CITY OF COSTA MESA
December 15, 1958
The City Council of the City of Costa Mesa, California; -.met in regular
session at 7:30 o'clock p.m., December 15, 1958, at the City Hall,
695 W. 19th Street, Costa Mesa.- The meeting was called to order by
the Mayor followed by the Pledge of Allegiance to the Flag and Invoca-
tion by Reverend Lester P. Sund.

Officials Present: City Manager, Asst. City Manager, City ATtorney,
City Engineer, Director of Finance, City Treasurer,
Chief Deputy City Clerk
Minutes Upon motion by Councilman Pinkley, seconded by Councilman B.Smith, and
carried, the minutes of the regular meeting of December 1, 1958, were
approved as written and previously distributed.
Statement re: A statement was read by Mayor Smith setting forth the attitude of the
Mesa No. 2 Annex. City Council regarding the proposed.:::meeting of the Newport Beach Council
on Mesa No. 2 Annexation. Mayor Smith said that inasmuch as the
legal action had been brought by the City of Newport Beach he felt that
Costa Mesa could only abide by the decision of the court and felt that
a further conference would be pointless.
PUBLIC HEARING The Mayor announced that the hour of 7:30 o'clock p.m. having arrived,
Northwest Improvement this was the time and place fixed by the City Council of the City of
District Costa Mesa, California, for hearing on the matter of the improvement
of West Victoria Street and certain other streets, alleys, and ease-
ments, in the City of Costa Mesa, under the provisions of Division 4
of the Streets and Highways Code of the State of California
The Clerk reported that notice of the hearing under Division 4
was given by mail, as provided in said Division and that said no-
tices were mailed more than 30 days prior to the date.i_fixed`..for-`
hearing, and that an Affidavit showing such compliance is on file
in his office.
The Mayor announced that prior to the consideration of protests it
would be necessary that the report under Division 4 of said code be
read to the Council. Whereupon the report, except as to the map, plat
or diagram and the assessed valuations and true valuations of, and
assessments and estimated assessments on each parcel of land, was read
to the Council.
The Mayor then inquired of the Clerk if any written protest or ob-
jections had been filed. The Clerk reported that certain written pro-
tests and objections bad been filed with him prior to the time set for
the hearing.
The Clerk then read to the Council all of said protests.
The Mayor then asked if any person desired to orally protest or
speak in support of any written protest filed.

All protests were referred to the Engineer for report and compu-
tation as to the percentage of the area represented thereby. The
Engineer reported that the protests, both oral and written, repre-
sented less than fifty per cent (50%) of the total area of the assess-
ment -district.
RESOLUTION NO. 542
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA
MESA, CALIFORNIA, DETERMINING RESULTS OF HEARING,
OVERRULING PROTESTS, DETERMINING THAT THE PUBLIC IN-
TEREST, CONVENIENCE AND NECESSITY REQUIRE CERTAIN
WORK OR IMPROVEMENT OF WEST VICTORIA STREET AND CER-
TAIN OTHER STREETS, ALLEYS, AND EASEMENTS (NORTHWEST
IMPROVEMENT DISTRICT) SUBSTANTIALLY AS SET FORTH IN
REPORT ON PROJECT FILED UNDER THE "SPECIAL ASSESS-
MENT ACT OF 1931," AND DETERMINING THAT SAID PROJECT
IS FEASIBLE AND MAKING OTHER DETERMINATIONS
"WHEREAS, this City Council has heretofore taken steps provided
by Sections 2821, 2822, and 2823 of the Streots and Highways Code
of the State of California, said Sections being a part of the "Special
Assessment Investigation, Limitation and Majority Protest Act of 1931",
being Division 4 of the Streets and Highways Code of the State of
California, for certain work or improvement in the City of Costa Mesa,
California; and
WHEREAS, this City Council directed Laurence J. Thompson to -pro-
cure the required information and prepare and present to the City
Council the written report on said work and improvement required by
the above Act; and
WHEREAS, said report has been presented to this City Council and
approved and ordered filed by this City Council; and
WHEREAS, by Resolution, this City Council fixed a time and place
for hearing by it on said report; and
WHEREAS, notice of said hearing was mailed as required by said Act;
and
WHEREAS, at the time and place so fixed, a hearing was duly held
by this City Council at which all written protests or objections were
presented, read and all persons desiring to be heard theron were heard,
and this City Council gave all persons present an opportunity to be
heard, in respect to any matter relating to said report, said work or
improvement, or any of the proceedings therefor; and
'WHEREAS, all persons desiring to appear and be heard were heard at
said hearing, and said hearing has been regularly held,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALI-
FORNIA, DOES HEREBY RESOLVETAS FOLLOWS:
SECTION 1. That said report contains all the matters and things re-
quired by law and that notice of hearing on the proposed project
generally described therein has been duly and regularly given.
SECTION 2. That not written protest has been filed with the Clerk
of this City Council by the owners of one-half of the area of the
property to be assessed for said proposed work or improvement and
that there is no majority protest, as provided in Section 2931 of
said.Streets and Highways Code, against only a portion of said pro-
posed work or improvement.
SECTION 3. That all protests and objections be and the same are
hereby overruled and denied.
SECTION 4. That the public interest, convenience and necessity
required the work or improvement substantially as set forth in said
report; that the project for said work or improvement is feasible;
that the lands to be assessed for said work will be able to carry
the burden of the proposed assessment for said work and that the
After a full, fair, and impartial hearing and an opportunity hav-
ing been given to all persons desiring to be heard, it was moved by
Councilman Meyers, seconded by Councilman Pinkley, and unanimously
carried, that all protests, both oral and written, be overruled and
denied, upon the finding that all protests, both oral and written, are
made by the owners of less than one-half of the area of the property
to be assessed for the improvement.
The City Council having before.it the report and the plat of the
assessment district, and being familiar with both, and having consid-
ered all protests filed, and the character and nature of the propsoed
work and the necessity for the same, and determined that the public
interest, convenience, and necessity require the improvement as sub-
stantially set forth in the report, and also having considered the
matter as to the area of the property to be assessed for the said
improvement. Councilman B.Smith presented Resolution No. 542 and
moved it adoption.

