October 16, 1967 PART I 9 1 The City Council of the City of Costa Mesa, California, met in regular session at 6:30 p.m., October 16, 1967, at the City Hall, 77 Fair Drive, Costa Mesa. The meeting was called to order by the Vice Mayor for the purpose of dis- cussion and debate on matters scheduled for Part II of the meeting and such actions as the Council desires to take under Section 2203 of the Municipal Code of the City of Costa Mesa. On motion by Councilman Pinkley, seconded by Councilman Tucker, and carried, the communica- tion was held over to the meeting of November 6, 1967, for report from the staff. 3$2 Newport Beach A Resolution from the -City of Newport Beach, entitled Appreciation of RESOLUTION OF.THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH Erosion Assistance COMMENDING THE.CITY.OF COSTA MESA FOR THEIR EFFORTS AND ASSISTANCE DURING A RECENT BEACH EROSION EMERGENCY, with a letter from Mayor Paul J. Gruber to the City Manager com- mending Carl and Harley Bogart and.all members of the Street Department involved in the project, was read. On motion by Councilman Pinkley, seconded by Councilman Tucker, and car- ried, the Resolution was received and -ordered filed. Denver Drive A letter from Edward C. Brown, 972 Denver Drive, Costa Mesa, Area Rezoning together with a petition bearing 28.signatures of Denver Drive residents and..a petition bearing 21 signatures of Babb Street residents, was presented asking that the Al area in that vicinity be rezoned and.that Denver Drive be developed as a cul-de-sac. On motion by Councilman Barck, seconded by Councilman Tucker, and carried, the letter was referred to the Planning Commission and the City Clerk was instructed to write a letter to Mr. Brown. City of Seal Beach A letter from the.City of Seal Beach expressing support of 1 1 County Assessor Andrew J. Hinshaw°s assessment procedure was read and on motion by Councilman Pinkley, seconded by'Council- man Barck, and carried, -the letter -was received and ordered filed. Celebrity Golf The City Clerk -presented resolutions endorsing the Orange Classic-. County Celebrity Golf Classic.to be held at the Costa Mesa . Golf and Country Club -on November 5, 1967, from the following cities: City of Huntington Beach, City of Newport Beach, City of Los Alamitos, City of Santa Ana, City of Tustin. On motion by Councilman Tucker, seconded by Councilman Pinkley, and carried, the communications.were ordered received and filed, and the City Clerk was instructed to write letters of appreciation.to each city.. Baker Street Two letters were presented regarding traffic on Baker Street. Traffic Protests Mr. Ben Lovelace, 2997 Croftdon Street, Costa Mesa, -submitted a -tape recording of.traffic noise at his home, and Miss Narendra Kumar, 2991+-Croftdon Street, asked speed -reduction to 25 or 30.miles per hour. On motion by Councilman Pinkley, seconded by.Councilman.Tucker, and -carried, the letters were referred to the Traffic Commission which has the problem under consideration. Elden Avenue -A letter from Charles W. Gist., 2682 Elden Avenue, reporting Weed Nuisance a weed nuisance existing in the 2600 block on Elden Avenue, was_read and on motion by -Councilman Pinkley, seconded by Councilman Tucker, and carried, the --communication was ordered received and filed. Fire Department- Dr. Robert.P. Rea, 745 Dover Drive, Newport Beach, expressed Commended appreciation of the prompt and efficient work of the Costa Mesa Fire :Department in response -to a flooding call at 547-549 West 19th Street on September 27th. On motion by Councilman Tucker, seconded by Councilman Pinkley, and carried, the Clerk was directed to send a copy of the letter to the Fire Department and the communication was ordered received and.filed. Sully -Miller Sully -Miller -.Contracting -Company requested a 30 -day extension Time Extended- of time to complete the annual street -resurfacing contract for the City, noting that.they had been asked to delay the Harbor Boulevard.portion of the contract until after the summer traffic .peak. On motion by Councilman Pinkley, seconded by Councilman Tucker, and carried, the extension was granted. 