HomeMy WebLinkAbout01/12/1970 - Adjourned City Council Meeting-�l Roll Call Ordinance Deferred Obnoxious ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF COSTA MESA January 12, 1970 The City Council of the City of Costa Mesa met in adjourned regular session at 7:00 P.M. in the Council conference chamber at the City Hall, 77 Fair Drive, Costa Mesa, California, said meeting having been duly and regularly adjourned from the regular meeting of January 6, 1970, and a copy of the notice of adjournment having been posted as required by law. The meeting was called to order by the Mayor, followed by the Pledge of Allegiance to the Flag and invocation by Director of Public Works George Madsen. Councilmen Present: Wilson, Tucker, Jordan, St. Clair, Pinkley Councilmen Absent: None Officials Present: City Manager., City Attorney, Director of Public Works/City Engineer, City Treasurer, City Clerk The City Attorney presented Ordinance 69-35, entitled AN 69-35 ORDINANCE OF THE CITY COUNCIL, OF THE CITY OF COSTA MESA, CALIFORNIA, PROHIBITING CERTAIN OBNOXIOUS CONDUCT, which Conduct had received first reading at the City Council meeting of December 2, 1969, and reported that certain court action pending on the subject made it advisable that adoption of the ordinance be held until court decision had been _reached. On motion by Councilman Tucker, seconded by Councilman St. Clair, further action on Ordinance 69-35 was deferred until such time as the City Attorney requests that it be placed on the agenda again. On motion by Councilman Wilson, seconded by Councilman Tucker, and carried, appointment of a Crime Prevention Committee was deferred to a personnel session to follow the meeting. 1 1 Councilman Tucker presented a proposed Ordinance entitled Billboard AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, Ordinance CALIFORNIA., AMENDING CHAPTER 6, ARTICLE 2, SECTION 6206 (A), To Be Drafted BUSINESS LICENSE FEE FOR BILLBOARDS. The Director of Planning also presented a proposed billboard franchise ordinance and reported that the Planning Commission was to meet with outdoor advertising representatives on February 2, 1970, for a discussion of proposed regulatory ordinances. After discussion, the proposed ordinances were referred to the Planning Department with directions to draft and present a proposed comprehensive billboard ordinance by the first Council meeting in March, on motion by Councilman Tucker, seconded by Councilman Jordan, and carried. The City Attorney reported that the Board of Supervisors had adopted an ordinance regulating mobile x-ray units and was desirous that a uniform ordinance covering these units should be enacted by all cities in Orange County. He stated that Ordinance 68-32, which had been given first reading on July 15, 1968, was substantially in accord with the County Ordinance but that uniformity in wording could Ordinance 70-4 be assured by adoption of Ordinance 70-4 entitled AN First Reading ORDINANCE OF THE CITY OF COSTA MESA, CALIFORNIA, REGUTA TING Mobile X -Ray Units MOBILE X-RAY UNITS AND MAKING PROVISIONS FOR THE AVAILABIL- ITY OF X-RAY FILMS, replacing the former proposed Ordinance 68-32. On motion by Councilman Jordan, seconded by Councilman Wilson, and carried, Ordinance 70-4 was given first reading by the following roll call vote: AYES: Councilmen: Wilson, Tucker, Jordan, St. Clair, - Pinkley NOES: Councilmen: None ABSENT: Councilmen: None 1 1 1 u 1 Ordinance 69-7, regulating close-out sales, adopted April 28, 1969, was presented to the Council for review. After discussion, Councilman Tucker moved that Ordinance 69-7 be repealed and that a committee representa- tive of the City Council, Chamber of Commerce, and staff be appointed to investigate and report on a revised form of regulation for such sales. The motion.was seconded by Ordinance 70-5 Mayor Pinkley, and Ordinance 70-5, entitled AN ORDINANCE OF First Reading