HomeMy WebLinkAbout2023-20 - Caltrans FHWARESOLUTION NO. 2023-20 RESOLUTION AUTHORIZING THE PUBLIC WORKS DIRECTOR OR DESIGNEE(S) TO EXECUTE ALL RELATED AGREEMENTS, CERTIFICATIONS, AMENDMENTS, AND DOCUMENTS TO FACILITATE PROCESSES RELATED TO THE CALIFORNIA DEPARTMENT OF TRANSPORTATION (CALTRANS) AND FEDERAL HIGHWAY ADMINISTRATION (FHWA) WHEREAS, the City of Cost Mesa is eligible to receive Federal and/or State funding for certain Transportation Projects, through the California Department of Transportation (Caltrans); and WHEREAS, Master Agreements, Program Supplemental Agreements, Fund Exchange Agreements and/or Fund Transfer Agreements need to be executed with Caltrans before such funds could be claimed; and WHEREAS, right-of-way certifications, amendments, and any other certifications need to be executed with Caltrans before such funds can be claimed; and WHEREAS, the City of Costa Mesa will cause work on a project to be commenced within a reasonable time after receipt of notification from Caltrans that funds have been approved and that the project will be carried to completion within reasonable time and diligence; and WHEREAS, the City of Costa Mesa will comply, where applicable, with provisions of the California Environmental Quality Act (CEQA), the National Environmental Policy Act (NEPA), the Americans with Disabilities Act (ADA), and any other Federal, state and/or local laws, rules and/or regulations. NOW, THEREFORE, the City Council of the City Costa Mesa hereby resolves as follows below: Section 1. The City of Costa Mesa hereby authorizes the Public Works Director or designee(s) to execute all Master Agreements, Program Supplemental Agreements, Fund Exchange Agreements, and/or Fund Transfer Agreements, including Right -of -Way Certifications, and any other certifications, amendments, and documents to facilitate processes related to the California Department of Transportation (Caltrans) and Federal Highway Administration (FHWA). Resolution No. 2023-20 Page 1 of 3 Section 2. The City of Costa Mesa agrees to fund any additional costs over the identified programmed amount. APPROVED AND ADOPTED by the City Council of the City of Costa Mesa at its regularly scheduled meeting held on the 18th day of April, 2023.
