HomeMy WebLinkAbout06/02/1975 - Adjourned City Council MeetingRoll Call New Planning Director Introduced ADJOURNED MEETING OF THE CITY COUNCIL CITY OF COSTA MESA June 2, 1975 The City Council of the City of Costa Mesa met in adjourned regular session at 7:30 p.m., in the Council Chambers of City Hall, 77 Fair Drive, Costa Mesa, said meeting having been duly and regularly adjourned from the regular meeting of May 20, 1975, and a copy of the Notice of Adjournment having been posted as required by law. The meeting was called to order by the -Mayor, followed by the Pledge of Allegiance to the Flag, and Invocation by Councilwoman Hertzog. Council Members Present: Council Members Absent: Officials Present: Pinkley, Hammett, Wilson, Raciti, Hertzog None City Manager, City Attorney, Director of Planning, Advance Planning Chief, City Clerk The City Manager introduced and welcomed Charles Roberts, newly -appointed Planning Director for the City of Costa Mesa. Public Hearing The Mayor announced, that this was the time and place Off -premise Sign set for the public hearing, continued from the meet - Regulations - ing of May 20, 1975, to consider off -premise sign Billboards regulations (billboards). The Environmental Impact Report was accepted by Council on April 1, 1975. The affidavit of publication is on file in the Clerk's office. Communications in support of the billboard ordinance as proposed, have been received from the following Costa Mesa residents: Sue Kirsch, 1868 Paros Circle; Ann and Mike Mound, 3128 Country Club Drive; Louise Napoli, 2974 Ceylon Drive; Edward McFarland, 1697 Oahu Place; Helene K. Hollingsworth, 1790 Pitcairn Drive; Shirley Price, 2409 Orange Avenue; John and Carol Graes, 3227 Iowa Street; and Earl Nellesen, The Earl's Plumbing, Incorporated, 1526 Newport Boulevard. The firms of Foster and Kleiser, and Pacific Outdoor Advertising, submitted a report for Council review containing suggestions for a reasonable and regulatory billboard ordinance for the City. The Planning Commission and the Planning staff recommend approval of the ordinance as proposed. The Advance Planning Chief gave a slide presentation depicting existing billboards in the City. He also outlined three alternatives to the proposed billboard ordinance. The following Costa Mesa residents spoke in support of the ordinance: Louise Napoli, 2974 Ceylon Drive, representing Costa Mesa Now; Ann Mound, 3128 Country Club Drive, repre- senting Mesa Verde Homeowners Association; Ed McFarland, 1697 Oahu. Place; Marilyn Voyer, 3353 Alabama Circle; Shirley Price, 2409 Orange Avenue; Randy McCardle, 1528 Jamaica Road; Mike Wills, 2284 Avalon Street; Marshall Scott, representing The Earl's Plumbing, 1526 Newport Boulevard; Maureen DiDomenico, 941 Coronado Drive; and Pat Perron, 2278 Avalon Street. John DeWitt, 2000 Balearic Drive, Costa Mesa, spoke in support of the ordinance and presented a petition urging the prohibition of bill- boards, containing 116 signatures. Thomas Nelson, 283 Lilac Lane, Costa Mesa, asked questions concern- ing the constitutionality of the ordinance. Bob Reid, Foster and Kleiser, 1550 West Washington - Boulevard, Los Angeles, spoke in opposition to a total ban of billboards, but indicated support of a reasonable regulatory ordinance. Brian Kennedy, representing Regency Outdoor Advertising, 10982 Roebling Avenue, Los Angeles, spoke in opposition to the -ordinance but offered suggestions for upgrading the billboards through height reduction, landscap- ing -etc. He also stated that billboards of a greatly improved design are now available. James L. Perry, Attorney, 705 El Camino Real,. Tustin, was present, representing Dennis Hogland, owner of.a billboard at 1785 Newport Boulevard. Mr. Perry stated his opinion that removal of :Mr. Hogland's billboard would be an infringement of his constitu- tional rights. Jay Kingry, representing Pacific Outdoor Advertising, 1740 Narva Street, Los Angeles, favored the retention of existing billboards with upgrading over a period of time. Willard Courtney, 611 St. James Place, Newport Beach, questioned the constitutionality of.the ordinance, and expressed his support of Alternate No. 3 described by the. Advance Planning Chief earlier in the meeting. Ernest Goldsworthy, representing -E. T. Legg and Company and Robert H. Daniel, expressed his support of Alternative No. 3. There being no other speakers, the Mayor closed the public hearing. A motion by Councilman Raci.ti, seconded by Mayor Pinkley, to adopt the billboard ordinance as proposed, was later withdrawn. On motion by Councilman. Hammett, seconded by Councilman Raciti, and carried, all ordinances will be read by title only. The Clerk.read the title of the proposed ordinance. The City Attorney indicated the follow- ing clerical corrections to the ordinance: Page 1, Lines 12, 13, and 14 - the following language to be deleted, "the City Council further finds and declares that off-site signs have been allowed to exist within the City solely on the basis of being a noncon- forming use." Page 2, Lines 3.and 4 - delete language "in implementing.the City's capital improvement plans," and substitute the following langu- age, "to promote.the General Plan of the City." Page 3, Lines 30, 31, 32, and Page 4, Lines 1 and 2 - delete entire Paragraph B which reads, "to the extent applicable, any sign, directional or off -premise as, defined here- in, that is or may be located within the area, or areas, contemplated within the California Outdoor Advertising Act (Cali- fornia Business and Professions Code Sections 5200 et seq.). The following language to be substituted for the above, " any directional or off -premise sign that is found to be within the provisions of the California Out- door Advertising Act.(California Business and Professions Code Sections 5200 et seq.) as determined'by the City Council." 1 Ordinance 75-32 First Reading Page 4, Lines 6 and 7 - delete words, "industrial or housing," on Line 6, and on Line 7, the word, "includes." Insert on Line 7 after the words, "development. which," the following: "offers for sale." A motion by Councilman Raciti, seconded by Mayor Pinkley, to adopt the ordinance as submitted by the Planning Commission, including the clerical correc- tions indicated by the City Attorney, was followed by discussion. Councilman Wilson suggested several amendments on Page 1 of the ordinance. After further discussion, the motion was voted upon and Ordinance 75-32, being AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, AMENDING ARTICLE TWO, CHAPTER SIX OF TITLE FIVE OF THE COSTA MESA MUNICIPAL CODE PROHIBITING THE CONSTRUCTION, EREC- TION, OR MAINTENANCE OF OFF -PREMISE SIGNS AS A PUBLIC NUISANCE, ENFORCING REMOVAL THEREOF UPON DUE NOTICE AND HEARING, was given first reading and passed to second reading, by the following roll call vote: AYES: Council Members:_ Pinkley, Hammett, Raciti, Hertzog NOES: Council Members: Wilson ABSENT:, Council Members: None On motion by Councilman Raciti, seconded by Council- woman Hertzog, and carried, Councilman Wilson voting no, the Council readopted Section 1 of the ordinance as their findings, supporting their action in adopt- ing the ordinance.
