HomeMy WebLinkAbout04/04/1960 - City CouncilREGULAR MEETING OF THE CITY COUNCIL CITY OF COSTA MESA April 4, 1960 The City Council of the City of Costa Mesa met in regular session at 7:30 o'clock p.m., April 4, 1960, at the City Hall, 695 West 19th Street, Costa Mesa. The meeting was called to order by the Mayor - followed by the Pledge of Allegiance to the Flag and Invocation by Reverend Herbert Johnson. ROLL CALL Councilmen Present: Rea, Pinkley, Meyers, B.Smith, J.Smith Councilmen Absent: None Officials Present: City Manager, City Attorney, City Engin- eer, Director of Public Works,'Director of Finance, Chief Deputy City Clerk Minutes 3/21/60 Upon motion by Councilman B. Smith, seconded by Councilman Meyers, and carried, the minutes of the regular meeting of March 21, 1960, were approved as written and previously distributed. Proclamation The Mayor presented a Proclamation proclaiming the week of Barber Shop Har- April 9 to 16 as Barber Shop Harmony Week in the City of mony Week Costa Mesa, whereupon a Barber Shop Quartette presented two numbers. PUBLIC HEARING The Mayor announced that this was the time and place set for Sunflower No. 2 the Public Hearing on Sunflower No. 2 Annexation. The Clerk Annexation reported that the notice of public hearing had been duly published and the affidavit was on file in his office. He reported that notice of hearing had been sent to all property owners and no written communications had been received. The Mayor then inquired if there were anyone present irishing to speak. No one desiring to speak it was moved by Councilman B. Smith, seconded by Councilman Pinkley, and carried, that the public hearing be closed. Thereupon it was moved by Councilman Pinkley, seconded by Councilman Rea, and carried, ORDINANCE 302 that first reading be given to Ordinance No. 302, being AN lst reading ORDINANCE OF THE CITY COUNCIL OF COSTA MESA APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY CONTIGUOUS TO THE CITY OF COSTA MESA, IN THE COUNTY OF ORANGE, KNOWN AND DESIGNATED AS "SUNFLOWER NO. 2 ANNEXATION." Adopt plans of The City Engineer presented to the Council plans and speci- S.A.I.D. fications for the Improvement of Santa Ana Avenue and certain other streets, alleys and easements in said City. After dis- cussion it was moved by Councilman B. Smith, seconded by Councilman Rea, and carried that the plans, drawings, specifi- cations and maps of the proposed assessment district be adopted. Smith, seconded by Councilman Pinkley that Resolution No. 720, being A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, COVERING PRELIMINARY DETERMINATION OF THE LEGISLATIVE BODY UNDER "SPECIAL ASSESSMENT INVESTIGATION, LIMITATION AND MAJORITY PROTEST ACT OF 1931," DETERMINING THE GENERAL NATURE, LOCATION AND EXTENT OF THE PROPOSED WORK AND ACQUISITION AND ORDERING THE PREPARATION OF A REPORT OF SAID IMPROVEMENT AND ACQUISITION, IN THE MATTER OF THE IMPROVEMENT OF SANTA ANA AVENUE AND CERTAIN OTHER STREETS, ALLEYS AND EASEMENTS IN SAID CITY (ASSESSMENT DISTRICT N0. 8), having been read in full, was adopted by the following roll call vote: AYES: Councilmen: Rea, Pinkley, Meyers, B.Smith, J.Smith NOES: Councilmen: None ABSENT: Councilmen: None Mulford-Jeanes The Attorney informed the Council that Mr. Holbrook Mulford Assessment Dis- had purchased a piece of property from John A. Jeanes, said trict charges property had been included in the Northwest Improvement Dis- trict,.and the Cty held a bond of Mr. Jeanes for a portion of the cost of the assessment on the property.now owned by _ Mr. Mulford. He would therefore recommend that a warrant be drai-m in the amount of $259.30 in favor of Mr. Mulford and the City in turn recover that amount from Mr. Jeanes. There- upon it was moved by Councilman Pinkley, seconded by Council- man Meyers, that authorization be given to the Director of Finance to issue a warrant in the sum of $259.30 for Mr. Holbrook Mulford. The motion carried by the following roll call vote: AYES: Councilmen: Rea, Pinkley, Meyers, B. Smith, J. Smith NOES: Councilmen: None ABSENT: Councilmen: None Gardner-W.V.I.D. The Attorney informed the Council that Mr. Wilbur C. Gardner Incorrect had received a card from the assessment engineer