The meeting was called to order by the Mayor followed by the Pledge of Allegiance to the Flag and Invocation by Reverend Gabler. ROLL CALL Councilmen Present: B..Smith, J.Smith, Meyers, Pinkley, Nelson Councilmen Absent-' - None Officials Present: Chief Deputy City Clerk, Asst. City Manager, City Engineer, City Attorney, Director of Finance, Planning Commissioner Tobias MINUTES Upon motion by Councilman B.`Smith, seconded by Councilman J.`Smith, and carried the minutes of the meeting of January 20, 1958 were approved as written. OPUING OF BIDS The Mayor announced that this was the time and place set for the opening No. Costa Mesa of bids for the fabrication, transportation, labor and equipment required Storm Drain for the delivery of approximately 2600 feet of 72 inch reinforced concrete pipe. The Clerk reported that three bids had been received. The bids were then publicly opened, read, and declared as follows: NAME AMOUNT CONCRETE COMUIT COMPANY $ 6 7;777. o o UNITED CONCRETE PIPE CORP. 703200.00 AMERICAN PIPE & CONSTRUCTION CO. 703070.00 Reference is hereby made to the bids on file with the City Clerk for all details as to unit prices and kind and class cf work to be done. Upon motion by Councilman B.Smith, seconded by Councilman Pinkley, and carried the bids were referred to the City �Engineer for checking and report later in the meeting. PUBLIC HEAR- The Mayor announced -that the hour of 7:30 Qnclock p.m. having arrived, this ING was.the time and place fixed by the City Council of the City of Costa Mesa Rezone #42 for public hearing of Rezone -Petition No. 42, and declared the hearing open. J. Warren Lennon The Clerk read the recommenlation for approval of the petition by the Planning Commission, subject to the understanding that the applicant, before this petition is considered by the City Council will offer a deed restric- tion for one living unit for each 1500 sq. ft. of land area, with two useable off street parking spaces for each unit. The Clerk reported that the required deed restriction had been received and no written protests had been received. There being no written communi- cations the Mayor asked if there were anyone present wishing to speak. Mr. Phil Sullivan was present in behalf of the applicant, Mr. J. TATarren Lennon, 474 Hilledge Drive. There was discussion on the text of the deed restric- tion and Mr. Sullivan was asked to reword a portion of it, and so agreed. All persons having been given full opportunity to be heard and no one ewishing to speak, it was moved by Councilman B.Smith, seconded by Councilman Meyers and carried that the meeting be closed. ORDINANCE NO. 193 Ordinance No. 193 being AN ORDINANCE OF THE CITY OF COSTA MESA AMENDING `SECTION 3.2 OF ARTICLE III OF ORDINANCE NO. 32 OF THE CITY OF COSTA MESA, CALIFORNIA, ENTITLED "AN ORDINANCE OF THE CITY OF COSTA MESA ESTABLISH- ING LAND CLASSIFICATIONS IN DISTRICTS WITHIN THE INCORPORATED TERRITORY OF THE CITY OF COSTA MESA, REGULATING THE USE OF PROPERTY THEREIN, ADOPTING A MAP OF SAID DISTRICTS, DEFINING THE TERMS USED IN THIS ORDINgICE PROVIDING FOR THE ADJUSTMENT, ENFCR CEMENT AMID AMENDMENT HEREOF, PRESCRIBING PENALTIES FOR VIOLATION HEREOF, AND REPEALING ORDINANCES AND PARTS OF ORDINANCES INCON- SI"STENT �TITH AND IN CONFLICT HER15JITH," changing the zoning of The East 100 ft. of Lcts 9 and 28, all of Lots 8 and 29 and the West 35 feet of Lots 7 and 30, Tract No. 57, from R4 to R2 was presented, and on motion by Councilman Pinkley, seconded by Councilman'Meyers,.Ordinance No. 193 gas given first reading and passed to second reading by the following roll call vote: AYES: Councilmen J.Smith, B. Smith, Pinkley, Meyers, Nelson NOES: Councilmen - None ABSENT: Councilmen - None Upon motion by Councilman B.Smith, seconded by Councilman Pinkley, and carried the recommendation of the Planning Commission on Rezone Petition No. 42 were upheld with the stipulation the wording in the deed be "There shall be a maximum of one (1) unit to every fifteen hundred (1500) square feet with two (2) parking spaces for each unit", and the recorded document placed in the hands of the Cit�r Clerk, fees paid by the applicant. J CHANGE IN ORDER Upon motion by Councilman Pinkley, seconded by Councilman Meyers, and OF BUSINESS carried the Oral and Written Communications were deferred in the order of business until after routine business had been considered. REPORT'S On motion by Councilman Pinkley, seconded by Councilman J.Smith, and carried the following departmental reports for the month of January were received and ordered filed: Building, Planning, 'Street, Fire, Pourid- master, Police Civil Defense, Director of Finance -free permits. Inasmuch as the City ?Engineer was checking the bids his report was deferred until he returned to the Council Chamber. The City Attorney stated that inasmuch as the items he had prepared had not been placed on the agenda, he would present them at the end of the meeting with the communications. REFUND'S TO CALIFOR- The Assistant City Manager reported that a