The,meeting was called to order by the Mayor followed by the Pledge of Allegiance to the Flag and Invocation by Reverend Mr. David. ROLL CALL Councilmen Present: B.Smith.. 'Pinkley, Meyers; J.Smith Councilmen Absent: Rea Officials Present: Chief Deputy City Clerk, City Manager, Asst. City Manager, Assistant City Attorney, City Engineer, Director of Finance,. City Treasurer. Minutes Upon motion by Councilman B.,Smith, seconded by Councilman Pinkley, and .carried the minutes of April 21; 1958 were approved as written and previously distributed. PUBT,I:C, HFARING -The Mayor announced that. the hour of 7:30 o!clock- p.m. having arrived. Weed Abatement this was the time 'and place set by the City'Council of the City of Costa Mesa for public hearing of.objections'or protests against Weed Abatement. The -Clerk reported that no written prctests had been received. There being no.written communications the Mayor asked if there were anyone present wishing to speak. All persons.having been given full -.opportunity to be heard, and no one wishing to speak, it was moved by Councilman Pihkley, seconded by Councilman Meyers, and carried that the hearing.be.closed. Thereupon it was moved by Councilman B.Smith, seconded by Comm il- man Pinkley that a minute resolution instructing the street superinten- dent to proceed with the -elimination of weeds in the City be adopted. The motion was -carried by the following:roll call vote: AYES: -Councilmen B.Smith, Pinkley, Meyers, J.Smith NOES:. Councilmen - None ABSENT; Councilman Rea No. Costa Mesa Storm A supplemental Agreement for additional pipe to be purchased from Drain Ratification of Concrete Conduit Company, for the North.Costa-Mesa Storm Drain was Agreement presented. Upon motion by Councilman B.Smith, seconded by Councilman RESOLUTION NO. 472 Pinkley, Resolution No. 472, being- A RESOLUTION OF,THE CITY COUNCIL OF THE 'CITY OF COSTA, MESA RATIFYING; CONFIRMING AND APPROVING A SUPPI MMAL AGRHEnW BMWM THE CITY OF COSTA MESA AND THE, CONCRETE CONDUIT COMPANY, DATED MAY 1ST, 3358, AND' AUTHORIZING THE EXECUTION THEREOF BY THE MAYOR AND CITY.CLERK,.was adopted by the following roll.call vote: AYES. Councilmen B.Smith, Pinkley, Meyers, J.,Smith NOES; Councilmen - None ABSEIL-.- . Councilman Rea Election Cost Inasmuch as the City Attorney was not present, it was moved by Councilman City Attor_ney.Report B.Smith, seconded by Councilman Pinkley, and carried that the report on County of Orange preparing iWexes for Election- and billing the City for $449.80 be deferred until the•City Attorney'is present. Report from State Upon motion by Councilman B.Smmith, seconded,'by Councilman Pinkley, and Controller carried the report from the DiTector,of'Finance.'advising the Council that the aiidit.report from the Controller of the State of California showed the claims submitted for matching fund monies to be proper, was received. and ordered filed. W. C. Ries A communication was read from W..C..Ries., City Treasurer, informing "would -of Out of State the Council that he be out state ..from May. 9..to May 25, 1958 and arranging for -Jeanne C. Adams to act in his behalf. Upon motion • by Councilman Pinkley, seconded by -Councilman Meyers, arra carried this was approved. Whitmarsh request for A communication was read from Mr. H. Z. Vhitmarsh requesting refund for refund Building Permit N0. 5499, tdjklfer witch a recommendation from the Building Official that no refund be".allowed. After discussion it was moved by Councilman B.Smith, seconded --.by Couracilinan Pink Zey, and carried that the recommendation of the Building Offie al be upheld -. and request be disallowed. Tentative Tract 2059 .Tentative Trac t Map No. 2059 in the Name of Al Watson, 1741 Ordhard Watson Drive, Santa Ana, to subdivide property along Senate and Capital Streets into 12 lots wasppresented. On motion by Councilman B.Smith, seconded by Councilman 'Pinkley, and carried, Tentative Tract Map No. 2059 was approved subject to the recommendations of the Planing Com- missions on file in the office of the City Clerk. Departmental Upon motion by Councilman Pinkley, seconded by Councilman Meyers and Reports carried the reports for the month of April were ordered received and filed from the following departments. Planning, Fire, Street, Building, Civil Defenses Police,•Poundmaster, Director of. Finance for ten free permits. REZONE PETITION Rezone Petition No. -43, for We C. Ramseys.128 Virginia Place, to N0. 