HomeMy WebLinkAbout02/24/1959 - Adjourned City Council Meeting1 .0 l REGULAR ADJOURNED MEETING OF THE CITY COUNCIL CITY OF COSTA MESA February 24, 1959 The City Council of the City of Costa Mesa, California, met in regular adjourned session at 7:30 o'clock p.m., February 24, 1959,at the City Hall, 695 West 19th Street, Costa Mesa. The meeting was called to order by the Mayor followed by the Pledge of Allegiance to the Flag and In- vocation by Mayor John Smith. ROLL CALL Councilmen Present: Rea, B. Smith, Pinkley, Meyers, J. Smith Councilmen Absent: None Officials Present: City Manager, City Attorney, City Engineer, Chief Deputy City Clerk PUBLIC HEARING The Mayor announced that the, hour of 7:30 o'clock p.m. having Northwest Improve- arrived this was the time and place fixed by the City.Council ment District of the City of Costa Mesa, California, for hearing on the matter of the improvement of West Victoria Street and certain other streets, alleys, and easements, under the provisions of Division 7 of the Streets, and Highways Code of the State of California. The Clerk reported that notice of the hearing under Division 7 was given by mail as provided by law and that an affidavit showing such compliance is on file in his office. The Clerk further announced that Notice of Improvement had been posted along the streets and alleys'of said Improvement District as required by law and that an affidavit of Posting was on file in his office. The Mayor announced that prior to the consideration of protests it would be necessary that the report under Division 4 of the Streets and Highways Code of the State of California be read to the Council. Whereupon the report,.except as to the map, plat, or diagram and'the assessed valuations and true valuations of, and assessments and estimated assessments on each parcel of land, was read to the Council. The Mayor then inquired of the Clerk if any written protests or objections had been filed. The Clerk reported certain written protests and objections had been filed with him prior to the time set for the hearing. The Clerk then read to the Council all of said protests. After said protests were read several persons asked if they might file written protests now. Thereupon all persons were advised that they might file with the Clerk at this time any written protests. Whereupon the following persons filed written protests: #369 Ludwig J. Vering 2020 Placentia #819 L. V. and -Elizabeth Fodor 543 Victoria #327, 328 Manuel Perez 2097 Placentia Whereupon the Clerk then read said protests. The..Mayor then asked if anyone else desired to file written protests. When no person so desired, the Mayor then asked if any person desired to speak in support of any written protest. The following persons spoke in support of the written protests: Mr. Henry Lusk 741 West Hamilton Mrs. Patricia Platte 2092 Wallace Mr. L. J. Vering 2077 Placentia All protests were referred to the Engineer for report and computation as to the percentage of the area represented thereby. The Mayor declared a recess and the meeting reconvened in fifteen minutes. The Engineer reported that the protests were made by owners of less than one-half of the area of the property to be assessed for the improvement. After a full, fair and impartial hearing and an oppor- tunity having been given to all persons desiring to be heard and no person further desiring to speak, it was moved by Councilman B. Smith, seconded by Councilman Pinkley, and unanimously adopted that all protests be overruled and denied upon the finding that all protests filed were made by the owners of less than one-half of the property to be assessed for the improvement. Oral Communications The Mayor inquired if there were any written communications. Mr. Custer There being no written communications he called for Oral Romar Builders Communications. Mr. Custer of Romar Builders thereupon spoke from the floor inquiring as -to whether or not he could secure a building permit for Lots 11 and 12 of Tentative The City Council having before it the report and the plat of the assessment district, the plans and speci- fications, and being familiar with both, and having considered all protests filed, and the character and nature of the proposed work and necessity for the same, and determined the public interest, convenience and necessity require the improvement as set forth in the plans and specifications, and also having considered the matter as to the area of the property to be assessed for the said improvement, Councilman B. Smith presented RESOLUTION 563 Resolution No. 563,.being A RESOLUTION OF THE CITY COUNCIL Determining Results OF THE CITY OF COSTA MESA, CALIFORNIA, DETERMINING RESULTS of Hearing OF HEARING OVERRULING PROTESTS, DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE CERTAIN WORK OR IMPROVEMENT OF WEST VICTORIA STREET AND CERTAIN OTHER STREETS, ALLEYS AND EASEMENTS (ASSESSMENT DISTRICT NO. 7) AS SET FORTH IN RESOLUTION OF INTENTION NO. 556, and moved its adoption., The motion was seconded by Council- man Pinkley, and carried by the --Following roll call vote: AYES: Councilmen: Pinkley, B. Smith, Rea, Meyers, J. Smith NOES: Councilmen - None ABSENT: Councilmen - None RESOLUTION 564 Councilman Pinkley presented Resolution No. 564, being A Ordering Work RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ORDERING THE WORK DESCRIBED IN RESOLUTION OF INTENTION NO. 556, ADOPTED ON THE 2nd DAY OF FEBRUARY, 1959, IN THE MA'T'TER OF THE CONSTRUCTION OF IMPROVEMENTS IN WEST VICTORIA STREET AND CERTAIN OTHER STREETS, ALLEYS AND EASEMENTS IN THE CITY OF COSTA MESA, and moved its adoption. The motion was duly seconded by Councilman Meyers, and unanimously adopted by the following roll call vote: AYES: Councilmen: Pinkley, B. Smith, Rea, Meyers, J. Smith NOES: Councilmen - None ABSENT: Councilmen - None On motion by Councilman Pinkley, seconded by Councilman. Meyers, and unanimously carried, the hearing was closed. ORDINANCE NO. 224 Ordinance No. 224 being AN ORDINANCE OF THE CITY OF COSTA 2nd Reading MESA APPROVING THE ANNEXATION OF CERTAIN UNINHABITED - Gisler No. 4 TERRITORY CONTIGUOUS TO THE CITY OF COSTA MESA, IN THE Annexation COUNTY OF ORANGE, KNOWN AND DESIGNATED AS "GISLER NO. 4 ANNEXATION", was presented for second reading. Following reading of the title, Councilman B. Smith moved that further reading be waived and that it be read by title .only. The motion was seconded by Councilman Rea and unanimously , carried. Thereupon Councilman B. Smith moved the adoption of Ordinance No. 224. The motion was seconded by Council- man Rea and adopted by the following roll call vote: AYES: Councilmen: Pinkley, B. Smith, .Rea, Meyers, J. Smith NOES: Councilmen - None ABSENT: Councilmen - None Oral Communications The Mayor inquired if there were any written communications. Mr. Custer of Romar Builders thereupon spoke from the floor inquiring as -to whether or not he could secure a building permit for Lots 11 and 12 of Tentative I Tract 2816, explaining that these two lots had been deleted when the Tentative Tract was approved and he used this for description only. The Attorney informed Mr. Custer that these permits could be.. -issued when the Final Tract has been approved by Council and recorded, providing that there is no proposed street or setback ordinance adopted. City Managers Mr. -Unger -stated that Mr. Pinkley,:as representative of the Report City on the Planning Committee ,for the Couhtyy-Water Commission, had recommended that the City .pay its $.10.for each water con- nection_for the fund to study the consolidation program. There- upon it was moved by Councilman B. Smith, seconded by Council- manRea,-that.the City pay to the Committee for its study $.10 for each water connection.