study of the costs on Plumbing NIA 35TI. CONSTRUC- Permits had been made and it cost the City $3.50 to process such a permit. TION Thereupon, after discussion, it was moved by Councilman B.Smith, seconded by Councilman J.Smith that the California Sewer Construction Co. be re- funded the excess on each unused plumbing permit over $3.50. The motion carried by the following roll call vote: AYES: Councilmen J.Smith, B.Smith, Pinkley, Meyers, Nelson NOES: Councilmen - None ABSENT: Councilmen - None 'WESTMINSTBiAVE. The Attorney reported that he and the City .Engineer had received a cost estimate on the property that must be secured to widen Westminster Avenue and recommended that this be not included in 1911 Act proceedings, but that if the Council wished to widen the street it pay out of City funds for the acquisition. Thereupon it was moved by Councilman B.Smith, seconded by Councilman Pinkley and carried that no action be taken at this time. REZONE PETITION Rezone Petition No. 38, for George W. Powell, 2263 Fairview Road, to NO. 38 rezone from R4 to Cl twenty-five parcels on both sides of Fairview Powell Avenue from the north property line of Fairview Farms, south approxi- mately 1200 feet to the C2 zone on Fairview Avenue, was presented. On motion by Councilman Pinkley, seconded by Councilman Meyers, and carried public hearing was set for February 17, 1958 at 7:30 orclock p.m. or as soon thereafter as possible in the Council Chambers. ANNEXATION #22 A request for annexation from Elwood F. Phillips. 11.5 N. McGadden P1. Baker `St. #4 Hollywood, California to annex a parcel of land of approximately four acres at the southeast corner of the intersection of Harbor Blvd. and Baker St. was presented. Upon motion by Councilman Pinkley, seconded by Councilman Meyers and carried the propsed annexation was ordered re- ferred to the Orange County Boundary Commission. Thereupon Councilman Pinkley moved that the contract be awarded to Concrete Conduit Co. and the Mayor and City Clerk be authorized to sign said contract in behalf of the City. the motion was seconded by Councilman.Neyers and carried by the following roll call vote: AYES: Councilmen J.Smith, B.Smith,, Pinkley, Meyers, Nelson NOES: Councilmen - None ABSENT: Councilmen - None (i Q.P Harbor Boulevard Upon motion by Councilman B.`Smith, seconded -by Councilman J.Smith, and Baker Avenue carried the installation of water pipe lines on Baker Avenue and Harbor Water Line accepted Boulevard by the Graven Co., having been completed in accordance with plans and spedfications, was accepted as recommended by the City Engineer. Bond Exonerated Upon motion by Councilman Pinkley, seconded by Councilman Meyers, the bond Tract 2310 on Tract No.2310 was exonerated. No. A communication was read from the Costa Investment Corporation 5656 W. 3H 2956 extended Zt., Los 'Angeles 36, California, requesting an extension of time for ap- proval of Tentative Map No. 2956 for one year from February 18, 1958. Upon motion by Councilman B.Smith, seconded by Councilman Pinkley, and carried Tentative Tract No. 2956 was extended for one.year from February 18, 1958. Guard cover- Discussion was held on the possibility of protecting all new catch basins ings for in the West 19th St. Improvement District with more bars, so that a small Catch Basins child would not be able to get through the openings. The City Engineer informed the Council that he would suggest bars 12 inches apart, but that these could only be installed with the approval of the contractor. There- upon it was moved by Councilman J.Smith, seconded by Councilman Meyers and carried that the contractor for the W. 19th St. Improvement District be contacted and arrangements made to install extra bars in all catch basins as soon as possible. - VARIANCE #302A Variance application No. 302 (amanded) being the application of Mike M. Dmytrowetz Dmytrowetz, 396 Bay Street, to permit the sharpening of lawnmowers, etc as a home occupation at 396 Bay Street, was read with the recommendation of the Planning Commission for approval for a period of one year. Upon motion by Councilman Pinkley, seconded by Councilman J.Smith, and carried the action of the Planning Commission was upheld and the application ap- proved. VARIANCE #435 Variance application No. 435, being the application of Burton H. Terhune, fir. Terhune 1831 Newport Blvd. to permit use of property at 127 E. 17th ;St. by the Christian Science Church was presented for three meetings a week, and the daily use of a portion as a reading room. This is a temporary (one -or two years) plan to permit the church to acquire land and build a church build- ing. -and received the recommendation of the Planning Commission for approval for a one year period under the same terms and conditions as were placed on the former Variance No. 265, ie. that adequate and sufficient useable off-street parking be provided at the side and rear of this building at the ratio of one parking space for every three seats and that the church police its own parking area. Upon