43 rezone from R4 to .Cl property on both sides..of Virginia pl. from 'Elden Ramsey to 242.041 easterly of Newport Blvd. was presented. The Public Hearing for this petition was held on April 21, 1958 and action deferred for the report of Welton Becket and Associates;, The Clerk read a report from Welton Becket concurring•in the recommendation of denial submitted by the Planning Commission for the reasons listed and for the following: 1)Amount of land presently zoned commercial is adequate to meet needs - of community. 2) There is vacant land resently zoned commercial im- mediately adjacent to this property. 3� If request were granted Council would have difficulty in justifying denial of requests for rezoning to commercial use in many other similar residential areas in the City. Thereupon it was moved by Counci]man.B.Smith,' seconded by Councilman Pinkley, andcarried that the recommendation for denial by the Planning Commission be upheld. Building -Moving Building Moving Application No. 182s for M. C. Selvage, 3121 West Coast No. 182- Highway, Newport Beach, to move a dwelling from K. Thanga and Coast Selvage Highway, Newport Beach, to 234 Rochester Street was again presented, having been deferred from the meeting of April 21, 1958, for study of drainage. Upon motion by Councilman B.Smith, seconded by Councilman Meyers, and carried, Building Moving Application No. 182 was approved subject to all the recommendations of: the Planning Commission with one exception. The recommendation of the Building Official for a retaining wall.on east and west property lines. This wall need not be built unless itis recommended by the City Engineer after his study of the property. Metropolitan Trans., The City Manager reported that he had secured some information on the Engr. Board Metropolitan Transit 'Fngineers and found that Mr. Al Koch, Orange County Surveyor and Road Commissioner, was amember;iof this board. Mr. Unger recommended that action be tabled until.a;,more detailed map could be secured. Thereupon it was moved by Councilman Pinkley, seconded by Councilman Meyers and carried that this be tabled until more complete -information is received. VARIANCE NO. 367 Variance Appl.,�.cation No. 367 for E. K. and Virginia Sti.ckney, 1652 Stiekney Newport Blvd. Costa Mesa to permit two.231 x 501 and one 221 x 501 trailer spaces and to convert present laundry room into a utilityroom for trailer spaces at 1652 Newport Blvd...was.again presentedhaving been deferred to this meeting on November 4, 1957, The Clerk reported that Mr. and Mrs. Stickney had been notified on April 29 that this would be on the agenda for May 5, and also reported that the Building Department had not received •the plot plan as requested pre:kiously, nor any other communication... Thereupon it was moved by Councilman B.Smith, seconded by Councilman Pinkley, and unanimously carried that the Vari- ance be denied. Rezone Petition No.44 Rezone Petition No. 44 for Kenneth W.