REGULAR MEETING OF THE CITY COUNCIL
CITY OF COSTA MESA
September 15, 1958
The City Council of the City of Costa Mesa, California, met in
regular session at 7:30 o'clock p.m., September 15, 1958, at the
City Hall, 695 W. 19th St., Costa Mesa. The meeting was called
to order by the Mayor followed by the Pledge of Allegiance to the
Flag --and Invocation by Reverend Clifford Fugate.

MINUTES Upon motion by Councilman B. Smith, seconded by Councilman Pinkley,
and carried, the minutes of the regular meeting of September 2, 1958
were approved as written and previously distributed.
REPORTS Upon motion by Councilman B.Smith, seconded by Councilman Meyers, and
carried,. the report from the Citlr Treasurer for the month ofAugust .
City Treasurer and the Annual Financial Report for the fiscal year ended June 30, 1958
Dr. of Finance the financial report for the two months period ending August 31, 1958
were received and ordered filed.
Tr. 1644 release A communication was read from the City Engineer recommending an 850
of portion of bond refund of $12,000.00 of the cash bond posted on Tract No. 1644 as
40 per cent of these improvements are now completed. Upon motion
by Councilman Pinkley, seconded by Councilman Meyers refund of
$10,200.00 limas granted the developer as recommended by the City
Engineer. Motion carried by the following roll call vote:

Departmental Upon motion by Councilman Pinkley, seconded bye Councilman Rea, and
Reports carried, the report of the Police Department for -the month of August
was received and ordered filed.
Upon motion by Councilman B.Smith, seconded by Councilman Rea, and
carried, the report of the Police Department for the month of August
was received and ordered filed. .-
AUDIT OF ACCOUNTS Upon motion by Councilman B.Smith, seconded by Councilman Rea, and
carried, the report on Audit of Accounts for the Fiscal Year, July 1,
1957 through June 30, 1958, having been deferred from the meeting of
September 2 to permit study, was received and ordered filed.
REzONE PETITION 46 Upon motion by Councilman Pinkley, seconded by Councilman Meyers, and
So. Calif. Bible carried, Rezone Petition No. 46, being the application of The Southern
College Hearing California Bible College; 2525 Newport Blvd., Costa Mesa, to rezone
Set a portion of the Bible College property from R4 to Cl and Ml -A as
shown, -on a map made a part of the application, was set for public
hearing on Oc tober 20, 1958 at 7:30 o'clock p.m. or as soon there-
after as possible in the Council -Chambers.
Bldg.-Mvg. Applies. Applications for Building Moving Permits Nos. 194 and 195, being the
X194 and 195 applications of Horace F. Silva, 256 E. 20th Street, Costa Mesa, to
Horace F. Silva move a house and garage from 1733 Santa Ana Avenue, Costa Mesa, to
257 Sierks Street, Costa Mesa, were read together with the recom-
mendatipn of the Planning Commission for approval subject to the
following conditions: 1) That there be a dedication of 30 feet
for street purposes the full width of the property along Sierks
Street. 2) That the requirements of the Building Department are
met. 3) That a bond of $1,000.00 be posted for the garage and a.
bond for $5,000.00 be posted for the house. 4) That the 30 foot
dedication for Sierks, the full width of this property be improved
by the applicant according to the requirements of the City Engineer.
Pfir. Silva Bras present and was agreeable to all the requirements.
Thereupon it was moved by Councilman B.Smith, seconded by Councilman
Meyers, and carried, the applications be approved subject to the.stip-
ulations of the Planning Commission.
Claim for Damages Upon motion by Councilman Pinkley, seconded by Councilman Meyers,
Isabel Lawrence and carried, the Claim for Damages for ISabel Lawrence, 1838 Pomona,
Costa Mesa, was referred to the City Attorney.
Request for Annexa- A communication was read from Jennings-Halderman, Inc., 200 W.
tion - Jennings- Washington Ave., Santa.Ana, requesting annexation of a portion of
Halderman, Inc. Tract 3363 as indicated on the map attached to the letter. Upon
motion by Councilman Pinkley, seconded by Councilman Rea, and carried,
the request was referred to the City Engineer and the City Attorney
for processing and referral to the Orange County Boundary Commis -
Sion.
Right of Way Deeds A right of way deed dated August 28, 1958, from William H. Meyers
for that certain storm drain north of Wilson between Raleight and
Pomona was presented. Upon motion by Councilman B.Smith, seconded
by Councilman Meyers, the deed was accepted and ordered placed on
-record by the following roll call vote:

A right of way deed dated September 8, 1958, from W. Scott Hume
for that certain street known as Maple Avenue, was presented.

