REGULAR MEETING OF THE CITY COUNCIL
CITY OF COSTA MESA
August 20, 1962
The City Council of the City of Costa Mesa, California, met in
regular session at 7:30 p.m., August 20, 1962, at the City Hall,
695 West 19th Street, Costa Mesa. The meeting was called to
order by the Mayor followed by the Pledge of Allegiance to the
Flag and Invocation by Reverend Clyde Skidmore, First Southern
Baptist Church.

Minutes Upon motion by Councilman Meyers, seconded by Councilman
August 6, 1962 Tomchak, and carried, the minutes of the regular meeting of
August 6, 1962, were approved as written and previously
distributed.
The Clerk presented the report of the Street Superintendent on
the cost of removing weeds, rubbish and refuse in front of and

The Mayor announced that this was the time and place set for

Clerk reported that notice of the public hearing had been duly

The Mayor then inquired if there were anyone present wishing to
be heard. No one wishing to speak, it was moved by Councilman
Meyers, seconded by Councilman Wilson, and carried that the
public hearing be closed. Thereupon it was moved by Councilman
Wilson, seconded by Councilman Meyers that first reading be given
to Ordinance 62-34, being AN ORDINANCE OF THE CITY COUNCIL OF
ORDINANCE 62-34.

be approved subject to the recommendations of the Planning
Commission: 1. Dedication of all land 30 feet from the center
line of Wallace and the 15 -foot spandrel to the City of Costa
Mesa for street purposes; 2. The improvement of Wallace Avenue
at owner's expense, with base, paving, gutters, curbs, residential

