CITY OF COSTA MESA
June 23 1958
The City Council of the City of Costa 1'2esa, California, met in regular
session at 7:30 p.m. June 2, 1958 at the City Hall, 695 W. 19th St.,
Costa Mesa. The meeting was called to order by the Mayor followed by
the Pledge of :Allegiance to the Flag and Invocation by Reverend Clifford
Fugate.

Minutes Upon motion by Councilman B.Smith, seconded by Councilman Pinkley, and
carried, the minutes of the meeting of May 19, 1958 were approved as
written and previously distributed.
Upon motion by Councilman Pinkley, seconded by Councilman Meyers, and
carried, the minutes of the meeting of May 26, 1958, were approved as
written and previously distributed.
PUBLIC HEARING
Mayor Smith announced that this was the time and place fixed for the
Underwood Annexation
In wring of protests or objections against the proposed "Underwood
Annexation". The Deputy Clerk reported that the -affidavits and proof
of the publication of the Resolution of Intention, and the mailing of
notices of adoption of the Resalution of Intention as required by law,
had been made and are on file in the office of the City Clerk. The
Mayor thereupon declared the hearing open.
The Clerk reported that no written protests had been received.
There being no written communications the Mayor asked if there were
anyone present wishing to speak. All persons having been given full
opportunity to be heard, and no one wishing to speak, it was moved by
Councilman Plinkley, seconded by Councilman B.Smith, and carried that
the hearing be closed.
ORDINANCE NO. 205
Thereupon Ordinance No. 205 being AN ORDINANCE OF THE CITY OF
COSTA MESA. APPROVING THE AN1MUTION OF CERTAIN UNIPUAHITED TERRITORY
CONTIGUOUS TO THE CITY OF COSTA MESA, IN THE COUNTY OF ORANGE, KNOW
AND DESIGNATED AS "UNDERWOOD ANNEXATION", was presented. Following
full reading of the Ordinance, section by section, Councilman B.Smith
moved that this constitute the first reading of Ordinance No. 205.
The motion was seconded by Councilman Meyers,and carried by the follow-
ing roll call vote:

PUBLIC HEARING
Mayor Smith announced that this was the time and place fixed by the
Rezone Petition 47
City Council of the City of Costa Mesa, California, for public hearing
Costa Mesa Estates
of Rezone etition No.�47, Costa Mesa Estates, 5656 W. 3rd Street to
rezone from R1 to Cl. Lots 1 through 7.of Tract No. 2750.
The Clerk read the recommendation for denial by the Planning
Commission for the followin reasons: 1) That it is not compatible
with the immediate area. 2 It appears to be detrimental to the high
cost residential area to the east. 3) There has been no indication
from the applicant as to what is proposed in the Cl area. 4) This
is a complete change from what was originally proposed for a profes-
sional and medical center.
The Clerk reported that no written protests had been received
but an.oral request had been received from Mr. Horton of Costa Mesa
Estates asking that the public hearing be continued to June 16, 1958
to enable him to prepare additional maps and information. There being
no written communications the Mayor asked if there were anyone present

moved by Councilman B,Smith,'seconded by Councilman Pinkley, and carried
that the request of the applicant be granted and the hearing extend to
June 16, 1958, at the hour of 7:30 o'clock p.m. or as soon as possible
thereafter.
PUBLIC HEARING The Mayor announced that this was the time and place set by the City
'E. 17th Street Imp. Council of the City of Costa Mesa for the hearing of protests -or objec-
District Changes tions on Resolution No. 477 adopted by the City Council declaring its
intention to make changes in the work proposed to be done.
The Clerk reported that no written protests had been received.
The Mayor asked if there were anyone present wishing to speak. All
persons having been given full opportunity to be heard; and no one
wishing to speak, it was moved by Councilman Pinkley, seconded by
Councilman Meyers, and carried that the public hearing be closed.
RESOLUTION NO. 482
Thereupon Resolution No. 482 being A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DETERMINING RESULTS
OF HEARING ON RESOLUTION OF INTENTION TO MAKE CHANGES IN THE WORK
PROPOSED TO BE DONE, OVERRULING PROTESTS, AND DETERMINING THAT THE
PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE CERTAIN CHANGES
IN THE WORK PROPOSED TO BE DONE IN THE IMPROVEMENT OF EAST 17TH STREET
AND CERTAIN OTHER STREETS AND ALLEYS (ASSESSMENT DISTRICT NO. 6) was
presented. Following full reading of the Rew1ution, it was moved by
Councilman B.Smith that Resolution No. 182 be adopted. The motion
was seconded by Councilman Pinkley and carried by the following roll
call vote.-