VARIANCE NO. 366-A Variance Application No. 366-A, being the application of Mesa Manor,
Mesa Manor, Inc. Inc. 17639 Van (hien Street, Van Nuys, California, to permit the con-
tinuation of one sign size 10' x 12' to be -erected on the south side
of Raleigh Street in Tract 2947 was read together with the recom-
mendation_ of the Planning Commission for approval for a period of
one year or until the homes are sold, whichever is sooner, and
subject to the requirements of the Building Department. Upon motion
by Councilman Pinkley, s3conded by Councilman Meyer, and carried,
Variance No. 366-A was approved subject to the stipulations of
the Planning Commission.
VARIANCE NO. 383-A Variance Application No- 383-A being the application of Dike and
Dike and Colegrove Colegrove, Inc., 419 E. 17th St:., Costa Mesa, to permit the con-
tinuation of one 10' x 30' sign on Lot 9, Tract 2955 and ten feature
signs to advertise the sale of homes in Tracts 2953, 2954, 2955
eras read together with the recommendation of the Planning Commission
for approval for one year or until the homes are sold, -,whichever is
sooner, and subject to the requirements of the Building Department.
Upon motion by Councilman B.Smith, seconded by Councilman Pinkley,
and carried, Variance No. 383-A was approved subject to the stipu-
lations of the Planning Commission.
The request of Kenneth W. Koll, 2826 Newport Blvd., Newport Beach
for a 7.5 foot width for the parking stalls in the parking area in
rear for the units to be built on the 18 lots facing Cabrillo Street
in Tract No. 3202, as per the plan, insread of the requirement No. 2
"Applicant provides two for one, adequate and properly marked off-
street parking in accordance with City Standards" was read together
with the recommendation of the Planning Commision for a minimum

The request of Kenneth W. Koll, 2826 -Newport Blvd., Newport Beach,
for a 7.5 foot width for the parking stalls in the parking area in
rear for the units to be built on the li lots facing Cabrillo Street
in Tract No. 3202, as per the plan, instead of the requirement No. 2
"Applicant provides two for one, adequate and properly marked off-
street parking in accordance with City Standards" was read together
with the recommendation of the Planning Commission for a minimum
width of eight (8) feet for the stalls in the parking area in the
rear of the lots approved for triplexes in Tract No. 3202 under
Variance No. 459. Upon motion by Councilman B.Smith, seconded by
Councilman Meyers, and carried, the eight feet parking stalls were
approved as recommended by the Planning Commission.
VARIANCE NO. 515 Variance Application No. 515, being the application of Eileen E.
Eileen E. Casey Casey, P. 0. Box 2063, Santa Ana, California, to permit two units
in addition to existing unit with a 10 foot rear yard setback at
570 Victoria St., Costa Mesa, was read together with the recommen-
dation of the Planning Commission for approval subject to the
following conditions: 1) That the storage cabinets in the carport
be removed. 2) That the applicant provide two for one off-street
parking under the supervision of the Planning Technician. 3) That
it comply with the requirements of the Building Department. Mrs;
Casey was present and requested that this be deferred to the end of
the meeting when her contractor would be present to answer any questions.
Thereupon it was moved by Councilman B.Smith, seconded by Council-
man Rea, and carried, that action be deferred to later in the meet-
ing to give the contractor time tp appear.
VARIANCE NO. 517 Variance Application No. 517, being the application of Virginia
Virginia Knudsen Knudsen 2115 W. IaPalma, Anaheim, California, to permit the con-
struction of four -duplexes on two lots containing 23,358.456 sq. ft.
of land area, making a shortage of 641.544 sq. ft., to be located
on the south side of Bernard St., 289.65' easterly of Maple Avenue was
presented together tiri th the recommendation of the Planning Comiission
for approval subject to the following conditions: 1) That there be
a 22 ft. dedication for widening of the alley; 2) That all driveways
and parking areas be asphalted as marked on the plot plan. 3) That
the parking ratio be two to one. Upon motion by Councilman B. Smith,
seconded by Councilman Rea, and carried, Variance No. 517 was approved
subject to the stipulations of the Planning Commission.
VARIANCE N0. 518 Variance Application No. 518, being the application of John Poole,
John Poole 2115 W. la Palma, Anaheim, California, to permit the construction
of two duplexes on a lot containing 11,679.228 sq. ft. of land area
which is 320.62 sq. ft. short of the required 12,000 sq. ft.,
located on the south side of Bernard St., 232.23 ft. easterly of
Maple Avenue was read together with the recommendation of the Plan-
ning Commission for approval subject to the following conditions:
1) That there be a 22 ft. dedication for widening of the alley:
2) That all driveways and parking areas be asphalted as marked on
the plot plan. 3) That the parking ratio be two to one. Upon
motion by Councilman Pinkley, seconded by Councilman Meyers, and
carried, Variance No. 518, bras approved subject to the stipulations
of the Planning Commission.
VARIANCE NO. 522