-Fether, 214 Via Ithaca, Newport Fether Beach, being a petition to rezone fr9m R4 tq R2, Lot 105, Newport Heights Tract, excepting therefrom the southerly 65 feet of the, westerly 130 feet, located on the east side of `Santa"Ana Avenue, 330'+ northerly of.East 17th Street was presented. Upon motion by. Councilman Pinkley, seconded -by Councilman Meyers and carried, P•Ublic Hearing was set for May. i9, 1958, at 7:30 p1clock p.m. or as soon thereafter as possible, in the Council Chambers., Rezone Petition No. 45 Rezone Petition No. 45, for Elwood F. Phillips, 11245 N.'McCadden P1., Hollywood 38, California, to rezone from Al to Cl, portion of Block 35, Phillips and 36, Fairview Tract, Orange County, located between Maple Street and Baker Avenue, approximately 125 ft. easterly of Harbor Blvd. was pre- sented. Upon motion by Councilman B.Smiths,seconded by Councilman Pinkley, and carried, public hearing was set for May 19, 1958, at the hour of 7:30 o'clock p.m. or as soon thereafter as.possible, in the Council Chambers. RESOLUTION NO. 473 Thereupon Councilman B.Smith, moved the adoption of Resolution No. 473, being A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA, MESA APPROVING THE MAP OF TRACT N0.,2059 AND ACCEPTING THE STREETS AND ALLEYS MOWN THEREON FOR i�BLIC USE FOR HIaWAY PURPMES AND AUTHORIZING THE. CITY CLERK TO SIGN SAID MAY AND AUTHORIZING THE MAYOR AND CITY CLERK Tol SIGN THE AGREEKENT. The motion was seconded, by Councilman Pinkley = and Resolution No. 473 was adopted by the following roll call vote: AYES: Councilmen B.Smith, Pinkley, Meyers, J.Smith NOES-_ Councilmen - None ABSEN(Ts Councilman Rea Fairview County Water Upon motion by Councilman Pinkley, secondedeby Councilman B.Smith, District and carried, the action of Mr. Swartz,Water Superintendent, in turning on the connection between Fairview County Water District and -City during the recent break in the Fairview County Water Districts line was ratified and Mr. Swartz was,commended for the quick service given. ; James Turley The Mayor placed the name of Mr. James Turley for member of the Board VPD II of Costa Mesa Vehicle Parking District No. 2 before the Council.- On . motion by Councilman B.Smith, seconded by.Couneilman Pinkley, and carried Mr. Turley was appointed for a .term of'three years on.the Board of Tgicle Parking District No.,2. RESOLUTION NO. 474 Resolution No 474, being a lMOLUTION OF THE CITY COUNCIL OF THE CITY Fire Equipment OF COSTA MESA AUTHORIZING THE EXECUTION OF AN AGREEKENT FOR TEKPORARY TRANSFER OF VEHICULAR EQUIPMENT BY AND BMW'EEN.THE STATE OF CALIFORNIA, CALIMRNIA DISRSTER_OFFICE, AND THE CITY OF COSTA MESA, was presented. Meyers,, J.Smith RESOLUTION NO. 476 The Clerk read the communication of the Orange County Boundary Com - Underwood Annexation mission approving the proposed Underwood Annexation. -Thereupon Resolution No -476; being A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA OF INTENTION TO ANNEX, AND GIVING NOTICE THEREOF was presented. On motion by Councilman Pinkley, seconded by Council- man B.Smith, Resolution No. 476 was adopted by the following roll call vote: AYES: Councilmen B.Smith, Pinkley, Meyers, J.Smith NOES: Councilmen - None ABSENT: -Councilman_ Rea VARIANCE 10. 468 Brand Variance Application No. 468, being the application of Joyzelle L. Brand, 939W. 19th Street, Costa Mesa, to..permit the maintenance of a studio in the home to -teach basic rhythms, (This will not involve tap or ballroom dancing, lessons will -be mostly private, no more than six. students to the class) was presented with the recommendation of the Planning Commission for approval -,subject to: 1) That there be no teaching earlier than 9:00 a.m. nor later thar6:00 p.m. 2) That there be no employees, 3) That there be no signs,on the premises. 4) That this be for a pefod of one year with , the privilege of asking for an extension, if needed, before the end of the year. Mrs. Brand was present and spoke in behalf of her application. Upon motion by Council- man Meyers, seconded by Councilman Pinkley, and carried the Council con- curred with the Planning Commission in granting the variance. VARIANCE N0. 