of the West charges Victoria Street Improvement District with the amount of $107.9+ shown., and had afterwards received from the Griffith Company_ a bill in the amount of $276.17 as billed, the latter being the correct amount of the improvements done to his pro- perty. The first amount being an error in the billing. The Attorney stated Mr. Gardner had requested that this be pre- sented to the Council for their decision as to which should be the correct amount. Councilman Meyers requested informa- tion as to the amount of the estimated assessment. Mr. Swartz stated that amount was $419.60. Thereupon, after discussion, it was moved by Councilman Meyers, seconded by Councilman Rea, and carried, that the correct amount of $276.17 as billed by the Griffith Company be the charges for Mr. Gardners property, and the damages requested by Mr. Gardner be denied. RESOLUTION 721 The Director of Public Works informed the Council that the Cross -Town hearing on the proposed bus line for Costa Mesa was to be Suburban Bus held April 22 in the'Garden Grove City Hall. He suggested Lines that if the Council was in favor of the bus line that a Resolution be adopted.and forwarded to them for the records. Thereupon it was moved.by Councilman Pinkley, seconded by Councilman B. Smith that Resolution No. 721, being A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA SUPPORTING THE APPLICATION OF CROSS-TOWN SUBURBAN BUS LINES, INC. FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY FOR A PASSENGER STAGE SERVICE BETWEEN THE CITIES OF LOS ANGELES, GARDEN GROVE AND COSTA -MESA, be adopted. Dudek It was moved by Councilman Pinkley, seconded by Councilman Meyers, that Resolution No. 722, being A RESOLUTION OF THE RESOLUTION 722 CITY COUNCIL OF THE CITY OF COSTA MESA ACCEPTING THE RESIGN - Wilson ATION OF ROBERT M. Councilmen: None ABSENT: Councilmen: None It was moved by Councilman Pinkley, seconded by Councilman RESOLUTION 723 Meyers that Resolution No. 723, being A RESOLUTION OF THE Dudek CITY COUNCIL OF THE CITY OF COSTA MESA ACCEPTING THE RESIGN- ATION OF ELMER DUDEK AND EXPRESSING APPRECIATION OF HIS LONG AND FAITHFUL SERVICE TO THE COMMUNITY, be -adopted. Smith NOES: Councilmen: None ABSENT: Councilmen: None Refund-Saffell A request for refund from Hudson B. Saffell for Building Building Permit Permit Application No. 11276 was presented, together with Application_ the recommendation of the Building Official for a. refund No. 11276 of $83.73, which is 85% of the permit fee; inasmuch as the plans had been checked. Thereupon it was moved by Councilman B. Smith, seconded by Councilman Meyers, that refund of $83.73 be granted. Myers, Assistant Winner City Engineer, recommending -that the $1,000.00 cash per- formance bond for Raymond -L. Winner for the improvement of Westminster between 16th Place and 16th Street on Vari- ance 706, be exonerated. Thereupon it was moved by Council- man Pinkley, seconded by Councilman B. Heller, Street Foreman, Kovack recommending that the cash bond of $1,200.00 less $65.00 for work performed by the -City be exonerated for Mr. Arthur Kovack, 310 Valencia Mesa Drive, Fullerton. There- upon it was moved by Councilman B:. Smith, seconded by Councilman Meyers that the cash bond of $1,200.00 less $65.00 or $1,135.00 be exonerated. Thereupon it was moved by Councilman B. Smith, seconded by Councilman Pinkley, that Ordinance No. 301 be adopted. Smith NOES: Councilmen: None ABSENT: Councilmen: None Building Building Moving Application No. 300, being the application Moving No. 300 of Edwin L. Noonan, 323 Bowling Green, Costa Mesa, to move -.Noonan a garage from 327 17th Place, to 356 16th Place, was.presented together -with the recommendation of the Planning Commission for approval subject to the following conditions: 1) All the requirements of the Department of.Building Safety; 2) The posting of a 2,000.00 bond. The Clerk also read a letter from the Building Official stating that the bond of $2,000.00 was set in error and should only be $1,000.00. Thereupon,it was moved by Councilman B. Smith, seconded by Councilman Meyers and carried that the recommendations of the Planning. Commission be upheld, but that the bond be lowered to $1,000.00 as recommended by