limitations as set forth in said Dvision 4 may be and shall be
disregarded, both with respect to the limitation on the district
as a whole and as to the limitation on individual specific assess-
ments.
SECTION 5. That by this Resolution it is the intention of this
City Council to disregard the limitations set forth in Dividon 4by
making all findings and determinations by the affirmative four-fifths
vote of all members thereof, as to necessity, feasibility and that the
lands to be assessed will be able to carry the burden of such proposed
assessment.

Said motion to adopt said Resolution No. 542 was duly seconded by
Councilman Rea, and unanimously adopted by the following roll call

On motion by Councilman Meyers, seconded by Councilman Pinkley, and
unanimously carried the hearing was closed.
Upon motion by Councilman Pinkley, seconded by Councilman Meyers,
and unanimously carried, the City Engineer and City Attorney were in-
structed to report back to the Council on Monday, December 22, 1958,
with the detailed recommendations on the proposed changes from and
decreases in and alterations in the hings proposed to be done as
directed by the Council.
REPORTS Upon motion by Councilman B.Smith, seconded by Councilman Rea, and
carried, the following reports were received and ordered filed, City
Treasurer, Director of Finance, Police Department, Civil Defense.
REFUNDS Upon motion by Councilman Pinkley, seconded by Councilman Rea, refund
of $6.65 was granted to Gerald T. Snyder, 281 Santo Tomas Street,
Costa Mesa, for an error in billing for weed cleaning on his lot,
as recommended by the Director of Finance. Motion carried by the
following roll call vote:

ORDINANCE NO. 218 Ordinance No. 218, entitled, AN ORDINANCE OF THE CITY COUNCIL OF THE
2nd reading CITY OF COSTA'MESA AMENDING SECTION 3.2 OF'ARTICLE III OF ORDINANCE
Rezone of Tracts 2836, NO. 32 OF SAID CITY CHANGING THE ZONING OF TRACTS NO. 2836, 2023, 2993,
2023, 2992, 2993, 2598 2993, 2598, was presented for second reading. Following reading of
the title, Councilman B.Smith moved that further reading be waived and
that it be read by title only. The motion was seconded by Councilman
Pinkley, and unanimously carried. Thereupon Councilman Pinkley moved
the adoption of Ordinance No. 218. The motion was seconded by Council
man Meyers, and adopted by the following roll call vote:

REZONE N0. 49 Rezone Petition No. 49, being the petition of Arthur Kovack, 320
Kovack Valencia Mesa Drive, Fullerton, to rezone from R4 to R2 the south-
easterly 250.00 feet of the northeasterly 132.00 feet of Lot No. 221,
Newport Heights Tract, which is located on the southwest corner of
Hay and Fullerton, Costa Mesa was presented. The Clerk informed the
Council that he had received a call from the Real Estate Agent and the
Escrow Company stating that Mr. Kovack had cancelled the deal. The
Attorney suggested to the Council that a communication be written
to Mr. Kovack requesting notification of whether or not he was still
interested in the rezoning. Upon motion byrCouncilman Pinkley, sec-
onded by Councilman Meyers, and carried, the Clerk was instructed to
write Mr. Kovack concerning his interest in the rezone petition.
RESOLUTION NO. 543 Upon motion by Councilman B.Smith, seconded by Councilman Pinkley,
Supplemental Gas tax Resolution No. 543 being A RESOLUTION OF THE CITY COUNCIL OF THE .CITY
Agreement OF COSTA MESA DOPTING BUDGET AND APPROVING SECOND SUPPLEMENTAL MEMORAN-
DUM OF AGREEMENT FOR EXPENDITURE OF GAS TAX ALLOCATION FOR MAJOR STREETS
was adopted by the following roll call vote:

