RIEGULAR MELTING OF THE CITY COUNCIL
CITY OF COSTA MESA
January 6, 1958
The City Council of the City of Costa Mesa, California, met in regular
session at 7.30 p.m.,, January 6, 1958 at the City Hall, 695 W. 19th
Street, Costa Mesa. The meeting was called to order by the Mayor followed
by the Pledge of Allegiance to the Flag and Invocation by Reverend Fugate.
ROLL CALL Councilmen Present: J.Smith, B.Smith, Pinkley, Meyers, Nelson
Councilmen Absent; None
Officials Present: Chief De;ty City Clerk, City Manager, Asst. City

Treasurer, Planning Commissioner Dudek
MINUTES Upon motion by Councilman B.Smith, seconded by Councilman J.Smith, and
carried the minutes of -the meeting of December 16, 1957 were approved
as written and previously mailed out.
Upon motion by Councilman Pinkley, seconded by Councilman B.Smith, and
carried, the minutes of the meeting of December 17, 1957 were approved
as written and previously mailed out.
OR&L COMMUNICATIONS The Mayor inquired if there were anyone present wishing to speak on any
item not on the agenda. Thereupon the following spoke from the floor:
Thereupon the following spoke from the floor, Mrs. Marie Karch, 640 Plumer,
Frank Bissell, 630 Plumer; Mrs..Marie Zelden, 636 Plumer, regarding the
grade of the property at the rear which would leave said properties in
a valley. After discussion it was moved by Councilman Pinkley, seconded
by Councilman B.Smith, and carried that the City Manager study the situa-
tion-andreturn with a report at the next regular meeting.
WRITTEN COMIKUNI- A communication was,read from Graven and Company requesting an extension
CATIONS of 30 days on their contract. Upon the recommendation of the City Engineer
Graven & Co. it was moved by Councilman B.`Smith, seconded by Councilman Meyers, and
extension carried that the contract be .extended 30 days.
Schools re- A communication,was read from William R. Roode, Director, Building Pro -
quest to be gram, Costa Mesa Union School District requesting an ordinance exempting
exempt for a schools for variance fees on tentative school sites. After discussion
variance fee it was moved by Councilman B.Smith, seconded by Councilman Meyers, and
carried that this be referred to the City Manager for study,'as to the
actual cost of the City in preparing a Variance and whether or not a
reduction would be possible, and to report back to the Council at the
next regular meeting.
Schools re- A communication was read from Carl K. Boswell, District Superintendent
quest on Tr. of the Costa Mesa Union School District regarding the Boards extending
No. 1634 an invitation to Mrs. Messing and her sons with respect to the property
being considered in. Tentative Tract No. -1634. Upon motion by Councilman
B.Smith, seconded by Councilman Pinkley, and carried the letter was held
for later in the meeting when Tract No. 1634 would be discussed.
Refund of A communication was read from California Sewer Construction Co. requesting
Permits a refund on permits not used for sewers, along with the recommendation
of the street Foreman recommending a total refund of $352.15 for permits
not used. After discussion it was moved by Councilman Pinkley, seconded
by Councilman Meyers and carried that the City Manager study how much the
City's cost.to write the permits, etc. and whether this refund should be
granted, and report back at the next regular meeting.
Street signs A communication was read from Mr. Arch D. Reid, 1597 Riverside P1. requesting,
information -on new street signs. Upon motion by Councilman B.Smith, seconded
by Councilman Meyers, and carried the communication was ordered received
and filed.
A communication was read from James and Maybell Hastings, 15526 Jacana Dr.
La Mirrda, California,regarding a possible change in the 'E. 17th Street
Improvement District, so that Westminster Avenue from Palmer to 15th St.
be made a 50 ft. street. After discussion it was moved by Councilman
Pinkley, seconded by Councilman J.SlIith, and carried that the communica-
tion be referred to the City Thgineer, and City Attorney for study and
report back at the next regular council meeting.

