REGULAR ADJOURNED MEETING OF THE CITY COUNCIL
CITY OF COSTA MESA
March 24, 1958
The City Council of the City of Costa Mesa, California met in regular
adjourned session at 8:00 p.m., March 24, 1958, at the City Hall, 695 W.
19th Street, Costa Mesa. The meeting was called to order by the Mayor
followed by the Pledge of Allegiance to the Flag and Invocation by
Councilman John Smith
ROLL CALL Councilmen Present: J.Smith, B.Smith, Pinkley, Meyers, Nelson
Councilmen Absent: Nofie
Officials Present: Chi4f Deputy City Clerk, City Manager, LAsst. City
Manager, City Attorney, City Engineer
Because of the number of people present the Mayor waived the order of
business and asked that Variance No. 457 for Mr. E. Stroot be present4d
at this time.
VARIANCE NO. 457 Variance Application No. 457, being the application of Edgar H. Stroot,
Stroot 243 Via Ithaca, Newport Beach to permit 0' rear yard setback for commercial':_::
buildings at the northwest corner of East 17th Street and Irvine Avenue
was again presented having been deferred from the meeting of March 17,
to permit study of right of way at the rear of said property and that
along Cabrillo - Avenue, for the purpose of an alley. Mr. Stroot was present,
and stated that he had contact 15 our of 21 of the property owners on
Cabrillo Street and most of them favored an alley, and would be willing
to dedicate the ten feet needed from their property. A petition bearing
14 signatures was read from property owners on E. 17th Street, stating they
definitely wanted a twenty foot alley. The following spoke from the
floor: Howard Sawyer, 480 E. 17th St.; Buzz Cornelius, J. W. Harrison,
Morri Molko. After -discussion it was moved by Councilman Meyers,
seconded by Councilman Pinkley, and carried that Variance No. 457, be
tabled until the next regular meeting on April 7, 1958, to permit the
property owners on:E. 17th Street to meet with the Cabrillo Stre4t
property owners for the securing of rights of way for an alley. Upon
motion by Councilman B.Smith, seconded by Councilman J.Smith, and carried,
that in event that the Council does not act on Variance No. 457 at the
next regular meeting the people signing the petition will be notified when
the Council will consider the Variance.
PARKING DISTRICT A communication was read from Parking District No. 1 -requesting the City
NO. 1
Council to instruct the City Attorney to take immediate action by the
filing of law suits to collect $100.00 notes from B. H. Terhune, Sr.,
Ray R. Ainsworth and J. E. 011erman, and John E. Ballard. Upon motion
by Councilman J.Smith, seconded by Councilman B.Smith, and carried the
City Attorney was instructed to file suit in behalf of Parking District
No. 1.
ORDINANCE NO. 199
Ordinance No. 199 entitled AN ORDINANCE OF THE CITY COUNCIL, CITY OF COSTA

MESA, AMENDING ORDINANCE NO. 25 FOR THE LICENSING OF BOXING AND WAESTLING
Fees
EXHIBITIONS was presented for second reading. Following reading of the
title, Councilman Pinkley moved that further reading be waived and that it be
read by title only. The motion was seconded by Councilman B.Smith, and
unanimously carried. Thereupon Councilman B.Smith moved the adgtion of
Ordinance No. 199. The motion was seconded by Councilman Pinkley, and
adopted by the following roll call vote:
AYES: Councilmen J.Smith, B.Smith, Pinkley, Meyers, Nelson
NOES: Councilmen - None
ABSENT: Councilmen - None
Abandon Alley
A communication was read from the Planning Commission recommending the
request of Gray, Mullins, and Buchanan, to abandon that certain alley
twelve (12) feet in width in Fairview Farms Tract adjoining Lot 5 on
the north (N. of Wilson, E. of Harbor) subject to granting of necessary
easement in accordance with the findings of the kCity Engineer for drain-
age. Mr. Marvin Sears, and Mr. Fred Duckett, were present in behalf of
the applicants. After discussion the City -Attorney presented the pro-
posed Ordinance of Intention. After reading in'full it was moved by

