HomeMy WebLinkAbout02/29/1960 - Adjourned City Council MeetingADJOURNED REGULAR MEETING OF THE CITY COUNCIL CITY OF COSTA MESA February 29, 1960 The City Council of the City of Costa Mesa met in ad- journed regular session, having adjourned by order of the City Council at its regular adjourned meeting of February 26, 1960, and the Clerk reporting that a copy of the Order of Adjournment was posted as required by law, at 7:30 p.m., February 29, 1960, at the City Hall, 695 West 19th Street, Costa Mesa. The meeting was called to order by the Vice -Mayor followed by the Pledge of Allegiance to the Flag and Invocation by Councilman Rea. ROLL CALL Councilmen Present: Rea, Pinkley, Meyers, B. Smith Councilmen Absent: J. Smith. Officials Present: City Manager, City Attorney, City Engineer, Director of Public Works, Chief Deputy City.Clerk PUBLIC HEARING The Vice Mayor announced that this was the time and place Adams No. 1 set for.the Public Hearing on the proposed :dams No. 1 Annexation Annexation. The Clerk stated that the public"notice had been duly published and affidaivt of the publication was on file in his office, notices mailed to all property owners and no written communications had been received. The Vice -Mayor inquired if there were anyone present wish- ing to speak. No one wishing to speak, it was moved by Councilman Pinkley, seconded %by Councilman Meyers and carried that the public hearing be closed. (14ayo-r Smith entered the chambers at this point.) ORDINANCE 295 Thereupon it was moved by Councilman Pinkley, seconded 1st reading by Councilman Rea, and carried that first reading be given to Ordinance No. 295 being AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY CONTIGUOUS TO THE CITY OF COSTA IESA, IN THE, COUNTY OF ORANGE, KNOWN AND DESIGNATED AS THE "ADAMS NO. 1 ANNEXATION". Agreement with The City Attorney presented the proposed agreement with Segerstroms on the Segerstroms for the use of four water wells on the use of Water Segerstrom property for emergency use. All wells had Wells been found to be good producing water wells. After dis- cussion it was moved by Councilman Pinkley, seconded by Councilman Meyers that the agreement be accepted and the Mayor and the City Clerk be authorized to sign said agreement on behalf of the City. The motion carried by the following roll call vote: AYES: Councilmen: Rea, Pinkley, Meyers, B. Smith J. RESOLUTION 705 The City Attorney presented a right of way deed and agree - Right of Way ment for the widening of Harbor Boulevard from Maier, Harbor Blvd. Bojarsky and Zeman. After:,discussion`.it was moved by Bojarsky & Councilman B. Smith, seconded by Councilman Pinkley that Zeman, Maier Resolution No. 705 being A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA ACCEPTING AN EASEIv NT DEED FOR THE WIDENING OF HARBOR BOULEVAhD FROM MAIER, bOJARSKY AND ZEMAN, A CO -PARTNERSHIP, AND AUTHORIZING THE EXECUTION OF A RIGHT OF WAY CONTRACT. Smith NOES: Councilmen: None ABSENT: Councilmen: None ORDINANCE 294 Upon motion by Councilman Pinkley, seconded by Council - 2nd reading. man Meyers, and carried, second reading was given to Harbor No. 1 Ordinance No. 294 and title only was read. Upon motion Annexation by Councilman Pinkley, seconded by Councilman Rea, Ordinance No. 291, being AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA APPHu\TING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY CONTIGUOUS TO THE CITY OF COSTA MESA, IN THE COUNTY OF ORANGE, KNOWN AND DESIGNATED AS "HARBOR NO. 1 ANNEXATION". The motion carried by the following roll ca -11 vote: AYES: Councilmen: Rea, Pinkley, Meyers, B. Smith, J. Smith NOES: Councilmen: .None ABSENT: Councilmen: None Building Moving, Building Moving Application No. 291, being the applica- No. 291 tion of Andy Zitney, 1819 Placentia Avenue, Costa Mesa, Zitney to move a dwelling from 360 East 21st Street to 1819 Placentia Avenue, was presented together with the recom- mendation of the Planning Commission for approval subject to the following conditions: 1) All the requirements of the Department of Building Safety and the posting of a $6,000.00 Bond; 2) Two for one off-street parking ratio under the direction of the Director of Planning. Mr. Zitney was present in behalf of his application. The Council requested information of Nr. Zitney as