REGULAR MEETING OF THE CITY COUNCIL
CITY OF CCESTA MESA
Januaiy 20, 1958
The City Council of the City of Costa Mesa, California, met in regular
session at 7:30 p.m., January 20, 1958 at the City Hall, 695 W. 19th
St., Costa Mesa. The meeting was called to order by the Mayor followed
by the Pledge of Allegiance to the Flag and Inovcation by Reverend
Crone.
ROLL CALL
Councilmen Present: J.Smith, Meyers, B. Smit., Nelson

Officials Present: Chief Deputy City Clerk, City Manager, Assistant
City Manager, City Attorney, City Engineer, City Treasurer,

ORAL COMMUNICATIONS
The Mayor inquired if there were anyone present wishing to speak on
any item not on the agenda. Thereupon Mr. Leland Edwards, 273 Monte
Vista, presented a petition with 110 signatures protesting the increase
of city taxes and -any increase in the budget for 1958 and 1959.
Variance No. 428
Mr. Frank Bissell requested.the Council to reconsider Variance No. 428
Klyn
for L. J. Klyn to permit a 01.rear yard setback at 375 E. 17th St.
-irfnich had previously been denied by the Planning Commission and City
Council because of the desire to have an alley at the rear of the property
'
Mr. Bissell stated -that Mr. Klyn would sign an agreement with the City
that he would tear the building down, at no cost to the city, at such
time that the proposed alley would go through. After discussion it
was moved by Councilman B.Smith, seconded'by Councilman Meyers that the
action on Variance No. h28 on January 6, 1958 be rescinced and the
variance be approved subject to the receipt by the City of an agreement
whereby the applicant agrees to remove said portion of the building, at
his own expense at such time that the ally goes through, and that he
deed ten feet for right of -way for said alley. The motion carried by the
following roll call vote:

Upon motion by C. B.Smith, seconded by Councilman J.Smith, and carried
the minutes of the meeting of January 6, 1958 were approved aa:-, written
and previously mailed out.
Upon motion by Councilman B.Smith, seconded by Councilman J.Smith, and
carried the minutes of the meeting of January 9, 1958.were approved and
written and previously mailed out.
WRITTEN COMMUNICA-
A communication was read from Mrs. Joseph Bayless, Build a Better Com -

munity Chairman, of the Costa Mesa Junior Friday Afternoon Club request-
ing the Mayor to proclaim March 12 as Arbor Day. On motion by Councilman
J.Smith, seconded by Councilman Meyers, the letter was received and or -

Evans Claim
A claim for Damages by Donald D. and Nelda E. JEvans against the City of
Costa Mesa was presented. Upon motion by Councilman J.Smith, seconded
by Councilman B.Smith, and carried, the claim was disallowed.
Communications were read from the City of Seal Beach (Resolution #976)
-Executive Office of the President, Office of the. Vice President, and
the Committee on Standard Metropolitan Areas, stating that a study is
being made on securing Orange County recognition as a Metropolitan Area.
Upon motion by Councilman J.Smith, seconded by Councilman Meyers and
carried that the communications be received and ordered filed.
Councilman Pinkley entered the meeting and took his seat.
Church. St.
A petition containing 111 signatures was presented requesting the City to
Rezoning
establish control over the commercial zoning between 19th and 20th Streets
and Newport Boulevard, and Church Street. It was.moved by Councilman B.
Smith, sedonded and carried,that the petition be received and ordered
filed, and that the petitioners be informed that the City Council has
instructed the Planning Commission to make a study'of this area.
W. 17th St.
A communication was read from.Wm. H. Warnecke, 635 W. 17th St. protesting
the surfacing of 'W. 17th St. as included in the West 19th Street Improve-
ment District. After discussion it�was moved by Councilman J.Smith,

City Engineer Final Tract 3287, being a tract for Buccola Investment Co. was presented
seconded by Councilman B.Smith, and carried that the communication be
received and filed, and Mr. Warnecke notified that thisstreet has not
been accepted by the 'City, and the contractor must make patches in the

surface so that the street will be useable until such time that it is
completely resurfaced.
Santa Ana An-
A communication from the Orange.County Boundary Commission, notifying
nexation
the City .of the proposed annexation of territory to the City of Santa
Ana (Main and Newport N.E. of Annexation) was ordered received and
filed, upon motion by Councilman B.Smith, seconded by Councilman Meyers,
and carried.,
REPORTS
A resolution withdrawing from the County lighting District all the

City Engineer Final Tract 3287, being a tract for Buccola Investment Co. was presented
Plumer St. The City Manager reported that upon checking the property at the rear
Grade of the Plumer Street properties that there will be a difference in the
grade but that the property will drain to 19th Street and not Plumer.
This is 'on private property and the City has no jurisdiction on private
property.
Variance Fees The City Manager gave the following report concerning the_cost of Vari-
ance Fees:
Direct Material Cost $8.90
Labor 16.45
Overhead 7.61
Cost per Variance7 2.96
After discussion it was moved by Councilman Pinkley, seconded by
Councilman B.Smith and carried that the request of the Schools to
waive Variance Fees on proposed school sites be denied due to the cost
as stated above.
Upon motion by Councilman J. Smith, seconded by Councilman Pinkley, and
carried the City Manager was directed to make a study of variance fees
in other cities and report back to the Council.
Permit Fees The -City Manager reported that because part of the permit refunds for
the California Sewer Construction Co. are charged by the Sanitary District,
no report was completed. Thereupon it was moved by Councilman Pinkley,
seconded by Councilman,Meyers and carried that the report be given at the
next regular Council Meeting.

