The meeting was called to order by the Mayor followed by the Pledge of Allegiance to the Flag and invocation by .Reverend C. T. Jorgenson of Brentwood Chapel. Roll Call Councilmen Present: Councilmen Absent: Officials Present: Tomchak, Wilson, Pinkley, Meyers, Smith None City Manager, City Engineer, Director City Clerk . Attorney, City of Public Works, Minutes Upon motion by .Councilman Tomchak, seconded by Councilman February 4, 1963 Meyers, and carried, the minutes of the regular meeting of February 4, 1963, were approved as written and previously distributed. PUBLIC HEARING The Mayor announced that this was the time and place set Rezone 193 for the public hearing on Rezone Petition 193 for George Buccola D. Buccola, 3700 Newport Boulevard, Newport Beach, to rezone property at the southeast corner of Fairview Road and Fair Drive as follows: From M1 to Cl: Parcel 1--A parcel at the southeast corner of Fair Drive and Fairview Road. From Ml to R4: Parcel 2--A parcel easterly of Fairview Road.and southerly of Parcel 1. The Clerk read the recommendation of the Planning Commission for approval that Parcel 1 be rezoned from Ml to Cl and that Parcel 2 be rezoned from M1 to R3 and provided that prior to second reading of the Ordinance.by the City Council, the following documents be filed with the City Clerk: 1. An agreement between the property owner and the City of Costa Mesa subject to the approval of the City Attorney that all utilities for this property will be located under- ground. 2. A deed for the dedication of all land 50 feet from the center line of existing Fairview Road to the City of Costa Mesa.for street purposes. 3. An agreement between the property owner and the City of Costa Mesa subject to the approval of the City Attorney, that prior to obtaining final occupancy on any structures to be constructed on this property, Fairview Road and Fair Drive along the property boundaries be improved with base, paving, curbs, gutters, residential and/or commercial side- walks, and concrete driveway approaches at the expense of the owner, under the direction of the City Engineer. 4. A deed for the dedication of 30 feet of property along the entire length of the easterly boundary of this property to the City of Costa Mesa for street purposes. 5. An agreement between the property owner and the City of Costa Mesa, subject to the approval of the City Attorney that, prior to obtaining occupancy of any structures to be constructed on this property, that the proposed 30 -foot street to be.dedicated under Item 4 be improved with base, paving, curbs, gutters, commercial and/or residential side- walks, and concrete driveway -approaches, at the expense of the owner, under the direction of the City Engineer. 6. An agreement between the property owner and the City of Costa.Mesa subject to the approval of the City Attorney for the construction of a 6 -foot opaque fence along the t PUBLIC HEARING southerly boundary line of the proposed development by Rezone 193 the owner,.at his expense, subject to the approval of the Buccola Planning Department. Continued 7. A deed;for the dedication of a 15-foot radius at the southeast corner of Fairview Road and Fair Drive to the City of Costa Mesa for street purposes. The Clerk reported that notice of said hearing had been duly published, and he read a letter from the applicant, George-D. Buccola, requesting that Item 1 be eliminated and requesting that Items 4 and 5 be changed. The .Mayor then inquired if anyone wished to speak. No one wishing to speak, the public hearing was closed upon motion by Councilman Wilson, seconded by Councilman Tomchak, and carried. After discussion Councilman Wilson moved that Rezone 193 be approved subject to the recommendations of the Planning Commission with the deletion of Item 1, and that the conditions of the Planning Commission be.met prior_to the second reading of the ordinance, and that Ordinance 63-7 Ordinance 63-7, being AN ORDINANCE OF THE CITY COUNCIL First reading OF THE CITY OF COSTA MESA CHANGING THE ZONING OF CERTAIN REAL PROPERTY AT THE SOUTHEAST CORNER OF FAIRVIEW ROAD AND FAIR DRIVE FROM Ml TO Cl AND R3, be given first reading. The motion was seconded by Councilman Meyers, and carried by the following,ro]1 call vote: AYES: Councilmen: Meyers, Smith, Wilson, Tomchak, Pinkley NOES: Councilmen: None ABSENT: Councilmen: None PUBLIC HEARING The Mayor announced that this was the time and place set Rezone 194 for the public hearing on Rezone 194, initiated by the Planning Commission, to rezone from Ml, Manufacturing District, to Cl, Local Business District, Lot 38; Tract 653,.Miseellaneous.Maps, Book 19, Page 42, Records of Orange County, property on the west side of Valley Road and south.of Victoria Street. The Clerk read the recom- mendation of the Planning Commission for approval pro- vided that prior to the second reading of the ordinance by the City Council, the following documents be filed -with the City Clerk: 1. A deed for the dedication of all land on Victoria to the City of Costa Mesaas shown on a map prepared by the Engineering Department of the City of Costa Mesa (realignment of Victoria Street)._ 2. A deed for the dedication of a 15-foot spandrel at the corner .of Victoria and Valley Road to the City of Costa Mesa for street purposes. 3. An agreement between the property owners and the City of Costa Mesa, under the approval of the City Attorney, that prior to obtaining final occupancy of any buildings constructed on this property that the property owners improve Valley Road and Victoria Street with base, paving, curbs, gutters, commercial sidewalks and concrete drive- way approaches, at their expense, under the direction of the City Engineer. The.Mayor then inquired-of the audience if anyone wished to be heard. Mr. Frank O'Connor, representing the owners, spoke. No one else desiring to speak, motion to close the public hearing was made by Councilman Wilson, seconded by Councilman Tomchak, and carried. After discussion Ordinance 63-8, being AN ORDINANCE OF THE Ordinance 63-8 CITY COUNCIL OF THE CITY OF COSTA MESA CHANGING THE First reading ZONING OF LOT 38.OF TRACT NO., 653 FROM M1 TO Cl, was given first reading upon motion by Councilman Wilson, seconded by Councilman Tomchak, and carried by the following roll call vote: AYES: Councilmen: Meyers, Smith, Wilson, Tomchak, Pinkley NOES: Councilmen: None ABSENT: Councilmen: None PUBLIC HEARING The Mayor announced that this -was the time and place set Rezone 196 for the public hearing on Rezone 196, initiated by the Planning Commission, to rezone from Al, Agricultural District, to Rl, Single-family Residential District, Lots 1 through 47, Tract 4894, Miscellaneous Maps, Book 172, Page 30, Records of Orange County, property on the northerly side of Paularino Avenue, beginning at a point 90 feet westerly -of the center line of Yellowstone Drive. The Clerk read the recommendation of the Planning Com- mission for approval and reported that notice of said hearing had been duly published, and the affidavit was on file in -his office, and he reported no communications had .been received. Ordinance 63-12 Thereupon Ordinance 63-12, being AN ORDINANCE OF THE CITY First reading COUNCIL OF THE CITY OF -COSTA MESA CHANGING THE ZONING OF ..CERTAIN REAL PROPERTY ON SUSANNAH PLACE FROM R2 .TO Rl, was given first reading on motion by Councilman Wilson, seconded by Councilman Tomchak, and carried by the following.'roll call vote: AYES: Councilmen: Meyers, Smith, Wilson, Tomchak, Pinkley NOES: Councilmen: None ABSENT: Councilmen: None PUBLIC HEARING The Mayor announced that this was the time and place set Precise plan for for the public hearing on the precise plan for a proposed 20 -foot alley 20 -foot alley, initiated by the Planning Commission, extending for a distance of 130 feet,.plus or minus, north from the center line of.existing Joann Street and located 165 feet, plus or minus, west of the center line of existing Pomona Avenue. The Clerk reported that notice of said public hearing had been duly published, and the affidavit was on file in his office. He reported that no written communications had been received and read the recommendation of the Planning Commission for approval. The Mayor then inquired if anyone wished to speak. No one wishing to speak, it was moved by Councilman Wilson, seconded by Councilman Tomchak, and carried, that the public hearing be closed. Thereupon it was moved by Councilman Wilson, seconded by Councilman Tomchak, that -Resolution 63-31 . Resolution 63-31, being A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA ADOPTING A PRECISE PLAN FOR A TWENTY -FOOT