The meeting was called to order by the Mayor followed by the Pledge of Allegiance to the Flag and invocation by Reverend Mr. Hannum. ROLL CALL _ Councilmen Present: B.Smith, Pinkley, Meyers, J.Smith Councilmen Absent: Rea Officials Present- Chief Deputy City Clerk, City Manager, Asst. City Manager, City Attorney, City:Ehgineer, Director of Finance Minutes Upon motion by Councilman B.Smith,.secpnded by Councilman Pinkley, and carried the minutes for the meeting of May 5, 1958, were approved as written and previously distributed. Upon motion -by Councilman B.Smith, seconded by Councilman Pinkley, and carried, .the minutes for the meeting of May 12, 1958, were approved as written and previously distributed. 3 PUBLIC HEARING The Mayor announced that the hour of 7:30 o'clock p.m. having arrived Rezone Petition 44 this was the time.and place fixed by the City Council of the City of Kenneth Fether Costa Mesa, California, for public hearing of Rezone Petitinn No. Lily, being the Petitiari'of Kenneth W. Fethe'r, 214 Via Ithaca, Newport, Beach, to rezone from R4 -.,to R2, Lot 105, Newport Heights Tract, excepting therefrom the,:;Southe rly 65 feet of the Westerly 130 feet, located on the East-side'of Santa Ana Avenue, 3301+ northerly of East 17th -;Street and declared the hearing open. - The Clerk read the recommendation for approval by the Planning Commission subject to the -Petitioner submitting to the City a letter indicating that he has placed deed restrictions on the property.pro-. viding one unit for each 1500 sq. ft. of land area and two usable and adequate off-street parking spaces for each -unit. The Mayor asked if there were anyone present wishing to speak. The Clerk, .;„. reported that no written protests had been received. There being no one present wishing.to speak it was moved by Councilman Pinkley,. seconded by Councilman Meyers,'and carried.that the Public Hearing be -closed. ORDINANCE: NO. 203 1 Ordinance No. 203, being AN ORDINANCE AM=NG SECTION 3.2 OF' ARTICLE III OF ORDINANCE NO. 32 OF THE CITY'OF COSTA MESA, CHANGING” THE ZONING OF A PORTION OF LOT N0.'-105, NEWPORT HEIGHTS .TRACT, FROK RL} to R2 was presented. On motion by Councilman B.Smith, seconded by Councilman Meyers, Ordinance No..203 was given first reading and. passed to second reading.by the following roll call vote: AYES. Councilmen B.Smith, Pinkley, Meyers, J.3ni.th NOES: Councilmen - None ABSENT: Councilman.Rea PUBISC HEARING The Mayor announced that the hour of 7:30 o'clock p.m. having arrived Rezone Petition 45 this was the time and place fixed by the City Council of the City of Elwood F. Phillips Costa Mesa, California, for public hearing of Rezone Petition No. 45, being the petition of Elftood F. Phillips, 1145 N..McCadden Place, Hollywood 38. ' Califomia; to rezone from Al to Cl portion of Blook..35 and 36, Fairview Tract, located between Maple Street and Baker Avenue approximately 1251 easterly of Harbor Blvd., and declared the hearing _ open. The Clerk -read the recommendation of the Planning Commission for approval. The Clerk reported that no written communications had been received. The Mayor inquired ifthere ere were anyone present wishing to -speak. There being no one present wishing to speak it.was moved by Councilman B.Smith, seeonded`by-'YMeyers and carried that, the hearing be closed. ~THE ORDINANCE NO. 201 Ordinance No. 204 being AN -ORDINANCE OF CITY COUNCIL OF THE CITY OF COSTA MESA AMENDING `SECTION 3.2 OF ARTICL ,III OF ORDINANCE NO. 32, CHANGING THE ZONING OF -PORTIONS- OE HACKS.3AND 36, FAIRVIEW TRACT, FROM Al TO Cl. was presented. On motion.by,Councilman B.Smith Election Charges 781 seconded by Councilman'Pinkley, Ordinance No. 204 was given first reading and passed to second reading by the following roll call vote: AYE'S: Councilmen -B.Smith, Pinkley, Meyers, J.Smith NOES: Councilmen = None ABSENT: Councilman -Rea Upon mo tion by Councilman Pinkley, seconded by Councilman Meyers, and carried, the City Attorney was allowed more time to check into the election charges -by the County to the City. Claim for Damages Upon motion by Councilman B.Smith, seconded by Councilman Meyers and Edward