the Building Official. Tentative Tentative Tract Map No. 3723 for K. W. Koll, 1555 Placentia Tract Map 3723 Avenue, to divide property on the north side of Gisler Avenue, Koll - bounded on the west by Tract No. 3625 into 42 lots, was pre- sented, together with the,recommendation of the Planning Com- mission for approval subject to all the requirements of the City Engineer and the Orange County Flood Control. After dis- cussion it was moved by Councilman B. Smith, seconded by Councilman Rea and carried, that the action of the Planning Commission be upheld. RESOLUTION 725 A request for change of street name of "Braemar Terrace" to Braemar Terrace "Gleneagles Terrace" in Tract No. 3470 was presented together to with the recommendation of the Planning Commission for approv- Gleneagles Terrace al. Thereupon it was moved by Councilman Rea, seconded by Councilman Pinkley, that Resolution No. 725, being A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA CHANGING 13 THE NAME OF "BRAEMAR TERRACE" IN TRACT NO. 3470 TO "GLENEAGLES TERRACE",•be adopted. Thereupon it was moved by Councilman Pinkley, seconded by Councilman B. Smith, that.public hearing for the proposed name change be set for May 16, 1960., at the hour of 7:30 o'clock p.m. or as soon thereafter as possible.in the Council Chambers of the City Hall, and that the Director of Planning notify all the. residents of the streets concerned of the public hearing. The motion carried. unanimously. Bonner Bonner, 2568 Yale Place, Costa Mesa, to permit encroachment of 10 feet into required 50 feet from center line of Tustin Avenue, or 40 feet from center line on the northwesterly cor- ner of Ogle and Tustin Avenues, was presented together with the recommendation of the Planning Commission for denial for the following reasons: l) There is a.possibility that'Tustin Avenue may be widened; 2) Since the lot is 630 feet deep, the Commission felt there was no necessity to ask for this en- croachment as the applicant has sufficient land. The Clerk read a request of the Boy's"Club of the Harbor Area to hold a circus on Baker Street, 660 feet easterly of Bristol Street on April 26, with 10% of the gate receipts and 20% of the advance ticket sales to be given to the Boy's Club for their swimming pool project, and also granting of a free permit. Smith, seconded by Councilman of Trailer Meyers and carried, the notification of the Controller of Coach Fees the State of California dated March 25, 1960 regarding ap- portionment of trailer coach fees was received and ordered filed. City Managers Mr. Unger reported his findings regarding the licensing of Report Trampoline locations in San Diego', Buena Park, Los Angeles, and certain other communities in Southern California. Sauter Mr. Unger reported to the Council that investigation had been made on whether or not a water line had been installed for Mr. Carl Sauter in connection with the West Victoria Street Improvement District and found no connection had been made, and he was working with Mr. Sauter and the Griffith Company to make the proper deduction in the billing. Lane Mr. Unger reported that he had investigated the driveway of Mrs. Rose Lane and found it to be adequate and that no change could be made in it and recommended Mrs. Lane be notified of the results of the investigation. Thereupon it was moved by Councilman B. Smith, seconded by Councilman Rea and carried that Mrs. Lane be notified that the driveway is adequate for automobile travel. C. K. Priest to Mr. Unger stated that Chief Deputy City Clerk C. K. Priest attend Institute had been appointed as a member of the election committee in the Southern California City Clerks Association and requested permission to attend the National Institute of Municipal Clerks to be held in St. Paul, Minnesota from May 16 - 19. He stated Mr. Priest would attend this and take his vacation at the same time. Mr. Unger stated that an advance of 200.00 would be required, which would be about one-half of the cost usually spent. Thereupon -it was moved by Council- man Rea, seconded by Councilman Pinkley that Mr. Priest be allowed to attend the National Institute of Municipal Clerks from May 16 - 19 and that an advance of $200.00 be approved.
