April 7, 1958 Nance and Killey Claims The City Attorney reported that upon exatin;'Lng`_the claims of Mr. and Mrs. James F. Nance III, and L. H. Killey, he found no liability on the,part of.the City. Thereupon it was moved by Councilman Pinkley, seconded by Councilman B.Smith, and carried that the claims.of Mr. and Mrs. Nance afid tlr. Killey be disallowed. The City Council of the City of Costa Mesa, California, met in regular session at 70.30 p.m, April 7, 1958 at the City Hall, 695 W. 19th Street, Costa Mesa. The meeting was called to order by the Mayor followed by the Pledge of Allegiance.to the Flag and Invocation by Father Nevin. ROLL CALL Councilmen Present. J.`Smith, B.'Smith, Pinkley, Meyers, Nelson Councilmen Absent: None - Officials Present: Chief Dep uty'City Clerk, Asst. City Manager, City Attorney, City E+ ineer, Director of Finance Minutes Upon motion by Councilman B.Smith, seconded by Councilman Pinkley, and carried the minutes of the meeting -of March 175 19589 were approved as written and previously distributed. Upon motion by Councilman Pinkley, seconded by Councilman Meyers, and carried the minutes of the meeting of March 24, 1958, were approved as written and previously distributed. PUBLIC HEARING The Mayor Announced that this was the time and place fixed for the .Baker Street hearing of protests or objections against the proposed Baker Street No. Annexation No. 4 Annexation. The Deputy City Clerk reported that the affidavits and proof of the ptb lication of the Resolution of Intention, and the mailing of notices of adoption of the Resolution of Intention, as re- quired by law, had been made and on file in,the office of the City Clerk. The Mayor thereupon declared the hearing open. The Clerk reported that no written protests had been received. There being no written communications the Mayor asked if there -were anyone present wishing to speak. All persons having been given full opportunity to be heard, and no one wishing to speak, it was moved by Councilman Pinkley, seconded by Councilman Meyers, and carried that the public hearing be closed. ORDINANCE NO.201 Thereupon Ordinance No. 201,.being.AN ORDINANCE OF THE CITY OF COSTA MESA APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY CONTIGUOUS TO THE.CITY OF COSTA.,MESA, IN THE COUNTY -OF ORANGE, KNOWN AS BAKER STREET No. 4 ANNEXATION, was presented. , Following full read- ing of the Ordinance section by section, Councilman B.Smith moved that this constitute the first reading of the Ordinance. The motion was seconded by Councilman Meyers, and carried. RESOLUTION NO.458 Thereupon Resolution No. 458, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA ORDERING THE VACATION OF A RIGHT OF WAY KNOWI`T AIS POMONA STREET -BETWEEN BAKER `STREET AND MAPLE AVENUE IN THE CITY OF COSTA MEBA,'was presented. Koll RESOLUTION NO. 459 The City Engineer presented the final map of Tract No. 1776 submitted in the name of K. Koll, for the subdivision of 12 lots, together with a certified check in the amount of $1,007.11, a bond in the amount of $11,500.00 and a signed Agreement. Thereupon Councilman B.Smith moved the adoption of Resolution No. 459, being A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA APPROVING THE MAP OF TRACT NO. 1776 AND ACCEPTING THE STREETS AND ALLEYS SHOWN THEREON FOR PUBLIC USE FOR HIGHWAY PURPOSES AND AUTHOR- IZING THE CITY CLERK TO SIGN SAID MAP AND AUTHORIZING THE MAYOR AND - CITY CLERK TO SIGN THE AGREEMENT. The motion was seconded by Council- man J.Smith, and Resolution No. b59 was adopted by the following roll call vote: AYES. Buccola, for the subdivison of 10 lots, together with G. Buccola a certified check in the amount of $1093.19, a bond in -the airiount of $-16,850.00, and a signed Agreement. Thereupon Councilman B.Smith moved the adoption of Resolution No. 460, being A RESOLUTION 'OF THE CITY COUNCIL OF THE CITY OF COSTA MESA APPROVING TIDE MAP OF TRACT NO. 3227 AND ACCEPTING.THE;..STREETS AND ALLEYS :SHOIIN THEREON FOR PUBLIC USE FOR HIGHWAY PURPOSES AND AUTHORIZING THE CITY CLERK TO SIGN SAID MAP AND AUTHORIZING THE MAYOR AND CITY CLERK TO SIGN THE AGREEMENT. Councilmen - None RESOLUTION NO. 161 Councilman B.Zrai.th, moved the.adoption of