F. Glenn carried, the Claim for Damages by Edward F. Glenn was -denied upon the recommen9ation'of the City Attorney. Oil Ordinance The City Attorney stated that in as the County is now in the Committee appointed process of adpting an Oil Ordinance he would recommnda committee be appointed to make _a draft of such an OrdinAnc a for the City. Thereupon it was moved by . Councilman Pinkley, seconded by. Councilman Meyers, and carred that a committee composed of the City Engineer, City Attorney, and Chairman of.the Planning Commission be appointed to prepare an Ordinance for.presentation.to the City Council for their study.. Request of Robert L. The City Attomey stated that the City Clerk had referred to him the Jewell for draw poker , request of Mr. _Robert L.• Jewell for a draw pokeR table at 1832 Newport Blvd. and that under the existing Ordinance the request was out, of order and would not be permitted. Thereupon it was moved by Council- man Pinkley, seconded by Councilman B.Smith; and carried that the . request be turned 'down on the grounds that the existing Ordinance, prohibits draw poker. Final Tract No. 3289 The City Edglme'r presented the final map of Tract No. 3289 submitted Geo. Bnecola in the name of George D. Buccola for the subdivision of 5.006 acres, into 24 lots located between Santa,Ana and Vestminster Avenues and 20th and 21st_`Streets, together with a certified check in the amount of $2331.73-, a bond in the amount of $33,400.00, and signed Agreement. Thereupon Councilman B.`Smith moved the adoption of Resolution RESOLUTION 478 No. 4781, being A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA APPROVING THE MAF OF TRACT NO. 3289 AND ACCEPTING THE STREETS AND ALLEY'S SFIMN THEREON FOR PUBLIC USE FOR HIGIOTAY PURPOSES' AND AUTHORIZING THE CITY CLERK TO SIGN STD MAP AND AUTHORIZING THE MAYOR AND CITY CLERK TO SIGN THE AGREEKENT. The motion was seconded by Councilman Pinkley.,-and Resolution No. 478 was adopted by the follow- ing ' roll call, vote,: AYES: Councilmen B.Smith, Pinkley, Meyers, J.'Smith NOS: "Councilmen - None ABSENT: Councilman Rea TRACT NO. 2750 IIpon recommendation of the City.Zigineer and upon motion by_,Councilman Bond exonerated Pin$ley, seconded by Councilman -,Meyers, and unanimous 7y4.carried.. the Council accepted the improvements in Tract No. 2750 which had been completed in accordance with,plans d and specifications, and ordered the bond 'exonerated. Tract No. 2873 Upon recommendation of the City Engineer and upon motion by Council - Bond exonerated. man B.Smith, seconded by Councilman Pinkley, and unanimously carried the Council accepted the improvements in -Tract No. 2873 which had. been completed in accordance with plans and specifications, and ordered the bond exonerated. 'Irat No. 3105, Upon recommendation of the City Engineer; and upon motion by Council - nd exonerated man Pinkley, seconded by Councilman B.Smith, and unanimously carried the Council accepted the improvements -in Tract No. 3185 which had been completed in accordance with plansand specifications, and ordered the bond exonerated. Director of Finance Upon motion by Councilman B.Smith, seconded by Councilman Pinkley, and and Treasurers report carried the report for the month of April for the Director of Finance and .City Treasurer were received and ordered filed. 782 Refund of Building Permit A communication was read from Mr. Stan Bailey, 2683 Santa Ana Avenue S. Bailey for refund of Building Permits No. 6276 and 6277, together with the recommendation of the Building Official for a refund of $76.50. Thereupon it was moved by Councilman B.Smith, seconded by Councilman Pinkley that the refund be granted. The motion carried.by the follow- ing roll call vote: AYES: Councilmen B.Smith, Pinkley, Meyers, J.Smith NOES: Councilmen - None ABSENT: Councilman Rea Rezone, Petition No. 47 Rezone Petition No. 47, for Costa Mesa Estates, 5656 W. 3rd St., Los. Costa Mesa Estates Angeles 36, California, to rezone from R1 to C1 Lots l through 7, Public Hearing set Tract No. 2750 was presented. Upon motion by Councilman B.Smith, seconded by Councilman Meyers, and carried, Public Hearing was set for June 2, 1958, at the hour of 7:30 o'clock p.m. or as soon thereafter as possible in the Council Chambers. Deeds of Right of Way A deed of right of way dated May 12, 1958 from Palmateer-Birdwell, Inc. by Christopher Howell Birdwell, Vice President and Virginia G. Bird- well, Secretary, for that certain street known as Victoria,Street was. presented. On motion by Councilman.B.Smith, seconded by Councilman Pinkley, Resolution No. 479 was adopted by the following roll call vote: AYES:, Councilmen B.Smith, Pinkley, Meyers, J.