1 1 Written The following written communications were ordered received Communications and filed on motion by Councilman Pinkley, seconded by Councilman Tucker, and carried: Assembly Committee on Elections and Reapportionments, notice of public hearings to be held throughout the State; Orange County Grand Jury, copy of resolution urging police -departments to conform to law prohibiting voiding of traffic citations; Seventh Sewer Main- tenance District, notice of proposed annexation in Tustin area; State Division of Highways, District VII, Mr. Haig Ayanian, District Engineer succeeding E. T. Telford, pledges cooperation in development of'the freeway program. McKenzie, Chairman of the March of Golf Classic Dimes campaign, asking permission to solicit contributions Solicitation through the Costa Mesa Golf and Country Club Celebrity Classic on November 5th and 6th through the sale of tickets and advertising space in the program, was read. On motion by Councilman Tucker, seconded by Councilman Pinkley, and carried, the requested permission was granted with Section 691+-1 of the Municipal Code being waived, subject to the filing of the required applic'ation:- forms. Jack Neer The application of Jack Neer, Box 25+8, Leucadia, for license Auction at to conduct an auction of Indian relics at the Women's Club, Women's Club 18th Street and Anaheim Avenue, on November 9th, was presented and on motion by Councilman Pinkley, seconded by Councilman Tucker, and carried, the license was approved. Departmental On motion by Councilman Pinkley, seconded by Councilman Reports Tucker, and carried, the following departmental reports were received and filed: Police, Finance, Building, Pound, and Parks. After discussion, upon Requirements motion by Councilman Tucker, seconded by Councilman Pinkley, Ordinance 67-33, being AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING CERTAIN SEC- TIONS OF ITS ZONING AND LAND USE ORDINANCE TO CLARIFY THE CP ZONING REQUIREMENTS, was given first reading and passed to second reading by the following roll call vote: AYES: Councilmen: Barck, Pinkley, Tucker NOES: Councilmen: None ABSENT: Councilmen: Wilson, Jordan Notice of The City Engineer said that Sully -Miller Contracting Company Completion had completed the Improvement of Adams Avenue, Section V, Sully -Miller from 900 Feet East of Harbor Boulevard to Fairview Road, and recommended that the work be accepted and notice of comple- tion be filed. Upon motion by Councilman Pinkley, seconded by Councilman Tucker, and carried, the request for a one-month extension was granted. - Call for. Bids Upon motion by Councilman Tucker, seconded by Councilman Bid Item 99 Pinkley, and carried, specifications for Bid Item 99, One One 1968 Tractor 1968 Tractor, were approved, and call for bids was authorized, bids to be opened on November 3, 1967, at 11:00 a.m. William J. Moran The Assistant City Manager reported that a final retention Company of $17,500.00 was being held on the Civic Center project Civic Center pending completion of certain items, including the emergency generator system, and requested authorization to negotiate with the contractor to complete the installation in accord- ance with required plans and specifications to meet all codes. Upon motion by Councilman Pinkley, seconded by Councilman Tucker, the request was approved and authorized with the stipulation that all other uncompleted items be included in the package and that no additional monies or the $17,500.00 retention is to be paid until such time as all items in question are completed and accepted and that the City Manager supply each Council member with listings of such items to be completed. PART II The City Council of the City of Costa Mesa, California, continued its regular session at 7:30 p.m., October 16, 1967, at the City Hall, 77 Fair Drive, Costa Mesa. The meeting was called to order by the Vice Mayor, followed by the Pledge of Allegiance to the Flag and invocation by the Reverend Duane 0. Mayfield of the Church of Christ. Roll Call Councilmen Present: Barck, Pinkley, Tucker Councilmen Absent: Jordan, Wilson Officials Present: Assistant City Manager, City Attorney, Acting City Engineer, Director of Public Works, City Clerk Variance V-25-66 On motion by Councilman Tucker, seconded by Councilman Spengler Pinkley,, and carried, the request for relief on certain con- ditions on Variance V-25-66, Don H. Spengler, 421 Seville Avenue, Balboa, was held over to the meeting of November 6, 1967, as requested by the applicant. Variance V-20-67 The Clerk presented the application for Variance V-20-67, Jork Alfred Jork, 640 Surf Street, Costa Mesa, for permission to encroach one foot, eleven inches, into required side yard setback in order to convert existing attached carport to a single garage at that address, together with