Final Tract 3161
The City Engineer presented the final map of Tract No.3161 submitted
K. W. Koll
in the name of K. W. Koll (Kendon Homes, Inc.) for the subdivision of
property north of Wilson Street and west of Fairview Road into 61-
lds, together with a certified check in the amount of '$4,733.49, a
bond in the amount of $6.,000.00,. and signed agreement.
Thereupon Councilman B.Smith moved the adoption of Resolution
No. 183, being A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA
MESA APPROVING THE MAP OF TRACT NO. 3161 AND ACCEPTING THE STREETS
AND ALL-ffS SHOWN THEREON FOR PUBLIC USE FOR HIGH[aY PURPOSES AND
AUTHORIZING THE CITY CLERK TO SIGN SAID MAP AND AUTHORIZING THE MAYOR
AND CITY CLERK TO SIGN THE AGRERMT. The motion was seconded by
Councilman Meyers, and Resolution No. 483 was adopted by the,.following
roll call vote:

Bonds exonerated
Upon motion by Councilman-B.`Smith, seconded by Councilman Pi.nkley,
Trs. 2959, 2966, 3075
and carried, the Council accepted the improvements on Tracts 2959,
2966, and 3075, which had completed in accordance with.plans and
specifications, and ordered the bands exonerated, upon the recom-
mendation of the City Engineer.
Auditors report
Upon motion by Councilman B.Smith, seconded by Councilman Pinkley, and
carried the Auditors report for the period of July 1, 1957, through
March 31, 1958 was accepted.
Departmental Reports
Upon motion by Councilman Pinkley, seconded by Councilman Meyers, and
carried, the following departmental reports were received and -ordered
filed: Building, Poundmaster, Street, Planning, Fire, `and,_ -report of
the Director of Finance on seven free permits.

Ordi:n.anc.ea-Yo. 203 was presented for second reading and the Deputy Clerk
reading tabled
notified the Council that the letter indicating that deed restrictions
have been placed on the property providing one unit for each 1500 square
feet of land area and two usable and adequate off-street parking spaces
for each unit had not been received. Thereupon it was moved by Council-
man B.Smith., seconded by Councilman Meyers, and unanimo�4y_, carried that
the second reading of Ordinance No. 203 be tabled until4the.;letter on
the deed restrictions is received.

reading of the title, Councilman B.Smith moved that further reading
be waived and that it be read by title only. The motion was seconded-

presented. On motion by Councilman'B.Smith, seconded by Councilman

approved subject to the recommendations of the Planning Commission,
on file in the office of the City Clerk.
Tentative Tract No. Tentative Tract.Map No. 3345 in the name of Athens Builders Company,
3345 Inc. 11933 Stanton Road, ANahei m, California, to subdivide property
Athens Builders west of Tustin Avenue, between Ogle and 16th Place into 14 lots was
presented.- On motion by Councilman Finkley, seconded by Councilman
Meyers, and carried, Tentative Tract Map No. 3345 was approved subject
to the recommendations of the Planning Commission, on file in the
office of the City Clerk. -
Compatible uses in The City Clerk read the recommendations of the Planning Commission
C1 and Cl -'S zones for additional uses compatible with the Cl and CI -S zones. After
discussion it was moved by Councilman B.Smith, seconded by Councilman
Meyers, and carried, that the City Attorney draft an Ordinance includ
ing these recommendations for presentation to the City Council.
Deeds of Right of Way A deed of right of way dated May 16, 1958 from Southern California
District of the Lutheran.Church-- Missouri Synold for that certain
street known as Victoria Street was presented. On motion by Council-
man B.Smith, seconded by Councilman Pinkley, the deed was accepted