ALLEY EXTENDING 130.FEET NORTH FROM THE CENTER LINE OF-JOANN STREET AND LOCATED 165.10 FEET WEST OF POMONA AVENUE, be adopted. The motion carried by the following roll call vote: AYES: Councilmen: Meyers, Smith, Wilson, Tomchak,' Pinkley NOES: Councilmen: None ABSENT: Councilmen: None PUBLIC HEARING The Mayor announced that this was the time and place set Sign Ordinance for the public hearing on -the proposed sign ordinance. The Clerk reported that notice of said public hearing had been duly published, and the affidavit was on file in his office. Continued Mr. J. Kingry of Pacific Sign Company, Mr. Jack Grey of Federal Signs, Mr. Matt La Borde of La. Borde Realty all discussed with the Council the proposed sign ordinance. No one else desiring to speak, public hearing was closed on motion by Councilman Tomchak, seconded by Councilman Wilson, and carried. On motion by Councilman Smith, seconded by Councilman Tomchak, the period in which appeal might be filed was -changed from 10 to 20 days, and second reading of the ordinance is to be held up until the pro- posed ordinance on.land use.is heard, and Ordinance 63-13, Ordinance 63-13 being AN ORDINANCE OF THE CITY OF COSTA MESA, CALIFORNIA, First reading REGULATING SIGNS, was given first reading and passed to second reading by the following roll call vote: AYES: Councilmen: Meyers, Smith, Wilson, Tomchak, Pinkley NOES: Councilmen: None ABSENT: Councilmen: None Ordinance 63-5 Upon motion by Councilman Smith, seconded by Councilman Second _reading Wilson, Ordinance 63 -5, -being AN ORDINANCE OF THE CITY and adoption COUNCIL OF THE CITY OF COSTA MESA CHANGING THE ZONING OF A CERTAIN'PARCEL OF LAND AT THE SOUTHEAST CORNER OF HARBOR BOULEVARD AND GISLER AVENUE FROM Al AND Rl TO Cl, was given second reading and adoption by the following roll call vote: AYES: Councilmen: Meyers, Smith, Wilson, Tomchak, Pinkley NOES: Councilmen:. Orange County Upon motion by Councilman Tomchak, seconded by Councilman Peace Officers Wilson, the Mayor and City Clerk were authorized to sign Association- the contract between the City.of Costa Mesa and the Orange contract for County Peace Officers Association for the Police Department. Upon motion by Council- man Tomchak, seconded by Councilman Wilson, and carried, the application was approved subject to the recommendations of the Planning Commission. Variance 1006 Variance 1006 for Donald A. Bailey, 2231 Miner Street, Bailey Costa Mesa, for construction of one additional unit, making a total of 4 units on 14,400 square feet. of land area (1 unit per. 3,600 square feet) in an RI zone, was presented together with the recommendation of the Planning Commission for approval subject to the following conditions: 1. Two-for-one, off-street parking for all units (a total of 8 spaces) under the direction of the Director of Planning; 2. Residential sidewalks and concrete driveway approaches to be.installed the full width of the property, by the owner or applicant, at his expense under the direction of the City Engineer; 3. Curb breaks to be installed under the direction of the Street Superintendent. The Clerk reported that no communications had been received. Upon motion by Councilman Wilson, seconded by Councilman Smith, and carried, Variance 1006 was approved subject to the recommendations of the Planning Commission. Conditional Use Conditional Use Permit C-145 for Shoreline Construction Permit C-14-5 Company, Incorporated, 2280 Newport'Boulevard, Costa Shoreline Mesa, to allow a.planned residential community containing Construction 16 units, a common green area,, and certain accessory structures.on property located on the northerly corner of Melody Lane and Fullerton Avenue in an R4 zone, was presented together with the recommendation of the Planning Commission for approval subject to the following conditions: 1. Residential sidewalks and concrete driveway approaches to be installed along Melody lane and Fullerton Avenue by the applicant, at his expense, under the direction of the City Engineer; 2. The applicant and/or subdivider shall 1 1 1 Conditional Use have on file with the City and be approved by the City, Permit C-145 the method by which Lot 17 is to be maintained; 3. That Shoreline these buildings shall meet,the Department of Building Construction Safety's requirements; 4. That prior