A communication was read from Guy W. Finney, 1519 Westminster St. dated
December 21, 1957 stating he felt the E. 17th St. Improvement District
would prove to be a burden. A communication dated January 2, 1958 stat-
ing he wished to withdraw'the 25 ft right-of-way dedicated to the City
was also read from Mr. Finney. After discussion it was moved by Council-
man Pinkley, seconded by Councilman B.;Smi.th and carried that the two com-
munications be received and filed.
A communication was read from L. A. Burgess, 1787 Orange Avenue, re-
questing to retain the 50 ft. driveway now existing.. After discussion
it was moved'by Councilman B.,`Smith, seconded by Councilman Pinkley and
carried that the communication be referred to the City -ENgineer, and a
report to be returned at the next Council meeting.
A communication was read from Ernest K. Hartman, 1350 West Bay Avenue,
Newport Beach, California, regarding his property on E. 17th St. and
Orange Avenue stating that he wished the curb on 1E. 17th 'St. to remain
where it is, instead of being moved. After discussion it was moved by
Councilman B.Smith'seconded by Councilman Meyers, and carried that the
claim be disallowed and the communication received and filed.
A communication was read from the Right of Way Department concerning
Ralph and Ethel R. Barnes, 134 E. 19th St. requesting that survey stakes
on the front be replaced at the time of construction. On motion by
Councilman J.Smith, seconded by.Councilman Pinkley and carried the com-
munication was ordered received and filed and a letter written to the
Barnes stating that the front stakes will be replaced at the time of
construction.
A communication was read from the Right of -Way Department concerning
Fmily a. Moorhouse, 2191 Miner Street requesting that a blank sewer
house connection be constructed from the existing sewer main to her
property line on the northerly side and the elevation of the flow line
kept at a minimum depth.. Upon motion by Councilman B.Smith, seconded
by Councilman Pinkley, and carried the communication was ordered received
and filed and aletter written to Mrs. Moorhouse stating that her request
will be i.ncorporatedin the ppoposed plans of the West Victoria Street
Improvement District.
A communication was read from the Right of Way Department concerning
Lena Leoni and Delores A. Lane requesting that existing palm trees be
moved back of the new right of way at the time of construction. Aftbr
discussion it was moved by Councilman B.Smith, seconded by Councilman
Pinkley and carried that this be tabled until the next regular meeting
to permit study and a cost estimate.
Departmental Reports On motion by Councilman Pinkley, seconded by Councilman Meyers, and carried
the Calendar Year Report of the Poundmaster and Building Department; the
monthly reports for December of the Planning Department, Police, Civil=
Defense, 'Street, Fire, Building., Poundmaster; and the report of the
Director of Finance for three free permits, were approved and ordered
received and filed.
Final TR'act,3297 The City Engineer presented the final map of Tract No.`3297, submitted
in the name of Crown Homes, Inc. for the subdivision of 3.50 acres,
into 18 lots, together with a certified check in the_:,amount of $1,496.25
a bond in the amount of $16,900.00 and signed Agreement.
Thereupon Councilman B.Smith, moved the adoption of Resolution
RESOLUTION NO. 433 No. 133, being A RESOLUTION OF THE CITY OF COSTA MESA APPROVING THE MAP
OF TRACT NO. 3297 AND ACCEPTING THE'STREETS AND ALLEYS SHOWN THEREON
FOR PUBLIC USE FOR HIGHWAY PURPOSES AND AUTHORIZING THE CITY CLERK TO
SIGN;SAID MAP AND -AUTHORIZING THE MAYOR AND CITY CIERK TOSIGN THE
AGREK4M. The motion was seconded by Councilman J.Smith, and Reso-

Opening
The City Manager requested that. he be authorized to have a notice published
of bids
inviting bids for work on the project, and recommended the opening of bids
on February 3, 1958., On motion by Councilman Pinkley, seconded by Council-,
man B.Smith, and carried the City.Manager was authorized to advertise for
bids.

Tentative Tract Tentative Tract Map No. 1634 in the name of Everson and Walker to sub -
#1634 divide property between Walnut Avenue and -E. 20th Street, and between
Everson and Walker Santa Ana Avenue and Raymond Avenue into 48 parcels was presented. Mr..
Eastman, 125 Broadway, representing Mrs. Messing and her sons, owners
of the property was present and requested approval of the Tentative Tract
even ghough the school had requested a meeting with the Messings on.
Wednesday, January 8. 'Mr. Carl Boswell, Superintendent of Schools was
present and stated that he had contacted the Messings inviting them to
meet with the school board to discuss this land for a possible future
school site. Mr. -Everson, developer, and Mr. Warren Messing, 630 Tustin
also spoke in favor of the tract. Mr. Messing stated that he and his
brother would meet with the school board as requested. Mr. Everson
requested that action be taken as soon as possible as they had loan
committments. After further discussion'it was moved by Councilman
B.Smith that decision on this Tentative Tract No. 1634 be delayed
until Thursday morning, January 9, 1958 at 7:00 a.m. The motion was
seconded by Councilman Meyers, and carried by the followi.rg roll call
vote.

VARIANCE N0. 431 Variance Application No. 431, being the application of First Church of
First Church of Christ Scientist, 427E. 17th Street , Costa Mesa to permit future land
Christ .scientist use as a church building site approximately 531 ft south of centerline
of Hamilton Street on the West side of Pomona was presented with the
recommendation of the Planning Commission for approval subject to the
approval of the church'Master plan showing the plot plan, parking, build-
ings, etc and that there be a dedication of 20 ft. at the rear of this
property to the City of Costa Mesa for street purposes. Upon motion
by Councilman B.Smith, seconded by Councilman Meyers, and carried the
Council concurred with the action of the Planning Commission.
PERMITS The application of Richard Lawrence dba Dicks H`orse'shoe was approved and
ratified on motion by Councilman B.Smith, seconded by Councilman J.Smith
and carried.
The application of Pacific Outdoor Advertising Co. 4647 Long Beach Blvd.,
Long Beach 5, California to erect billboards at 1640 Newport, 1578 New-
port (2 opposite sides of lot) and 433 W. 19th St. was presented. After
discussion it was moved by Councilman B.Smith, seconded by Councilman
Pinkley and carried that action be deferred to the next regular meeting
to permit the Council time to study the locations.
WR 132 Warrant Resolution -No. WR 132, including Payroll No. 84 was presented

CITYMANAGERS Upon motion by Councilman B.Smi.th, seconded by Councilman P7nkley and
REPORT carried, the City Manager was authorized to receive and hold in trust
a sum of,money from a number of property owners on Cecil Place, against
the completion of an improvement on their street at the same time the sub-
division across the street commences their improvement with payment of
this money to the contractor, as selected by the property owners, upon
the completion and inspection of the work. The property owners to be
instructed in writing that they will have to pay their regular assessment
share when the improvement district is started, credit to be given for the
improvements now being put in.
