CALIFORNIA, APPROVING THE FINAL MAP FOR TRACT NO. 17980, AND THE
ABANDONMENT OF A STORM DRAIN EASEMENT PURSUANT TO THE
SUBDIVISION MAP ACT

THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS, on July 25, 2016, the Planning Commission approved the Vesting
Tentative Map for Tract No. 17980 for a subdivision to construct a 56 -unit, two-story,
detached residential common interest development ("Tentative Map"), conditioned upon
the satisfaction of certain conditions of approval ("Conditions"), a copy of which are on file
with the Planning Division and are available for review upon request; and
WHEREAS, a final subdivision map for Tract No. 17980 ("Final Map") has been
presented to the City Council for approval; and
WHEREAS, the City Council finds the Final Map is in substantial conformance with
the Tentative Map; and
WHEREAS, the City Council finds the Final Map fully conforms to the requirements
of the Subdivision Map Act (California Government Code sections 66410 et seq.),
Chapter XI (Subdivisions) of Title 13 (Planning, Zoning and Development) of the Costa
Mesa Municipal Code, and the Conditions; and
WHEREAS, the Final Map includes the abandonment of an existing easement for
storm drain and appurtenant and incidental purposes, recorded October 16, 1984 as
Instrument No. 84-426937 of the Official Records of Orange County, pursuant to sections
66499.20.2 and 66434(g) of the Subdivision Map Act; and

WHEREAS, the City has no present or future need for the storm drain easement,
as it only benefits the subject property; and
WHEREAS, the City intends that, pursuant to section 66434(g) of the Subdivision
Map Act, the filing of the Final Map shall constitute abandonment of the storm drain
easement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF COSTA MESA that:
1. The City Council finds the foregoing recitals are true and correct.
2. The City Council hereby finds that the City has no present or future need for
the storm strain easement recorded October 16, 1984 as Instrument No. 84-
426937 of the Official Records of Orange County, as it only benefits the subject
property, and hereby authorizes the abandonment of the storm drain easement.
3. Pursuant to section 66434(8) of the Subdivision Map Act, the filing of the Final
Map for Tract No. 17980 shall constitute abandonment of the storm drain
easement recorded October 16, 1984 as Instrument No. 84-426937 of the
Official Records of Orange County. The City Clerk is authorized and directed
to certify to this fact on the Final Map.
4. The City Council hereby approves the Final Map as presented, and the City
Clerk is authorized and directed to certify to this fact on the Final Map.
5. The City Clerk and City Engineer are hereby authorized to sign the Final Map.