Fred W. Martin home in an R1, Single -Family Residential zone, was presented
together with the recommendation of the Planning Commission for
approval subject to the following conditions: 1. No signs;
2. No employees; 3. No lessons after 9:00 p.m.; 4. For one
year with the right to request renewal without fee. After dis-
cussion, it was moved by Councilman Smith, seconded by Council-
man Wilson, and carried that the application be approved subject
to the conditions of the Planning Commission.
Conditional Use Conditional Use Permit C-105 for Ted R. Bolte and M. H. Koll,
Permit C-105 251 22nd Street, Costa Mesa, for permission to erect a 10 -foot
Ted R. Bolte and by 10 -foot Temporary Directional Sign, 1 foot from the front
M. H. Koll property line to advertise the first sale and/or lease of apart-
ments,,property located at 1955 and 1965 Pomona, Costa Mesa, was
presented together with the recommendation of the Planning
Commission for approval for a period of one year or until the
first sale or lease of apartments at 1965 Pomona, whichever is
sooner, subject to all the requirements of the Department of
Building Safety, and that said sign is to be removed by the
applicant, at his expense, at the end of one year and an Agree-
ment to this effect shall be signed by the applicant, subject
to the approval of the City Attorney. After discussion, it
was moved by Councilman Wilson, seconded by Councilman Meyers,
and carried that the application be approved subject to the
recommendations of the Planning Commission.
Conditional Use Conditional Use Permit C-106 for Humble Oil and Refining Company,
Permit C-106 Box 7033, Long Beach 7, for permission to construct and operate
Humble Oil a service -station in a C2 zone on property located on the south -
Company westerly corner of West 17th Street and Placentia Avenue, Costa
Mesa, was presented together with the recommendation of the
Planning Commission for approval subject to the following
conditions: 1. Commercial sidewalks to be installed by the
owner or applicant at their expense for a distance of 180 feet
on Placentia and 126 feet on West 17th Street, under the direction
of the City Engineer; 2. That the improvements of streets are
to include base, paving, gutters, and curbs to be provided at
applicant's expense along the 180 feet of Placentia and the 126
feet of West 17th Street, also concrete driveway approaches to
be installed, all under the direction of the City Engineer;
3. All street cuts shall be subject to the approval of the
Traffic Commission or the City Engineer; 4. An agreement
shall be signed by the applicant that they will be responsible
for the cost of moving any structure that may be in the path
of future street widening; 5'. The approval of this Condi-
tional Use Permit does not grant approval of the location of the
pump island, signs or canopies. After discussion, it was moved
by Councilman Meyers, seconded by Councilman Tomchak, and
carried that the application be approved subject to the recom-
mendations of the Planning Commission.
Conditional Use Conditional Use Permit C-107 for Humble Oil and Refining
Permit C-107 Company, Box 7033, Long Beach.7, for permission to construct
Humble Oil and operate a service station in a C2 zone on property located
Company on the northerly corner of Newport Avenue and Bay Street, Costa
Mesa, was presented together with the recommendation of the
Planning Commission for approval subject to the following condi-
tions: 1. Dedication of all land 30.00 feet from the center
line of existing Bay Street to the City of Costa Mesa for
street widening purposes; 2. The improvement of the northerly
one half of Bay Street, at owner's expense, including base,
paving, curbs, gutters, commercial sidewalks and concrete
driveway approaches, under the direction of the City Engineer;
3. Installation of commercial sidewalks and concrete driveway
approaches along the westerly side of,Newport Boulevard, by
the applicant, at his .expense under the direction of the
State Division of Highways; 4. That the 35 -foot spandrel
radius be dedicated to either the City of Costa Mesa or the
State Division of Highways and shall be improved at the expense
of the applicant under the direction of either of the above
jurisdictions; 5. The location and number of curb cuts on
Bay Street shall be cleared with the Costa Mesa Traffic Commis-
sion or the City Engineer; 6. The approval of this Conditional
Use Permit does not in any way constitute the approval of loca-
tion of any items shown on the plot plan. After discussion,
it was moved by Councilman Tomchak, seconded by Councilman
Meyers, and carried that the application be approved subject
to the conditions of the Planning Commission.
Conditional Use Conditional Use Permit C-108 for Michael Kay, 23+0 Newport
Permit C-108 Boulevard, Costa Mesa, for permission to exceed maximum height
Michael Kay as per Section 9270.2 (4), Division VII, Municipal Code,
allowing the construction of a multi -story residential develop-
ment not to exceed 3 stories on property located at the north-
west corner of 16th Place and Westminster Avenue, in an R2
zone, was presented together with the recommendations of the
Planning Commission for approval subject to the following
conditions: 1. Dedication of all land 25 feet from the center
line of Westminster; the 15 -foot spandrel radius at the inter-
section of 16th Place and Westminster Avenue and 2.5 feet
along the rear property lines for alley purposes; 2. The
improvement of the westerly one half of Westminster at owner's
expense, with base, paving, curbs, gutters, under the direction
of the City Engineer; 3. The installation of residential
sidewalks and concrete driveway approaches on Westminster and
East 16th Place at owner's expense, under the direction of the
City Engineer; 4. The improvement of the alley as per City
Standards for a width of 17.5 feet and a length of 180.13 feet
at owner's expense under the direction of the City Engineer;
5. The trash area to be adjusted to allow a sight distance
visibility for cars backing onto the alley; 6. Dedication of
5 feet on East 16th Place on lot described in Assessor's book
as 117-152-09 to the City of Costa Mesa for street purposes;
7. Block walls at ingress and egress to be under the direction
of the Planning Department. After discussion, it was moved by
Councilman Wilson, seconded by Councilman Meyers, and carried
that the application be approved subject to the conditions of
the Planning Commission.
Conditional Use - Conditional Use Permit C-109 for Sulo V. Nyholm, 1988 Charle
Permit C-109 Street, Costa Mesa, for permission to construct in a C2 zone,
Sulo V. Nyholm a single-family dwelling on the second story in conjunction
with a physical therapy operation on the first floor on property
located at 1988 Charle Street, Costa Mesa, was presented
together with the recommendation of the Planning Commission for
approval. After discussion, it was moved by Councilman Smith,
seconded by Councilman Meyers, and carried that the application
be approved subject to the conditions of the Planning Commission:
1. Screening of exposed parking area on Charle Street and along
Conditional Use both sides of the property according to standards of the City
Permit C-109 of Costa Mesa. 2. Installation of commercial sidewalks and