THE CITY COUNCIL OF THE CITY OF COSTA MESA,'CALIFORNIA, Close -Out Sales REPEALING ORDINANCE NO. 69 -7 -OF SAID CITY COUNCIL, was given first reading•by the following roll call vote: AYES: Councilmen: Tucker, Jordan, Pinkley NOES: Councilmen: Wilson, St. Clair ABSENT: Councilmen: None A proposed ordinance regulating service stations, which had Proposed Ordinance On motion by Councilman St. Clair, seconded by Councilman Tabled Wilson, and carried, a proposed ordinance regulating garage Garage Sales and patio sales was tabled indefinitely. An amended revision of Ordinance 69-32 entitled AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, Public Hearing Set PROVIDING FOR SWAP MEETS AND THE NECESSITY FOR A PERMIT FOR Swap Meets THE SAME; -ESTABLISHING CONDITIONS TO BE IMPOSED UPON SAID ,PERMIT; ESTABLISHING THE FEE TO BE PAID FOR THE SAME AND PROVIDING FOR REVOCATION AND PENALTIES, was presented by the City Attorney, and after discussion was set for public hearing on January 19, 1970, on motion by Councilman Jordan, seconded by Councilman Wilson, and carried. On motion by Councilman St. Clair, seconded by Councilman Jordan, and carried, the context of the proposed ordinance regulating service stations was adopted as a statement of policy to be used as a guide line for applicants for service stations. Ordinance 68-37, entitled AN ORDINANCE OF THE CITY COUNCIL Ordinance 68-37 OF THE CITY OF COSTA MESA, CALIFORNIA, RELATING TO PUBLIC Tabled GATHERINGS AND REGULATING THE SAME; RELATED TO CROWD CONTROL Crowd Control AND REGULATING THE SAME, which had been held since October 21, 1968, for study, was tabled for an indefinite period on motion by Councilman Tucker, seconded by Councilman Jordan, and carried. Ordinance 68-29, entitled AN ORDINANCE OF THE CITY COUNCIL Ordinance 68-29 OF THE CITY OF COSTA MESA REPEALING ARTICLE 5, CHAPTER VIII, Not Adopted COSTA MESA MUNICIPAL CODE, RELATING TO SIGNS AND ESTABLISHING Made Policy Guide SECTIONS 8500 THROUGH AND INCLUDING SECTION 8512 OF ARTICLE 5, For Signs CHAPTER VIII, RELATING TO THE REGULATION OF SIGNS, which had been given first reading on July 1, 1968, was again presented for consideration with attached resolutions adopting certain sign standards. After discussion, Councilman Tucker moved for adoption of the Ordinance but the motion died for lack of a second. -On motion by Councilman Wilson, seconded by Councilman Jordan, the context of the proposed Ordinance 68-29 was adopted as a policy to guide the Planning Department and the Council in regulating signs, by the following roll call vote: AYES: Councilmen: Wilson, Jordan, St. Clair, Pinkley NOES: Councilmen: Tucker ABSENT: Councilmen: None Proposed Ordinance On motion by Councilman St. Clair, seconded by Councilman Tabled Wilson, and carried, a proposed ordinance regulating garage Garage Sales and patio sales was tabled indefinitely. Wilson, seconded by Councilman Jordan, and carried; Councilman St. Clair voting No. Ordinance 70-7, entitled AN ORDINANCE OF THE CITY COUNCIL Ordinance 70-7 OF THE CITY OF COSTA MESA, CALIFORNIA, RELATING TO MINOR Proposed Minor ZONE EXCEPTIONS AND AUTHORIZING -DECISIONS AND POLICY DUTIES Zone Exceptions TO THE PLANNING STAFF, was presented by the City Attorney, and on motion by Councilman Wilson, seconded by Councilman Jordan, and carried, was held over to the meeting of January 19, 1970. Country Club The City Attorney reported that the proposed contract for Operation operation of the Country Club was now being reviewed by the Alcoholic -Beverage Commission, and would be ready by January 15-, 1970. Personnel Session The Council went into personnel session at 10:45 p.m. The Council concluded its personnel session at 11:10 p.m., Crime Prevention - and the Mayor adjourned.the meeting, announcing that Commission appointments to the Crime Prevention Commission would be Announcement made at the meeting of January 19, 1970.