Councilman Pinkley, seconded by Councilman B.Smith that Ordinance No.200
being AN ORDINANCE OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING ITS
INTENTION TO ORDER THE VACATION.OF A CERTAIN -ALLEY,' adopted. The

Rezone Petition The Deputy City Clerk presented Petition No. 45 submitted by Elwood F.
No. 45 Phillips, 1145 N. McCadden Pl., Hollywood 38, requesting the rezoning
Phillips of a portion of Lots 35 and 36, Fairview Farms Tract from Al to Cl.
Upon motion by Councilman Pinkley, seconded by Councilman B.Smith, and
unanimously carried, Rezone Petition No. 45 was referred to the Planning
Commission.
'Alcoholic Beverage The Deputy City Clerk read applications of New On -Sale Beer license for
Licenses Harry C. Milkes, Marie and Lloyd Salisbury for "The Lariat" at 1895 Park
Avenue (Supplemental) and for B -Y Enterprises, Inc. for "Ed-ks Hof Brau"
for New On -Sale General at 1712 Placentia Avenue. Upon motion by Council-
man B.Smith, seconded by Councilman J.Smith that the applications be re-
ceived and filed. After discussion Councilman J.Smith withdrew his second
and the MaY9r.x-declared the motion dead for the lack of a second. The
applications to be brought up at the next regular meeting, April 7, 1958•
Sound Trucks Upon motion by Councilman B.Smith, seconded by Councilman Meyers, and
carried, permission was granted the Director of Finance to issue a permit
for sound truck for the forthcoming elect$on at the rate of $10.00 per day
0:00 a.m. through 7:00 p.m., No Sundays, subject to a pproval by the Chief
of Police.
Adjournment Upon motion by Councilman J.Smith, seconded by Councilman Pinkley, and
carried, the meeting adjourned at 1Q:00 p.m.

Street Signs at
A communication was read from Summerland Land Company (Mesa Verde)
Mesa Verde
10835 Santa Monica Blvd., Los Angeles 25, California, requesting
permission to install special street signs with white letters on green
background, iridescent, instead of the regulation signs of black letters
on white background. After discussion it was moved by Councilman B.
Smith, seconded by Councilman Meyers that the request be granted. After
still further discussion, and upon notification by the City Attorney that
this change would have to be made by Ordinance, Councilman Meyers with-
drew his second and Councilman B.Smith withdrew his motion. Thereupon
on motion by Councilman B. Smith, seconded by Councilman Meyers, the
request was tabled to the next regular meeting of the Council, for the
purpose of the Council viewing both types of signs. The motion carried
by the following roll call vote:
AYES: Councilmen J.Smith., B.Smith, Pinkley, Meyers
NOES: Councilman Nelson
ABSENT: Councilmen - None
Assignment for
The City Attorney presented to the Council an Assignment from Howard B.
refund of -$3000
Lawson to secure for the City, $3,000. for the installation of an inter-
communication system in the City Hall, which had not been installed
during construction of the new City Hall. Upon motion by Councilman
B.Smith, seconded by Councilman Pinkley, and carried the Council.ac.cepted
for the City the Assignment and authorized the Mayor and City Clerk to
sign it in behalf of the City, and instruct the City Attorney to take
whatever steps necessary to acquire the $3,000.00 :for the City.
Rezone Petition
The Deputy City Clerk presented Petition No. 44 submitted by Kenneth W.
No. 44
Fether, 214 Via Ithaca, Newport Beach, requesting the rezoning of a

portion of Lot 105, Newport Heights Tract. (Tent. Tr. #1193) from R4 to
R2. Upon motion by Councilman Pinkley., seconded and unanimously carried,
Rezone Petition No. 44 was referred to the Planning Commission.