to Council action,, Continued subdivider and/or applicant shall file an amended Use Permit and Revised Record of Survey including proposed recreation area to be included in Lot 17; 5. A copy of the Record of Survey shall be filed with the State Real Estate Commission. Presented with Conditional Use Permit C-145 was Record of Record of Survey Survey No. 18, for Shoreline Construction Company, No. 18 Incorporated, 2280 Newport Boulevard, Costa Mesa, to Shoreline divide a portion of Lot 221, Newport Heights Tract, into Construction 17 parcels, property on the northerly corner of Melody Lane and Fullerton Avenue together with the recommendation of the.Planning Commission for approval subject to all the conditions imposed on Conditional. Use Permit C-145. The Clerk reported that no communications had been received on either of the applications. Mr.,Ed Craul, 2280 Newport Boulevard, Costa Mesa, representing Shoreline Construction came forward and spoke and also answered questions of the Council. Upon motion by Councilman Wilson, seconded by Councilman Tomchak, and carried, the City Attorney was instructed to draft an ordinance regulating condominium projects and Conditional Use Permit C-145 together with Record of Survey No. 18 were ordered held over tb.-thb. meeting of March 4, 1963. Permits The Clerk read the request of P B R Company, 920 East Arlee P B R Company Place, Anaheim, for approval of the location of a sign at - 17th and Santa Ana Streets. Mr. Bill Winterberg spoke in support of the request. Motion to deny the request was made by Councilman Wilson, seconded by Councilman Tomchak. After discussion Councilman Wilson withdrew the motion, and Councilman Tomchak withdrew the second. A new motion was made by Councilman Wilson, seconded by Councilman Tomchak, and carried that the request be held over to the meeting of March 4, 1963. Harry L. Dady The Clerk read the request of Harry L. Dady forpermission to erect a temporary sign to advertise tract homes. Mr. Don Hayden of Union Sign Company spoke for the appli- cant. After discussion the request was approved for one year or until the homes are sold, whichever is sooner, on motion by Councilman Smith, seconded by Councilman Wilson, and carried, Councilman Tomchak voting No. City of Hope The application of the City of Hope of Intention to Solicit for Charitable Purpose with a request for the waiving of conditions provided for under Section 691+ J of the Municipal Code was presented. Upon motion by Councilman Wilson, seconded by Councilman Tomchak, and carried, the request was granted. Orange County The application of the Orange County Society for Crippled Society for Children and Adults,.Incorporated, 585 South Tustin Crippled Children Avenue, Orange, of Intention to Solicit for.Charitable and Adults Purpose with a request for the waiving of conditions provided for under Section 691+ J of the Municipal Code was presented. Upon motion by Councilman Wilson, . . seconded by Councilman Tomchak, and carried, the request was granted. Warrant Resolution Warrant Resolution No. 323 including Payroll Nos. 220 323 and 221 was approved -on motion by Councilman Tomchak, seconded by Councilman Wilson, and carried by the 0 Warrant Resolution following roll call vote: 323 AYES: Councilmen.: Meyers, Smith, Wilson, Tomchak, Continued Pinkley NOES: Councilmen.: None ABSENT:. Written Upon motion by Councilman Wilson, seconded by Councilman Communications Smith, and carried, the following written communications were received and filed: Newport Harbor Union High School District; California Gas Transmission Company; Mrs. Meta Dinehart; Mr. and Mrs. Edgar Nissley; City of Anaheim. The Clerk presented a letter from the City of Fountain Valley expressing opposition to the Withholding of State Income Tax and the Re -Apportionment of the State Senate. Upon motion by Councilman Wilson, seconded by Councilman Smith, and carried, the Council went on record as being in accord with .the City of Fountain Valley (Councilman Tomchak voting NO). Orange County Upon motion by Councilman Wilson, seconded by Councilman Department of Tomchak, and carried, the following application for an Social Welfare increase in capacity in a boarding home for the aged by the Orange County Department of Social Welfare was ordered received and filed: Lorene G.