motion by Councilman B. Smith, seconded by Councilman Pinkley, and carried, the application was approved as recom- mended. VARIANCE #436 Variance Application No. 136, being the application of Fred R. Tjaden 2012 Tjaden - Meyer Place to permit 8 units on 22, 412 sq. ft..and a rear yard encroach- 24 dent to 10 feet of rear p ropertylin.e at 2012 Meyer Place was read, with the recommendation of the Planning Commission for approval in accordance with the plot plan submitted with the application with the off-street parking property designated. Upon motion by Councilman Pinkley, seconded by Councilman Meyers, and carried, the action of the Planning Commission be upheld, and the application granted. VARIANCE #437 Variance application No. 437, being the application of Blanchard FE. Bishop .Drive, La Habra, California, to permit one 51 sign to advertise Trailer Park at 132 W. 1daTi.lson Street, recommendation of the Planning Commission for approval. man B.'Smith, seconded by Councilman Pinkley and carried the Planning Commission was upheld. VARIANCE No. 438 The Hale Co. = Omar Blanchard, 330 x 1-01 illuminated was read with the On motion by Council - the action of Variance application No. 138, being the application of the Hale Company, 1771 W. Lincoln, Anaheim, California, to permit continued use of existing signs and temporary real estate office for one additional year as granted in Variance No. 128 and its amendment to advertise sale of homes in Tracts No. 2671, 2672, and 2132, was presented with the recommendations of the Planning -Commission for approval for one year or when the sale of the homes is accomplished, whichever is sooner. The property owners at 1451 and 1445 Shamrock Lane were present and stated that the 100 ft. sign had bloom down causing property damage. After discussion it was moved by Councilman J. Smith, seconded by Councilman Meyers, and carried that action be deferred to the next regular meeting to permit the Building Official to inspect all the signs and make a detailed report. VARIANCE No. 439 Variance application No. x.39, being the application of Thomas.W. Johnson, T. Johnson 901 W. 19th St., to permit the establishing of a darkroom in a garage for a mail order business of processing home movies and T. V. commercial - film 'was read with the recommendation of the Planning Commission for ap- proval on the following conditions: 1) for a period of one year. 2)no retail sales, mail order only, 3) no employees, 4) no signs 5) approval of fire department. Upon motion by Councilman Pinkley, seconded by Council- man J.'Smith, and carried actioni:was deferred to the next regular meeting to permit the Building and Fire Departments to make an inspection and bring a detailed report -b the Council. VARIANCE N0. 441 Variance application No. 441, being the application of John Sinki.ewicz 'Sinkiewicz 225 Tustin. Avenue, Newport Beach, California to permit building of a one bedroom duplex on corner lot, was read, with the recommendation of the Planning Commission for approval on the condition that there be not less than six adequate and property marked off-street parking spaces. Upon motion by Councilman B.`Smith, seconded by Councilman Meyers, an VARIANCE N0. 41i.5 Variance application No. 445, in the name of Archie Hammond, 1982 West - Hammond minster to permit a front yard setback of 42 feet from the centerline of Esther St. was presented with the recommendation of the Planning Commission for approval. Upon motion by Councilman J. Smith, seconded by Councilman Pinkley, and carried the action of the Planning Commission was upheld. d carried the action of the Planning Commission was upheld. At this point the Mayor declared a ten minute recess and the meeting re- convened at 9:05 p.m. -WRITTEN COM14UPdI- A communication was read from Mrs. Helen A. Collins, 2732 Palmer stating CATIONS that she felt that the charging of a dog license for two years was not fair, especially if a person had an older dog, and it may die with the period. The City Attorney informed Mrs.,CoZlisn that if any dog should Dog Licenses die within the even numbered year, a refund for the odd numbered year would be returned by the Finance Department upon presentation -of evidence of the dogs _ death. Thereupon it was moved by Councilman J.Smith, seconded by Councilman PInkley, and carried, that the letter be received an d filed. A communication was read from M. F. Bundy 228 Ogle St. requesting a refund of $20.00 on Bia.s:lding Application No. 634., paid January 27, 1958 due to it not being possible to make the necessary corrections, together with the Refund recommendation of the Building Official for a 85% refund, or $17.00, - Building App. provided all the work that has been done without permit be -removed. After discussion it was moved by Councilman B.'Smith, seconded by Councilman Meyers, and carried that the refund be granted, with -L-he stipulation as set forth above. Smith, B.