469 Variance Application No. 469, being the,application of College Park College Park -!No. 4 No. 4, 2116 So. Main Street, Santa Ana, to permit 510`" high fence at east side propery line along Fairview Road as shown on the plot plan, was read with the recommehdation of the Planning Commission for ap- proval on the condition that the fence be similar to their fence along Harbor Blvd. as well as being.a solid masonry wall. Upon motion by Councilman B.Smith, seconded by Couneilman'Meyers, and carried the Council concurred with the action of the Planning Commission in granting the Variance. VARIANCE NO. -470 Variance Application No. 470, being the application of Gene Shelly, Shelly 315.,E. 8th Street, Los Angeles, to permit the construction of six (0) units located approximately 248.441 southerly of the centerline of Bay Street, on the East side of Meyer P1., was read with the recom- mendation of the Planning.Commission for approval on the condition that the applicant provides two adequate and properly marked and usably off street parking spaces for each unit' The following spoke in op position to the granting of the variance: Mr. Lawrence Byward, 2018 Meyer P'1., Mrs. Geneva Barnard, 644 Cove St., Mrs. Lawrence Byward, Mrs. David Buttram, 2016 Meyer P1.< Mrs. Buttram presented a petition bearing ten signatures opposing the variance. Mr. Shelly was present and stated that he planned to live in one of the units also. After discussion it was moved by Councilman B.Sm_ith, seconded by Councilman Pinkley that the Variance be.denied and_the'action of the Planning Commission be overruled by the following roll call vote: AYES: Councilmen J.Sm#'+ , Pinkley, Meyers, B.Smith NOES: Councilmen - None ABSENT: Councilman Rea VARIANCE N0, 471 Variance Application No. 471,, being the application of Philip R. Lucas, Lucas 169 Flower St.., Costa Mesa, to permit three.unitscn-lot containing 7,762.5 sq. ft. of.land area & 169 Flower Street was read, with the recommendation of the Planning Commission.,fgr denial for the following reasons: 1) Applicant is over -building. 2).Surrounding neighborhood is more of the R1 type. 3) The whole parking problem is not a workable and proper off-street parking setup.- 4) There is a shortage of approx- imately 1,240 sq. ft. or 15%. The clerk read a communication from H.A. Langdale protesting the Variance. After discussion it was moved by Councilman Pinkley, seconded by Councilman Meyers, and carried that the Council concurred with the action of the Planning Commission in derWi ng the Variance.. 1 1 Variance No. 473 Klyn Variance No. 474 . Crown Homes. Variance No.. 475, Bolotin Variance No. 476 County of Orange '777 Variance Application No. 473, being the application of Lawrence J. Klyn, 2561 Bayshore Drive, Newport Beach, to permit construction of a three -unit dwelling on a 601 x 137.51 --lot consisting_of -8,250 sq. ft. was -read, with the recommendation of,the Planning Commission for approval on the condition -that there be two paved and properly marked off-street parking spaces, for each dwelling- unit. Upon motion by Councilman B. Smith,.seconded by Councilman Pinkley, and carried, the Council con- curred -with the action of the Planning Commission in approving the Variance. Variance Application No. 474, being the application of Crown Homes, 2826 Newport Blvd. Newport Beach, to permit encroachment into front and rear yards of Lots 1, 52 62 7, 8, and 12 of Tract 1776 was read with the recommendation of the Planning .,Commission for approval. Upon motion by Councilman B.Smi.th seconded by Councilman Meyers, and carriedthe Council concurred with the Planning Commission for approval. Variance Application No. 475; being.the application of A. Ivon Bolotin, 870h ictoria Street to permit two rear yard setbacks of 19 feet each at 870 Victoria Street, was redd with the recommendation of the Planning Commission for approval subject to the following -conditions: 11) That there be dedicated for street purposes to the City of Costa Mesa five feet along Victoria Street. 