Variance Application No. 522, being the application 6f E. B. Jor-
genson, 252 Wake Forest, Costa Mesa, to permit a 141,rear yard set-
back for addition was presented together with the recommendation
of the Planning Commission for approval. On 1motion by Councilman
B. Smith, seconded by Councilman Meyers, and carried, Variance No.
522 was approved as recommended. -
VARIANCE NO. 523 Variance Application No. 523, being the application of Koll Construc-
Koll Const. Co. tion Co., 2826 Newport Blvd., Newport Beach, to permit a tract sign
to advertise the sale of homes in Tract No. 3161 to be located on
the south side of Wilson, between Fairview Rd. and College Avenue,
across the street from Colgate Avenue, was Presented together with
the recommendation of the Planning Commission for approval for a
period of one year or until the homes are sold, whichever is soom r,
and subject to the requirements of the -Building Dept. Upon motion
by Councilman Pinkley, seconded by Councilman Rea, and carried,
Variance No. 523 was approved as recommended.

VARIANCE NO. 524 Variance Application No. 524, being the application of Koll Con-
Koll Const. Co. struction Co., 2826 Newport Blvd., Newport Beach, to permit a tract
sign to advertise the sale of homes in Tract No. 3161 to be located
on the west side of Newport Blvd, between Fair Driveand Wilson, was
presented together with the recommendation of the Planning commission
for approval for a period of one year or until the homes are sold,
whichever is sooner, and subject to the requirements of the Building
Department. Upon motion by Councilman Pinkley, seconded by Council-
man Meyers, and carried, that Variance No. 524 be approved as recom-
mended.
ORAL COMMUNICATIONS An application for a permit for used furniture and appliance sales
and some new furniture in the name of Andrew Price, to do business
at 2016 Newport Blvd., Costa Mesa, bras read together with a letter
from the Occupancy Inspector of the Building Department stating
that the use of the requested structure for an F-2 occupancy would
be denied by the Building Department: -Mr. Price was present and
stated that he didn't feel he should rebuild the structure and re-
quested that he be allowed to withdraw his application at this time.
Thereupon it was moved by Councilman B.Smith, seconded by Councilman
Rea, and carried, that the request for withdrawal be approved.
An application for Wesley W. Giraud for new and used furniture at
1768 Newport Blvd., Costa Mesa, was approved on motion by Council-
man B.Smith, seconded by Councilman Rea, and carried, withthe stip-
ulation that nothing be stored or displayed outside the building.
An application for Floyd 0. and Dorothy A. Rogers, for retail new
and used furniture at 2366 Newport Blvd., was approved on motion by
Councilman B.Smith, seconded by Councilman Pinkley, and carried,
subject to the letter submitted as filed in the office of the City
Clerk.
The Mayor inquired if there were anyone present wishing to speak on
some item not on the agenda. Thereupon Councilman B.Smith referred
to a letter from Emil Myrehn opposing the name change of E: 17th
Street and stated that it should be made a part 6f the file for
the public hearing on October 6,1958.
The Clerk read a petition signed by 14 property owners requesting
the City to abandon the proposed street widening at the rear of the
property facing Wallace Ave. between 19th and Hamilton. Upon motion
by Councilman B.Smith, seconded by Councilman Pinkley, and carried,
the petition was deferred for further study.
RESOLUTION NO. 515 Councilman Pinkley presented Resolution No. 515, being A RESOLUTION
Commending Chamber of OF THE CITY COUNCIL OF THE CITY OF COSTA MESA COMMENDING THE CHAMBER
Commerce on Voting OF COMMERCE OF THE CITY OF COSTA MESA FOR ITS OUTSTANDING AND CON -
Registration STRUCTZVE' INTEREST IN BEHALF OF GOOD CITIZENSHIP, and moved its
adoption stating that during the recent registration campaign, 2,120
residents registered to vote. The motion was seconded by Councilman
B.Smith.and Resolution No. 515 was adopted by the following roll call
vote:

