October 26,. 1959
The City Council of the City of Costa Mesa met in adjourned
regular session, having adjourned by order of the City Council
at its regular meeting of October 19, 1959, and the Clerk re-
porting that a copy of the Order of Adjournment was posted
as required by law, at 8:00,p.m., October 26, 1959, at the
City Hall, 695 West 19th'1Street, Costa Mesa. The meeting was
called to order by the Mayor followed by the Pledge of Alle-
giance and Invocation by Mayor Smith.

PUBLIC HEARING
Bristol No. 3 Annexa-
tion
The Mayor announced that this was the time and place set for
public hearing of protests or objections againstthe proposed
election for Bristol No. 3 Annexation. The Clerk reported that
the affidavit and proof of the publicatian of the Resolution
of Intention,.and the mailing of notices of adoption of said
resolution as required by law, had been m ade and were on file
in the office of the City Clerk. The Mayor thereupon declared the
hearing open. The Clerk read protests from owners of thirty
parcels of land in the proposed annexation. The Mayor inquired
if.there were anyone else wishing to file written protest who had
not already done so, and that such protests could be filed with
the Clerk at this time. All persons having been given full op-
portunity to file further written protests, and no one desiring
to do so, it was moved by Councilman Pinkley, seconded by Council-
man B.Smith, and carried, that the protests be referred to the
City Clerk and City Engineer for check and report back.
At this point the Mayor inquired if there were anyone
present wishing to speak on Bristol No. 3 Annexation. Thereupon
Mr. Walter Shellenberger spoke from the floor in protest and
asked several questions. Mrs. O'Hallaren, 12812 Paularino,
also spoke from the floor asking questions on procedure of an
annexation that is inhabited.
The Mayor inquired if there were anyone else wishing to
speak or if anyone wished to file a written protest. No one de-
sired to speak and no one wished to file a written protest.
The Mayor thereupon called for farther business on the
agenda until such time as the City Clerk and City Engineer had
determined their findings.
ORDINANCE NO. 275 Ordinance No. 275, being AN ORDINANCE OF THE CITY COUNCIL OF THE
2nd reading CITY OF COSTA MESA AMENDING SECTION 10.3 OF ARTICLE X OF ORDINANCE
Setbacks Tr. 3363 and NO. 32 OF SAID CITY ESTABLISHING SETBACKS IN TRACT NO. 3363 AND
Alley between Hamilton BETWEEN VICTORIA AND HAMILTON STREETS EAST OF HARBOR BOULEVARD,
and Victoria was presented for second reading. Upon motion by Councilman B.
Smith, seconded by Councilman Rea, and carried, Ordinance No. 275
was read by title only. Thereupon it was moved by Councilman
Pinkley, seconded by Councilman Meyers, that Ordinance No. 275
be adopted. The motion carried by the following roll call vote:
AYES: Councilmen Rea, B.Smith, Pinkley, Meyers, J.Smith
NOES: Councilmen - None
ABSENT: Councilmen - None
Right of Way Deeds Upon motion.by Councilman B.Smith, seconded by Councilman Rea,
a right of way deed dated September 10, 1959, for a temporary
easement for the Santa Ana Avenue Storm Drain Channel, from Frank
and Anna L. Belcher was received and ordered placed on record by
the following roll call vote:
AYES: Councilmen Rea, B.Smith, Pinkley, Meyers, J.Smith
NOES: Councilmen - None
ABSENT: Councilmen!- None

Upon motion by Councilman B.Smith, seconded by Councilman Rea,
a right of way deed dated September 22, 1959, for a temporary
easement for the Santa Ana Avenue Storm Drain Channel, from
Nicholas Angelo and Juanita I. Elefther was received and ordered
placed on record by the following roll call vote:
AYES: Ccu ncilmen Rea, B.Smith, PInkley, Meyers, J.Smith
NOES: Councilmen - None
ABSENT: Councilmen - None
Upon motion by Councilman B.Smith, seconded by Councilman Rea,
a right of way deed dated October 21, 1959, from Robert K. and
Helen L. Snyder for that certain street known as Sierks Street
was received and ordered placed on record by the following roll
call vote:
AYES: Councilmen Rea, B.Smith, Pinkley, Meyers, J.Smith
NOES: Councilmen - None
ABSENT: Councilmen None
Upon motion by Councilman B.Smith, seconded by Councilman Rea,
a right of way deed dated October 22, 1959, from Eugene Dugas for
that certain street known as Thurin Avenue, was received and
ordered placed on record by the following roll call vote:
AYES: Councilmen Rea, B.Smith, Pinkley, Meyers, J.Smith
NOES: Councilmen - None
ABSENT: Councilmen - None
RESOLUTION NO. 659 Upon motion by Councilman Meyers, seconded by Councilman Pinkley,
Endorsement of Worlds Resolution No. 659, being A RESOLUTION OF THE CITY COUNCIL OF THE
Fair in 1966 CITY OF COSTA MESA ENDORSING THE HOLDING OF A WORLDS FAIR IN THE
LOS ANGELES COUNTY IN 1963 was adopted by the following roll call
vote:
AYES: Councilmen Rea, B.Smith, Pinkley, Meyers, J.Smith
NOES: Councilmen - None
ABSENT: Councilmen - None
Communication of Macco A communication was read.from Macco Corporation requesting permis-
Corp. trailer sion to place a house trailer for a construction office on Tract
3487 in the City of Costa Mesa, during the construction of new
dwellings. It was moved by Councilman B.Smith, seconded by
Councilman Meyers, and carried, that the Clerk notify Macco Cor-
poration that this use of a trailer is allowable under the trailer
ordinance.
Communication of Gover= Upon motion by Councilman Pinkley, seconded by Councilman Rea,
nor of Hawaii and carried, the communication from Robert F. Ellis, Administra-
tive Assistant to the Governor of the State of Hawaii, acknowledg-
ing receipt of Costa Mesa Resolution No. 654, was received and
ordered filed.
A. B. C. Report Upon motion by Councilman Pinkley, seconded by Councilman B.Smith,
and carried, the report of the Alcoholic Beverage Control on a new
on -sale beer license for James H. A. Cook and Ruby J. Cook, the
Highlander, 436 E. 17th Street, was received and ordered filed.
Recess The report of the City Engineer and City Clerk on the protests of
the Bristol No. 3 Annexation not yet having been received, the
Mayor declared a fifteen minute recess..
Bristol No. 3 Annexa- The meeting was called to order by the Mayor at 9:05 p.m. The
tion Report on Protects City Engineer reported that the total Assessed Valuation of the
proposed Annexation was $348,760.00 and protests amounted to
$154,220.00 which was approximately 1521 per cent of the total,
that there Mere 502 acres in the proposed annexation and pro-
tests amounted to 71 acres or 14% of the total.
Thereupon it was moved by Councilman Pinkley, seconded by.
Councilman Meyers, and carried, that protestswere not made by the
owners of one-half of the value of the territory proposed to be
annexed as shown on the last equalized assessment roll..
Thereupon it was moved by Councilman Pinkley, seconded by
Councilman B.Smith, and carried, that the public hearing be closed.
ADJOURNMENT Upon motion by Councilman Pinkley, seconded by Councilman B. Smith,
and carried, the meeting was adjourned at 9:10 o'clock p.m. to
8:00 o'clock a.m. on October 27, 1959, at the Council Chambers in
the City Hall, 695 West 19th Street, Costa Mesa.