Resolution No. 161 being Right of Way Deed A RESOLUTION OF THE .CITY COUNCIL OF THE CITY OF COSTA MESA ACCEPTING A DEED OF RIGHT OF WAY FOR 'STORM DRAIN AND UTILITY PURPOSES FOR TRACT NO. 3227 IN THE CITY OF COSTA MESA. The motion was seconded by Councilman Pinkley, and Resolution No. 461 was adopted by the following roll call vote: AYE'S: Councilmen J.Smith, B.Smith, Pinkley, Meyers, Nelson NOES: Councilmen - None ABSENT: Councilmen - None Departmental Reports Upon motion by Councilman Pinkley, seconded by Councilman Meyers, and carried the following reports were received and ordered filed: Civil Defense, Building, Police, Pound, Street, Fire, Planning, Finance for six free permits. Vehicle License Fee Upon motion by Councilman B.Smith, seconded by Councilman J. -Smith, and Apportionments carried the report from the Controller of theState of California stat- ing that the apportionments of Vehicle License Fee Revenues during the 1957-1958 Fiscal Year for Costa Mesa,was $82,914.00 was ordered received and filed. VARIANCE NO. 457 Variance No. 457, having been deferred from the meeting of March 24, E. Stroot 1958, was again presented together with a request from Mr. Stroot for withdrawal. After discussion it was moved by Councilman B.Smith, seconded by Councilman Pinkley, and carried that Variance No.' 457 be tabled. VARIANCE NO. 443 Variance Application No443, for HerbSmall9 was again presented upon Small the request Mr. Rod Earl Lippold, attorney for Mr. and Mrs, `mall, 'of and upon the receipt of the letter from Mr. and Mrs. Paul Chernow stating they had_no objection to Plan No.2, as previously recommended by the Planning Commission. Mr. Chernow viewed Plan 2, Amended, and agreed that this was the plan they would accept. Thereupon it was moved by Councilman B.Smith, seconded by Councilman Pinkley, and unani- mously carried that Variance No. 443 be approved asp er Plan No. 2 and the letter of Mr. Chernow, which states "......I would like to state herein, that I have no objections to Plan No. 2, providing there will be no doors, trash, incinerators, clotheslines,.garbage or the like, facing my front door area...." become a part of the application. 7 5 REZONE PETITION The Clerk presented Petition No. 43, submitted by Dale Ramsey requesting No. 43 the rezoning of both sides of Virginia Place from Elden to 242.041 east - Dale Ramsey erly of Newport Blvd. from R4 to Cl. Upon motion by Councilman Pinkley, sefanded by Councilman Meyers,,, -and carried, Rezone Petition No. l3 was set for public hearing on April. 21, 1958 at 7:30 o'clock p.m. or as soon thereafter as possible. Annexation request A request for annexation to the City of Costa Mesa from Milan and Laurel Underwood Underwood of Lot 227, excepting the Northerly 110 feet thereof, Newport Heights Tract was read. Upon.motion by Councilman B.Smith, seconded by Councilman Pinkley, and carried the request together with the map was ordered referred to the Orange County Boundary Commission. Bus Franchise: Upon,motion by Councilman Pinkley, seconded by Councilman Meyers, Extension and carried the request of Mr. Noack to extend the bus franchise for four months was approved,, to Aig ust 159 1958. Subdivision No.. 190 Subdivision Application No. 190, being the application of -M. L. Hoxeng Hoxeng 686 Hamilton'Street, to subdivide property, a portion of Lot 38, Tract No. 93 686 and 690 Hamilton `Street into 2 parcels having.one,.sub-standard lot, was presented with the recommendation of the Planning -Commission for approval on condition that there be a dedication for street purposes of at ;.:least thirty (30) feet from the centerline of Hamilton Street. Variance No. 330A Variance application No..330A being the application of,Mrs. Elizabeth Matranga Matranga, 279 E. 'Ihilson, Costa Mesa, to permit continuation of a small beauty shop.in the residence at 279 E®.Wilson, was read with the recom- mendation of the Planning Commission for approval for one year, no signs to be displayed, and no employees hired. Upon motion by Councilman Meyers, seconded by Councilman J.