2) That ihere'be not less than two adequate and properly marked off-street parking spaces -for each unit in the entire area. Upon motion -by Councilman Pinkley seconded by Councilman Meyes, and carried the Council concurred with the Planning Commission for approval, with the stipulation that Varance'become valid upon receipt of the deed of right of wag by the City Clerk. Variance Application No. 476,, being the, application of County of Orange, Orange County 'Court House, Santa Ana, to pe�mn'.t the construction of an addition to the existing Justice -Court on property zoned R4 as shown on plans on file in the office of the Planning Department, and made a part ,of this application, was read with the; recommendation of the Planning, Commission for approval subject tothe following conditions: 1) That the parking area to the rear.be cleaned up, paved and properly marked for off-street parking for not less than 25 cars. 2) That there be a legal -size sign on the front of the existing building or driveway. 3) That neither in the existing building or in the new addition or any place on the premises will prisoners be confined over- night. Upon motion by Councilman B.Smith, seconded by Councilman Meyers, and carried, the action of the Planning Commission was upheld, with one clarification, that No.2 of the stipulations be restated to read -- That there be a sign"of adequate size placed on the front of the existing building or driveway, pointing to the parking lot -that is to be provided. Variance No. 477 Variance Application No., 477, being the application of Harold L. Hetrick, Hetrick. 20462 S.W. Birch -Street., Santa Ana; to permit the -construction of three units on lot size 79.131 x 108.271 located on the West side of Pomona, 90 feet southerly of- the centerline of Wilson" Street, was read with the recommendation of the Plan gCommission for approval. Upon motion tion of Councilman-B.Smith seconded b Councilman Me ers and carried the � Y Meyers., Council concurred with the -action of the P ' lanni.ng Commission in g ranting the variance. PATS The application of Albert. V. Haworth "for new and used.plumbing supplies and building materials at 2075 Newport Blvd, was grantdd on motion by Councilman B.Smith seconded by Councilman Meyers, and carried. A -communication was read -from Robert -Behrens, Secretary, Orange County Micro Midgets, 15737�Eucalyptus3,-Bellflower;-alifornia, requesting changing the hours of racing from 1.600 p.m, to 6:00 pm. Sunday after- noon to 5:30 to 10:00 p.m. Friday and Saturday nights. Mr. Robert Baker, 1348 Bellfower, Bellflotrer,.President requested than an extension of time also be granted, inasmuch"as.the license expires on June 30, 1958 It was suggested to.Mr. Baker that a,communication stating such a request be directed to'the City Council. After discussion:.it was moved by Councilman B. Smith, seconded by Counclman.Meyers,-and, carried that the hour ohange be granted to 5:30 p.m. , to -10::00 P. M. 'on ,Friday and Saturday nights. Oral Communications The Mayor inquired if there were anyone desiring to --speak on some item not listed on,the agenda. Thereupon Mr. Robert L. Jewell, 378 La Perle P1., Costa Mesa,'requested the Council to.grant permission for a card room license, for a draw poke game at 18322 Newport Blvd, proposing a 5%.gross license fee. 'Mr. Jewell was requested to make application for a,license on the proper form. Upon motion by Councilman B.Smith, seconded by Councilman Meyers, and carried, -,.the City Manager was directed to obtain legal advice on the Ordinance as adopted by the City, and report back at the next regular Council meeting on May 19. Written Communications A communication was read -from -Edward F. Glenn, 280 Avocado St., requesting payment of $95.48for damages done to his automobile on traveling the City Streets, Upon motion by Councilman Pinkley, seconded by Councilman Meyers, and carried, the claim was referred to the City Attorney. A communication was read from H. P. Cooper, 201.x. Federal Ave. a copy of a letter sent to Bank of America concerning the possibility of . building a retaining wall across the , rear of his piopery to prohibit drainage. THe City Engineer informed the-Councilthat only one one year extension was permissible. The'Clerk.informed the Council that Mr. `Sullivan had been granted a one year extension 6n August 15, 1956.