Audit of Accounts Upon motion by Councilman Pinkley, seconded by Councilman Meyers,
and carried, the report on Audit of Accounts was deferred to the
next regular meeting of the City Council.
Norse Street Right A right of way deed dated December 2, 1958, from Richard F. Opp, for
of Way that certain street known as Norse Street was presented. On motion
by Councilman B.Smith, seconded by Councilman Rea, the deed was ac-
cepted and ordered placed on record by the following roll call vote:

A right of way deed dated November 6, 1958, from Fred W. and Elsie
M. and Walter H. Opp, Leah B. Dinger, Norma F. Schweitzer, Caroline
Opp Kelly, Estelle L. Fassett, Joan L. Wasmann, for that certain
street known as Norse Street was presented. Upon motion by Councilman
B.Smith, seconded by Councilman Rea, the deed was accepted and ordered

At this point Mr. Paul Cortez spoke to the Council stating that he
had brought in a right of way deed to Mr. Wilson earlier in the day
and requested that it be approved at the same time as the two pre-
vious. Thereupon it was moved by Councilman Pinkley, seconded by
Councilman Meyers, that the right of way deed of Paul M. and Nellie P.
Cortez for that certain street known as Norse Street be accepted and
ordered placed on record by the following roll call vote;

ABSENT: Councilmen - None
Thereupon the Attorney stated that Mr. Cortez had stated in a letter
to the Council that this right of way was offered under certain con-
ditions, and read the conditions. After discussion it was moved by
Councilman Pinkley, seconded by Councilman Rea, and carried, that
the action accepting the decd be rescinded and a communication be
forwarded to the Planning Commission requesting their recommendations
on the subdivision of the lots and the proposed width of Norse Street.
RIGHT OF WAY DEEDS A right of way deed dated December 12, 1958, from Oliver W. and
Shirley P. Broomhead for that certain street known as Victoria Street
was presented. Upon motion by Councilman Pinkley, seconded by Council-
man B.Smith, the deed was accepted and ordered placed on record by the

Upon motion by Councilman Pinkley, seconded by Councilman B.Smith,
and carried, permit was granted Donald F. Peterson for a one night

Oral Communications The Mayor inquired if there were anyone present wishing to speak on
some item not on the agenda. No one desiring to speak, the Mayor
called for Written Communications.
Written Communications A communicationvwas read from W. D. O,barr, Secretary, Board of Trustees
Orange County M squito Abatement District stating that the term of
Mr. James T. Kilpatrick expires at the end of the year and stating
Kilpatrick that Mr. Kilpatrick during the past three years has attended 33 out
Mosquito District of 35 meetings held by the Board, a 94% attendance record. There-
upon it was moved by.Councilman Pinkley, seconded by Councilman Rea,
and carried, that Mr. James T. Kilpatrick be reappointed to the Board
of Trustees for a two year term.
March of Dimes Upon motion by Councilman Pinkley, seconded by Councilman B.Smith,
Campaign and carried, permission was granted to the National Foundation of March
of Dimes to conduct its annual campaign in the City of Costa Mesa start-
ing January 1, 1959 through January 31, 1959•
Toncray-Trailer Upon motion by Councilman Pinkley, seconded by Councilman Meyers, and
carried, permit was granted to Mr. Lee Toncray, for trailer for a
night watchman at 1680 Superior Avenue for a period of one year,
December 3, 1959•
State H.ghways Upon motion by Councilman B.Smith, seconded by Councilman Pinkley;
freeway plans and carried the communication from the Division Of Highways regard-
ing freeway planning was received and ordered filed.
Work on North.Costa Upon the recommendation of the Assistant City Engineer it was moved
Mesa Storm Drain by Councilman B.Smith, seconded -by Councilman Meyers, and carried,
Accepted that the work of the Hane Construction Company, Inc. on the N rth
Costa Mesa Storm Drain and Fairview Bond Channel D-4, be accepted.
Hartshorn - referred Upon motion by Councilman B.Smith, seconded by Councilman Pinkley,
to Sanitary District and carried, the communication of Mrs. E. D. Hartshorn, 38� Costa
Mesa Street concerning the treatment of her garbage can by the
collectors, was referred to the Sanitary District.
W.R. No. 161 Upon motion by Councilman Pinkley, seconded by Councilman Meyers,
Warrant Resolution No. 161 including Payroll No. 108 was approved
by the following roll call vote: A

City Managers Report The City Manager informed the Council that there would be a meeting
of the American Institute of Park Executives in Redwood City from
January 18-21, 1958. Upon motion by Councilman Pinkley, seconded b
Councilman Meyers, and carried, Councilman Rea was authorized to
attend the meeting in behalf of the City of Costa Mesa with ex-
penses paid.