`Smith, and carried, the Council con-, carred with the Planning Commission in granting the variance. '759 Variance No. 429 Variance Application No. 129, being the application of Eugene Dugas, Dugas 447 Lido `Spud, Newport Beach, California, to permit nine units on a lot which has an area of 25,630 square feet at 2083 Thurin Avenue, was read with the recommendation of the Planning Commission for approval on the condition that the applicant provide not less than eighteen (18) usable off-street parking spaces adequately designated and marked in accordance with the City `Standards. Upon motion by Councilman B®Smith seconded by Councilman Pinkley, and carried the Council concurred with the action of the Planning Commission in granting the variance. Variance No. 155 Variance Application No. 455, being the application of Maurice Gross Gross 7907 E. 8th ;St., Downey, California,"to permit the construction of 112 units allowing not less than 1500 sq. ft. of land area per unit, was read with the recommendation of the Planning Commission for approval subject to the following conditions: 1) There be submitted a more detailed plan for the buildings and elevation. 2) Detailed plan of the streets, curbs, and gutters, entry --.ways, etc. 3) Thtt the drainage problem be worked out under the guidance of the City Engineer. 4) That the necessary off-street parking be adequately and properly laid out under the superkision of the City Engineers office. 5) That there be a dedication for street purposes of thirty (30) feet from the center- line of Bay Street. 6). That there be curbs, gutters, sidewalks, and street lights along.Bay Street. 7) That there be submitted a Ten- tative Tract Map. 8) That no building permit be issued until the above requirements are approved by the Planning Commission. After discussion it was moved by Councilman B.Smith, seconded by Councilman Meyers, and carried,.the Council concurred with the Planning Commission. Variance No. 156- Variance Application No. 156, being the application of James H. Purvis, Purvis 2233 Republic, to permit ten foot rear yard.setback for -an addition of a playroom was -read with the recommendation of the Planning Commission for approval.- Upon motion by Councilman B.Smith, seconded by Councilman J.Smith, the Council concurred wi#i the Planning Commission in granting the Variance. Variance No.. 461 Variance Application No. 461, being the application of Costa Mesa Costa Mesa ;Savings and Savings and Loan Association 1872 -Newport Blvd., to permit temporary Loan deviation from parking .requirements on Lot 4, Block A, Tract 18 was read with the recommendation of the Planning Commission for approval for a period of one year with the provision that, if during the yearts period the second story of the building is going to be utilized for leasing or renting, that the buildings on Lot 4 be removed and the lot used for parking; and likewise, at the end of the year the applicant will corm back for the review of this application. Mr. Roy Greenleaf, Jr. was present in behalf of the applicant. Upon motion by Councilman B.Saa th seconded by Councilman Meyers, and carried the Council concurred with the action of the Planning Commission for approval. VARIANCE N0. 462 Variance No. 162, being the application of R. C. Cerf, 3514 Amesbury Dr., R. C. Cerf Los Angeles, to permit t4.o 4 unit apartments on two lots 50 x 137.5 each making a total of 8 units; Amendment: and a ten (10) foot rear yard set- back was read with the recommendation of the Planning `Commission for approval as amended. Mr. Thomas Hoyd, 6710 W. Coast Highway, Newport Beach, was present in behalf•o£ the-applic ant. After discussion as to the incompleteness of the plot plan, Mr. Hoyd agreed to have available a new copy showing both units for the next meeting. Thereupon it was moved by Councilman Pinkley, seconded by Councilman Meyers, and carried that Variance No. 462 be deferred to the next regular meeting on April 21, 1958, for the applicant to secure a more complete set of plot plans. PERMITS The application of Paul R. Rickli for a juke box at Haps, 686 W. 19th Sto was granted on motion by Councilman J.Smith, seconded by Councilman Pi.nkley, and carried. The application of Beach.Amusement Co. for one baseball game and one shill pool game at the Penquin, 130 E. 17th .St. was granted upon motion of Councilman