The meeting was called to order by the Mayor, followed:by the Pledge of Allegiance to the Flag, and Invocation by the Reverend Wayne Tesch, Newport -Mesa Christian Center. The City Manager indicated that this item -will be addressed at the Tabled upcoming League of Cities Conference, and that staff will need to research the plan in detail to establish more specifically this City's position. On motion by Vice Mayor Hammett, seconded by Councilman McFarland, and carried, this item was tabled pending more information.and recommendations from the staff prior to the League meeting. Warrant. ADOPTING_ COUNCIL POLICY MANUAL AND APPROVING POLICY NO. 000-1, SETTING FORTH -THE POLICY AND PROCEDURE FOR THE ADMINISTRATION OF SAID MANUAL, was adopted by the following -roll call vote: AYES: Council Memb-ers: Hertzog, Hammett, Raciti, McFarland, Smallwood NOES: Council Members: None ABSENT: Council Members: None Wastewater The City Manager discussed a proposed wastewater Reclamation reclamation project by the Orange County Water District, for the area around Water Factory No. 21. If approved by the State Water Resources Control Board,'this project would ultimately provide waste- water reclamation for the -irrigation of parks, golf courses, and other recreational.facilities. The City Manager expressed -enthusiasm for the project and recommended Council approval of the conceptual plans. After discussion, on -motion by Councilman Raciti, seconded by Councilwoman Smallwood, and carried, the Council endorsed the proposed project. Equipment On motion -by Vice Mayor Hammett, seconded by Council - Mechanic I man McFarland, and carried, authorization was given to fill the -budgeted position for Equipment Mechanic I in the Public Services Department - Facilities and Equipment Division. Loan to The City Manager pr.esented:a request for a loan to the Redevelopment Costa Mesa RedevelopmentAgency,in the amount of Agency $182,000.00. In explanation of this request, the Agency can only receive tax increment revenue equal to its current liabilities, therefore, it is necessary that the Agency borrow the stated amount.in order to receive the maximum revenue. On motion by Councilman McFar- land, seconded by Councilwoman Smallwood, the loan was approved by the following roll call vote: AYES: Council Members: Hertzog, Hammett, Raciti, McFarland, Smallwood NOES: Council -Members: None ABSENT: Council Members: None Fire Station Bids received for the Construction of Costa Mesa Fire No. 3 Station'No. 3 at 1865 Park Avenue, are on file in the Clerk's office. The bids received are considerably Awarded over the amount estimated for the project but the City H. W. Sant Manager -expressed his'opinion that this is due to the Company tremendous inflation in the construction industry. To complete the project will require a.transfer of funds from the unappropriated surplus, in the amount of 1 L 1 1 1 $234,000.00. After discussion, on motion by slice Mayor'Hammett, seconded by Councilwoman. Smallwood, the contract was awarded to H. W. Raciti.', McFarland, Smallwood NOES: Council Members: None ABSENT: Council Members: None Public Hearing The Clerk announced that this was the time and place Tentative set for the public hearing to review Tentative Parcel Parcel Map Map 5-77-20., William and Susan St.. Clair, 2012 Santa 5-77-20 - Ana Avenue, Costa Mesa, for the property located at St. Clair 1976 Orange,Avenue. Environmental Determination: Exempt. The affidavits of posting, publishing, and mailing are on file in the Clerk's office. No com- munications have been received. The applicant is proposing to divide the property into three parcels, providing access from Orange Avenue to Parcels 2 and 3. over a 20 -foot easement, which will extend across the south side of Parcels 1 and 2. The Planning staff recommended denial of the request based on the opinion that it is inconsistent with the intent of the zoning ordinance, which the staff feels intended all residential -properties to have direct access on a public street. The Planning Commission approved the request based on the findings that the City has previously approved lots of this°nature and that the property -does meet the 6,000 square foot minimum lot size requirement. The applicant was present and addressed the Council in support of the request, stating his opinion that.the 1aw.does not specifi- cally prohibit what he is