to whether or not there was a fence built on City property and also .a platform which was used for trash cans. NIr. Zitney stated that the fence was in City property as was the platform and he would remove both should the City so request. After discussion, it was moved by Councilman B. Smith, seconded by Councilman Meyers, and carried, that the application be granted subject to all the conditions of the Planning Commission, with the added stipulation that if the platform and fence are a menace on behalf of the City upon the request of the Director of Planning, both will be removed. Building Moving Building Moving Application No. 292, being the applica- No. 292 tion of Dorothy S. Grant,.266 East 16th Street., Costa Grant Mesa, to move a dwelling from 334 East 21st Street to 266 East 16th Street, was presented together with the recommendation of the Planning Commission for approval subject to the following conditions: 1) Subject to all the.requirements of the Department of Building Safety including the posting of a $4000.00 Bond; 2) Two for one off-street parking:::ratio.,under the direction of the Director.of Planning; 3) That a minimum of 10 feet is maintained between the existing dwelling and the move -in; 4) Residential sidewalks.and a concrete approach to be installed by the applicant. Applicant stated that the 10 feet between buildings would be maintained. After discussion it was moved by Councilman B. Smith, seconded by Councilman Rea and carried, that the permit be granted subject to all the conditions of the Planning Commission. RESOLUTION 706 Upon motion by Councilman B. Smith, seconded by Council - Supplemental man Meyers, Resolution No. 706, being A RESOLUTION OF Agreement -Gas THE CITY COUNCIL.'.OF THE CITY OF COSTA MESA ADOPTING 13UD- Tax GET AND APPROVING FIRST SUPPLEEENl'AL MEMORANDUM OF AGREE- MENT FOR EXPENDITUttE OF GAS TAX ALLOCATION FOR MAJOR CITY STREETS, was adopted by the following roll call vote: h AYES: Councilmen: Rea, Pinkley, Meyers, B. Smith, J. Smith NOES: Councilmen: None ABSENT: Councilmen: None Right of Way Upon motion by Councilman Pinkley, seconded by Council - Deeds man Meyers, a right of way deed dated January 29, 1960 from David and Catherine Barnard and A. E. and Lois Tiffany for that certain storm drain south of 18th Street, was received and ordered placed on record by the following roll call vote: AYES: Councilmen: Rea, Pinkley, Meyers, B. Smith, J. Smith NOES: Councilmen: None ABSENT: Councilmen: None Upon motion by Councilman Pinkley, seconded by Council- man Meyers, a right of way deed dated February 8, 1960 from Roy W. and Edna Roush for that certain street known as Virginia Place was received and ordered placed on record by the following roll call vote: AYES: Councilmen: Rea, Pinkley, Meyers, B. Smith, J. Smith - NOES: Councilmen: None ABSENT: Councilmen: None Upon motion by Councilman Pinkley, seconded by Council- man Meyers, a right of way deed dated February 23, 1960 from Macco Corporation for that certain storm drain ease- ment adjacent to Tract 3470 and Lots 21 and 22 of Tract 3470 within Tract 653, was received and ordered placed on -record by the following roll call vote: AYES: Councilmen: Rea, Pinkley, Meyers, B. Smith, J. Smith NOES: Councilmen: None ABSENT: Councilmen: None Upon motion by Councilman Pinkley, seconded by Council- man Meyers, a right of way deed dated February 24, 1960 from Lorayne E. After discussion it was moved by Councilman B. Smith, seconded by Councilman Meyers,.and carried that permit be granted for one year, subject to the approval and requirements of the -Department of"Building Safety. Refund -Kirch A communication"was read from Mrs. Olive V. Kirch, 1455 Superior Street, requesting refund of $5.00 for a dog license,. inasmuch as she lives in County territory. Upon motion by Councilman Pinkley, seconded by Councilman Meyers, the full refund of $5.00 was granted to Mrs. Olive V. Kirch for Dog License No. 39. Smith that Resolution.No.-707­,._being A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA URGING THE GOVERNOR OF THE STATE OF.CALIFORNIA TO CALL A SPECIAL SESSION OF THE LEGISLATURE.FOR THE.PURPOSE OF ENACTING NARCOTIC RESTRICTIONS, be adopted. The motion carried by the following roll call vote: AYES: Councilmen: Rea., Pinkley, Meyers, B. Smith, J.
