The meeting was called to order by the Mayor, followed by the Pledge of Allegiance to the Flag, and Invocation by The Reverend Kearney Frantsen, Prince of Peace Lutheran Church. Roll Call Council Members -Present: McFarland;'Raciti, Hertzog Council Members Absent: Smallwood, Schafer Officials Present: City Manager, City Attorney, Assistant Planning Director, Director of Public Services, City Clerk Minutes On motion by Councilwoman Hertzog, seconded by Council - August 21, 1978 man Raciti, and carried, the minutes of the regular meeting of August 21, 1978, were approved as distributed and posted as there were no corrections. Ordinances A motion was made by Councilwoman Hertzog, seconded by Councilman Raciti, and carried, to read all ordinances by title only. CONSENT CALENDAR. The Planning staff continues to recommend that the wording of the last paragraph of Section 13-833(a) of the proposed ordinance, pertaining to apartment vacancy rate for the City, be retained. There being no speakers, the Mayor closed the public hearing. After Council discussion, a motion was made by Council- woman Hertzog, seconded by Councilman Raciti, amending the last paragraph of Section 13-833(a) to read: 1 1 1 "Planning Staff shall present to the Planning Com- mission vacancy statistics from the most recent data compiled by either the U. S. Department of Housing and Urban Development or other governmental agency. The Planning Commission shall determine the apartment vacancy rate for the City based on the most current Ordinance 78-38 data available"; and Ordinance 78-38, being AN ORDI- First Reading NANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, AMENDING TITLE 13 OF THE COSTA MESA MUNICIPAL CODE RELATING TO CONDOMINIUM DEVELOPMENTS AND THE CONVER- SION OF APARTMENTS TO CONDOMINIUMS, AND CLARIFYING THE DEFINITIONS OF VACANCY RATE AND STOCK COOPERATIVE, was given first reading and passed to second reading, by the following roll call vote: AYES: Council Members: McFarland, Raciti, Hertzog NOES: Council Members: None ABSENT: Council Members: Smallwood, Schafer Public Hearing The Clerk announced that this was the time and place R-78-13 set for the public hearing for Rezone Petition R-78- 13, Costa Mesa City Council, for permission to rezone property at 2160, 2166, and 2172 College Avenue, and at 396 Victoria Street, from AP to R2. Environmental Determination: Negative Declaration adopted for General Plan Amendment GP -78-2B. The Planning staff and Planning Commission recommended approval based on Sections II and III of their Staff Report. The Affidavit of Publication is on file in the Clerk's office. A letter has been received from Thomas E. Nelson, 2172 College Avenue, Costa Mesa, in support of R4 zoning if lot combinations are attained, and R3 zoning if lots are individually developed. There being no speakers, the Mayor closed the public hear- ing. After discussion, on motion by Councilman Raciti, seconded by Councilwoman Hertzog, Ordinance Ordinance 78-39 78-39, being AN ORDINANCE OF THE CITY COUNCIL OF THE First Reading CITY OF COSTA MESA, CALIFORNIA, CHANGING THE ZONING OF A PORTION OF LOT 55, TRACT NO. 57, FROM AP TO R2, was given first reading and passed to second reading by the following roll call vote: AYES: Council Members: McFarland, Raciti, Hertzog NOES: Council Members: None ABSENT: Council Members: Smallwood, Schafer Public Hearing The Clerk announced that this was the time and place Animal Zone Map set for the public hearing to consider the Negative Declaration of Environmental Impact and proposed ordinance revising the Animal Zone Map, establishing two animal zones which regulate the keeping of ani- mals in the City, and prezoning unincorporated areas within the City of Costa Mesa's Sphere of Influence. The Affidavits of Publishing and Posting are on file in the Clerk's office. No communications have been received. The following persons spoke in favor of placing the proposed Pacific -Canyon Island Annexation area in Zone 2, which permits a variety of animals including horses: Richard Amacher, 2210 Canyon Drive, and Marvin E. Roberts, 2208 Canyon Drive. Ben Lon- deree, 2191 Canyon Drive, requested clarification of what animals were allowed in Zone 2, and the City Attorney responded by quoting Section 3-38 of the Costa Mesa Municipal Code. There being no other speakers, the Mayor closed the public hearing. After - discussion, on motion by Councilwoman Hertzog, sec- onded by Councilman Raciti, the Negative Declaration of Environmental Impact was adopted, and Ordinance Ordinance 78-40 78-40, being AN ORDINANCE OF THE CITY COUNCIL OF THE First Reading CITY OF COSTA MESA, AMENDING TITLE 3 OF THE COSTA 1 1 1 MESA MUNICIPAL CODE REVISING THE ANIMAL ZONE MAP, placing the entire Pacific -Canyon unincorporated area in Zone 2, was given first reading and passed to second reading by the following roll call vote: AYES: Council Members: McFarland, Raciti, Hertzog NOES: Council Members: None ABSENT: Council Members: Smallwood, Schafer Councilmanic Mayor McFarland stated ..that a regular meeting of Comments the Costa Mesa Redevelopment Agency was scheduled for September 6, 1978, at 7:30 p.m., in the fifth floor Conference Room of City Hall, but the Study Session which was scheduled for 5:30 p.m. would not be held until after the scheduled meeting, if at all.