proposing, that he believes this to be the best use of the property, and that the immediate neighbors approve -of his proposal. Mr. Gentosi, adjacent property owner, felt that a fence should be constructed between his property and Mr. St. Clair's, and expressed a willingness to contrib- ute to the cost involved. Mr. Gentosi also indicated that the rear of the property needed to be graded for proper drainage. During the discussion which fol- lowed, the. -City Attorney raised the issue of the 20-foot.easement and stated that this may be a problem if Mr: St..Clair intends to retain ownership, but further added that a solution could be worked out. There being.no other speakers, the Mayor closed the public hearing. On motion by Councilwoman Small- wood, seconded by Vice Mayor Hammett, and carried, the Exempt Declaration of'Enviromental Impact was accepted as meeting the requirements of the law, and Tentative Parcel Map S-77-20 was approved subject to conditions as recommended by the Planning Commission. Appeal Hearing The Clerk announced that this was the time and place - O'Connor set for the appeal hearing to consider the request from Johnny Z. O'Connor, 359 - 22nd Street, Costa ZE-76-212. Mesa, appealing the Planning Commission's decision Park Fees regarding payment of park fees for the project at 1961 Anaheim Avenue and 1962 Meyer Place, approved Denied under Zone Exception ZE-76-212. The affidavits of publishing, posting, and mailing are on file in the Clerk's off -ice. No communications have been received. The applicant was present to answer questions from the Council and re -stated his contention that he received incorrect information from the staff as to whether the new park fees would affect his project. During the discussion which followed, the Council expressed regret that a misunderstanding had..occurred, but felt that to grant an exemption may establish a precedent. Vice Mayor Hammett did not concur with this opinion and felt that.-Mr..0'Connor's project was far along in the planning process. and.' -should not be subject to the increased fees.' There being no other speakers, the Mayor closed the public hearing. On motion by Councilwoman Smallwood, seconded by Councilman. McFarland, and carried, Vice Mayor.Hammett voting no, the appeal for exemption from the 'increased park fees, was denied.. Public Hearing The Clerk announced that this was the.time and place GP -77-2E'- set for the public hearing:, continued from the meet- Cagney ing of August 15,-1977, for General Plan Amendment GP -77-2E, William J. Cagney, 550 Newport Center Held.Over Drive, Suite 434', Newport Beach, for permission to amend the. -land use designation of ..property located along the north:side of Baker.Street, east of Babb Street, from Low Density;Residential to Medium Density'Residential. Environmental Determination: Negative Declaration. The Clerk announced that a request for a -continuance -has been received from Long Beach Construction:Comp.any,.to,allow sufficient time for revision of- plans. Don Adkinson was present.representing.the:.applicant and requested a Study'Session.on October 10,-1977; to review the new plans; followed.by a continued public hearing on October 17. Jim Taylor,'4repr•esenting.the developer, supported.this request for the -dates indicated. Mayor Hertzog responded)that a more convenient time for the Council would-be in:November as certain Council Members wi-ll:not be present for the October dates suggested. After -.further discussion, on motion by Vice.Mayor Hammett, seconded by Councl- woman- Smallwood, - and carried, the public hearing was continued :to the meeting of November 21, 1977, with a Study Session on November 14, 1977,.at 2:00 p.m., in the fifth floor Conference Room of City Hall. Recess The Mayor declared a -recess at 8:00 p.m., and the meeting -reconvened at 8:05 p.m. Public Hearing The Clerk announced -that this was.the time and place R-77-24 set for the -public hearing for Rezone Petition R-77- 24, Costa Mesa City Council';_for'permission to rezone property located-between.1820 and 1842 (even numbers) Park Avenue, and 533 and..541 (odd numbers) Center Street, from C2 to R4=CP,.into conformance with the Central Area Plan. Environmental Determination: Environmental.Impact Report accepted by Council on July 5 ,1977. The Aff.idavit:of Publication is on file in the Clerk's .office. Nocommunications have been received.