�Smith, Meyers, Nelson NOES: Councilman Pinkley ASSENT: Councilmen - None 72 Fire and Health A communication was read from Harry 'EridC Corona, California stating that Complaint the property adjoining his home at 214 'E. Camellia Lane has debris and rubbish that is a fire and health hazard. It was moved by Councilman Pinkley, seconded by Councilman Meyers, andcarried, that the communica- tion be referred to the Fire and Health Departments for report back at the next regular meeting. A communication was read from Walter Mellinger, 854 Joann Street, re- questing the Council to confider covering the storm drain ditch between the Sunshine Homes and the Fairview Hospital.` It was moved by Council- -man Pinkley, seconded by Councilman Meyers, and carried that the letter be received and filed and Mr. Mellinger advised that the North Costa Mesa Storm Drain will take care of this ditch, and that the contract for the pipe had been awarded. A communication was read from the Orange County Boundary Commission notify- ing the City of the proposed annexation of territory to the City of Santa Ana (Huntzinger and Harbor N.E. of Annexation). Upon motion by Council- man Pinkley, seconded by Councilman J.Smith, and carried, the communica- tion was ordered -received and filed. A communication was read from. Raymond N. Rapp, dated January 30, 1958, together with a petition bearing 35 signatures protesting the conditioh of the new streets in the W. 19th Street Improvement District. Gorman, Charles Kimbrough 680 W. 18th St.' John G. McDonald (The latter two spoke on a petition presented at the second hearing on the W. 19th St. Improvement District.requesting the lowering of a sewer line) Mr. Shepins,'670 W. 18th, Mr. Donald'Rapp, 1839 Pomona, Mr. Mario Durante, i-833 Pomona, Mrs. Durante, 1833 Pomona, Mrs. Isabel Lawrence, 1849 Pomona. Upon -motion by Councilman J.Smith, seconded by Councilman B.Smith, and carried the Council requested the petition referred to by Mr. McDonald to be .brought back to the Council at the next regular meeting;. After discussion it was suggested by the City Attorney that the citi- zens -who signed the petition select a committee to represent them with - ,the Council on inspections, etc. on the streets, and that notice be given to the City Manager of the members of the committee, and the name and phone number of one,member who may be contacted to notify them of meetings and action. After further discussion it was moved by Councilman B.Smith seconded by Councilman Meyers and carried that the five Councilmen constitute a committee of the whole to study the conditions, to meet with the com- mittee of citizens, inspect the work being done by the contractor, and supervise tests taken of the thickness of the surfacing. PERMITS The appliction of Confidential Research Bureau, 920`S. Main St., Santa Ana to operate a detective agency and to provide guards for business firms was granted on motion by Councilman Pinkley, seconded by Councilman J. Smith, and carried. The application of Statewide Sp ecial Patrol and Guard Service, 8172 Holt Street, to operate a special patrol and guard service was granted on motion by Councilman Pinkley, seconded by Councilman Meyers, and carried. A request for a permit for the Campus Estate Homeowners, Inc. to hold a dance at the American Legion Hall, on February 15, 1958 was approved, fee waived, on motion by Councilman J.Smith, seconded by Councilman Pinkley, and carried. W.R. #134 Warrant Resolution No. W.R. 1343 including Payroll No. 86 was presented for approval. On motion by Councilman B.Smith, seconded by Councilman Meyers, WR No. 134 was adopted by the following roll call vote: AYL+'S: Councilmen J.Smith, B.Smith, Pinkley, Meyers, Nelson NOES: Councilmen - None ABSENT: Councilmen - None `Subdivision #181 The City Attorney presented"Subdivision Appliction No. 181 for Clarence R. Dunham Dunham, stating that the Planning Commission had recommended that curbs and gutters, and sidewalks be installed by the applicant along the north- easterly 66 feet of Parcel A at such time as required by either the Im provement District or the Subdivision going in to the Southwest. After discussion it was moved by Councilman B.Smith, seconded by Councilman Meyers that the application be agroved upon the receipt by the City Clerk of a bond in the minimum amount of $600.00 guaranteeing that curbs, gutters, and sidewalks will be put in along the Northeasterly 66 feet of P-wel A. at the o- aners expense, on or before June 30, 1960. The City Attorney presented the deletions and additions as recommended by the City Attorney and City Engineer for the E. 17th Street Improve- ment District. Inasmuch as the Council wished to give this further study actinn was delayed to Monday, February 10, 1958 at 7:30 p.m. The Mayor presented the request of the Welcome Wagon to secure a letter from the Mayor welcoming new citizens to Costa Mesa. Upon motion by Councilman B.Smith, zeconded by Councilman J.Smith, the Mayor was di- rected to write a letter of welcome to be used"by the Welcome Wagon. The motion was carried. Councilman Pinkley abstaining from voting.