`Smith NOES: Councilmen - None ABSENT: Councilman Rea Special Census Cost It was moved by Councilman Pinkley, seconded by Councilman Meyers, that a minute resolution authorizing the Director of Finance to pay Special Census costs, estimated.at `2,195.00 upon certification by the Supervisor be adopted. The motion carried by the following roll call vote: AYES: Councilmen B.'Smi.th, Pinkley, Meyers, J.Smith NOES: Councilmen - None ABSENT: Couhci.lman Rea VARIANCE NO. 478 Variance Application No. 478, being the application of Julia S. Hemenway Hemenway, 1961 Fullerton Ave., Costa Mesa, to permit four units on 11,508 sq. ft. of land area, which is short 492 sq. ft. of the re- quired 12,000 sq. ft. (Two units are already existing) was read with the recommendation of the Planning Commission for approval subject to the following conditions: 1) That it be checked for drainage by the Engineering Dept. 2) That there be a dedication of 5.00 feet for the widenign of Fullerton Avenue. 3) That there be not less than 529, properly marked and paved off-street parking spaces for each unit under the direction of the .Planning Director, Mr. -Edward Doan, son of Mrs.-Hemenway, was present, and stated.they would be gl&d to comply with all .the conditions required. Thereupon it was moved by== Councilman Pinkley, seconded by Councilman Meyers and carried that the action of the Planning Commission for approval be upheld, but that said variance be valid upon receipt of the right of way deed by the City Clerk. VARIANCE NO. 479 Variance Application No. 479, being the application of Everson -Walker, Ev,erson-Walker Realtors, 1767A Newport Avenue, Costa Mesa, to permit a 4' x 81 single face sign to advertise the sale of homes in Tract No. 1634, on Lot 1 of Tract No. 1634, was presented with the recommendation of the Planning Commission for approval.for a period of one year or until the homes are sold, whichever, is sooner. Upon motion by Councilman B.Smith, seconded by Councilman Pinkley, and carried, the Council concurred with the Planning Commission in granting the variance. VARIANCE NO. 480 Variance Application No. 480, being the application of Raymond N. Rapp, Rapp 712"Weelo Drive, Costa Mesa to permit a ten foct rear yard setback at 712 Weelo Drive, was presented together with the recommendation of the Planning Commission for approval on the condition that the rear yard ) setback be held to 15 feet instead of the requested 10 feet, and that there be at least six adequate and properly marked and designated off-street parking spaces under the direction of the Planning Director. Upon motion by Councilman Pinkley,, seconded by Councilman Meyers, and carried, the Council concurred with the Planning Commission in grant- ing the Variance. VARIANCE N0. 481 Variance Application No. 481, being the application of Kenneth W. Koll, Koll 2826 Newport Blvd. Newport Beach, to permit a five foot rear yard setback on each of the 18 lots facing the proposed Cabrillo Street in Tract No. 3202 ttZ" was presented together with the recommendation of the Planning Commission for denial for the following reasons: 1) This request appears to be against.the'State Housing A't require- ments. 2) It is against the Fire Dep artm�nt's requirements. 3) The Commission has been put on notice that other property owners on either side -of Mr. Kolls property will follow with the same re- quest which would leave an area in the rear of approximately 10 feet. After discussion it was moved by Councilman B.Smith, seconded by Councilman Pinkley, and carried that the Council concurred with the Planning Commission in derging the variance- VARIANCE N0. 