Upon the recommendation of the City Engineer, it was moved by Council -

Burgess The City Engineer reported that he investigated the driveway request

be done at this time. Thereupon it was moved by Councilman B.Smith,
seconded by Councilman Pinkley and carried that the report of the
Engineer be accepted.
Moving of The City Manager reported that no decision had been reached as to the
Palm Trees moving of the palm trees for Lena Leoni. Thereupon it was moved by
Councilman J.Smith, seconded by Councilman Pinkley, and carried that this
be given further study.
Pacific Out- Upon motion by Councilman Pinkley, seconded by Councilman B.Smith that

It was the request of the Council that the City Clerk notify
the Pacific Outdoor Advertising that the Council requests that they
please use discretion as to what is advertised inasmuch as one of
the billboards is located directly across.from the Church.
Upon motion by Councilman Pinkley, seconded by Councilman Meyers, and
carried the City Manag6r was instructed to investigate this type of
sign in other communities
Westminster The City Attorney reported, that an appraisal is being made of the house
Avenue that must be acquired for the bxtension of Westminster Avenue and no
report is available as to the cost. Thereupon it was moved by Council-
man B.Emith, seconded by Councilman Pinkley, and carried that this
report be given at the next regular meeting.
Bldg. -Moving Building Moving Application -No. 173, for Ray I. Cozad to move a building
#173 -Amended from 279 E.'17th 'St. to 1710 Santa Ana Avenue was presented. Mrs. Mil
Cozad Walker, 300 E. 17th 'St., and Roger -Watson spoke from the floor. Mr.
Watson requested that consideration be given for the possibility of
acquiring an alley at the rear of this property. After discussion it
was moved by Councilman B.Smith, seconded by Councilman Meyers and
carried that Building Moving Application No. 173 -Amended be granted with
the recommendations of the Planning Commission, and that 22 feet be
dedicated to the City at the rear of the property fat furture alley
purposes, but that.this 22 feet be counted for the purposes of building
setback.
Rezone Petition #42 Rezone Petition No. 42 for J. IWarren Lennon, 474 Hilledge Drive, Laguna
J. Warren Lennon Beach to rezone the south side of Wilson Street, between College and
Fairview from R4 to R2 was presented; Upon motion byCouncilman B.Smith,
seconded by Councilman Meyers, and carried public hearing was set for
February 3, 1958 at 7:30'oeclock p.m. or as soon thereafter as possible
in the Council Chambers.
Tentative Tract Tentative Tract Map No. 1644, in the name of Willard L. Killion, 3400
No. 1644 - Killion Via Lido, Newport Beach, California, for the subdivision of property
south of Baker and east of College into 21 parcels, was presented. On
motion by Councilman B.:Smith, seconded by Councilman Pinkley, and car-
ried Tentative Tract -No. 1644 was approves subject to the recommendations
of the Planning Commission on file in the office of the City Clerk.

Variance ##432 Variance application No. 432 being the application of Card Coisstruction
Card !Construction Co., Inc. 1700 W. Coast Highway, Newport Beach to permit 18 units on
3,000 sq. ft. of land was read with the recommendation of the Planning
Commission for denial. Applicant telephoned City Clerk for withdrawal
of this Variance. Thereupon it was moved by Councilman Pinkley, seconded
by Councilman Meyers, and carried that the application be withdrmm
as requesthd by the applicant.
Variance #133 Variance Application No. 433, being the application :of Ernie Phillips,
Phillips 20201 Acacial; Santa Ana Heights, Santa Ana, California, to permit the
growth and culture of miniature cacti and succulent plants for propa-
gation for wholesale business was presented together with the recom-
mendation of the Planning Commission for denial. A communication re-
questing withdrawal of this application was read from the applicant.
Upon motion by.Councilman B.Smith, seconded by Councilman J.Smith,
and carried the application was withdrawn as requested by the appli-
cant.
Variance ##434 Variance Application No. 434, being the application of Lucille Drew
Drew 2072 Orchard Drive, Santa Ana, California, to permit three additional
spaces for an existing trailer park was presented, together with the
recommendation of the Planning Commission for approval. Upon motion

the Council concurred with the action of the P-lgnning Commission.

The application of the Mesa Club for a Public IDance Hall at 1818
Newport Blvd. was granted on motion by Councilman Pinkley, seconded
by Councilman Meyers, and carried.
WR 133 Warrant Resolution No. WR 133, including Payroll No. 85 was presented
for approval. On motion by Councilman Pinkley, seconded by Councilman
Meyers, W.R. No. 133 was adopted by the following roll call vote:

Orange County Airport Discussion was held on the proposed expansion of the Orange County
RESOLUTION NO. 438 Airport. The City Manger reported that three excellent points should
be considered: 1) New flight route over Back Bay.: 2) New 2500 ft.
runway. 3) Control tower to be under C.A.A. After discussion it
was moved by Councilman B.'Smith, seconded by Councilman Pinkley that
the City be in favor of the proposed plans and Resolution No. 438,
being A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA
APPROVING THE PROPOSED IMPROVKvMT AND EXPANST ON OF THE ORANGE COUNTY
AIRPORT was adopted by the following roll call vote:
AYES: Councilmen J.Smith, B.Smith, Pinkley, Meyers, Nelson
NOES: Councilmen - None
ABSENT: Councilmen - None