RESOLUTION NO. 484 Resolution No. 484., being a RESOLUTION OF THE CITY COUNCIL OF THE CITY
Budget for gas tax OF COSTA. MESA ADOPTING BUDGET AND APPROVING MEMORANDUM OF AGREEMENT FOR
EXPENDITURE OF FUNDS ALLOCATED UMER SECTION 2107.5 OF THE STREETS AND
HIGHWAY'S CODE was presented. On motion by Councilman B.Smith, seconded
by Councilman Meyers, Resolution No. 484 was adopted by the following

Subdivision No. 199 Subdivision Application No. 199, being the application of Helen G.
Helen G. Lomax Lomax to subdivide property at 276 Santa I-sabel into three parcels,
was presented with the recommendation of the Planning Commission for
approval subject to the following conditions: 1) a 5.001 dedication
to the City for street widening along Santa Isabel. 2) That the 501
road easement off of Santa .Ana to Lot A be a permanent easement and -
that it be permanently tied to Lot A. 3) That the 501 road easement
from Santa Ana Avenue to service Lot A be improved according to the
specifications of the City Engineer so that it will be usable for
the accommodations of Lot A. 4) That prior 'to final approval it be
determined whether or not this 501 road easement,as shown on Map
entitled Job #5798 is a ermanent-easement. 51 That curbs and gutters

motion by Councilman B.Smith, seconded by Councilman Meyers and carried,
the action of the Planning Commission was upheld and the application
approved subject to the stipulation as listed.
Variance No. 339"A Variance Application No. 339A, being the application of Summerland Land
Summerland Land Co. Co., 1124 Beverly Drive,'Los Angeles 35, California, for continuation of
two temporary Directional Subdivision signs; one DF 151 x 301 and one
corner of Harbor Blvd. and Gisler Road; was read with the recommendation
of the Planning Commission for approval for a period of one year or
until the homes are sold, whichever is sooner. Upon motion_.by Conncil-
man Pinkley, seconded by Councilman Meyers, and carried .the Council
concurred with the Planning Commission in granting the'.variance as
recommended with the additional stipulation that both signs be in-
spected by the Building Dept. for safety, and any necessary corrections
be made.
Variance No. 340A Variance Application No. 340A being the application of Lucy E', MacCarte:r,
Lucy MacCarter dba Harbor Trailer Supply, 2170 Harbor Blvd., Costa Mesa, for continua=