seconded by Councilman Meyers, and carried, action was deferred
to the Council meeting of September 4, 1962, until Council has
acted on Rezone Petition 179.
Recess The Mayor declared a five-minute recess, and the meeting
reconvened at 9:40 p.m.
Subdivision 428 Subdivision Application 428 for Lillian W. Butler, 2020 Aliso
Lillian W. Street, Costa Mesa, to divide property located at 2436 Newport
Butler Boulevard, Costa Mesa, into 2 parcels, (Parcel B has substandard
frontage) was presented together with the recommendations of
the Planning Commission for approval subject to the following
conditions: 1. Commercial sidewalks to be installed by the
applicant, at.her expense, with concrete driveway approaches,

the application was approved subject to the conditions of the

Subdivision 429 Subdivision Application 429 for Donald Dobkins, President of
Donald Dobkins L. L. Dobkins Construction Company, 10032 Garden Grove
Boulevard, Garden Grove, to divide property located on the
.southeasterly corner of Wilson and Placentia into 2 parcels,
was presented together with the recommendation of the Planning
Commission for approval subject to the following conditions:
1. If, in the opinion of the City Engineer, a cul de sac can
be developed, applicant shall provide necessary deed of right
of way on his property for that portion of the cul de sac.
If a cul de sac cannot be developed in the opinion of the City
Engineer, then applicant shall dedicate the 25 feet for the
length of 50 feet at the westerly terminus of existing Congress
Street; 2. Street shall be improved with base, curbs, gutters,
residential sidewalks, and concrete driveway approaches, at
owner's expense, under the direction of the City Engineer;
3. Street lights to be installed at applicant's expense, under
the direction of the Street Lighting Superintendent. Upon
motion by Councilman Meyers, seconded by Councilman Wilson, and
carried, the application was approved subject to the recommenda-

Subdivision 431 Subdivision Application 431 for Constantin A. Flink, 155 East
Constantin Flink 21st Street, Costa Mesa, to divide property located at 155 East
21st Street and 163 East 21st Street, Costa Mesa, into 2 parcels,
(Parcel A is substandard in frontage) was presented together with
the recommendation of the Planning Commission for approval subject
to the following conditions: 1. Residential sidewalks to be
installed by the owner, at his expense, across the front of
Parcel B, on 21st Street, for a distance of 126 feet and concrete
driveway approaches under the direction of the City Engineer;
2. That a copy of the recorded easement be filed with the City
of Costa Mesa for the 15 -foot ingress and egress from 21st
Street to Parcel A. Upon motion by Councilman Smith, seconded
by Councilman,11ilson, and carried, the application was granted
subject to the conditions of the Planning Commission.
PERMITS Upon motion by Councilman Smith, seconded by Councilman Meyers,
and carried, permission was granted to Donald E. Swedlund of
Coast General Tire, 585 -West 19th Street,.Costa Mesa, for per-
mission to erect a directional sign nine feet by eleven feet on
PERMITS the corner of Wilson Street and Newport Boulevard on the
Continued property of Four Seasons Trailer Park.
The application of the Junior Chamber of Commerce for permission
to operate a sound truck in the City of Costa Mesa on Saturday
and Sunday the 25th and 26th of this month to advertise the seat
belt clinic to be held on those days was approved upon motion
by. Councilman Wilson, seconded by Councilman Smith, and carried,
the license fee being waived.
The application of Eggman Enterprises, 10031 Garden Grove
Boulevard, Garden Grove, for permission to operate 11 skill
games was presented. It was reported that the games were
already in operation in violation of the Municipal Code. Upon
motion by Councilman Tomchak, seconded by Councilman Wilson,
and carried, the License Department was instructed to inform
the owner that the machines must not be in operation until a
permit is obtained, which may be done at the next council
meeting of September_+, 1962.
The application of Southern California Security, 1+582 Golden
West, Westminster, for permission to operate a private patrol
was presented. Upon motion by Councilman. Smith, seconded by
Councilman Tomchak, and carried, the application was granted
subject to the approval of the Chief of Police.
The application of Donald E. Bigelow, 267 Costa Mesa Street,
Costa Mesa, to operate a mobile sharpening service was presented.
Upon motion by Councilman Wilson, seconded by Councilman Tomchak,
and carried, the application was granted subject to the approval
of the Chief of Police.
The application of the United Cerebral Palsy Association of
Orange County, Incorporated, Post Office Box 1374, Santa Ana,
for permission to solicit funds on a house-to-house campaign
was presented. Upon motion by Councilman Tomchak, seconded by
Councilman.Wilson, and carried, the application was granted
with the conditions of Section 691+, Subsection J, of the
Municipal Code being waived.
Atlantic Pacific The application of the Atlantic Pacific Patrol, 7795 Westminster
Patrol Avenue, Westminster, was presented for permission for a private
patrol. Upon motion by.Councilman Wilson, seconded by Council-
man Tomchak, and carried, the application was approved subject
to the approval of the Chief of Police.
Bench Ad The communication from the Bench Ad Company requesting per -
Company mission.to install and maintain 6 benches was deferred until
the City Attorney completes his investigation of the bench
ordinances of various cities and gives a report, upon motion by
Councilman Tomchak, seconded by Councilman Meyers, and carried.