the recommenda- tion of the Planning Commission for approval subject to the following conditions: 1. Installation of concrete resi- dential sidewalks and approach in front of this property by the owner at his expense, per standard specifications of the City of Costa Mesa. 2. A one-hour wall will be required on property line side for the garage. The Clerk reported that no written communications had been received. The Vice Mayor asked if anyone wished to be heard, and the applicant protested the sidewalk requirement of the Planning Commission. After discussion, upon motion by Councilman Tucker, seconded by Councilman Pinkley, the application was approved subject to the recommendation of the Planning Commission with Con- dition No. 2 modified to allow the applicant one year's time to install the sidewalks, and within 90 days, if the appli- cant does not decide to convert his carport into a garage and install the sidewalks in one year's time, then he is to be granted refund of one-half of his variance application fee of $35.00, by the following roll call vote: AYES: Councilmen: Barck, Pinkley, Tucker NOES: Councilmen: None ABSENT: Councilmen: Jordan, Wilson Variance V-22-67 Variance V-22-67, being the application of Roy J. The Clerk reported that no written communications had been received, and the Variance V-22-67 Vice Mayor asked if anyone wished to speak on the proposed Continued variance. The applicant was present. After discussion, Variance V-22-67 was approved subject to the recommendations of the Planning Commission on motion by Councilman Pinkley, seconded by Councilman Tucker, and carried. Conditional Use The Clerk presented application for Conditional Use Permit Permit C -60-66-A C -60 -66 -Amended, for Juanita Marcus, 162 Cecil Place, Costa Marcus Mesa"'for permission to continue to operate a home occupa- tion for grooming poodles, on a modified and part-time basis by appointment only, at that address. He read the recom- mendation'of the Planning Commission for approval subject to the following conditions: 1. Installation of residential sidewalks and concrete driveway approaches by the applicant at her expense, per standard specifications of the City of Costa Mesa. 2. No signs. 3. No employees. 4. Time limit of three years. The Clerk said that no written com- munications had been received. The Mayor asked if anyone wished to speak. The applicant was present. Upon motion by Councilman Pinkley, seconded by Councilman Tucker, and carried, the application was approved subject to the recom- mendations of the Planning Commission. Tentative Tract The Tentative Map of Tract 6483, for Michael D. Kay, 400 6483 North Ne�port Boulevard, Newport Beach, to divide property Michael D. Kay described as Lot 93 and a portion of Lot 94 of Tract 653 into 16 lots, was presented with the recommendation of the Planning Commission for approval subject to the conditions set forth in the Planning Department's letter dated October 6, 1967, and the requirements of the Director of Engineering dated September 26, 1967. The property is located on the east side of Valley Road approximately 132 feet southerly of the center line of Victoria Street. After discussion, action on Tentative Map of Tract 6483 was deferred to the meeting of November 6, 1967, on motion by Councilman Tucker, seconded by Councilman Pinkley, and carried. - Conditional Use The Clerk presented application for Conditional Use Permit Permit C-56-67 C-56-67 for Merle Valdez, 2450 College Drive, Costa Mesa, Valdez for permission to continue use permit to teach piano in the home in an Rl, Single Family Residential Zone, at that address. He read the recommendation of the Planning Commis- sion f6r approval subject to the following conditions: 1. No signs and no employees. 2. No lessons after 9:00 p.m. or before 9:00 a.m. 3. Time limit of three years subject to Commission review. The Clerk said that no written com- munications had been received. Mr. John Valdez was present. The Mayor asked if anyone wished to speak. Upon motion by Councilman Pinkley, seconded by Councilman Tucker, and carried, the application was approved subject to the recom- mendation of the Planning Commission. Conditional Use Application for Conditional Use Permit C-57-67, Harvey A. Permit C-57-67 and Irma Ter Bush, 324 Victoria Street, Costa Mesa, for Ter Bush permission to continue the conditional use permit for the repair of laon mowers as a home occupation at that address in an R2 zone .and permission to conduct a very small mail order business card business; was presented together with the recommendation of the Planning Commission for approval subject to the following conditions: 1. No signs permitted due to zone restrictions. 