tion of a trailer to be used for a watchman at 2170 Harbor Blvd. was
read with the recommendation of the Planning Commission for approval
for a period of one year subject to -the requirements of the Building
Department. Upon motion by CouncilmanB.Smith, seconded by Councilman
Pinkley, and carried, the Council concurred with the Planning Commis-
sion in granting the variance, as.recommended.
Variance No. 172
Variance Application No. 1.72, being the application of Dr. Robert
Dr. Robert Beauchamp
Beauchamp, 200 E. Bay Front, Balboa, California, to permit one unit
for each 1500 sq. ft. of land area for a -cooperative apartment project
located on the north side .of 16th Place, between Santa Ana Avenue and
'Westminster, was read with the recommendation of the Planning Commission
for approval under the following conditions: 1) 1/2 of Ogle Street to
_
be put thm ugh according to the City standards including curbs, gutters,
pavement, sidewalks, street lights and dedicated to the City a 254 width
for 1/2 street. 3 ) That there be a maximum of 106 units :with a minimum
of 200 off street parking spaces, roperly_paved and marked, under the
direction of the Planning Dept. 4 Drainage under the supervision of
the City Engineer. 5) The sidewalks be installed along 16th Place and
Santa Ana Avenue. Upon motion by Councilman B.Smith, seconded by
Councilman Meyers, and carried the Council concurred with the Planning
Commission in granting the variance as recommended.
Variance No. 486
Variance Application No. 486, being the application of Norman C. Hill,
Norman C. Hill
2163 Orange Avenue, Costa Mesa, to permit 16 additional units .on a
lot size 66.034 x 3954, a total of 26,081.85 sq. ft. and 11.48.94+ feet
per unit on the west side of Orange Avenue,:330.151 south of the
centerline of 22nd Street, was read with the recommendation of the
Planning Commission for denial for the following reasons: 1) The
applicant is over -building the subject property. 2) The parking
layout is not adequate or usable. 3) It is not compatible with the
immediate residences. 4) There is no'special circumstance, either on
the application or from the evidence obtained from the applicant.
Mr. Carl Silva, 514 Center Street, spoke in behalf of the applicant,
and informed the Council that he had .new plans to be presented for 15 units
and'a new arrangement for parking. Mr. Silva was informed by the City
Attorney that the Council could not act on a new plan that had not been
presented to the Planning Commission. Mr. Russ Razer, 2156 Rural P1.
protested the Variance. After further discussion it was moved by
Councilman B.Smith, seconded by Councilman.Meyers, and carried, that
the action of the Planning Commission be upheld and the Variance be
denied.
Variance No. 487
Variance Application No. 487), being the application of Louise Arlee
Louise A. Higbee
Higbee, 333 E. 18th Street, Costa Mesa, to permit the operation of
a dance studio in the rear building on the lot at 333 E. 18th Street
aas read with the recommendation of the Planning Commission for ap-
proval on the following conditions; .1) For a period of one year; 2)
No employees; 3) No signs; 4) that it meets the requirements of the
Fire Dept; 5) That it meets the requirements of the Building Dept.
6) That at least four usable off-street parking spaces be provided
on said lot. Upon motion by Councilman Meyers, seconded by Councilman
Pinkley, and carried the Council concurred with the action of the Plan-
ning Commission in granting the Variance as recommended with one ex -
cep tion,i.e. No. 1 instead of a period of one year said Variance will
expire on June 30, 1959.
Variance No. 488
Variance Application No. 188, being the application of Jacob Bodenhoefer,
Jacob Bodenhoefer
2165 Orange Avenue, Costa Mesa, to permit ten units on lots size 66.034
x 235.304 = 15,536:859 sq. ft. located 1254 Weste2y of the centerline -
of Orange Avenue and 330.159 'Southerly of the canterline of 22nd 'Street
was read with the recommendation of the Planning Commission for denial
for the following reasons: 1) The applicant is over -building on the
subject property. 2)nThe parking"layout %s not adequate or usable.
3) It is not compatible Uri.th the immediate residences. 4) There is no
special circumstances, either'on the application or from the evidence
cb tained from the applicant. Mr. Carl Silva spoke in behalf of the
applicant. Mr. Norman Hill spoke in favor of the Variance. After dis-
cussion it was moved'by Councilman Pinkley, seconded by Councilman
Meyers, and carried that the recommendation of the Planning Commission
be upheld and the Variance be denied.
Variance No. 189
Variance Application No. 489, being the application of Dike and Cole -
Dike and Colegrove
grove Inc., 419 'E. 17th Street, Costa Mesa, to permit temporary sign