B.;Smith, seconded by Councilman J.Smith, and carried. The application of G(:Uen West Amusement Co. for one juke box at The Penquin, 130 E. 17th `St. was granted upon motion by Councilman B.Smith, seconded by Councilman J,Smith, and carried. I ,3 :a, ORAL CO MUNICA TIONS The Mayor inquired if there were anyone present wishing to speak on some subject not on the agenda. Thereupon Mr. Matthew Gloza, 525 Fairfax Dr. addressed the Council requesting their assistance concern- ing the drainage of the alley adjacent tD his property, which is deeded to the City. After discussion it was moved by Councilman B.Smith., seconded by Councilman J.Smith that this matter be'referred to the City Engineer for report back at the next regular meeting of April 21. A communication was read from Marie Karch, 610 Plumer, Costa Mesa, concerning drainage damage from adjacent property at the rear of her property. Mrs. Karch was present to discuss --,'.her problem. The City Attorney informed the Council, that inasmuch as this was not a City Street or City Property doing the damage the City had no jurisdic- tion over it and suggested Mrs. Karch contact the property owner requesting him to investigate the complaint, or her attorney., A communication was read from the Orange County Fair, requesting permission to hang overhead flag lines in Costa Mesa at designated locations for the Orange,County Fair to be held May 23 - June. 1. Flags to be installed on,May 15.and will be removed not ._later than June 4. Upon motion by Councilman Pinkley, seconded by.Councilman Meyers, and carried the permit was granted, subject to the appx•oval of the Clief of Police. Application for Alcoholic Beverage License for B -Y Enterprises, Edts Hof Brau, 1712 Placentia,Avenue for new on -sale -Gere ral was presented. Upon motion by Councilman B.Smith, seconded by Councilman.J.Smith, and carried the application was received and ordered filed. Application for Alcoholic Beverage License for Harry C. Milkes, and Marie, and Lloyd E. *Salisbury for The Lariat, for New on -Sale Beer at 1895 Park Avenue was presented. It was moved by Councilman J. Smith that inasmuch as 1895 Park Avenue was in the immediate vicinity of the Girl Scout House' Library, City Park, and Boys Club,, that the City Council shoo protest the application. The motion was seconded by Councilman Pinkley and carried by,the following roll callvotem AYES; Councilmen J.:anith, ' Pinkley, Meyers, Nelson NOES: Councilman B.Smith ABSENT.- Councilmen. - Ibne A communication was read from the State Compensation Insurance Fund stating that a substantial cost saving resulted directly.from,:the interest and active participation in accident prevention displayed by the employees of the City and the City, would receive a dividend of $2,763.71, 50.5% of the total premiums paid of the policy year ending July 1, 1957. Upon motion by Councilman B.Smith, seconded by;Council- man Pinkley, and carried the communication was received and ordered filed and a communication sent by the City Manager conveying congratu- lations from the City Council to each of -the employees in the City for having so few accidents. Transfer of Funds A communication was read from the Director of Finance requesting author- ization' disposition of two trust fund balances 1)Comm rcial Way Street Improvement, and 2) Plumer Street Improvement., into the General Fund. Upon motion by Councilman,Pinkley, transfer of these two funds to the General Fund was approved. On motion by Councilman B.Smith,..seconded by Councilman Pinkley., WR 139 was adopted by the following roll call vote.- AYES.- ote@AYES: Councilmen J.Smith., B. -Smith., Pinkley, Meyers, Nelson NOES: Councilmen ® None ABSENT.- Councilmen None The Mayor presented a communication from the Orange County Associated Chambers of Commerce requesting support for a civic beautification pro- gram that will "Keep Orange County Clean and Beautiful". It was moved by Councilman B.'Smit h, seconded by Councilman Meyers, that the communication be received and filed. IN The Mayor presented a communication inviting attendance at the _Second Orange County Governor's Town Hall Meeting on Youth to be held at Chapman College, on Thursday, April 17, 1958.