2. No employees. 3. No sales at this location of new or used equipment. 4. This opera- tion not to be conducted before 8:00 a.m. or after 6:00 p.m. local time, and not at all on Sunday. 5. For a period of six months. 6. The existing garage, now being used for working purposes, be made immediately usable for one car at such time that applicant no longer has rental space. 7. Parking area for two spaces to be provided in a manner to Conditional Use be approved by the Director of Planning and to be completed Permit C-57-67 within 60 days after approval of this application by City Continued Council. Mrs. Ter Bush was present and spoke. The Vice Mayor asked if anyone else wished to speak. Upon motion by Councilman Pinkley, seconded by Councilman Tucker, and carried, the application was approved subject to the recom- mendation of the Planning Commission. Conditional Use Permit C-58-67 The Clerk presented application for Conditional Use Permit C-58-67, Mesa Verde Development Company, 2850 Mesa.Verde Mesa Verde Drive, Costa Mesa, for permission to maintain one 10 -foot Development by 30 -foot subdivision directional sign -on the east side of Harbor Boulevard, 500 feet north of Fair Drive, to advertise the initial sale of residential units in Tract 4660, a con- cominium. He read the recommendation of the Planning Com- mission for approval subject to the following conditions: 1. The sign shall -be removed in one year or upon the sale' of the last unit in this tract, whichever is sooner. 2. A bond is to be provided in the amount of $100.00 to guarantee the removal of the sign within 30 days after the expiration of the conditional use permit. Failure to do so will result in forfeiture of the bond. 3. Any copy change from that approved by the Planning Commission will result in automatic forfeiture of the bond and removal of the sign. Mr. Jim- imWebb Webbof the Mesa Verde Development Company was present. Upon motion by Councilman Pinkley, seconded by Councilman Tucker, and carried, the application was approved subject to the recommendation of the Planning Commission with the added conditions that this is the last renewal for this particular sign and with Condition No. 2 changed to read: "A bond is to be provided in the amount of $100.00 to guaran- tee the removal of the sign within 30 days after the expira- tion.of the conditional use permit, or upon the sale of the last unit, whichever is sooner. Failure to do so will result in forfeiture of the bond." Oral Communications Nick Ziener, Executive Manager of the Costa Mesa Chamber of Commerce, announced the formation of the Costa Mesa Civic Playhouse Patrons Association, and urged attendance at -the current production October 21st, and participation in the salute to the new organization which will follow the play. Ted Bologh, 2063 President Place, Costa Mesa, expressed dissatisfaction with information provided to him by the City. Mrs. Brenda Foster, 268 Walnut Street, asked an explanation of the rules governing signs on trailers. Kimball Bartlett, 968 Lansing Lane, reported that his child had.been bitten by a dog and asked stricter enforcement of leash and quarantine regulations. After discussion, on Animal Control Law motion by Councilman Pinkley, seconded by Councilman Tucker, and"carried, the City Attorney .was directed to investigate current animal control laws in comparable cities and bring the Costa Mesa animal control regulations up to date. Councilman.Pinkley reported that he, with the City Manager and Councilman Wilson, had met with the manager of the local office of the Pacific Telephone Company and discussed inequities in toll call districts and proper recognition of Costa Mesa by the telephone company. 1 Live Entertainment Dean Pollom of the Costa Mesa Police Department said that Permit application for a live entertainment permit had been received Jiminy's from Jiminy's, 171+ Placentia Avenue, Costa Mesa. He reported that the background information is incomplete, and that a prearranged grand opening on October 20, 1967, had been set and for that reason requested a temporary live entertainment permit. Upon motion by Councilman Tucker, seconded by Councilman Pinkley, and carried, a temporary live entertain- ment permit to run for 20 days was granted.