6' x110' to be located 60' from the centerline of both streets to
advertise the sale of homes in Tracts 2953, 2954 and 2955 on the
Southwest corner of Baker and Fairview was read together with the
recommendation of the Planning Commission for approval for a period
of one year or until the homes are sold, whichever is sooner. Upon
motion by Councilman Meyers, seconded by Councilman Pinkley, and
carried the action of the Planning Commission was upheld and the sign
be inspected by the Building Department.
PERMITS Upon motion by Councilman Pinkley, seconded by Councilman B.Smith,
and carried, license was granted -to Lee Andrews for junk collection.
Junk to be hauled out of:town.
Upon motion by Councilman B.'Smith, seconded by Councilman B.`Smith,
and carrried, permit was.granted to Frances Iba dba The Attic `Shop
at 2320 Newport Blvd. for retail of antiques and oil paintings as
listed on license on condition that all business be conducted inside
'the buiUding, building be inspected and occupancy permit received.
Upon motion by Councilman Pinkley, seconded by Coanci lman Meyers, and
carried, permit was granted to Orange County Music Inc. for a_ skill
game at Wagon Wheel, 1830 Newport Blvd.
Oral Communications The Mayor called for oral communications. There being no one,present
wishing to speak the Mayor called for written communications.
Written Communications Communication was read from Sam Kinsfather, 166 E. 20th Street, re-
questing an appeal on the decision of the Planning Commission on Sub-
division Application No.'198. Thereupon it was moved by Councilman B.
Smith' seconded by Councilman Pinkley, and carried that appeal be held
on June 16, 1958 at the hour of 7:30 o'clock p.m. or as sooi�.thereafter
as possible.
Communication was read from Mr. and Mrs. Harry Erick, 105. Beverly Rd.
Corona, California, requesting an appeal to the decision of the Plan-
ning Commission on -Subdivision Application No. 200. Thereupon it was
moved by Councilman Pinkley, seconded by Councilman Meyers, and carr-
ied that the appeal be held on June 16, 1958, at 7:30 o'clock p.m.
or as soon thereafter as, possible. -
Communication was read from Rev. CU -0,e ifilliams, District Campmeeting
Treasurer, Southern California District Church of the Nazarene request-
ing permission to erect a tent for religious purposes on the campus of
the Southern Califo rnia Bible College on July 17 and 18, services to be
held July 21 through Ju1y'27. Upon motion by Councilman Pinkley,
seconded by Councilman Meyers, and carried, permit was granted, fee
waived, subject to the approval of the Fire Dept.
A communication was read from L. E. Dasher, Representative of South-
eastern Cdlifornia Conference of Seventh -day Adventists, requesting
a permit to erect a tent for a 90 day period beginning June 15, 1958
on the Southwest corner of Pomona and 19th Streets to conduct a series
of .meetings, four nights,per week. Mr. Dasher was present and stated
that these meetings would be. held fm m 8:00 p.m. to 9:30 p.m.., adequate
parking and sanitary facilities would be provided, and . all_ regulations
of the City would be met. After discussion it was moved by -Councilman
B.,Smith, seconded by Councilman Pinkley, and carried, that action be
tabled and cards be sent;to .the,property owners within a 300 feet radius
of the property, notifying them of apublic hearing to be held on Monday,
June 9, 1958, at the hour of 7:30 o'clock p.m. or as soon thereafter
as possible.
A communication was read from Franz E. DeBeerI President;.South Coast
Plumbing, 208 W. Victoria, Costa Mesa requesting refund of X5'.10 on
Plumbing Permit No. 12790. Upon'the recommendation of the Building
Official it was moved by .Councilman Meyers,seconded by Councilman
Pinkley, and carried that the request be denied.

W R 1.46 Warrant Resolution No. W R 146, including Payroll No. 94 was presented
for approval. On motion by Councilman Pinkley, seconded by Councilman
Meyers, WR No. 116 was adopted by the following roll call vote:
AYES: Councilmen Pinkley, B. Smith, Meyers, J. Smith
NOES: Councilmen - None
ABSENT: Councilman Rea
Weed Abatement cards Mr. Unger requested the'Councils authorization to issue a warrant
purchased from County and add it to the next warrant list in the -amount of $132.19 to=
purchase from the Orange County, 8,813 dards of property owners to
be used for weed abatement. Upon -motion by Councilman B..Smith,
seconded by Councilman Meyers and carried, the Director of Finance
was authorized to draw'a warrant in the amount of $132.19 to the
County of Orange and add it -to the next warrant list.
Adjournment Upon motion by Councilman B.Bmith, seconded by Councilman Meyers, -and
carried, the meeting adjourned at 9:20 p.m. to Monday, June 9, 1958,