William T. A letter of complaint about the bottleneck of Harbor Boulevard
McManus from 19th Street to Wilson Street was received from William T.
McManus, 621 San Vincente Boulevard, Santa Monica. Upon motion
by Councilman Smith, seconded by Councilman Wilson, and carried,
the City Manager was instructed to write a letter telling
Mr. McManus the City'.s future plans for Harbor Boulevard.
Pacific Electric A communication from the State of California Public Utilities
Railway Company Commission enclosing a copy of an application of the Pacific
Electric Railway Company for authority to construct a drill
track across Huntzinger Avenue in the City of Santa Ana was
received. The City Manager was instructed to write an early
favorable reply upon motion by Councilman Wilson, seconded by
Councilman Meyers, and carried.
Clair Engle Upon motion by Councilman Smith, seconded by Councilman Meyers,
and carried, the communication from Senator Clair Engle
acknowledging receipt of the resolution regarding prayers in
public schools was ordered received and filed.
Alcoholic Upon motion by Councilman Tomchak, seconded by Councilman
Beverage Control Wilson, and carried, the communication of the Alcoholic
Beverage Control for an on -sale beer license for Bobby R.
Boydstun and Mary H. Boydstun was ordered deferred to the next
meeting of September 4, 1962.

Standard Oil A letter from .the Standard Oil Company of California stating
Company - Mrs. that a car owned by the City had damaged one of their stations
Frances A. located at 2160 Harbor Boulevard was received. Also a letter
Walker from Mrs. Frances A. Walker, 333 Bay Street, Costa Mesa, stating
that.she had been burned and injured when a gas stove in the
Costa Mesa Park flared up in her face was received and -read.

Oral communica- Mr. Don Wallace,, 900 Sea Lane, Corona del Mar, came forward
tions and spoke when the Mayor inquired of the audience if anyone
Don Wallace wished to speak on any item that was not on the agenda. Mr.
Wallace said that he wished to operate a dog kennel in the City
in an M1 or C2 zone.. He was advised to select specific loca-
tions and discuss them with the City Manager.
REPORTS
The City Attorney reported that he had prepared for the Council's
City Attorney
consideration a resolution adopting the plans and specifications
of Drainage District Improvement No. 1 (Adams Avenue). The City
Manager reported that he received a letter from C. J. Segerstrom
and Sons, 3315 Fairview Road, Costa Mesa, regarding the Adams
Avenue improvement program statingthat they wished Adams Avenue
from Royal Palm to a point approximately 100 feet west of the
intersection of Mesa Verde Drive and Adams Avenue to be excluded
from the Drainage District. After discussion during which it
was pointed out that it was necessary to provide this drainage
for the entire area, it was moved by Councilman Wilson, seconded

by R. W. McClellan and Son and a.Notice of Completion filed
