdde of the installation of safety devices, street lights, signs, etc. in the two improvement districts, W. 19th Street'and,E. 17th Street, that will be completed next year,.and report back to the Council. ADJOURNMENT Upon motion by Councilman J.Smith, seconded by Councilman Meyers, and carried the meeting was adjourned at 10:20 p.m. 1 of'of the City of Costa Mesa AT -TEST: ,2® City Clerk of the City of Costa Mesa B ' - Chief Deputy 1 on Church Street between 19th St. and 20th St., across from the present Church Street C2 zoning. Upon motion by Councilman B.Smith, seconded by Councilman zoning Pinkley, and carried the Planning Commission was requested to make a study of the property, with the suggestion that it at least be changed to C1 in this area. Drainage study The City Manager requested that thelCouncil consider the possibility of requesting the Flood Control District to make a study of the drainage systems to the East of the area known as the Santa Ana Improvement Dis- trict shortly after the first of the year. After discussion it was moved by Councilman Pinkley, seconded by Councilman Meyers and car- ried that the City Manager be instructed to request the Board of Supervisors to make a study of the drainage system. Study of North As requested by the City Manager, it was moved by Councilman B.Smith Costa Mesa Storm seconded by Councilman J.Smith, and carried that the City Manager be Drain authorized to enter into an agreement with the County Flood Control District for a drainage project known as the -North Costa Mesa Storm Drain, in behalf of the City of Costa Mesa. Safety Device Upon motion by Councilman B.Smith, seconded by Councilman Pinkley and study carried the City Manager was directed to have a study mdde of the installation of safety devices, street lights, signs, etc. in the two improvement districts, W. 19th Street'and,E. 17th Street, that will be completed next year,.and report back to the Council.