483 Variance Application No. 483, being the application of..Palmateer- Pa,lmateer-.rdwell Birdwell Inc., 1303 Columbine Place, Anaheim, California, to permit a 13th unit on a lot which is short 562.50 sq. ft. of the required 39,000. sq. ft. and a 15 foot rear yard setback on buildings C. D, and E as shown on the plot plan, which is a part of the application, was presented together with the recommendation of the Planning Com- mission for approval subject to the followirg conditions: 1) That the drainage be subject to the approval of the City Engineering Dept. 2) a dedication of a 5.001 right of way for the widening of Victoria Street and 3) That there be, properly paved and marked, two off-street parking spaces for each unit subject to the approval,of the.,Planning Director. Upon motion by Councilman B.Smith, seconded„by Councilman Pinkley., and carried the Council concurred with the Planning Com- mission in granting the Variance, but that said Variance,to'become validupon.receipt of the right of way deed by the City. Clerk. VARIANCE N0. 484 Variance Application No. 484, being the application of.First Assem- First Assembly of bly of God Church, 22nd. and Elden Avenue, Costa Mesa, dalifornia, God Church to permit construction of additional church facilities(as per plot plan, made a part of the application, was read with the recommendation of the Planning Commission for approval on the following conditions: 1) That there be a dedication from the Church of 5.00 .feet, .for widen - of 22nd Street and Elden Avenue. 2) That the Parkin Lot on the Northeast corner of Virginia Place and Elden Avenue be tied to the church property until such time.thaty the acquire a substituted park- ing lot next to or closer to the present church. 3) That -the leasing arrangements on the parking lot on the Northeast corner of -Virginia Place and Elden be submitted to the City Attorney for checking and approval. 4) That the parking area, both on the church property as well as the.parking lot, be adequately surfaced and markdd for off- street parking under the direction of the Planning Director,`, 5) That the parking lot be enclosed with a chain link type fence.,, Pastor M. Cronic, representing the Church, was present and inquired whether or not the deeds must be given to the City at the present time. ORAL COM1UNICATIONS The Mayor inquired if there were anyone present wishing to speak on some item not on the agenda. Thereupon Chief of Police McKenzie in- formed the Council that he had been appointed Chairman of the Orange County Peace Officers Assn. -Committee for Mutual Aid and requested the Council for permission to prepare an agreement. Thereupon it was moved by Councilman Pinkley, seconded by Councilman B.Smith, and carried that the Council was in favor of such an agreement and author- ized the City Attorney and Chief of Police to prepare _such an agree- ment for the Council to study. t�RiTTEN COMMUNICATIONS A communication was read from Roven-Spiegel Construction Co. 5656 W.' 3'7d Street, Taos Angeles 369 California p requesting a 90. day exten- sion on Tentative Tracts No. 2953 and 2954 which expire.on May 19, 1958, as plans and specifications were being ppepared_for filing of a final tract map under No. 2029. Upon the recommendation of the City Engineer it was moved by Councilman Pinkley, seconded by. `4Touncilman-Meyers, and carried that a 90 day extension to August 19, 1958 be granted. A communication was read from Steuart Yost, Manager, Orange County Fair, requesting that the week of May 23 through June 1 be proc- laimed Orange County Fair week, and proclaiming Costa Mesa -Day on Friday, May 23. It was moved by Councilman Pinkley, seconded by Councilman B.Smith, and carried that the Mayor issue a proclamation proclaiming these dates. Masterson, Chairman of`the Assembly Revenue and Taxation Subcommittee on Public Indebtedness notifying the Council of the meeting on May 23, 1958 in Richmond was received and ordered filed. Upon motion by Councilman B.Smith the recommendation of ..Costa Mesa Vehicle Parking District No. 1 that $200.00 with interest at 6% from April 1, 1957, be paid to R. W.