WRITTEN COMMUNICATIONS There being no further oral communications, the Mayor called for
Witten Communications.
' Griffin Taxi Cab The Deputy Clerk reported that two letters had been receiving ap-
Permit pealing the decision of the Council on the denial of Leonard
Joseph Griffin for a taxi drivers permit. The City Attorney again
informed the Council that according to the Ordinance the Council
could not grant a permit to Mr. Griffin. Thereupon it.was moved
by Councilman Pinkley, seconded by Councilman Rea, and carried
that the Council uphold their decision of the last meeting, for
denial.
Newporter, Inc. A communication was read from Newporter, Inc., 225 21st St.,
house trailer for Newport Beach, requesting an extension on Variance No. 389 for a
watchman trailer on the plant property to be used for a watchman. After dis-
cussion it was moved by Councilman B.Smith, seconded by Councilman
Meyers, and carried that a permit be granted Newporter, Inc. fora
trailer for watchman to be located at 1612 Placentia Ave., for a
period of one year, to October 7, 1959.
Harper P.T.A. A communication was read from Mrs. Michael Warner, President,
bicycle parade Harper School P.T.A. requesting permission to hold a bicycle parade
in conjunction with the school carnival on October 4 between 10:30 a.m.
and 12:30 p.m., the route to be determined by the Police Department.
Chief McKenzie stated that if the roads were passable in that area
he would approve a route. Thereupon it was moved by Councilman Rea
seconded by Councilman Pinkley and carried that the request be
granted subject to the approval of the Chief of Police.
Appcd!ti. Upon motion by Councilman B.Smith, seconded by Councilman Rea,
Mra lerUCoach Fees and carried, the communication from the Controller of the State of
California regarding apportionment of Trailer Coach Fees to the
County of Orange was received and ordered filed.
Hearings on Bill- Upon motion by Councilman Pinkley, seconded by Councilman B.Smith,
Board Control and carri.el, the communication from the California Roadside Council,
12 Garces Ave., San Francisco 27, regarding hearings on billboard
control was received and ordered filed.
A. B. C. Upon motion by Councilman B.Smith, seconded by Councilman Pinkley,
Sam Cox's Mkt. and carried, that the application of Alcoholic Beverage Control on
a person-to-person transfer of off -sale wine and beer license for
Alvin and Betty L. Roman dba Sam Cox's Market, 17+1 Newport Avenue
was received and ordered fild.d.

The Deputy Clerk read the communication from the Department of Al -

cholic Beverage Control for a premise -to -premise on -sale beer
to be protested
license for Jack L. Gosney at 111 Broadway, Costa Mesa. Mr. Pinkley
stated that he had checked the original variance for this group of
buildings and it had stipulated that the parking was for normal store
use only and not a place where the public would congregate. He
felt that because of the inadequate parking, and the close proximity
to a church and school the City should protest the application,
and thereupon moved that the City Attorney be directed to protest
the application on these two grounds. The motion was seconded by
Councilman Rea, and carried by the following roll call vote:

Warrant Resolution No. 155 including Payroll No 102 was presented
for.approval. On motion by Councilman B.Smith, seconded by Council-
man Pinkley, W. R. No. 155 was adopted by the following roll call
vote:

City Managers Report

E. 18th St.
Drainage
The City Manager reported that he and the City Attorney, and Council-
men Meyers and Rea attended a meeting on Friday, September 12, with
a group of property owners on E. 18th Street to discuss a drainage
problem on this street, and after some discussion the property owners
requested him to present to the Council their request to extend the
drainage pipe to Irvine Avenue or as far as drainage money will
permit. Thereupon the following spoke from the floor requesting the
extension and opposing the drainage system as it is now propsed:
Mr. M. L. Crane, 318 E. 18th StI, Mr. Bradley Hughes, Mrs. Hash,
Mr. Dodge; Mrs. Dodge, Mr. Beryl Palmer, Mr. Robert Camp. After
considerable discussion it was moved by Councilman Meyers, seconded
by Councilman B.Smith, and unanimously carried that 'the request be
denied.
VARIANCE NO. 515 Mrs. Casey informed the Council that he contractor had not arrived
Eileen E. Casey and she desired that further action be deferred to the meeting of
October 6, 1958. Thereupon it was moved by Councilman B.Smith,
seconded by Councilman Pinkley, and carried, that Variance No. 515
be deferred to October 6, 1958.
Adjournment Upon motion by Councilman B.Smith, seconded by Councilman Pinkley,
and carried, the meeting adjourned at 9:10 p.m.
