CITY COUNCIL AGENDA REPORT MEETING DATE: SEPTEMBER 18, 2012 SUBJECT: ROADWAY MARKINGS AND TRAFFIC SIGN MAINTENANCE INVITATION TO BID DATE: SEPTEMBER 6, 2012 FROM: PUBLIC SERVICES DEPARTMENT PRESENTATION BY: ERNESTO MUNOZ, PUBLIC SERVICES DIRECTOR BOBBY YOUNG, FINANCE11T DIRECTOR KIMBERLY HALL BARLOW, SPECIAL COUNSEL FOR FURTHER INFORMATION CONTACT: ERNESTO MUNOZ, PUBLIC SERVICES DIRECTOR (714) 754-5343 RECOMMENDATION: Staff recommends that the City Council: 1. Reject the bid received for Roadway Markings and Traffic Sign Mainterrance from BC Traffic Specialist. 2. Direct staff to re -advertise the Notice Inviting Bids for Roadway Markings and Traffic Sign Maintenance. BACKGROUND: In accordance with Council Policy 100-6, a Roadway Markings and Traffic Sign Maintenance Committee was formed to evaluate the potential for contracting of on-going City services. The Committee met on three (3) occasions to discuss the duties and responsibilities of the Roadway Markings and Traffic Sign Maintenance Bid. At the regular City Council meeting of October 18, 2011, the various alternatives for Roadway Markings and Traffic Sign Maintenance were presented to the City Council. The City Council directed staff to release the Notice Inviting Bids (Bid). The Bid for Roadway Markings and Traffic Sign Maintenance was released on March 23,. 2012. The Bid was posted on the City website and in the lobby of City Hall. However, no public notice was given by publication in a newspaper or trade paper of general circulation published in the county as stipulated in the State Contract Act, Article 3, Advertisements for Bids, Section 10140 Public Notice. ANALYSIS: In response to the City's Bid, one bid was received (Attachment 1). Due to the fact that the one (1) bid received in the amount of $741,697.33 is more than 70% greater than the 2011/12 adopted budget of $432,613 for this service, staff recommends that the bib be rejected. Further, the Evaluation Committee recommends that the Roadway Markings and Traffic Sign Maintenance Bid be re -bid. This Bid should include proper public notices in the local Orange County Register, the City website, and bid clearinghouses to properly advertise the Bid as required by the State Contract Act and to encourage the participation of more companies in the competitive process. The Notice Inviting Bids is to remain the same and would be released in whole and without modifications. The potential contractor will provide the management and administration of a comprehensive maintenance program for a wide variety of Roadway Markings and Traffic Sign Maintenance services. FISCAL REVIEW: No fiscal analysis was conducted for this report. ALTERNATIVES CONSIDERED: 1. The Council may recommend additional changes to the Bid or to the advertising process to encourage broader participation from vendors. 2. The Council may receive and file the report. LEGAL REVIEW: The City is Linder a preliminary injunction, which prevents it from contracting out services currently being performed by members of the Costa Mesa City Employees' Association. The Council may approve a contract and authorize the Chief Executive Officer to execute the contract in the future when and if the injunction against the City is lifted or determined not to apply. CONCLUSION: The Notice Inviting Bids process was completed for Roadway Markings and Traffic Sign Maintenahce services and resulted in only one (1) bid being submitted. Because of the limited noticing with the first Bid, the bid should be rejected and the Bid readvertised. In addition to advertising in the Orange County Register, advertisement with several Bid Clearinghouses that have been identified and since used, will likely result in greater participation by private contractors.
